CONSERVATION COMMISSION LOWELL, MASSACHUSETTS June 12, 2024 Note: These minutes are not completed verbatim. Members Present: Brad Buitenhuys, Louisa Varnum, Perry Downs, Marie Burns, Robert Ciccarelli Members Absent: Kevin Dillon, Stephen Laput Others Present: Francesca Cigliano, Senior Planner CALL TO ORDER ORDER OF BUSINESS CONTINUED BUSINESS Request for Determination of Applicability Berkeley Development, LLC 16 Pulpit Rock Road Pelham, NH 03076 Project Location: Llewellyn St & Christian Street 01850 Berkley Development, LLC is seeking a determination regarding where there is a resource area subject to the Wetlands Protection Act present on the site. On Behalf: None Speaking in Favor: None Speaking in Opposition: None Discussion: B. Buitenhuys noted that the applicant had requested a continuance because the peer reviewer was still working on reviewing the application. Motion: P. Downs motioned and M. Burns seconded the motion to continue the item to the 6/26 Conservation Commission meeting. The motion passed unanimously, (5-0). NEW BUSINESS Request for Determination of Applicability Lowell Housing Authority 350 Moody Street Lowell MA 01851 Project Location: 50 Stackpole Street 01852 A Request for Determination of Applicability has been filed by Lowell Housing Authority to replace a retaining wall at their development on 50 Stackpole Street. The proposed project is within 100 feet of the Concord River. On Behalf: Hooshi Afshar, Applicant’s Engineer Laura Watts, Lowell Housing Authority Speaking in Favor: None Speaking in Opposition: None Discussion: B. Buitenhuys said breaching the crest would require some additional protections. L. Watts said they won’t be touching that. There’s no need to go beyond the high point of the wall. Don’t foresee any situation breaking that crest. Could add silt bags around but having them around the entire riverbed would be an extra cost that won’t be necessary since there won’t be any impact to the resource area. Motion: P. Downs motioned and R. Ciccarelli seconded the motion to issue a Negative III Determination with the following condition: 1. The drainage basin shall be cleaned out after high rain events. The motion passed unanimously, (5-0). Request for Certificate of Compliance Carlosalberto Cordeiro 243 West Meadow Road Lowell, MA 01854 MassDEP #206-0563 Project Location: 243 Westmeadow Rd 01854 The applicant is seeking a Certificate of Compliance for a project that received an Order of Conditions (OOC) in July 2004 (DEP #206-0563). On Behalf: Carlosalberto Cordeiro, the Applicant Speaking in Favor: None Speaking in Opposition: None Discussion: None Motion: P. Downs motioned and R. Ciccarelli seconded the motion to issue the Certificate of Compliance. The motion passed unanimously, (5-0). OTHER BUSINESS 5/22 meeting minutes M. Burns motioned and R. Ciccarelli seconded the motion to approve the minutes. The motion passed unanimously, (5-0). ADJOURNMENT P. Downs motioned and M. Burns seconded the motion to adjourn the meeting. The motion passed unanimously, (5-0). The time was 7:26PM.
