MINUTES VILLAGE OF LOS LUNAS THURSDAY, APRIL 9, 2020 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met Thursday, April 9, 2020 in regular session at 6:00 PM at the Council Chambers. Roll call was taken and the following were present: Charles Griego, Christopher Ortiz, Cruz Munoz, Phillip Jaramillo, and Gino Romero. Meeting was conducted and recorded through Webex.com. Mayor: Charles Griego Mayor Pro Tem: Christopher Ortiz Council: Gino Romero Phillip Jaramillo Cruz Munoz Also present were: Gregory D. Martin and Debra Sanchez. In accordance with Ordinance 114A, the following agenda was prepared and circulated as required: • CALL MEETING TO ORDER. • PLEDGE OF ALLEGIANCE. • APPROVAL OF AGENDA. • PUBLIC INPUT FORUM. 1. RESOLUTION 20-11 – APPROVE THE APPLICATION AND PETITION OF SIVAGE COMMUNITY DEVELOPMENT, LLC FOR FORMATION OF THE FIESTA PUBLIC IMPROVEMENT DISTRICT (PID) AND APPROVING RELATED DOCUMENT AND AGREEMENTS, INCLUDING A PID INFRASTRUCTURE DEVELOPMENT AND ACQUISITION AGREEMENT. 2. RESOLUTION 20-10 – VILLAGE OF LOS LUNAS EMERGENCY DECLARATION – COVID 19 RESP9ONSE. 3. RESOLUTION 20-09 – SUBMIT APPLICATION FOR MUNICIPAL ARTERIAL PROGRAM (MAP) FUNDING 2020/2021. 4. DESTRUCTION OF 2019 ELECTION RECORDS PER STATE STATUE 3.8.71C. 5. EXECUTIVE SESSION: a) Hire FT Solid Waste Supervisor – Solid Waste Division / Public Works Department. 6. APPROVAL OF MINUTES: a) Minutes from March 19, 2020 Council Meeting. 7. ADJOURNMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Charles Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Councilman Munoz to lead the Council and audience in the Pledge of Allegiance. • APPROVAL OF AGENDA. Mayor Griego then announced that Item one would be postponed until the Council meeting on April 23, 2020. With that amendment, Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve amended council agenda. MOVED: Councilman Munoz SECONDED: Councilman Jaramillo CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR AND 0 AGAINST. • PUBLIC INPUT FORUM. None. 1. RESOLUTION 20-11 – APPROVE THE APPLICATION AND PETITION OF SIVAGE COMMUNITY DEVELOPMENT, LLC FOR FORMATION OF THE FIESTA PUBLIC IMPROVEMENT DISTRICT (PID) AND APPROVING RELATED DOCUMENT AND AGREEMENTS, INCLUDING A PID INFRASTRUCTURE DEVELOPMENT AND ACQUISITION AGREEMENT. Postponed until council meeting of April 23, 2020. 2. RESOLUTION 20-10 – VILLAGE OF LOS LUNAS EMERGENCY DECLARATION – COVID 19 RESPONSE. Fire Chief John Gabaldon presented item two. A declaration of a local disaster and public health emergency includes the ability to take measures to reduce the possibility of exposure to disease, control the risk, prevent the spread of the disease, and promote the health and safety of individuals in the Village of Los Lunas. The enactment of this declaration, the Village Council, declares all rules and regulations that may inhibit or prevent prompt response to this threat suspended for the duration of the incident. Mayor Griego asked Council if they had any questions. They commented on that it was a good resolution and thanked John for all his hard work. Mayor Griego asked for a motion from Council on resolution 20-10. APPROVAL: Motion to approve resolution 20-10. MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR AND 0 AGAINST. 3. RESOLUTION 20-09 – SUBMIT APPLICATION FOR MUNICIPAL ARTERIAL PROGRAM (MAP) FUNDING 2020/2021. Mr. Michael Jaramillo presented item three. The Village of Los Lunas is responding to an invitation by submitting a project proposal to the New Mexico Highway and Transportation Department to participate in the 2020/2021 Municipal Arterial Program. The Village is required to match a percentage of 25% of the total cost of the project and the scope of the work is intended to improve the roadway condition of Gensen Drive, including asphalt replacement, storm water collection and pedestrian mobility and neighborhood access conditions. The estimated cost for this project is $375,000.00. Mr. Jaramillo asked if there were any questions. Councilman Ortiz asked if the road would be only for a turn in. Mr. Jaramillo replied that it will be a right out – only can go south, you will not be able to turn to go north. Councilman Munoz asked Mr. Jaramillo if the money was in his budget. Mr. Jaramillo replied that he did not, but if awarded, he would have to initiate a budget adjustment. Mayor Griego asked for a decision from Council. APPROVAL: Motion to approve resolution 20-09. MOVED: Councilman Jaramillo SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR AND 0 AGAINST. 4. DESTRUCTION OF 2018 ELECTION RECORDS PER STATE STATUE 3.8.71C. Mr. Gregory D. Martin presented item four. State statue require municipalities to destroy election materials/records from the previous election year, in this case 2018 was our last election held for the Village of Los Lunas. Mayor Griego asked Council if there were any questions – there were none. Mayor Griego asked for a motion. APPROVAL: Motion to approve. MOVED: Councilman Jaramillo SECONDED: Councilman Munoz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes; Councilman Ortiz – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR AND 0 AGAINST. 