Minutes for the Lowell License Commission meeting for Thursday, June 1, 2017 at 6:00 p.m., held in the City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852. Present: John Descoteaux, Commissioner, Chairman, Commissioners Clifford Krieger, Terry McCarthy, Martha Howe, and Joseph Donahue; and Deputy Superintendent Jack Webb of the Lowell Police Department, and James Wellock, Assistant City Solicitor. The Commission, on the motion by Commissioner Krieger, second by Commissioner Howe, voted to approve the minutes for meeting May 11, 2017. Ms. DeFranzo Pelletier stated this will be the fourth year in managing the venues. Deputy Superintendent Webb stated the Lowell Police had no problem with the venues. The Commission reviewed the application for special one-day license to sell/dispense all alcoholic beverages by Sokhary C. The Commission, on the motion by Commissioner Howe, second by Commissioner Krieger, voted to approve the license for Sokhary C. Chau. Webb inquired as to the time for the St. Anthony Feast because of the residential neighborhood. Mr. Mendonca duly noted the concern not to have event activity upset the neighbors at night. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Krieger, voted to approve licenses Patricia Donahue, Gabby Davis, Steve Mendonca, Yun-Ju Choi, Susana Silva, and Tony Teixeira. The Commission reviewed the special events permit for amplified outdoor public entertainment from William M. Taylor, Lowell Police Department, Movie Showing (TBD/family-friendly), Lowell Police Department's #LPDSafeSummer Movie Night Deputy Superintendent Webb stated that the police will be hosting the same event as last summer. Commissioner Krieger noted the St. Anthony event be coordinated with the Lowell Police Department. Mr. Mendonca stated there will be full cooperation. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Krieger, voted to approve permits for outdoor amplification by Blue Shamrock during the Summer and early Fall, and for events to be held by Lowell Community Charter Public School, Made In Lowell, St. Anthony Church, and the Portuguese American Lowell Youth Center. The Commission opened the public hearing on the application filed by Rizzo’s Lowell Inc., George A. Rozopoulos, President, for a malt beverages and wines only restaurant license for premises at 129-131 East Merrimack Street, four (4) rooms, 4 entrances, 4 exits, indoor area 3,277 sq. ft. It is requested that George Rozopoulos be approved as manager of record for Rizzo’s Lowell Inc. Rizzo’s Lowell Inc. has filed applications for license for common victualler, and for automatic amusement device. The following individuals were present: George A. Rozopoulos, and Atty. James J. Burke, legal counsel for Rizzo’s Lowell Inc. The Executive Secretary requested the Commission to consider a vote to enter into executive session to comply with, or act under the authority of, MGL Chapter 6 Section 172 regarding a review of information as a result of a background check with the Department of Criminal Justice Information Services. The Commission, on the motion by Commissioner Krieger, second by Commissioner Donahue, voted by roll-call to go into executive session: Chairman Descoteaux, aye; Commissioner Krieger, aye; Commissioner McCarthy, aye; Commissioner Howe, aye; Commissioner Donahue, aye. The Commission recessed the regular License Commission minutes June 1, 2017 page 4 of 12 meeting at 6:18 p.m. It was announced by Chairman Descoteaux that at the conclusion of executive session in the Mayor’s Reception Room, the Commission will return to the Council Chamber in order to vote by roll-call to resume the regular meeting. The Commission, on the motion by Commissioner Krieger, second by Commissioner Donahue, voted by roll-call at 6:25 p.m. to resume the regular meeting. Attorney Burke addressed the Commission by stating he would like to withdraw the application for license for automatic amusement device; the application was filed in mistake. The Commission reviewed and ordered placed on file the affidavit for abutter notification, church and school within 500 feet, with white postal slips and return receipts, filed by Atty. Burke. The legal notice was published in the Lowell Sun newspaper May 19, 2017; abutters, church, school sent notice May 22, 2017. Atty. Burke spoke of Mr. Rozopoulos other businesses and experience. Chairman Descoteaux questioned Mr. Rozopoulos about the business. Commissioner Krieger questioned why a common victualler license had not been applied for when the business opened three months ago. Atty. Burke stated there had been a misunderstanding. Chairman Descoteaux opened the hearing for public comment. Maurice Mason addressed the Commission, speaking in favor of the application by Rizzo’s Lowell Inc. There was no one present to speak in opposition. The public commentary portion of the hearing was closed. