Minutes for the Lowell License Commission meeting for Thursday, September 14, 2017 at 6:00 p.m., held in the City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852. Present: John Descoteaux, Commissioner, Chairman, Commissioners Clifford Krieger, Martha Howe, Joseph Donahue; and Captain Jack Webb of the Lowell Police Department. Absent: Commissioner Terry McCarthy The Commission reviewed the meeting minutes of August 24, 2017. Commissioner Donahue made the motion to approve the minutes, second by Commissioner Krieger, so voted. The Commission reviewed the application by 99 Restaurants of Boston, LLC, all alcoholic beverages restaurant licensee at 850 Chelmsford Street, for change of two corporate officers. Attorney Joseph H. Devlin of Boston was present as legal counsel for 99 Restaurants of Boston, LLC. Atty. Devlin explained to the Commission the “inverted process” the Alcoholic Beverages Control Commission will use in order to review the many applications by the same corporate entity in Massachusetts. The Commission, on the motion by Commissioner Donahue, second by Commissioner Howe, voted to approve the change of corporate officers by 99 Restaurants of Boston, LLC. The Commission reviewed the request for reconsideration of the application by Speros & Co., Inc., d/b/a Lowell Burger Company, Nicholas J. Speros, Director, for all alcoholic beverages restaurant license at 143 Merrimack St. Nick Speros was present. Mr. Speros explained that a clerical error was cited by the Investigator of the Alcoholic Beverages Control Commission. The application was amended. The Commission, on the motion by Chairman Descoteaux, second by Commissioner Howe, approved the amendment to the application for submission to the A.B.C.C. for reconsideration. The Commission reviewed the applications by Barbara L. Gagel to dispense Wines only at the Ayer Lofts Art Gallery, 172 Middle St. for the following events: Art Exhibit - Lowell Celebrates "Gray Words" a Kerouac event, Friday, October 6, 2017 from 4:30 p.m. to 7:00 p.m.; and the Mask Show - local artists, Saturday, November 4, 2017 from 4:00 p.m. to 6:30 p.m. Ms. Gagel was present. The Commission, on the motion by Commissioner Donahue, second by Commissioner Howe, voted to approve licenses to dispense Wines for Barbara L. Gagel. License Commission minutes September 14, 2017 page 1 of 3 The Commission reviewed the applications for special one-day license to sell/dispense malt beverages & wines only, or either one by Tabatha Garnett, Catering Manager, Aramark, for the following events: NEASC meeting & reception at University Crossing, Moloney Ballroom, 220 Pawtucket St., on Friday, September 22, 2017, 2:30 p.m. to 6:00 p.m.; Nursing Faculty reception at the New England Quilt Museum, 18 Shattuck St., for Wednesday, September 27, 2017, 5:00 p.m. to 9:00 p.m.; and, the Mock Trial Alumni event at the Allen House, 2 Solomont Way, for Thursday, September 28, 2017, 5:00 p.m. to 9:30 p.m. Tabatha Garnet was present. Ms. Garnet stated that the event of September 22nd is a meeting/reception for the New England Association of Schools and Colleges in answer to the question from Commissioner Krieger. The Commission, on the motion by Commissioner Krieger, second by Commissioner Howe, voted to approve licenses for Tabatha Garnett of Aramark. The Executive Secretary stated that the application by Wendi Wilkens has been withdrawn for the Farmers Market at Mill No. 5, 250 Jackson St., 4th floor, for Sunday, September 17, 2017, 11:00 a.m. to 3:00 p.m. Ms. Wilkens contacted the office to make the request to withdraw because the Farmer’s Market manager, at the last minute informed her that there was no designated place available for her due to over- booking. Ms. Wilkens is requesting her application be withdrawn without prejudice. The Commission, on the motion by Commissioner Howe, second by Commissioner Donahue, voted to grant Ms. Wilkens request. The Executive Secretary’s report was reviewed by the Commission, to wit: Event cancellation September 6, 2017 by Gabby Davis – Made In Lowell, special one-day licenses granted August 24, 2017, issued August 31, 2017: All Alcoholic Beverages, $125.00, 143SP2017, Gabby Davis - Made In Lowell, Pawtucket Prism @ waterfront plaza between ICC & MCC Cowan Bldg., Opening Reception Lowell Food & Wine Festival, Thursday, September 7, 2017, 7:00 p.m. to 10:00 p.m.; All Alcoholic Beverages, $125.00, 144SP2017, Gabby Davis - Made In Lowell, JFK Plaza, Arcand Drive, Grand Tasting Lowell Food & Wine Festival, Saturday, September 9, 2017, 1:00 p.m. to 5:00 p.m.; License Commission minutes September 14, 2017 page 2 of 3 All Alcoholic Beverages, Credit of $75.00 [2 hours or less], 145SP2017, Gabby Davis - Made In Lowell, Tutto Bene Wine & Cheese Cellars, and parking lot @ 58 Prescott St., Sips & Sweets, Saturday, September 9, 2017, 9:00 p.m. to 11:00 p.m. The Commission, on the motion by Commissioner Donahue, second by Commissioner Krieger, voted to place the Executive Secretary report on file.