5. EXECUTIVE SESSION. Mayor Griego announced that the Council would be going into executive session pursuant to NMSA 1the following matters may be discussed in closed session: hire FT Solid Waste Supervisor. APPROVAL: Motion to go into executive session pursuant to NMSA 1978 Section 10-15-1 (H) (2). MOVED: Councilman Ortiz SECONDED: Councilman Romero CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes, Councilman Ortiz – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR AND 0 AGAINST. 6:19PM. At 6:30PM, Mayor Griego asked for a motion from Council to reconvene indicating that they discussed a request to hire FT Solid Waste Supervisor. APPROVAL: Motion to approve MOVED: Councilman Jaramillo SECONDED: Councilman Ortiz CARRIED: Motion passed on a vote of 4 (Councilman Romero – yes, Councilman Ortiz – yes; Councilman Munoz – yes; Councilman Jaramillo – yes) FOR AND 0 AGAINST For the FT Solid Waste Supervisor, Mayor Griego recommended Josh Chavez. The Village of Los Lunas Council is pleased to have residents of the community take time to attend Village Council Meetings. Attendance and participation is encouraged. Individuals wishing to be heard during Public Hearing proceedings are encouraged to be prepared and will be limited to three (3) minutes in order to allow everyone the opportunity to be heard. PUBLIC COMMENTS ARE EXPECTED TO BE CONSTRUCTIVE AND DEVOID OF CHARACTER ASSASSINATION. Questions raised on non- agenda items may be answered at a later date by letter in order to facilitate proper research. Written comments are welcome and should be given to the Village Administrator prior to the start of the meeting. RESOLUTION 20-11 – APPROVING THE APPLICATION AND PETITION OF SIVAGE COMMUNITY DEVELOPMENT, LLC FOR FORMATION OF THE FIESTA PUBLIC IMPROVEMENT DISTRICT (PID) AND APPROVING RELATED DOCUMENT AND AGREEMENTS, INCLUDING A PID INFRASTRUCTURE DEVELOPMENT AND ACQUISITION AGREEMENT. TAB 1. ACTION REQUESTED OF COUNCIL: PUBLIC HEARING. Approve or disapprove. BACKGROUND AND RATIONALE: The Village of Los Lunas desires to continue to foster, promote and enhance economic development through the formation of public improvement districts in accordance with New Mexico state statutes and the Village’s public improvement ordinance (Ordinance 448). On January 9, 2020, Sivage Development submitted to the Village its application for the formation of the Fiesta Public Improvement District, including the proposed formation resolution and PID infrastructure and acquisition agreement under consideration. Once formed the District will be an independent political subdivision, the purpose of which would be to finance public infrastructure, including on-site and off-site roads, water and sewer benefitting the property within the boundaries of the district. The Developer will construct the infrastructure and dedicate the infrastructure to the Village for maintenance purposes. The Developer may be reimbursed for the cost of the public infrastructure through the assessment of special levies on the property located within the District. The maximum annual special levy on each developed and platted parcel would be $750. Special levies would be billed by the County Treasurer in the same manner as property taxes. The Village Council would serve as the Board of the District. The Village Clerk will serve as Clerk of the District and Michael Sivage will serve as the Treasurer of the District. The Application, formation resolution, PID infrastructure and acquisition agreement and related documents have been reviewed by Village Staff, the Village Attorney, and the Village’s bond counsel. Comments, questions and requests for information were provided to the Developer, responses were received, and all open items have been resolved. BACKGROUND AND RATIONALE: Municipal Clerk shall retain election records for two years after the election per §3-8-71; the records shall be destroyed when the two year period is up per §3-8-71C. (March 6, 2020). Included in the destruction: - absentee ballot register, application for absentee ballots, absentee voter lists and affidavits of destruction. - signature roster and registered voter list - machine printed returns - oaths of office of the precinct board - declarations of candidacy and withdrawals - copies of all election material required to be published or posted - copy of all sample ballots and ballot sheets - voting machine permits - certificates submitted by voters - copies of all affidavits and certificates prepared in connection with the election - all results of recounts, rechecks, contests and recanvas - all other significant election materials 5.
