Minutes for Lowell License Commission meeting, Thursday, August 21, 2014 at 6:30 p.m., Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852 Present: Cliff Krieger, Commissioner, presiding, Commissioners Kristen Hogan, Terry McCarthy, Nancy McGovern, Captain Thomas Kennedy, Lowell Police Department Absent: John Descoteaux, Commissioner, Chairman The Commission approved the minutes for meeting July 31, 2014 on a motion by Commissioner Hogan, second Commissioner McCarthy. The Commission reviewed applications for public amusement licenses for carnival by Fiesta Shows, John Flynn, representative, at Welcome/Festival Field, 381-501 Pawtucket Blvd., Friday, September 5, and Saturday, September 6 – 2014; Friday, September 12, and Saturday, September 13 – 2014; Friday hours 6 p.m. to 11 p.m.; Saturday hours 12 noon to 11 p.m. John Flynn was present. On a motion by Commissioner McCarthy, second by Commissioner Hogan, the Commission voted to approve the licenses to Fiesta Shows for carnival on Friday, September 5, and Saturday, September 6 – 2014; for carnival on Friday, September 12, and Saturday, September 13, 2014. The Commission reviewed application by Global Spectrum, LP, Keith Vaske, General Manager, for public amusement license for Martial Arts at the Lowell Memorial Auditorium, for the East Coast Fighting Championships II, Friday, September 12, 2014 from 7:30 p.m. to 11:30 p.m. Todd Stoudenmire was present, representing Global Spectrum. The Commission also reviewed the public amusement application by Global Spectrum, LP for license for the 9th Annual Business Leadership Forum, Thursday, September 25, 2014 from 6:30 p.m. to 10 p.m. at the Lowell Memorial Auditorium. Commissioner McCarthy questioned Mr. Stoudenmire about security for the East Coast Fighting Championship. Mr. Stoudenmire stated that there will be four Lowell police officers as detail, and private security employed by Global Spectrum. On a motion by Commissioner Hogan, second by Commissioner McCarthy, the Commission approved public amusement licenses to Global Spectrum for the above events September 12, and 25, 2014 at Lowell Memorial Auditorium. The Commission reviewed for ratification the special one-day license to sell/dispense all alcohol beverages issued to Olimpio Brasil of the Holy Ghost Society at Holy Ghost Park, 65 Village St., for the Eddie Casella Dinner held Sat., August 16, 2014 from 12 noon to 1:30 a.m. The license was issued August 5, 2014. Olimpio Brasil was present. The 1 Lowell License Commission meeting minutes August 21, 2014 Commission voted to ratify the issuance of said license to Olimpio Brasil for the event of August 16, 2014 at Holy Ghost Park on a motion by Commissioner Hogan, second by Commissioner McGovern. The Commission reviewed applications for special one-day licenses to sell and/or dispense malt beverages & wines only, or either one. The applicants appeared before the Commission: David W. Burns, Tracy Martino, Donna R. Julian, Pete Crewe, and Crystal Arnott. Commissioner Krieger informed each of the applicants that the license will be in their name, and each has the responsibility for the sale and service of the alcohol beverages. The Commission, on the motion by Commissioner Hogan, second by Commissioner McCarthy, voted to grant a special one-day license to sell and/or dispense malt beverages & wines only, or either one to said individuals for the each person’s event: David W. Beer & wine tasting fundraiser, for Friday, October 17, 2014 from 7 p.m. to 10 p.m. The Commission reviewed the application by Global Spectrum, LP for special events permit for amplified outdoor public entertainment for the WAAF 107.3 Rock Music via Mobile Radio Station in conjunction with the East Coast Fighting Championship block party to be held at the front plaza of Lowell Memorial Auditorium, Friday, September 12, 2014 from 5:30 p.m. to 7:30 p.m. Todd Stoudenmire was present in place of Dean Easterling, Event Manager. Mr. 2 Lowell License Commission meeting minutes August 21, 2014 Stoudenmire stated that an amplification check may begin as early as 4:30 p.m. On motion by Commissioner McGovern, second by Commissioner Hogan, the Commission approved the special events permit for said event, and to allow amplification to begin, as suggested by Mr. Stoudenmire as early as 4:30 p.m. The Commission reviewed the application by 99 Restaurant of Boston, LLC, 850 Chelmsford St., all alcoholic beverages restaurant licensee, for change of officer/director/managing member without new personnel as replacement. Amy Manchester was present as representative; Ms. Manchester is the manager of record. Two corporate officials have left the company; there are no