MINUTES VILLAGE OF LOS LUNAS THURSDAY, MAY 11, 2017 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, May 11, 2017 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Pro Tem Gino Romero, Councilman Christopher Ortiz, Councilman Gerard Saiz, and Councilwoman Paulette Sanchez-Montoya. Mayor: Charles Griego, Excused Mayor Pro Tem: Gino Romero Council: Gerard Saiz Christopher Ortiz Paulette Sanchez-Montoya Also present were: Gregory Martin , Debra Sanchez, Sandy Schauer, Bob Anderson, Antoinette L. Torres, Manuel Marquez, Jim Rickey, Barbara Pino, Claire Cieremans, Dana Sanders, and Deborah Fox. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: • CALL MEETING TO ORDER. • PLEDGE OF ALLEGIANCE. • APPROVAL OF AGENDA. • PUBLIC INPUT FORUM. 1. ORDINANCE 276-2017-1 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 2. FIXED ASSET DISPOSAL. 3. MEMORANDUM OF UNDERSTANDING – SUPPORTING THE LOS LUNAS SCHOOLS SWIMMING POOL. 4. BID AWARD – JANITORIAL SERVICES. 5. BID AWARD – ELECTRICAL SERVICES. 6. MEMORANDUM OF AGREEMENT – REQUEST FOR FLEET MAINTENANCE SERVICES 2017/2018. 7. EXECUTIVE SESSION. a. Hire High School Students & College Aides for 2017 Recreation Program – Recreation Department. 8. APPROVAL OF MINUTES: a. Minutes from April 20, 2017 Council Meeting. b. Minutes from February 11, 2017 – Council Retreat. 9. ADJOURNMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Pro Tem Romero brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Pro Tem Romero asked Claire Cieremans to lead the Mayor, Council and audience in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Pro Tem Romero announced that Mayor Griego was excused from tonight’s meeting. Mayor Pro Tem Romero asked if there were any changes/corrections to the council agenda – Councilman Gerard Saiz asked that Item 3 be moved to Item 1. Mayor Pro Tem Romero asked for a motion from Council. APPROVAL: Motion to approve amended agenda MOVED: Councilman Saiz SECONDED: Councilwoman Sanchez-Montoya CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya - yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. None. 1. MEMORANDUM OF UNDERSTANDING – SUPPORT OF THE LOS LUNAS SCHOOLS SWIMMING POOL. Mr. Jason Duran presented item one. Los Lunas School District is requesting a MOU to partner with the Village of Los Lunas for the 2017 swim season. They are asking for $35,000.00 for the operating cost for the 2017 year. Councilman Saiz mentioned that they should collaborate one day, in the future, to seek out grants that would help support the renovation/construction and operation of an aquatic facility – it’s been on the our wish list for many years. Mayor Pro Tem Romero asked for a motion from Council. APPROVAL: Motion to approve MOU MOVED: Councilman Ortiz SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya - yes) FOR AND 0 AGAINST. 2. ORDINANCE 276-2017-1 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DISINATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Mayor Pro Tem Romero asked for a motion from Council to recess as a Council and open in to a public hearing. APPROVAL: Motion to recess MOVED: Councilman Saiz SECONDED: Councilwoman Sanchez-Montoya CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya- yes) FOR AND 0 AGAINST. Recessed at 6:19p.m. Mayor Pro Tem Romero asked for a motion from Council regarding Ordinance 276-2017-1. APPROVAL: Motion to approve Ordinance 276-2017-1. MOVED: Councilwoman Sanchez-Montoya SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya - yes) FOR AND 0 AGAINST. 3. FIXED ASSET DISPOSAL. Police Chief Naithan Gurule presented item three. Chief Gurule is seeking approval to delete a list of fixed assets that are no longer in use. They are worn-out, unusable or obsolete to the extent that each item is no longer economical or safe for continued used by the Police Department. The BMW motorcycles are obsolete and will be used for parts. Mayor Pro Tem Romero asked for a motion from Council. APPROVAL: Motion to approve fixed asset disposal. MOVED: Councilman Saiz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya - yes) FOR AND 0 AGAINST. 4. BID AWARD – JANITORIAL SERVICES. Mr. Jason Duran presented item four. The Community Services Department went out for bid for Janitorial Services for the Village of Los Lunas buildings and also added the Transfer Station office to the list. We opened bids on April 27, 2017 – we received five bids. Action One Janitorial came in with a bid of $6,900.00 – this is a nonresponsive bid meaning that they did not fill out the bid form properly, it should have been for annual service and not monthly. C & S Company came in with lowest bid of $88,799.88. Councilman Saiz asked if the incident had been taken care of that happened a couple of weeks ago. Jason replied that it had been. Councilwoman Sanchez-Montoya talked about the condition of the bathrooms and wanted to make sure that those issues would be addressed (not toilet paper, cleaning/maintenance, etc.). Jason said those issues had and will be addressed. If there were no more questions, Mayor Pro Tem Romero asked for a motion from Council. APPROVAL: Motion to approve lowest bidder, C & S Company for $88,799.88. MOVED: Councilman Saiz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya – yes with prejudice) FOR AND 0 AGAINST. 