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Krieger, voted to grant for calendar year 2017 a malt beverages & wines only restaurant license to Rizzo’s Lowell Inc. for premises at 129-131 East Merrimack St.; to approve George A. Rozopoulos as manager of record; to grant a license for common victualler to Rizzo’s Lowell Inc. The Commission opened the public hearing on the application filed by BS Collaborative, Inc., d/b/a Fuji, Wen Qing Chen, President, for an all alcoholic beverages restaurant licensee for premises at 61 Merrimack Street, 2 rooms, 1 entrance, 2 exits, and square footage 8,797. It is proposed that Ms. Yu Ping Li be approved as manager of record for BS Collaborative, Inc. BS Collaborative, Inc. has filed applications for license for common victualler; entertainment in a licensed restaurant – juke box, t.v., License Commission minutes June 1, 2017 page 5 of 12 radio. The following individuals were present: Yu Ping Li, Wen Qing Chen, and Gar Chiang, Esq., representing Atty. Peter Lim, legal counsel for BS Collaborative, Inc. The Commission reviewed and ordered placed on file the “affidavit of notice of mailing to abutter and others,” signed by Peter Lim, with abutter list, white postal slips, one return receipt. Chairman Descoteaux questioned Yu Ping Li as proposed manager of record if she understood the rules and regulations for sale and service of alcoholic beverages. Ms. Li stated yes. Attorney Chiang stated that Wen Qing Chen is a Sushi Chef. Chairman Descoteaux opened the hearing for public comment. There was no one present to speak in favor or in opposition to the application. The public commentary portion of the hearing was closed. The Commission, on the motion by Commissioner Krieger, second by Commissioner Donahue, voted to grant for calendar year 2017 an all alcoholic beverages restaurant license to BS Collaborative, Inc. for premises at 61 Merrimack St.; to approve Yu Ping Li as manager of record; to grant a license for common victualler, and a license for entertainment in a licensed restaurant – juke box, t.v., radio to BS Collaborative, Inc. Commissioner Krieger made the motion, second by Commissioner McCarthy, to continue the hearing scheduled today on the allegations of misconduct as charged by William M. Taylor, Superintendent of Police, in a communication to License Commission dated May 8, 2017, alleging misconduct by LCRC, Inc., d/b/a Dudley's, 19 Merrimack St., Matthew J. Murphy, Interim Manager, all alcoholic beverages restaurant licensee at 19 Merrimack St.; furthermore, to schedule for the same date hearing(s) on the Superintendent of Police allegations to the License Commission, dated May 10, 2017, regarding all alcoholic beverages restaurant licensees of a promoter without obtaining a promotion license from the Lowell License Commission, a violation of Rule 2.12 of the Alcohol Beverages Regulations: The Middle Street Village, Inc., d/b/a The Village Smokehouse, 92-98 Middle St., Alan F. Kaplan, Mgr.; LD Holdings, LLC, d/b/a Bar 74 Lounge & Grill, 76-78 Merrimack St., David E. Heeley, Mgr., LD Holdings, LLC, d/b/a Revolution, 74 Merrimack St., Sean Brine, Mgr. for Thursday, June 22, 2017. Attorney Michael Zaim, legal counsel for LCRC, Inc., and Matthew Murphy of LCRC, Inc. appeared before the License Commission minutes June 1, 2017 page 6 of 12 Commission. Attorney Zaim addressed the matter of outstanding taxes paid to the Department of Revenue, and to Unemployment Assistance. The Executive Secretary stated the application for change of manager for LCRC, Inc. may soon be approved by the A.B.C.C. Assistant Solicitor Wellock addressed the matter of police officers to be present for the hearing(s). The Commission unanimously voted to approve the motion to hear the allegations as charged by Superintendent Taylor on June 22, 2017 at 6:00 p.m. in the City Council Chamber. Attorney Travis Jacobs of The Jacobs Law LLC appeared before the Commission as legal counsel for LD Holdings LLC, d/b/a Bar 74 Lounge & Grill, and LD Holdings LLC, d/b/a Revolution. Chairman Descoteaux, Commissioners Krieger and Donahue discussed with Atty. Jacobs the finding by Lowell Police Deputy Superintendent Webb the test results of the ID scanner purchased for LD Holdings, LLC, d/b/a Revolution, Sean Brine, Manager, all alcoholic beverages restaurant licensee at 74 Merrimack St. Attorney Jacobs stated a new scanner was purchased in place of the scanner reviewed by Deputy Webb. Commissioner Donahue stated the [new] scanner be tested by police. Chairman Descoteaux made the motion to place Deputy Superintendent Deborah Friedl’s communication, dated May 18, 2017, on file, second by Commissioner Krieger, so voted. The Commission opened the public hearing in consideration of the public need in accordance with Massachusetts General Laws Section 12, Chapter 138, to decrease the hours during which sales of alcoholic beverages may be made by LD Holdings, LLC, d/b/a Bar 74 Lounge & Grill, David E. Heeley, Jr., Manager, located at 76-86 Merrimack Street. The Commission may fix the hours for the sales of alcohol beverages for a licensee before 11:00 a.m. and after 11:00 p.m. during the calendar week (Sunday to Saturday). The following individuals were present: Lauren DiSalvo, David E. Heeley, Jr., and Attorney Travis Jacobs. Attorney Jacobs stated that his