MINUTES PLANNING & ZONING MEETING September 2, 2015 The Village of Los Lunas Planning & Zoning Commission met in their regular session on Wednesday, September 2, 1915 at 6:00 pm in the Village Council Chambers. Members present were as follows: Commissioner David Crawford, Terry Ulibarri, Stephanie Williams, Frank Vigil & Walter Baca. Staff members present were Christina Ainsworth, Community Development Director & Marie Marquez, Recording Secretary. Members of the public present were as follows: Martin J. Garcia. Aaron Havnes. Juanita Simon, Dana Simon & Rosella Haynes. The Meeting was called to order by: Chairman Stephanie Williams APPROVAL OF AGENDA Chairman S. Williams called for any changes or additions to the agenda. Commissioner T. Ulibarri made a motion to approve the agenda as presented. Commissioner David Crawford seconded the motion. Everyone voted yes, motion carried. SWEARING OF PARTICIPANTS AGENDA ITEMS: PRELIMINARY PLAT - Tortuga Land Company I ITEM 1 — PRELIMINARY PLAT Tortuga Land Company — Chairman S. Williams introduced Item I- The action requested of this commission is to have a public hearing to review and recommend to council approval or disapproval of this Preliminary Plat application submitted by Tortuga Land Company. Christina Ainsworth approached the podium and presented the item and gave a brief background & rational about the preliminary plat request. She pointed out the location on the screen which is on Camelot Blvd and Ken Haynes Rd., adjacent to Days Inn, the new Buffalo Wild Wings & Walgreens. The whole area in the back is zoned C-I, which permits commercial development. She also pointed out Ken Haynes road which ends where the Buffalo Wild Wings is, but is proposed to extend all the way through that vacant property and connect to Camino Del Rey, which would provide connection to all the roads that are already existing. The property will then be subdivided into lots that could be developed for various commercial uses that are permissible in the C-i zoning. Staff has reviewed the submittal, and were able to get answers to questions that they were concerned about such as drainage, outside ponding for the area, questions regarding why the connection of road is a certain way. Access is to be provided for all those lots through Ken Haynes arid being that it is compatible with existing land uses & it is a permissible division, staff recommends approval. Christina said, there were no public comments received. The questions described were only amongst the staff. Mr. Martin Garcia. Agent for Tortuga Land Development came up to state the reason for the request of this Preliminary Plat. He said, over the past few years they have had many interests in developing portions of the property. The interests that have come in have been for smaller portions in the sixteen acres the property currently has, and the time frame has taken a long time so as a result they have chosen a different site. So, in anticipation of future people coming in with future interests,what they did is setup a series of lots that vary from one to 2.7 acres. This allows them to attract from small to larger commercial businesses coming in. They tried to set the largest lot in the center so it creates a hub around to focus that as a primary interest and others would be supporting services of that sort. The primary interest is to get it set up so that if someone comes in with an interest and they have a short fuse they can offer that, and move forward and keep the development on that property. Mr. Garcia said, they are very much aware that Ken Haynes Road extension is their responsibility, it has been widened as per the Village of Los Lunas standards and as far as the drainage is concerned they know that retention ponds are required, and will be taken care of and maintained by the property owners. As far as the water line, they will extend it to the west and eventually making a 1oop out of it to make sure it functions properly. Commissioner F. Vigil questioned the lighting in that development and Mr. Garcia said, at this time that has not been discussed but they are willing to comply with Village requirements. Their long-term goal is to build this roadway, water and sewer to the extent that the Village is comfortable with excepting ownership and maintenance of it, and their long-term goal is to turn this road over as a public roadway to the Village of Los Lunas. Commissioner F. Vigil also questioned the signage and Mr. Garcia said, it would be similar to what’s there nothing larger to pollute the area. Chairman S. Williams asked about the types of businesses they were anticipating to place there? Mr. Garcia said, probably clothing stores and those type of things Commissioner D. Crawford also questioned if there would be another access from Main St. and Mr. Garcia responded, their primary access would be through the Ken Haynes Road. Commissioner T. Ulibarri asked if it would be possible for them to come before the commission to request larger lot approval in the future? Mr. Garcia replied, yes it is possible someone might just come in requesting 2 acre lots in place of 1. He said, they try to keep them small so that they are practical. Commissioner W. Baca asked Christina, if the infrastructure was going to change and at what point would it be brought before the commission? Christina said, they would have to submit subdivision improvement plans to the Village engineer to be reviewed. Cristina also told the commissioners that the Village Code requires that they bring in a subdivision for the entire