individuals proposed as replacements. The Alcoholic Beverages Control Commission, in a communication dated April 8, 2014, acknowledged the transactions. On a motion by Commissioner Hogan, second by Commissioner McGovern, the Commission approved the application of 99 Restaurant of Boston, LLC. The Commission opened the hearing on the application by Lucky Lantern, Inc., d/b/a Mandarin Asian Bistro, for the transfer of the all alcoholic beverages Restaurant license from Stella LLC, d/b/a Centro, Patricia A. Stella, Manager, for premises at 24 Market Street, unnumbered doors south side, east side; sidewalk seating for restaurant; dining area, bar area, kitchen, food prep area on first floor; basement for storage only. The licensee Stella LLC has a 1 a.m. legal closing time. It is requested that Yu Zhou be approved as manager of record for Lucky Lantern, Inc., Lucky Lantern, Inc. has filed applications for the following licenses for premises at 24 Market St. – common victualler; entertainment license for TV(s) and recorded background music. Atty. Christopher Coleman appeared before the Commission as legal counsel for Lucky Lantern, Inc. Yu Zhou was present. Atty. Coleman stated that Mr. Zhou would operate the business Sunday to Saturday, 11 a.m. to 11 p.m. daily; approximately six to eight employees will be receiving service training; entertainment would be one or two television(s). Atty. Coleman stated that his client plans to enter into a sidewalk seating agreement with the City of Lowell. Commissioner Krieger opened the hearing for public comment. There were no individuals who spoke in favor or against the transfer application. The public comment portion of the hearing was declared closed. After discussion, the Commission, on a motion by Commissioner Hogan, second by Commissioner McGovern, voted to approve the transfer of the all alcoholic beverages Restaurant license from Stella LLC to Lucky Lantern, Inc. for premises at 24 Market Street. The Commission approved Yu Zhou as manager of record for Lucky Lantern, Inc. License for common victualler was granted by the Commission to Lucky Lantern, Inc., 3 Lowell License Commission meeting minutes August 21, 2014 Yu Zhou, President, for premises at 24 Market Street. The Commission approved an entertainment license for television, and background music for Lucky Lantern, Inc. for premises at 24 Market Street [no fee required]. The Commission opened the hearing on the application by L’Aigle D’Or, Inc., all alcoholic beverages Restaurant licensee at 645 Pawtucket Blvd., for change of corporate officer/director, and for change in beneficial interest. Patricia Lang Farnsworth, Esquire, was present to answer questions regarding the change in beneficial interest from Leiserv LLC of Brunswick Corporation to AMF Bowling Centers Inc. An employee of Brunswick Zone Lowell was present. Ms. Farnsworth explained that Brunswick does not have any other holdings in Massachusetts, and that the proposed acquisition by AMF Bowling Centers Inc. would be its sixth section 12 (MGL 138) license in Massachusetts. Management as well as the business name will remain the same for the licensee L’Aigle D’Or, Inc. Commissioner Krieger opened the hearing for public comment. There were no individuals who spoke in favor or against the proposed change of officer/director/beneficial interest. The public comment portion of the hearing was declared closed. After discussion, the Commission, on a motion by Commissioner McCarthy, second by Commissioner Hogan, voted to approve the application by L’Aigle D’Or, Inc. The Commission reviewed the application by DCR Enterprises Inc., Charlene Rogers, President, for Second Hand Motor Vehicles, Class II, used car Dealer license for premises at 1625 Middlesex St. Presently, the licensee is Action Rentals, Inc., Kenneth J. Mackey, President, license # 725-B, premises defined as 1625 Middlesex Street, suite 4, office area of approx. 600 sq. ft. within building, and approx. 7,700 sq. ft. of leased space in an open lot for 35 vehicles. Charlene Rogers was present. Ms. Rogers stated that DCR Enterprises will continue with car rentals, and that the Class II license will allow for sale of rental cars at auction. There are two auction cites locally, in Concord and in Framingham. There is a pending lease agreement with the property owner. On a motion by Commissioner McGovern, second by Commissioner Hogan, the Commission voted to grant a license for Second hand Motor Vehicles, Class II, Used Car Dealer to DCR Enterprises, Inc., Charlene Rogers, President, for premises at 1625 Middlesex Street. The Class II license, # 725-B, is to be surrendered for cancellation by Action Rentals, Inc.
