Minutes for Lowell License Commission meeting, Thursday, September 11, 2014 at 6:30 p.m., Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852 Present: John Descoteaux, Commissioner, Chairman, Commissioners Cliff Krieger, Kristen Hogan, Terry McCarthy, Nancy McGovern, and Captain Thomas Kennedy of the Lowell Police Department. The Commission approved the minutes for meeting August 21, 2014 on a motion by Commissioner Krieger, second Commissioner Hogan. The Commission reviewed the request to cancel the special one-day license granted August 21, 2014 to Donna Julian to sell and/or dispense malt beverages & wines only, or either one, and also the request of a credit for fee paid for the license issued to Donna R. Julian; the event is the ECFC Block Party to be held at the front plaza, fence enclosed, of the Lowell Memorial Auditorium, 50 East Merrimack St., for Friday, September 12, 2014 from 5:30 p.m. to 7:30 p.m. Mrs. Julian noted in a communication dated September 8, 2014 that a family emergency is cause for her to make the request as noted above. The Commission, on a motion by Commissioner Krieger, second by Commissioner McCarthy, voted to cancel said license issued to Donna Julian, and credit the license fee paid for another license the Commission may grant. The Commission reviewed special one-day license applications for all alcoholic beverages. Olimpio Brasil of the Holy Ghost Society filed application for the event at Holy Ghost Park, 65 Village St., for Saint Peter’s Church, to be held Saturday, September 20, 2014 from 12 noon to 1:30 a.m. Mr. Brasil was present. Mr. Brasil has filed a second application, as follows: Olimpio Brasil of the Holy Ghost Society at Holy Ghost Park, 65 Village St., Borba’s 25th Anniversary, for Sunday, September 21, 2014 from 12 noon to 1:30 a.m. The Commission, on a motion by Commissioner Hogan, second by Commissioner McGovern, voted to grant licenses to Olimpio Brasil of the Holy Ghost Society for said events of September 20, and September 21, 2014. The Commission reviewed special one-day license applications to sell and/or dispense malt beverages & wines only, or either one Robert T. Julian, III of Julian Lenzi Hospitality Group, Inc., appeared before the Commission on his application for the event at the front plaza, fence enclosed, of Lowell Memorial Auditorium, 50 East Merrimack St., for ECFC Block 1 Lowell License Commission meeting minutes September 11, 2014 Party, for Friday, September 12, 2014 from 5:30 p.m. to 7:30 p.m. Mr. Julian stated that the area would be sectioned off for the block party to allow for a maximum number of 1,000 ticket holding patrons. Jack Fletcher of the Lowell Catholic Athletic Department, 530 Stevens Street, appeared before the Commission on his application for the event Rock-N-Roll Night, Saturday, September 20, 2014 from 7:00 p.m. to 10:30 p.m. at the Lowell Catholic Gymnasium. Mr. Fletcher stated that the event is sponsored by the booster club as a fundraiser for the school athletic program. James M. Demers of Knickerbocker Club, 36 Chamberlain St., appeared before the Commission on his application for yard sale, Sunday, September 28, 2014 from 11:00 a.m. to 3:00 p.m. at the outdoor grounds located at 36 Chamberlain St. Mr. Demers stated it is requested that a keg of draft beer be available for the scheduled outdoor event. On a motion by Commissioner Hogan, second by Commissioner, the Commission voted to grant special one-day licenses for malt beverages and wines only, or either one to Robert Julian, Jack Fletcher, and James Demers. The Commission approved the credit of license fee paid by Donna Julian for the license granted to Robert T. Julian III of Julian Lenzi Hospitality Group, Inc. The Commission reviewed the special one-day license applications to dispense wines only from Karen Boutet of Zeitgeist Gallery, at 167 Market Street; there are two applications, the events are Art Receptions, Saturday, September 20, 2014 from 6:00 p.m. to 9:00 p.m., and for Saturday, October 4, 2014 from 6:00 p.m. to 9:00 p.m. Ms. Boutet was present. The Commission, on a motion by Commissioner McCarthy, second by Commissioner Krieger, voted to approve the licenses to dispense wines only for Karen Boutet of Zeitgeist Gallery for the premises at 167 Market St. The Commission reviewed the application for special events permit for amplified outdoor public entertainment from Francey Slater of Mill City Grows, for Saturday, September 20, 2014, from 1 p.m. to 5 p.m.; the event is the 3rd Annual Harvest Festival, at Rotary Park & community garden @ 22 Richmond Ave. There is to be live music and d.j. Ms. Slater was present. Ms. Slater, in response to a question about available parking, stated there will be parking at the Rogers School with a shuttle running from the school to the site of the Harvest Festival. The Commission voted to approve the special events permit for Francey Slater of Mill City grows on the motion by Commissioner Hogan, second by Commissioner Krieger. 2 Lowell License Commission meeting minutes September 11, 2014 The Commission took no action on the application by Rami Salameh, d/b/a Wireless Professional, 480 Bridge Street, for license for Second Hand Articles and/or Clothing – May 1, 2014 to April 30, 2015. Mr. Salameh was absent. The Executive Secretary noted that the application was listed on the meeting agenda for July 17, 2014, and Mr. Salameh was absent. The Commission requested Captain Kennedy have a police officer inquire on the matter of whether there is a buying/selling of second hand cell phones and accessories at 480 Bridge St. Captain Kennedy stated he would have an officer follow-up on the request. The Commission reviewed the communication from Arthur H. Ryan Jr., Acting Superintendent of Police, dated August 21, 2014, re: allegation of misconduct against Camila, LLC, dba Reservations, Jorge Torres, Manager, all alcoholic beverages Restaurant licensee at 179 Central St. – not displaying license on the licensed premises in a conspicuous place., a violation of Section 1.13 of the Alcoholic Beverages Regulations Issued by the Lowell License Commission. A discussion followed as to whether Mr. Torres had gone to the police station to pick-up the AB license for Camila, LLC on Saturday, August 16, 2014 after the three days suspension was served. The Executive Secretary stated that he thought Mr. Torres had inquired about the license on August 16th. Captain Kennedy noted that the license was not on display at the restaurant on Wednesday, August 20th when the establishment was open for business. Chairman Descoteaux made the motion to schedule a hearing for September 25, 2014 on the matter said allegation as noted in the Acting Superintendent’s communication, second by Commissioner Krieger, so voted. The Commission reviewed the Alcoholic Beverages Control Commission advisories regarding 10:00 a.m. alcohol beverages sales on Sunday. Commissioner Krieger made the motion to have it be recorded as duly noted in lieu of approved when forwarding notice to the A.B.C.C. on change of hours, second by Commissioner McCarthy, so voted. Commissioner Descoteaux made the motion, second by Commissioner Krieger, to have on the meeting agenda for September 25, 2014 a discussion of the alcohol beverages regulations for licenses issued by the Lowell License Commission, so voted. The Commission voted to adjourn the meeting at 6:55 p.m. on a motion by Commissioner Krieger, second by Commissioner McCarthy.
