The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings. Attendance and participation is encouraged. Individuals wishing to be heard during Public Hearing proceedings are encouraged to be prepared and will be limited to three (3) minutes in order to allow everyone the opportunity to be heard. PUBLIC COMMENTS ARE EXPECTED TO BE CONSTRUCTIVE AND DEVOID OF CHARACTER ASSASSINATION. Questions raised on non-agenda items may be answered at a later date by letter in order to facilitate proper research. Written comments are welcome and should be given to the Village Administrator prior to the start of the meeting. Written materials will not be accepted during regular agenda items in the interest of time. MICHAEL JARAMILLO 1. BID AWARD – WELL #3 DRILLING. TAB 1. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Village of Los Lunas Public Works Department advertised and received two (2) bids for the Well No. 3 Replacement - Phase I Project. The scope of the project is to drill, complete and replace the water well in improving water production. This project is funded by Local LEDA Funds. Bids Received: Amount: File Construction, LLC $1,318,396.24 RMCI, Inc $1,565,364.00 (These bids do not include NMGRT.) MICHAEL JARAMILLO 2. BID AWARD – EFFLUENT LOADOUT STATION. TAB 2. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Village of Los Lunas Public Works Department advertised and received one (1) bids for the Effluent Loadout Station. The scope of the project is to sell effluent water to construction customers; in addition, to utilize effluent water for Village maintenance purposes, including street sweeping and dust control. This project will allow others to obtain non-potable drinking water at a reduced cost. This project is funded by a matching Bureau of Reclamation Grant. Bids Received: Amount: RMCI, Inc $311,420.00 (This bids does not include NMGRT.) MICHAEL JARAMILLO 3. RESOLUTION 10-25 – NEW MEXICO FINANCE AUTHORITY. TAB 3. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Village of Los Lunas Public Works is submitting an application for financial assistance for the North Waterline Phase I Project. The waterline project is on the SFY 2020 Fall Fundable List. The project was reviewed and ranked by New Mexico Environment Department and the Drinking Water Bureau’s priority ranking criteria. The referenced project received a ranking of #2. The project is eligible for a grant amount of $625,000 so the loan request would be $1,875,000 rather than the $2,500,000. MICHAEL JARAMILLO 4. MEMORANDUM OF AGREEMENT (MOA) – RIO METRO REGIONAL TRANSIT DISTRICT 2019/2020. TAB 4. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Rio Metro Regional Transit District (RMRTD) has requested a Memorandum of Agreement (MOA) to full-fund the annual salary and benefits, of one (1) Heavy Duty Mechanic position within the Public Works Department Fleet Maintenance Division for 2019/20; this would add one (1) new full-time position. RMRTD has no involvement, authority or responsibility for how the Village manages its maintenance division, operates or maintains its operations. RMRTD understand this MOA request will support the increased growth in fleet maintenance services provided to RMRTD and the Village of Los Lunas Fleet. MICHAEL JARAMILLO 5. MEMORANDUM OF AGREEMENT (MOA) – ELEVENTH AMENDMENT / REQUEST FOR FLEET MAINTENANCE SERVICES 2019/2020. TAB 5. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Rio Metro Transit Agency is requesting to enter into a Eleventh Amendment Memorandum of Agreement (MOA) with the Village of Los Lunas to continue performing fleet maintenance services and storage for their public transportation vehicles. They will continue to pay costs for fuel, supplies and storage of units. The Village of Los Lunas has performed these services for Rio‐Metro under previous agreements for the past Ten (10) years. ERIN CALLAHAN 6. REQUEST FOR PROPOSAL (RFP) – EL MOLINO REDEVELOPMENT PROJECT. TAB 6. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The Village of Los Lunas Community Development Department advertised and received one proposal for the El Molino Redevelopment Project. The scope of this project is to solicit the purchase and continued development of all or a portion of the Village-owned site located at 906 Juan Perea Rd. SE, with the north half of the site as a charter school and other related educational facilities, and the south half for other uses that are compatible with the Village’s TOD area and the Station Area Plan. Proposals Received: School of Dreams Educational Foundation GREGORY D. MARTIN 7. REQUEST FOR PROPOSAL (RFP) – LEGAL SERVICES. TAB 7. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The current contract for Legal Services expires October 31, 2019. Per State purchasing, we are required to advertise for these services every four (4) years. The Village of Los Lunas advertised a Request for Proposals (RFP) for Legal Services in September/October 2019. Two (2) proposals were received. The proposals were reviewed and ranked by a staff committee of five. The recommendation of the committee is to award the proposal to the firm with the highest total points. Firm: Total Points (100 possible): Griego & Guggino 93.3 Cuddy & McCarthy, LLP 70.8 GREGORY D. MARTIN 8. 2020 SCHEDULE OF COUNCIL MEETING DATES AND 2020 HOLIDAY SCHEDULE. TAB 8. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: The 2020 Council Meeting dates and holiday schedule have been reviewed and are ready for Council approval. If approved, the dates will be published in the Village calendar and posted to the Village website. IRIS PADILLA & 9. RESOLUTION 19-26 – HOURLY PAY TO POLICE OFFICERS WORING ON SPECIAL PROJECTS OR EVENTS CHARLES FILES THROUGH OUTSIDE SOURCES. TAB 9. ACTION REQUESTED OF COUNCIL: Approve or disapprove.  BACKGROUND AND RATIONALE: On September 8, 2016, the Village Council adopted Resolution 16-27 setting the hourly pay for police officers working special projects or events paid through a third party at $34.00 per hour. That hourly rate was determined based upon the average overtime rate of all police officers working the special project or event. Resolution 19-26 updates Resolution 16-27 using the same formula to calculate the hourly rate to be paid to police officers working special events or projects that are to be paid by third parties. The proposed new hourly rate will be $40.00 per hour or the hourly rate negotiated in the agreement with the third party, whichever is greater. The hourly rate being proposed takes into consideration the current pay scale for police officers that was approved by the Village Council. JASON DURAN 10. LOS CERRITOS PARK LOT SPLIT. TAB 10. ACTION REQUESTED OF COUNCIL: Approve or disapprove. BACKGROUND AND RATIONALE: Los Cerritos Park is owned and maintained by the Village of Los Lunas. Although this is the case a portion of the southern end of the park was never properly deeded to the Village. This item gives staff the ability to formalize the process so the Los Cerritos HOA is no longer is associated with the property. 11. EXECUTIVE SESSION – pursuant to NMSA 1978 Section 10-15-1(H), the following matters will be discussed in closed session: TAB 11. a) On behalf of the Community Development Department, I am requesting Council approval to enter into a direct negotiation with the School of Dreams Educational Foundation for the sale and development of 10 acres of Village-owned property in the Metropolitan Redevelopment Area. 12.