5. BID AWARD – ELECTRICAL SERVICES. Mr. Jason Duran presented item five. Community Services also went out to bid for electrical services for all the Village of Los Lunas buildings. We received four responsive bids – bids were open on April 27, 2017. Jason indicated that he was contacted by McDade & Woodcock regarding the New Mexico State Wage Decision Act. This act ensures that employers are paying their employees equitably based on the pay scales from the New Mexico Department of Labor. Jason indicated that he followed up on this item and said that C and Sons and Phaze One fell beneath, but because C and Son and Phaze One, their owners are the journeymen, they are able to pay their semiskilled employees their wages. Jason recommended to Council that C and Sons be the primary contractor and Phaze One be the secondary contractor based that they submit their paperwork to New Mexico Workforce Solutions and they pass the State Wage Decision Act. Mayor Pro Tem Romero asked if the Council had any questions – there were none. Mayor Pro Tem Romero asked for a decision from Council. APPROVAL: Motion to approve C and Sons as the primary contractor and Phaze One as the secondary contractor contingent that they pass the State Wage Decision Act. MOVED: Councilwoman Sanchez-Montoya SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya – yes) FOR AND 0 AGAINST. 6. MEMORANDUM OF AGREEMENT – REQUEST FOR FLEET MAINTENACNE SERVICES 2017/2018. Mr. Michael Jaramillo presented item six. Rio Metro is requesting to enter into a MOU with the Village of Los Lunas to continue performing fleet maintenance and storage services for their public transportation vans. They will continue to pay costs for fuel, supplies, labor and storage. The Village has provided them with these services for the past seven years. Mayor Pro Tem Romero asked if the Council had any questions- there were none. Mayor Pro Tem Romero asked for a motion from Council. APPROVAL: Motion to approve MOU with Rio Metro. MOVED: Councilman Saiz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya - yes) FOR AND 0 AGAINST. 7. EXECUTIVE SESSION. Mayor Pro Tem Romero announced that the Council would be going into executive session pursuant to NMSA 1978 Section 10- 15-1, that the following matters will be discussed in closed session: the hiring of High School Students and College Aides for the 2017 Recreation Program. APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Ortiz SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilwoman Sanchez- Montoya - yes) FOR AND 0 AGAINST. Adjourned at 6:40 p.m. At 6:50 p.m., Mayor Pro Tem Romero asked for a motion to reconvene to go back into open session after discussing: the hiring High School Students and College Aides for the 2017 Recreation Program. APPROVAL: Motion to reconvene in open session pursuant to NMSA 1978 Section 10-15-1 (H) (2). Mayor Pro Tem Romero announced that Mayor Griego had submitted a written letter regarding the hiring’s – it contains all the names of the students who would be hired for Summer Recreation. ORDINANCE 276-2017-1 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DISIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Ms. Christina Ainsworth presented item two. This is a rezoning for property located at 420 Trujillo St. NE. They are splitting the property for family purposes. It is consistent for our long-term plan – the property will remain the same. The Planning & Zoning Commission did recommend approval. Mayor Pro Tem Romero asked if there was anyone in the audience who wanted to comment for or against the rezoning – there was no one. There were no more comments made on this item. Mayor Pro Tem Romero asked to close the public hearing and Council would go back in to open meeting. BACKGROUND AND RATIONALE: Antoinette Torres, acting as agent for Manuel Marquez, has applied for a zone change from R-R to R-1, for the property located in Subd: Land of Manuel Marquez, Tract B-1A, 0.85 ACRES, with a street address of 420 Trujillo St. NE, for the purpose of allowing a future lot split NAITHAN GURULE 2. FIXED ASSET DISPOSAL. TAB 2. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Pursuant to Section 13-6-1 NMSA Disposition of obsolete, worn-out or unusable tangible personal property, the disposal of fixed assets must be approved by the governing authority. The assets to be disposed of are worn-out, unusable or obsolete to the extent that each item is no longer economical or safe for continued use by the Village of Los Lunas. The current resale value of each of these items is below $5,000.00. BACKGROUND AND RATIONALE: Los Lunas School District is requesting to enter into a Memorandum of Agreement (MOA) to partner with the Village of Los Lunas to ensure that the Los Lunas High School Pool can successfully open for the summer of 2017.
