MINUTES VILLAGE OF LOS LUNAS THURSDAY, OCTOBER 4, 2018 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, October 4, 2018 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Charles Griego, Christopher Ortiz, Gerard Saiz and Gino Romero. Councilman Phillip Jaramillo was excused. Mayor: Charles Griego, Mayor Pro Tem: Christopher Ortiz Council: Gerard Saiz Gino Romero Phillip Jaramillo, excused Also present were: Gregory D. Martin, Debra Sanchez, Guy & Elisabeth Dicharry, Ginny Adame, Joe Griego, Sandy Schauer, Deborah Fox, and Jim Rickey. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: • CALL MEETING TO ORDER. • PLEDGE OF ALLEGIANCE. • APPROVAL OF AGENDA. • PUBLIC INPUT FORUM. 1. ADMINISTERING THE POLICE ATHLETIC LEAGUE (PAL) PROGRAM THROUGH THE VILLAGE OF LOS LUNAS / LOS LUNAS POLICE DEPARTMENT. 2. JOINT POWER AGREEMENT (JPA) – BOSQUE OPEN SPACE PRESERVE. 3. EXECUTIVE SESSION: a) Hire FT Utility Billing Clerk/Cashier – Utility Billing Division / Public Works Department. 4. APPROVAL OF MINUTES: a. Minutes from September 20, 2018 Council Meeting. b. Minutes from September 18, 2018 Government/Council Workshop. 5. ADJOURNMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Deborah Fox to lead the Council and audience in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego announced that Councilman Jaramillo was excused – he then asked council if there were any changes to the agenda – no comment from council. Mayor Griego asked for a motion. APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. None. 1. ADMINISTERING THE POLICE ATHLETIC LEAGUE (PAL) PROGRAM THROUGH THE VILLAGE OF LOS LUNAS / LOS LUNAS POLICE DEPARTMENT. Ms. Ginny Adame presented item one. The Police Athletic League was established under the Los Lunas Safety and School Security Department in 2017. They currently serve over 100 students from third grade all the way up to high school. They are seeking a new location for the group to meet. Mayor Griego asked Chief Gurule if he had the staff to run the program. Police Chief Gurule replied that Ginny Adame will manage the grant and Joe Griego said he would stay on to help. The program will be ran through the Police Department with the help of volunteers. They will start off small with about 25 students. Mayor Griego asked council if they had any comments – there were none. Mayor Griego asked for a motion from council. APPROVAL: Motion to approve MOVED: Councilman Saiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. 2. JOINT POWERS AGREEMENT (JPA) – BOSQUE OPEN SPACE PRESERVE. Mr. Jason Duran presented item two. Jason is seeking approval of a JPA for the Bosque Open Space Preserve. The preserve contains 1,000 acres of open space in the JPA which also includes the River Park. Any improvements to the park, request(s) will have to be submitted to the MRGCD for approval. Vehicles/ATV’s will have to be permitted to drive on the levy’s – the pass/key can be obtained from MRGCD for $50.00 beginning April 1st – we will not be responsible for this process. Mayor Griego wants to make sure that we will not be enforcing, it will be the MRGCD responsibility. No hunting within certain limits – cutting wood will have to be permitted by MRGCD. Mayor Griego asked if there were any questions from Council – there were none. Mayor Griego asked for a motion from council. APPROVAL: Motion to approve JPA MOVED: Councilman Romero SECONDED: Councilman Oritz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz - yes; Councilman Saiz – yes; Councilman Romero - yes) FOR AND 0 AGAINST. 3. EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1the following matters would be discussed in closed session: hiring of a FT Billing Utility Clerk/Cashier. APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Ortiz SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero – yes) FOR AND 0 AGAINST. Adjourned at 6:17 PM. At 6:38PM, Mayor Griego asked for a motion from Council indicating that they discussed the hiring of a FT Billing Utility Clerk/Cashier. APPROVAL: Motion to approve MOVED: Councilman Saiz SECONDED: Councilman Oritz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero – yes) FOR AND 0 AGAINST. Mayor Griego put up the name of RayAnna Benavidez for the Billing Utility Clerk/Cashier position. APPROVAL: Motion to approve MOVED: Councilman Romero SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero – yes) FOR AND 0 AGAINST. 4. MINUTES. Mayor Griego asked if there were corrections to the council minutes of September 20, 2018 – there was none. MOTION: Motion to approve September 20, 2018 minutes MOVED: Councilman Ortiz SECONDED: Councilman Saiz CARRIED: Motion passed on a vote of 3 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Romero – yes) FOR AND 0 AGAINST. Mayor Griego asked if there were any correction to the Government/Council Workshop minutes of September 18, 2018 – there were none. Ms. Iris Padilla presented item four. This proposed amendment modifies 12.11 – Smoking Policy to Tobacco Free Work-Place, which captures the New Mexico Clean Air Act standards and addresses smokeless tobacco products and electronica smoothing devices. Notice was posted in the Valencia County News Bulletin for 15 days – September 9, 2018 through September 20, 2018. Mayor Griego asked if there any comments from council – there were none. Mayor Griego asked the audience if there were any comments – there was none. Mayor Griego asked for a motion to close the public hearing. The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings. Attendance and participation is encouraged. Individuals wishing to be heard during Public Hearing proceedings are encouraged to be prepared and will be limited to three (3) minutes in order to allow everyone the opportunity to be heard. PUBLIC COMMENTS ARE EXPECTED TO BE CONSTRUCTIVE AND DEVOID OF CHARACTER ASSASSINATION. Questions raised on non-agenda items may be answered at a later date by letter in order to facilitate proper research. Written comments are welcome and should be given to the Village Administrator prior to the start of the meeting. Written materials will not be accepted during regular agenda items in the interest of time. GINNY ADAME & 1. ADMINISTERING THE POLICE ATHLETIC LEAGUE (PAL) PROGRAM THROUGH THE VILLAGE OF LOS CHIEF GURULE LUNAS / LOS LUNAS POLICE DEPARTMENT. TAB 1. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Los Lunas/Valencia County PAL (LL/VC PAL) Program was established under the Los Lunas Safety and School Security Department in 2017 and has successfully partnered with: Los Lunas Schools, Los Lunas Police Department, Los Lunas Fire Department, Los Lunas Parks and Rec./Park Rangers, TNT Boxing and Mentoring Club, Department of Health, New Mexico State University, Village of Los Lunas/Valencia County DWI Program and many other community partners to serve over 100 youth. The LL/VC PAL is an outstanding prevention program connecting our community leaders to our youth and it is in need of a new fiscal agent to continue. The Los Lunas Police Department is an excellent fit for the LL/VC PAL program and the Village is a champion of programing and opportunities for its youth and future leaders providing a great opportunity to continue the LL/VC PAL Program under its fiscal administration. JASON DURAN 2. JOINT POWERS AGREEMENT (JPA) - BOSQUE OPEN SPACE PRESERVE. TAB 2. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Bosque Open Space Preserve Joint Powers Agreement contains 1,000 acres of open space to the north and south of the river bridge. This area will be available to the public for passive recreational uses and be managed by the Open Space Division in conjunction with the Middle Rio Grande Conservancy District. 3. EXECUTIVE SESSION – pursuant to NMSA 1978 Section 10-15-1(H), the following matters will be discussed in closed session: TAB 3. a) Hire FT Utility Billing Clerk/Cashier – Utility Billing Division / Public Works Department. 4.
