VILLAGE OF LOS LUNAS
THURSDAY, NOVEMBER 4, 2021
The Board of Trustees of the Village of Los Lunas, County of Valencia, and State of New Mexico met virtually Thursday, November 4, 2021 in
regular session at 6:00 PM. Roll call was taken and the following were present: Mayor Charles Griego, Councilman Cruz Munoz,
Councilman Christopher Ortiz, Councilman Phillip Jaramillo and Councilman Gino Romero. Meeting was conducted in person and recorded
through Webex.com.

3. MOA - THIRTEENTH AMENDMENT MEMORANDUM OF AGREEMENT – REQUEST FOR FLEET MAINTENANCE SERVICES 2021/2022.
Mr. Michael Jaramillo presented item three. Entering into the thirteenth amendment memorandum of agreement between the Village of Los
Lunas and Rio Metro. Services are for performing fleet maintenance and storage of vehicles. Will continue to pay costs for fuel, supplies and
storage of units. Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from Council.

4. MOA – MEMORANDUM OF AGREEMENT – RIO METRO REGIONAL TRANSIT DISTRICT 2021/2022.
Mr. Michael Jaramillo presented item four. Rio Metro is asking to continue the MOA (second year) between the Village of Los Lunas to fund
the annual salary and benefits for one Heavy Duty Mechanic position within the Public Works Department Fleet Maintenance Division for
2021/2022.
Mayor Griego asked Council if they had any questions – there were none. Mayor Griego asked for a motion from Council.

matters may be discussed in closed session: hiring of a FT Water Maintenance Operator and hire two (2) FT Solid Waste Laborers.

1. EASEMENT VACATION APPROVAL FOR SUBD: LAND OF ERNEST & SUNDAY CORDOVA TRACT: B1B1 .50 AC B-5-28 2001 REV.
Ms. Erin Callahan presented item 1. This is an easement vacation located south of Sichler Rd SW and west of Amistad Rd SW. The Mariano
Chavez Family Partnership has requested plat vacation approval for a 10’ public utility easement at Subd: Land of Ernest & Sunday Cordova
Tract: B1B1 .50 AC B-5-28 2001 Rev. This request is to vacate a ten-foot utility easement that is located in the middle of the parcel.
Property is located in Council District 3 and not in a FEMA zone. This is a vacant lot. Surround by R-1 single family. Item was posted in the
Valencia County News Bulletin on September 16, 2021 and letters went out to adjacent property owners. There were no protests received
on the request. All utilities have been installed in the public right of way. The Community Development Department recommends approval
of this public utility easement vacation. Mayor Griego asked if there were ay questions from Council – there were none. Mayor Griego asked
if there was anyone from the public who wanted to speak. Ms. Elizabeth Autry spoke in favor of the easement vacation. Mayor Griego asked
for a motion to close the public hearing.

2. ORDINANCE 461 – RECREATIONAL CANNABIS REGULATIONS.
Ms. Erin Callahan presented item two. Presented to Council is an update to Ordinance 461. This item has been extensively discussed with
presentations by Mr. Alex Ochoa. This ordinance will establish guidelines for recreational cannabis – basically time/place and matter
regulations that we are allowed to establish per state statue. An informational discussion was held at a Council Workshop to discuss a
refined draft of the ordinance. Updates were given by Council - buffers at 300 ft. at the property line of the cannabis establishment, buffers
around churches, other cannabis establishments, daycare centers, public parks, schools, and Village facilities. We also looked at our density
requirements which we are allowed to establish by statue – one establishment per two square miles. Also, considered prohibiting any
cannabis consumption areas. Council updates were made – Alex included all the buffers on a map and with all the buffers the Village would
prohibit any cannabis shop in the Village. Legal counsel, Larry Guggino, noted that I would be an excessive regulation to provide an
ordinance that was so restrictive. Mr. Guggino gave a couple of recommendations – as far as the buffers are concerned, 300 ft. is not an issue,
however, he recommends that the only buffer are the two items that the state specifically addresses in the statue are schools and day cares.
The ordinance was amended to include only schools and day care facilities. He also had a concern with density – he recommended that we
use a per capita density. He also recommended that we do not prohibit consumption areas – the state statue notes that we may allow
consumption areas in the Village. With all this in mind, updates and restrictions were made. Councilman Romero asked for an example on
he density per capita. Erin replied, one cannabis establishment per 2,000 residents. Based on the last census which put us over 17,000
residents, so that would mean 9 establishments. Mayor Griego asked if anyone in the audience wanted to speak for or against Ordinance
461 – there was no comment. Mayor Griego asked for a motion to close the public hearing.

BACKGROUND AND RATIONALE:
Community Development held a Council Workshop on August 19, 2021, and presented at the September 15,
2021, Village Council meeting to discuss local cannabis regulations permitting residential and commercial
cannabis activity. This agenda item is to establish a local recreational cannabis ordinance developed through the
previous meetings with Mayor and Council.

BACKGROUND AND RATIONALE:
Rio Metro Transit District is requesting to enter into a Thirteenth Amendment MOA with the Village of Los Lunas
to continue performing fleet maintenance services and storage for their public transportation vehicles. They will
continue to pay costs for fuel, supplies and storage of units. The Village of Los Lunas has performed these
services for Rio‐Metro under previous agreements for the past twelve (12) years.

BACKGROUND AND RATIONALE:
Rio Metro Regional Transit District (RMRTD) has requested a Memorandum of Agreement (MOA) to the
continuation of fully-funding the annual salary and benefits, of one (1) Heavy Duty Mechanic position within the
Public Works Department Fleet Maintenance Division for 2021/22; this would maintain the support of one (1)
full-time position. RMRTD has no involvement, authority or responsibility for how the Village manages its
maintenance division, operates or maintains its operations. RMRTD understand this MOA request will continue
to support the needs within in fleet maintenance services provided to RMRTD and the Village of Los Lunas Fleet.
