The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings. Attendance and participation is encouraged. Individuals wishing to be heard during Public Hearing proceedings are encouraged to be prepared and will be limited to three (3) minutes in order to allow everyone the opportunity to be heard. PUBLIC COMMENTS ARE EXPECTED TO BE CONSTRUCTIVE AND DEVOID OF CHARACTER ASSASSINATION. Questions raised on non-agenda items may be answered at a later date by letter in order to facilitate proper research. Written comments are welcome and should be given to the Village Administrator prior to the start of the meeting. Written materials will not be accepted during regular agenda items in the interest of time. GREGORY D. MARTIN & 1. MEMORANDUM OF UNDERSTANDING (MOU) – REGIONAL RAIL PARK. LARRY GUGGINO TAB 1. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: In June 2016, RIO Real Estate Investment Opportunities LLC (Rail Park) announced its plan to develop a regional rail park in the Village of Los Lunas. A Logistics Park allows related logistics services and facilities to achieve higher efficiencies and improve the flow of business services within specific industrial development zones. A commonly accepted definition is that a modern logistics park provides two main functions: logistics organization and management functions that depend upon economic development function of logistics services. Key industries that will be located at the park include manufacturing, logistics, warehouse/distribution, and operation centers. The site is located off of NM Highway 6 and Interstate 25. Currently, the site is vacant land that was recently incorporated into the Village of Los Lunas. In order to begin development, the park needs to complete a rail spur. The cost of this spur is about $400,000. In October 2016, the Village of Los Lunas requested state economic development department (NMEDD) and local governments within in the Albuquerque Metro area to financially participate in this regional project. Investment from the private sector will be up to $20 million to complete this project. Bernalillo County and the Village of Los Lunas have requested the State of New Mexico provide LEDA funding in support of this project. The request to NMEDD is to commit $200,000 for the rail spur. This MOU and Resolution between Bernalillo County and the Village of Los Lunas would commit up to $400,000 to manage and fund the construction of the spur. These monies will be administered and secured by the Village via the LEDA process. At full build-out, the Rail Park is estimated to create up to 5,000 jobs and generate up to 10-years of ongoing construction. Any State and Local contributions to this project would be managed by the Village of Los Lunas. The Village would create a separate fund for this project. the Rail Park would make an application to the Village under its applicable LEDA Ordinance to become a qualifying project under that Ordinance. No payments shall be made until the Rail Park has been approved as a qualifying project and payments shall only be made for reimbursements for construction, reconstruction, improvement or other acquisition of infrastructure, public works improvements essential to the location or expansion of the Rail Park, and payments for professional services contracts necessary for local or regional governments to implement the project or technical assistance. GREGORY D. MARTIN & 2. TRANSER OF THE OWNERSHIP OF LOT 2 OF THE LOT LINE ADJUSTMENT SURVEY FOR THE VILLAGE OF LARRY GUGGINO LOS LUNAS FROM THE VILLAGE OF LOS LUNAS TO VALENCIA COUNTY. TAB 2. ACTION REQUESTED OF COUNCIL: Approve or disapprove.  BACKGROUND AND RATIONALE: Last year the New Mexico Legislature approved a Joint Resolution transferring all the property abutting Highway 314, which was being leased by the Village, Valencia County and the Los Lunas Schools from the State of New Mexico to the Village of Los Lunas. A requirement of the Joint Resolution was that the Village transfer ownership of the property being leased by Valencia County from the State of New Mexico back to Valencia County. Lot 2 of the Lot Line Adjustment Survey for the Village of Los Lunas is a portion of the property along Highway 314 that was being leased by Valencia County from the State and which was transferred to the Village of Los Lunas. That lot is currently used by Valencia County for the animal control shelter and county maintenance yard. The transfer of title to this lot is in satisfaction of the Joint Resolution requirements. Valencia County has agreed to pay for its proportionate share of the cost incurred by the Village of Los Lunas in complying with the conditions of the Joint Resolution. GREGORY D. MARTIN & 3. PLATEAU TELECOM GIGABIT CITY PRESENTATION. & VINCE TYSON TAB 4. ACTION REQUESTED OF COUNCIL: Information purposes only. BACKGROUND AND RATIONALE: Plateau Telecom has collaborated with the Village of Los Lunas to provide fiber-optic communications to complete our “Regional Vital Communication Plan.” They are now proposing to install fiber-optic cabling to the residents and businesses of Los Lunas to offer superior Internet connections at reasonable price points. 5.
