MINUTES VILLAGE OF LOS LUNAS THURSDAY, JUNE 24, 2021 The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met virtually Thursday, June 24, 2021 in regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Phillip Jaramillo, Councilman Christopher Ortiz and Councilman Cruz Munoz. Councilman Gino Romero was excused. Meeting was conducted in person and recorded through Webex.com. RESOLUTION 21-14 – EDWARD BYRNE JUSTICE ASSISTANCE GRANT (JAG) FY 2021 LOCAL SOLICITATION PROGRAM. 2. FINAL PLAT APPROVAL FOR VALLECITO PHASE I. 3. JOINT POWERS AGREEMENT (JPA) – NEW MEXICO MUNICIPAL LEAGUE / NEW MEXICO SELF-INSURERS’ FUND. 9. EXCUTIVE SESSION: a) Hire Public Works Technician – Water/Sewer Division / Public Works Department. b) Hire PT Recreation Aide – Recreation Division / Parks and Recreation Department. c) Ratify hiring 2 Summer Recreation High School Aides – Recreation Division / Parks and Recreation Department. 10. APPROVAL OF MINUTES: a) Minutes from June 10, 2021 Council Meeting. b) Minutes from June 17, 2021, Workshop/Special Meeting. 11. ADJOURMENT. • CALL MEETING TO ORDER. At 6:00 PM, Mayor Griego brought the meeting to order and welcomed the audience. • PLEDGE OF ALLEGIANCE. Mayor Griego asked Ginny Adame to lead the Council and WebEx participants in the Pledge of Allegiance. Mayor Griego announced that Councilman Romero is excused. • APPROVAL OF AGENDA. RESOLUTION 21-14 – EDWARD BYRNE JUSTICE ASSISTANCE GRANT (JAG) FY 2021 LOCAL SOLICITATION PROGRAM. Police Chief Naithan Gurule presented item one. Requesting permission to apply for the United States Department of Justice, Office of Justice Programs has made funds available in the amount of $15,740.00 to the Los Lunas Police Department. Funds will be used to purchase equipment, supplies, and training information systems (air purifiers and respirators for SWAT Team). Mayor Griego asked Council if there were any questions – there were none. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve resolution 21-14. This is an Evaluator Contract for the Office of Substance Abuse Program. Seeking approval for the contractor, Ms. Concha Montano – she brings over thirty years of experience to this position. Program Evaluator Contract and Enforcement Coordinator Contract for the Local DWI Program. The first contract is for an evaluation contract is for the prevention component of the DWI Program for Concha Montano and the second contract is for the enforcement contract for Joe Griego. Mr. Joe Griego has been with the program for many years and a former Police Officer for the Village of Los Lunas. Mayor Griego asked if the Council had any questions – there were none. Mayor Griego asked for a motion from Council. APPROVAL: Motion to approve contracts for Concha Montano and Joe Griego. VILLAGE OF LOS LUNAS PAL PROGRAM: PROGRAM COORDINATOR, MENTOR COORDINATOR, AND MENTOR ASSISTANT CONTRACTS REQUESTING PERMISSION TO ENTER INTO CONTRACTS WITH INDIVIDUALS. Ms. Ginny Adame presented item six. Three contracts for the PAL Program – the first contract is for Noel Chavez (assists with coordination and reporting for the PAL Program); the second is for Joe Griego (oversees the mentoring); and third and last contract is for David Adame (been with mentoring program and TNT). RESOLUTION 21-13 – RESOLUTION AUTHORIZING THE VILLAGE OF LOS LUNAS TO PICK-UP SIXTY-SEVEN PERCENT (67%) OF THE PERA MUNICIPAL PLAN 3, MUNICIPAL POLICE PLAN 5, AND MUNICIPAL FIRE PLAN 5 MEMBER CONTRIBUTIONS IN EFFECT JULY 1, 2021. Ms. Rebekah Klein presented item seven. Senate Bill 90 increased the employee contribution rate for all eligible employees under the municipal general Fire Plan by 1.50%, also the Village of Los Lunas will continue to pick up 67% of the employee’s PERA contribution for all eligible employees. This resolution does not change the contribution rate for the employees who participate in the municipal plan and the municipal Police plan. JOINT POWERS AGREEMENT (JPA) – NEW MEXICO MUNICIPAL LEAGUE / NEW MEXICO SELF-INSURERS’ FUND. Mr. Gregory D. Martin presented item eight. Presenting to Council a JPA that was recently approved by the board of the New Mexico Self- Insurers’ Fund. There were some changes made by the New Mexico Municipal League. the updated JPA reflects the first substantive change to the document in over thirty years, and represents a significant step forward in equity, transparency, and accountability, which together were cornerstone considerations in the Board’s editing process. Although the Board’s approval itself compels members’ assent with changes to the agreement’s terms, the Village still must sign the document for it to take legal effect. Managing consultants acting agent for Sivage Community Development LLC has requested final plat approval for Vallecito Phase I. The legal description: Subd: Las Terrazas at Fiesta Subdivision Tract: LC-B-1 S: 16 T: 7N R: 2E 26.89 Acres Plat M-480, Phase 1 of the proposed Vallecito Subdivision. The property is located north of Main St along Los Cerritos Rd NW. This is a final plat request for 36 lots within the Vallecito Subdivision. There is not a request to accept the roads for maintenance because we have a financial guarantee that has been submitted to allow the final plat to move forward without the infrastructure to be complete as per subdivision regulations. All proposed single-family residential within the Fiesta Master Plan. This is within Council District 2. Notice of public hearing was published in the Valencia News Bulletin on June 3, 2021 and was mailed to adjacent property owners per municipal code. There has been no letters or phones calls in opposition of this request. Based on the municipal code and the comprehensive plan, the Community Development Department recommends approval of this final plat. This item is the Sun Valley Ranch Homes, Rio Abajo Commercial Development – legal description: requested minor subdivision approval for lots 1 through 18 and Columbine Circle of Subd: Sun Valley Ranch Homes #1 S: 27 T: 7N R: 2E .05 Acres Plat A-39; Tract: 70E2 S: 27 T: 7N R: 2E 0.20 Acre Map 72 2006 Rev; and Tract: 113 S: 27 T: 7N R: 2E 0.22 Acre Map 72 2006 Rev. The subject property is located on the southeast corner of Main St SE and Edeal Rd SE. Property owner is Rio Abajo LLC; applicant name is Montgomery and Andrews, P.A. This item was heard before Planning & Zoning Commission on June 2, 2021 and was recommended for approval. This request is to combine all of the lots and vacate Columbine Circle and to create one contiguous parcel of land. The proposed use commercial land that would be marketable for future commercial development. Zoning is currently C-2 Commercial. This item was advertised in the Valencia News Bulletin on May 13, 2021. Certified mail was sent to all adjacent property owners per our subdivision ordinance. Community Development Department received no phone calls or letters in opposition – phone calls received were inquires about what this was all about. The Development Review Committee has reviewed this – there are no issues with the application and based on our municipal code and comprehensive plan, the Community Development Department recommends approval of this minor subdivision. Mayor Griego asked if the easements were being vacated – Erin replied yes. Mr. Rico Gonzales from Montgomery and Andrews was present. Mr. Gonzales commented his client is currently taxed for 21 individual parcels and this taxation structure is an impediment to the marketability. They want to establish one contiguous parcel.
