Berkley Development, LLC is seeking a determination regarding where there is a resource area subject to
the Wetlands Protection Act present on the site.

B. Buitenhuys noted that the applicant had requested a continuance because the peer reviewer was still
working on reviewing the application.
Motion:
P. Downs motioned and M. Burns seconded the motion to continue the item to the 6/26 Conservation
Commission meeting. The motion passed unanimously, (5-0).

Request for Determination of Applicability
Lowell Housing Authority
350 Moody Street

Project Location: 50 Stackpole Street 01852
A Request for Determination of Applicability has been filed by Lowell Housing Authority to replace a
retaining wall at their development on 50 Stackpole Street. The proposed project is within 100 feet of
the Concord River.

Discussion:
B. Buitenhuys said breaching the crest would require some additional protections.
L. Watts said they won’t be touching that. There’s no need to go beyond the high point of the wall. Don’t
foresee any situation breaking that crest. Could add silt bags around but having them around the entire
riverbed would be an extra cost that won’t be necessary since there won’t be any impact to the resource
area.
Motion:
P. Downs motioned and R. Ciccarelli seconded the motion to issue a Negative III Determination with the
following condition:
1. The drainage basin shall be cleaned out after high rain events.
The motion passed unanimously, (5-0).

In accordance with the Massachusetts General Laws Chapter 131, Section 40, and the City of Lowell
Wetland Ordinance Section 280.1-13, the Lowell Conservation Commission will hold a meeting on
Wednesday, June 12, 2024 at 7:00 PM in-person in the City Council Chamber, 375 Merrimack Street,
Lowell MA 01852.
Meetings will be held in the City Council Chamber at 375 Merrimack Street, Lowell MA 01852
with public welcome and by using remote participation as follows:
Members of the public may view the meeting via ltc.org or local cable channel
6. Those wishing to speak regarding a specific agenda item shall register to
speak in advance of the meeting by sending an email to
fcigliano@lowellma.gov , dricker@lowellma.gov , AND
pcutrumbes@lowellma.gov indicating the agenda item and a phone number to
call so that you may be issued zoom link to the meeting. If no access to email,