client [LD Holdings, LLC] with the security team in place, which the prior owner had zero involvement; will not have the money for the security team, and be counter-productive if the hours are reduced. Atty. Jacobs stated, after the license transfer was approved by the A.B.C.C., on March 3rd a routine inspection for appropriate posting of licenses, cites violation of minor issues extremely short period of time. For two, three years, the prior male owners ran [the License Commission minutes June 1, 2017 page 7 of 12 establishment] poorly. Atty. Jacobs addressed the issues of March 24th when the minor passed-out; the report of April 7th, two incidents, alleged assault . . . a similar incident reported at another establishment; [patron alleged] punched in face by four black men. Outside the bar, [the patron] had no visible injuries. Atty. Jacobs questioned if the incident is valid. The second report of a perpetrator seen directly in front of door [that] was pointed by witnesses to police; the licensee issued citation. Atty. Jacobs stated Regulation 1.16 – Manager Responsibilities, language ambiguous, police called to licensed premises, how is the licensee to know they are obligated. The issue with promoters, regulation is ambiguous “any person or entity,” then Google is a promoter to generate revenue, all bars are in violation. What does Regulation 2.12, in this instance, have to do with “pub crawl?” What does the [licensing] board have duty to deal with [a] promoter? What circumstances is a licensee to obtain a license? My client [Lauren DiSalvo] used a decade of savings to purchase license [business]; purchased an ID scanner. Atty. Jacobs proceeded to speak of prior licensee when Chairman Descoteaux asked that he stay on point. Atty. Jacobs stated [LD Holdings, LLC] has been here ninety days; the licensee is required to keep order on the premises. Chairman Descoteaux requested Asst. Solicitor Wellock respond to the matter of the public need to decrease hours. Asst. Solicitor Wellock stated [since] the first disciplinary matter a drain on City resources for police to show up at the establishment[s] responding to assaults. There are some issues with the security plan. There is a public need to decrease hours. Chairman Descoteaux opened the hearing for public comment, requesting if anyone would like to speak in favor of reducing the hours. There was no one present in favor. Chairman Descoteaux requested for anyone to speak in opposition to the decrease of hours. Colleen [last name unknown] addressed the Commission; she stated she works as part of the security from 10:30 p.m. to 1:30 a.m. at the front door of the establishment. She will call the establishment’s bouncers if there is a problem. She stated a roll back of hours will cause her loss of income. Demetrios Papoulias stated there were no issues with the prior licensee. The lady in the bathroom was an oversight, but did check every single door. A second woman [name unknown] identified herself as an employee who works in the bar, stated she is in opposition to a decrease in hours. Chairman Descoteaux asked if anyone else would like to speak. There were no other individual to speak; Chairman License Commission minutes June 1, 2017 page 8 of 12 Descoteaux closed the hearing for public comment. Commissioner Howe asked Lauren DiSalvo a series of questions on her residency in Lowell, her knowledge of the names of Mayor, and City Manager. Ms. DiSalvo stated she is not a Lowell resident, and did not know the names of the City officials. Commissioner Howe questioned Deputy Webb about the need for additional police. Deputy Webb stated Supervisors assign officers to cover establishments. Commissioner Howe stated to Attorney Jacobs that back in January [the presentation] was a dog and pony show, training staff. You were not at the hearing for the March 24th incident at Bar 74 and Revolution which was a bit egregious; [legal] counsel was told there could have been a wrongful death; three out-of-state IDs were a red flag; there was an ID used of a friend. There is a major problem with an absentee owner; she should live here. Commissioner Donahue stated the day the license was issued, there was a problem, culminating with the young lady in the ladies room. Promises have not been kept; without this board hammering away, nothing will be done; false licenses, kids getting in, inattention to responsibility, a disappointment; looking for more responsible managers. Commissioner McCarthy stated there is a management problem, same staff/management team. Attorney Jacobs stated [LD Holdings, LLC] to file request for change of manager; an out-of-state owner, nothing in regulation regarding residence; don’t understand what is happening in the background; don’t have to be physically present. Atty. Jacobs stated not to protect against potentiality, hit them again, questioned if bar is the cause to place police on the street, trying to single out on bar, understand board’s desire to crack down; other licensees with years of violations, do not see same thing for other bars, taking measures with this