License Commission

Minutes for the Lowell License Commission meeting for Thursday, November 30, 2017 at 6:00 p.m., held in the City Council Chamber, 2nd floor, City Hall, 375 Merrimack St., Lowell, MA 01852. Present: Commissioners Clifford Krieger, presiding, Terry McCarthy, and Martha Howe; and Captain Jack Webb of the Lowell Police Department. Absent: Commissioners John Descoteaux and Joseph Donahue The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted to approve minutes for meeting of November 9, 2017. The Commission opened the public hearing on the application by SAPT LLC, d/b/a Lowell Liquors, Sachin Patel, Manager, all alcoholic beverages package store licensee at 638 Rogers Street, for transfer of LLC shares. Legal notice published in Lowell SUN newspaper Friday, November 17, 2017. Sachin Patel was present. Commissioner Krieger opened the hearing for public comment; requested to hear from individuals who wish to speak in opposition. There was no one to speak in opposition. Commissioner Krieger requested to hear from individuals who wish to speak in favor. There was no one to speak in favor. The public comment portion of the hearing was closed. The Commission, on the motion Commissioner McCarthy, second by Commissioner Howe, voted to ratify the approval of the LLC beneficial interest change and transfer of shares that had first been presented to the Commission at the meeting held on September 28, 2017. The Commission reviewed the matter of the issuance of a special one-day license to sell/dispense malt beverages & wines only, or either one on November 20, 2017 to Wendi Wilkins of Tuttobene at Lucy Larcom Park, for the Lucy Larcom Holiday Market, Saturday, November 25, 2017, 2:00 p.m. to 7:00 p.m. Wendi Wilkens was present. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted to ratify the issuance of said license to Wendi Wilkens, license # 186SP2017. The Executive Secretary informed the Commission that Ms. Patricia Donahue notified the Secretary on November 8, 2017 of the event cancellation for which a license for malt beverages and wines only was granted September 28, 2018 to Norm Caron, Gallery Z, 167 Market St., brunch, Sunday, November 12, 2017, 11:00 a.m. to 1:00 p.m., – license # 153SP2017. License Commission minutes November 30, 2017 page 1 of 4 The Commission reviewed the application for Public Amusement license for Show by Chaotic Wrestling Incorporated, Walter J. Jamitkowski, President, at Game Time Sports, 1703 Middlesex St., Chaotic Wrestling, Friday, December 8, 2017, 8:00 p.m. to 11:00 p.m. Walter Jamitkowski was present. Mr. Jamitkowski stated the show is a professional wrestling event. In the past, professional wrestling events were held at the Polish American Veterans Hall, 201 Coburn St. The new site is a “trial venue.” Approximately 300 people are expected based upon ticket sales thus far according to Mr. Jamitkowski. He stated he has requested detail police for the show. Captain Webb stated in the past there have been no problems. Commissioner Howe questioned about security between the wrestlers and patrons. Mr. Jamitkowski stated there will be a security barrier; 300 to 400 chairs will surround the stage. Commissioner Krieger encouraged Mr. Jamitkowski visit neighbors outside the venue to offer information about the event and the arrangements for security. At the end of discussion, the Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted to approve the public amusement license for Chaotic Wrestling Incorporated for December 8, 2017 from 8:00 p.m. to 11:00 p.m. at Game Time Sports, 1703 Middlesex St. The Commission opened the public hearing on the application filed for change of manager, new officers and directors for Holy Ghost Society, Inc., d/b/a Holy Ghost Society, all alcoholic beverages club licensee for premises at 65 Village Street. It is requested Christopher M. Torres of Lowell as manager of record. Christopher Torres was present. Mr. Torres stated he is the new President for Holy Ghost Society. The Commission questioned Mr. Torres about his background, employment, and training. Mr. Torres stated that he has worked for the Holy Ghost Society as a volunteer, and stated his day-time employment. Captain Webb stated that the Lowell police have had good luck with the Holy Ghost Society. Commissioner Krieger announced that the hearing was open for anyone to speak in favor of the application. There was no one present to speak in favor. Commissioner Krieger asked if anyone wish to speak in opposition. There was no one present to speak against the application. The public commentary portion of the hearing was closed. The Commission, on the motion by Commissioner McCarthy, second License Commission minutes November 30, 2017 page 2 of 4 by Commissioner Howe, voted to approve the application by the Holy Ghost Society, Inc. for change of manager, new officers and directors. The Commission reviewed the application by SALT, Inc., d/b/a 7-Eleven 37464A, Alan R. Marcotte, President, malt beverages & wines only package store licensee at 970 Gorham Street, for change of business name from Tedeschi Food Shops. Alan Marcotte was present. Mr. Marcotte stated that the business name change was initiated by the parent company 7-Eleven, Inc. of Dallas, Texas. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, voted to approve the business name change. The Commission reviewed the application by Chelmsford Street Quick Mart, Inc., Johnny Kayrouz, President, malt beverages & wines only package store licensee at 299 Chelmsford Street, for change of manager to Simon E. Elzenni of Lowell. Simon E. Elzenni, and Attorney Michael Zaim, legal counsel for Chelmsford Street Quick Mart, Inc., were present. Attorney Zaim offered information about the business and the work experience of Mr. Elzenni. The Commission, on the motion by Commissioner Howe, second by Commissioner McCarthy, voted to approve Simon E. Elzenni as manager of record for Chelmsford Street Quick Mart, Inc. The Commission reviewed the application by Dan Clapp dba 1634 Meadery, a Farmer Winery, for a license to sell wine at a Lowell Winter’s Farmers Market at the premises of 250 Jackson St., Mill No. 5, 4th floor, Sundays commencing December 10, 2017 thru April 30, 2018, 11:00 a.m. to 3:00 p.m. Dan Clapp was present. Mr. Clapp stated that he has been approved for the farmer winery license on two previous meetings for the Farmer’s Market at 250 Jackson St. The Massachusetts Department of Agriculture certified the Farmer’s Market for the period December 10, 2017 to April 30, 2018. The Commission, on the motion by Commissioner McCarthy, second by Commissioner Howe, approved the license to sell wine by Dan Clapp at the Farmer’s Market. The Commission reviewed the communication from Raymond Kelly Richardson, Deputy Superintendent of Police, dated 11-7-2017, regarding allegations of misconduct on October 28, 2017 as charged against Alexander LLC, d/b/a Vibe Restaurant and Lounge, Alexi M. Torres, Manager, all alcoholic beverages License Commission minutes November 30, 2017 page 3 of 4 restaurant licensee at 179 Central Street. After a brief discussion, the Commission, on the motion by Commissioner Howe, second by Commissioner McCarthy, voted to schedule the hearing on the allegations of misconduct against Alexander LLC for Thursday, December 14, 2017 at 6:00 p.m. to be held in the City Council Chamber. Furthermore, the Commission requested the presence of a City attorney at the hearing of December 14th and that based upon Lowell police reports, individuals who are witnesses to the October 28th incident, that those individuals be present at the hearing, and, if necessary, subpoenas be served upon the following individuals as witnesses to answer questions: Oscar Andres Quintana, age 29; Randy Scott Hancock, age 44; Ricardo Rios, age 19; Mario Darvel Roman, age 27; Brittany Carrion, age 18.
