MINUTES VILLAGE OF LOS LUNAS THURSDAY, NOVEMBER 1, 2018 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, November 1, 2018 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Mayor Charles Griego, Christopher Ortiz, Gerard Saiz, Gino Romero and Phillip Jaramillo. Mayor: Charles Griego, Mayor Pro Tem: Christopher Ortiz Council: Gerard Saiz Gino Romero Phillip Jaramillo Also present were: Gregory D. Martin, Debra Sanchez, Melanie Y. Chavez, Viola Chavez, Pedro Chavez, Jerome Chavez, Stephen Chavez, Ginny Adame, Sandy Schauer, Bob Anderson, Jim Rickey, and Cheryl Luna. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: • CALL MEETING TO ORDER. • PLEDGE OF ALLEGIANCE. • APPROVAL OF AGENDA. • PUBLIC INPUT FORUM. 1. ORDINANCE 271-2018-2 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOSLUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. 2. MRMPO CALL FOR PROJECTS FOR FFY 2020-2025 TIP DEVELOPMENT. 3. PROFESSIONAL SERVICES CONTRACT BETWEEN MID-REGION COUNCIL OF GOVERNMENTS AND THE VILLAGE OF LOS LUNAS. 4. RESOLUTION 19-01 – VILLAGE OF LOS LUNAS OPEN MEETINGS ACT. 5. 2019 SCHEDULE OF COUNCIL MEETING DATES AND 2019 HOLIDAY SCHEDULE. 6. EXECUTIVE SESSION: a) Hire FT DWI Compliance Officer – Community Services Department. b) Hire FT Public Works Technician – Water/Sewer Division – Public Works Department. 7. APPROVAL OF MINUTES: a. Minutes from October 18, 2018 Council Meeting. 8. ADJOURNMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Jerome Chavez to lead the Council and audience in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego asked council if there were any changes to the agenda – no comment from council. Mayor Griego asked for a motion. APPROVAL: Motion to approve MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Jaramillo – yes; Councilman Romero - yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. None. 1. ORDINANCE 271-2018-2 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Mayor Griego asked for a motion to recess as council and convene in a public hearing. APPROVAL: Motion to approve MOVED: Councilman Saiz SECONDED: Councilman Jaramillo CARRIED: Motion passed on a vote of 4 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Jaramillo – yes; Councilman Romero - yes) FOR AND 0 AGAINST. 6:02PM. Discussion and testimony can be found on the last page. Mayor Griego asked for a motion from council. APPROVAL: Motion to approve ordinance 271-2018-2 and adopt findings of Planning & Zoning. MRMPO CALL FOR PROJECTS FOR FFY 2020-2025 RIP DEVELOPMENT. Mr. Michael Jaramillo presented item two. There are some new requirements to solicit funds from State Transportation Improvement Program. The TIP program is a funding source that many agencies seek for a funding source. Some of the new requirements that have come out are long-range plan, public safety, affordability, and pedestrian and pedestrian mobility. The state has asked that we meet with our governing bodies and identify projects. We can take five projects from the ICIP and Mr. Jaramillo will be back at the next council meeting with resolutions for these projects. On the fifth project listed, this does qualify for CMAC funding. CMAC funding is targeted towards transportation projects. The four projects are for surface repair, ADA accessibility or mobility, and retention systems. Further discussion was held on the projects. Michael will bring five resolution back to council for approval at the November 15th council meeting. This was for informational purposes only. 3. PROFESSIONAL SERVICES CONTRACT BETWEEN MID REGION COUNCIL OF GOVERNMENTS AND THE VILLAGE OF LOS LUNAS. Mr. Michael Jaramillo presented item three. The Village of Los Lunas desires to implement EDA Project Number 08-01-05243 (waterline extension) funded the Office of the Economic Development Administration along NM 6 to the Central Rail Park. The Village desires to engage the Mid-Region Council of Governments to render certain project management, reporting and supporting services in connection with the EDA project. The maximum amount of compensation to MRCOG shall not exceed $50,000 under this agreement. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from council. APPROVAL: Motion to approve MOVED: Councilman Jaramillo SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 4 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Jaramillo – yes; Councilman Romero - yes) FOR AND 0 AGAINST. 4. RESOLUTION 19-01 – VILLAGE OF LOS LUNAS OPEN MEETINGS ACT. Mr. Gregory Martin presented item four. Pursuant to the Open Meetings Act, staff are seeking council approval to adopt the 2019 Open Meetings Act for the Village of Los Lunas. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from council APPROVAL: Motion to approve resolution 19-01. MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Jaramillo – yes; Councilman Romero - yes) FOR AND 0 AGAINST. 5. 2019 SCHEDULE OF COUNCIL MEETING DATES AND 2019 HOLIDAY SCHEDULE Mr. Gregory Martin presented item five. The 2019 council meeting dates and holiday schedule have been reviewed and are ready for council approval. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from council. EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1the following matters would be discussed in closed session: hiring of FT DWI Compliance Officer and the hiring of a FT Public Works Technician. APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Saiz SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 4 (Councilman Ortiz – yes; Councilman Saiz – yes; Councilman Jaramillo – yes; Councilman Romero – yes) FOR AND 0 AGAINST. Adjourned at 6:34 PM. At 6:56PM, Mayor Griego asked for a motion from Council indicating that they discussed the hiring of FT DWI Compliance Officer and the hiring of a FT Public Works Technician. ORDINANCE 271-2018-2 – AN ORDINANCE PROVIDING FOR THE CHANGE IN ZONING OF A DESIGNATED AREA WITHIN THE MUNICIPALITY OF LOS LUNAS, COUNTY OF VALENCIA, STATE OF NEW MEXICO. Ms. Christina Ainsworth presented item one. This is a request to rezone a piece of property located at 600 Pedro Chavez Lane from MH to R-1 for the purpose of allowing a residential dwelling. Property located in a residential area – mobile homes and single-family dwellings. Notices were mailed to property owners within the 100 ft. Planning & Zoning held a meeting and the application was approved. There were a couple of people who spoke but there was no opposition to the request. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego announced that this was a public hearing and if there was anyone who wanted to speak for or against the request – there was none. Mayor Griego asked for a motion from council to close the public session. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Melanie Y. Chavez has applied for a zone change from M-H to R-1 for the property located in Land of Pedro Chavez tract: 50A3B2A 0.22 acre map 67 2000 rev, with a street address of 600 Pedro Chavez Ln. BACKGROUND AND RATIONALE: The Mid-Region Metropolitan Planning Organization (MRMPO) has begun the development of the FFY 2020- 2025 Transportation Improvement Program (TIP) for the Albuquerque Metropolitan Area (AMPA). This notification serves as the formal call for transportation proposals. Any surface transportation project within the AMPA (NMDOT District 3), which receives Federal funding must be include in the TIP. The Public Works Department will be presenting the TIP Development criteria and requesting possible projects. Staff has created a list of possible projects based on the Infrastructure Capital Improvement Plan (ICIP). MICHAEL JARAMILLO 3.