licensee; counterproductive to reduce hours. Commissioner Krieger questioned Atty. Jacobs if promoters get paid by establishments. Atty. Jacobs stated [promoters] receive some pay. Commissioner Krieger stated there is a cluster of establishments, Dudley’s, Bar 74, Revolution; cluster of problems down there; small change to see if there is an impact, send report to [Executive Secretary]; trying to help business make money. Atty. Jacobs stated establishment calls . . . none of the dates involve case number. How does the licensee know of the calls, licensee had zero notification. Deputy Webb stated case number reports [required] great amount of police attention. Chairman Descoteaux stated to contact manager of record, some calls [for] traffic control; March 3rd police initiated inspection at Revolution. License Commission minutes June 1, 2017 page 9 of 12 Chairman Descoteaux stated he did not vote in favor of this licensee, cites personal experience; for a life savings investment and not have the owner of the establishment to be there, to entrust to people you didn’t know, are the right people in the right place; concur with Commissioner Howe, a bad feeling of an out-of-state owner, feel bad for employees. We need some tweaking here, basically last chance; board has had it, something has to change. Atty. Jacobs stated Bar 74 had one violation, one of the factors for the board; common thread, want to succeed, allow three weeks for evidence of security. Chairman Descoteaux stated the security issues, we all want to see that change. Chairman Descoteaux made the motion to decrease the hours during which sales of alcoholic beverages may be made by LD Holdings, LLC, d/b/a Bar 74 Lounge & Grill, for the calendar week from 2:00 a.m. to 1:00 a.m., effective Friday, June 2, 2017 at 8:00 a.m.; furthermore, to review the hours of sales of alcoholic beverages at a public hearing Thursday, July 13, 2017 at 6:00 p.m. in the City Council Chamber, motion seconded by Commissioner McCarthy; roll-call vote: Chairman Descoteaux – aye; Commissioner Krieger – aye; Commissioner McCarthy – aye; Commissioner Howe – aye; Commissioner Donahue – aye. Chairman Descoteaux stated the Commission at the July 13th meeting willing to [consider] the hour of 2:00 a.m. The Commission opened the public hearing in consideration of the public need in accordance with Massachusetts General Laws Section 12, Chapter 138; to decrease the hours during which sales of alcoholic beverages may be made by LD Holdings, LLC, d/b/a Revolution, located at 74 Merrimack Street. The Commission may fix the hours for the sales of alcohol beverages for a licensee before 11:00 a.m. and after 11:00 p.m. during the calendar week (Sunday to Saturday). The following individuals were present: Lauren DiSalvo, Sean Brine, and Attorney Travis Jacobs. Chairman Descoteaux opened the hearing for public comment, requesting if anyone would like to speak in favor of reducing the hours, there was no one to speak, that portion of the hearing was closed; requesting if anyone wished to speak in opposition, there was no one to speak. Chairman Descoteaux closed the hearing for public comment. Atty. Jacobs spoke to the Commission about the matter of a decrease of hours for the licensee’s business Revolution. Commissioner Donahue stated to Atty. Jacobs that he believes the Commission sent message to Bar 74 and Revolution which will allow each establishment to implement changes. Commissioner Krieger made the motion to amend the hearing date for LCRC, Inc., d/b/a Dudley's, The Middle Street Village, Inc., d/b/a The Village Smokehouse, LD Holdings, LLC, d/b/a Bar 74 Lounge & Grill, 76-78 Merrimack St., LD Holdings, LLC, d/b/a Revolution, 74 Merrimack St. from June 22, 2017 to July 13, 2017 because he will not be available for the June 22nd meeting; motion seconded by Commissioner McCarthy, so voted. Commissioner Krieger requested Asst. Solicitor Wellock review the possibility of subpoena be served to the promoter as a witness for the July 13th hearing. Asst. Solicitor Wellock stated he will, and will get back to the Commission. The Commission reviewed the communication from William M. Taylor, Superintendent of Police, to License Commission, dated May 18, 2017, regarding allegations of misconduct as charged against Vannak Kann, d/b/a The Crown, all alcoholic beverages restaurant licensee at 74 Middlesex St. The Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to schedule a hearing on the allegations against Vannak Kann for Thursday, June 22, 2017 at 6:00 p.m. in the City Council Chamber. The Commission reviewed the communication from William M. Taylor, Superintendent of Police, to License Commission, dated May 29, 2017, regarding allegations of misconduct as charged against Alexander LLC, d/b/a Vibe Restaurant and Lounge, Alexi M. Torres, Manager, all alcoholic beverages restaurant licensee at 179 Central St. The Commission, on the motion by Commissioner Krieger, second by Commissioner McCarthy, voted to schedule a hearing on the allegations against Alexander LLC for Thursday, June 22, 2017 at 6:00 p.m. in the City Council Chamber.