property if they are going to subdivide portions, and this is the reason they are here. This makes it easier for them if someone comes in and wish to purchase a lot and need to consolidate the line. They would just have to do a summary plat and that would be an administrative staff approval, and they would not have to go through this public hearing process. Planning & Zoning approves the Preliminary Plat which acts as a recommendation to Council for the Final Plat which they approve. Chairman S. Williams called for anyone wishing to comment for or against this proposal of the Preliminary Plat to come forward. Dana Simon, resident of Angel Loop came up and was concerned about the undeveloped land and the traffic on that road. She said, the residents there were very concerned about the types of businesses that would be going in in the area. The residents — there are opposed to any liquor stores, dollar stores, smoke shops, payday loans & car lots. Her home is right at the corner of Angel Loop & Golden Gate and they have seen a tremendous amount of traffic leading to the CYFD office and the amount of accidents that happen on Golden Gate and Camelot that are hazardous. She said, she was not against the development coming into Los Lunas but she said, they need to be more selective as to the types of businesses that come in, and will be boardering the southend of the Golden Gate road. This would be quite disturbing. Mr. Garcia came up and told the commissioners that one of the things they would do is be more sensitive to the neighborhood on the southside. One of the steps to do that, is to try to keep the buildings closer to the center of the site and the parking further out to the perimeter to try to accommodate those things. Chairman S. Williams asked, what about building a wall between the Golden Gate Road and the property? Christina said, staff would highly discourage a wall because they would want to provide compatible uses for the neighborhood. Commissioner D. Crawford also had a concern about big trucks coming in to deliver merchandise. Mr. Martin said, the lots are big enough and improvements have been made to the Ken Haynes road. He said, we will try to keep everything well organized as we develop the property. Commissioner F.Vigil asked if the Village can limit certain types of business to come in that property? Christina said, this was not a zoning application. Chairman S. Williams asked what types of businesses could come in there? Christina said, most likely retail & offices. Ralph Mims, Economic Development Manager came up and told the commissioners that Smoke Shops, Title Loans businesses most likely go into buildings that are already built. They don’t go into places where they have to build from the ground up. The rent would be too high for them. Commissioner W. Baca was also very concerned about the high amount of traffic going through Golden Gate, but Mr. Garcia said, they are certainly going to try to minimize the traffic by utilizing Ken Haynes Road most of the time except Golden Gate had to be a connection point because of the legal access that abuts to a public street. Their goal is to have a route inside the property so they minimize the access to Golden Gate. There were no further comments. Chairman S. Williams called for a motion to approve this preliminary plat. Commissioner T. Ulibarri made a motion that the Tortuga Land Company application for a Preliminary Plat for Tracts IAIB Lands of Peter H. Naumburg be approved with the suggestion, that staff look at the need for a Traffic Impact Study. Commissioner F. Vigil seconded the motion. Everyone voted yes, motion carried. ITEM 2—APPROVAL OF MINUTES — Minutes of August 19, 2015 Chairman S. Williams called for a motion to approve the minutes for August 19, 2015. Commissioner W. Baca made a motion to approve the minutes as amended. Commissioner F. Vigil seconded the motion. Everyone voted yes, motion carried. ITEM 3-DISCUSSION Community Development Activity Report — a. Community Development Activity Report Regarding the potential purchase of the Old Monte Vista trailer park on Juan — Perea. Christina explained the situation about the Metropolitan Redevelopment Area Plan which is a mechanism that the state allows for municipalities to utilize funds in a way that they are traditionally permitted to do. Municipalties typically can use their funds to provide services to build public facilities, but not necessarily for private development. In that case that is what we would be doing. A consultant has been hired and they are currently working on that area plan and is projected to be completed by the end of October. The development of the plan will go through a public hearing process but all of that has to happen before the Village can pursue the acquisition of the property. The Village would also like to purchase the two lots north of that property as well, but nothing is definite yet. Christina also told the Commission that Accurate Machine sold the component of their operation to Party City so they’re doing the transfer of that now. Ralph Mims said, that will create more jobs in the Village. The building is huge and we’re glad to have them in our Community. There are also some potential buyers for the Merrilat building as well. Sivage has also purchased a couple of the subdivisions on northside of Fiesta by the High School, so they will be building homes there. b. Code Enforcement Issues — Rattle Snakes has been a problem on Ventana and a colony of prarie dogs on Juan Perea Rd. ITEM 4- ADJOURNMENT Chairman S. Williams F.
