LOWELL LICENSE COMMISSION REGULAR MEETING MINUTES Date: March 25, 2021 Time: 6:00 p.m. Location: This meeting is being held remotely in accordance with the Governor of Massachusetts’ March 12, 2020 order suspending certain provisions of the Open Meeting Law G.L. 30A, Section 20. ROLL CALL: On a roll call at 6:00 p.m., members present were, namely: Chairman Descoteaux, Commissioner Donahue, Commissioner Howe and Commissioner Krieger. Commissioner McCarthy was absent. MINUTES: Acceptance of the Meeting Minutes for February 11, 2021 Commissioner Krieger made a motion to accept and place on file the minutes from the Lowell License Commission Meeting of Thursday, March 25, 2021; seconded by Commissioner Donahue. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED 1. Application by Sizzling Kitchen, [d/b/a] Sizzling Kitchen LLC, Phuong-Tuyen Nguyen, Manager, for an all alcoholic beverages restaurant license for premises at 602 Merrimack St. It is requested that legal notice be published in local newspaper, and public hearing to be held on April 8, 2021 at 6:00 p.m. via ZOOM video conference. Commissioner Howe made a motion to approve the application by Sizzling Kitchen, [d/b/a] Sizzling Kitchen LLC, Phuong-Tuyen Nguyen, Manager, for an all alcoholic beverages restaurant license for premises at 602 Merrimack St, and for a legal notice be published in the local newspaper, as well as hold a public hearing on April 8, 2021 at 6:00 p.m. via ZOOM video conference; seconded by Commissioner Donahue. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED 2. Application by Boston Tonight, LLC, [d/b/a] Trend, Elefterios L. Kretikos, Manager, for an all alcoholic beverages restaurant license for premises at 15, 19-25 Merrimack St. It is requested that legal notice be published in local newspaper, and public hearing to be held on April 8, 2021 at 6:00 p.m. via ZOOM video conference. Commissioner Donahue made a motion to approve the application by Boston Tonight, LLC, [d/b/a] Trend, Elefterios L. Kretikos, Manager, for an all alcoholic beverages restaurant license for premises at 15, 19-25 Merrimack St, and for a legal notice be published in the local newspaper, as well as hold a public hearing on April 8, 2021 at 6:00 p.m. via ZOOM video conference; seconded by Commissioner Krieger. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED Lowell License Commission • 165 Merrimack Street • Lowell, MA 01852 (Page 2 of 3) 3. Application by Sonesta International Hotels Corporation, [d/b/a] Sonesta Select Boston Lowell, Michael Lessard, Manager, for transfer of an all alcoholic beverages restaurant license for premises at 30 Industrial Avenue East. It is requested that legal notice be published in local newspaper, and public hearing to be held on April 8, 2021 at 6:00 p.m. via ZOOM video conference. Commissioner Howe made a motion to approve Sonesta International Hotels Corporation, [d/b/a] Sonesta Select Boston Lowell, Michael Lessard, Manager, for transfer of an all alcoholic beverages restaurant license for premises at 30 Industrial Avenue East, and for a legal notice be published in the local newspaper, as well as hold a public hearing on April 8, 2021 at 6:00 p.m. via ZOOM video conference; seconded by Commissioner Krieger. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED 4. Application by A.V. St. Mary Inc. [d/b/a] Dream Market, Enas Nashed, Manager, for a wines and malt beverages license for premises at 358 Mammoth Road. It is requested that legal notice be published in local newspaper, and public hearing to be held on April 8, 2021 at 6:00 p.m. via ZOOM video conference. Commissioner Krieger made a motion to approve the application by A.V. St. Mary Inc. [d/b/a] Dream Market, Enas Nashed, Manager, for a wines and malt beverages license for premises at 358 Mammoth Road, and for a legal notice be published in the local newspaper, as well as hold a public hearing on April 8, 2021 at 6:00 p.m. via ZOOM video conference; seconded by Commissioner Howe. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED 5. Application for special one-day license to sell/dispense malt beverages and wines only, or either one: Edward Crockett and Elysia Niemi for a wedding, Saturday, October 2, 2021, 3pm to 10pm at Rogers Fort Hill Park, 53 Park Avenue East. Ms. Niemi informed the Commission that approximately 120 people will be in attendance for the wedding. The parks department has approved their request as well. They have contacted the police department and a police detail will be present. They will also have three (3) state certified bartenders on hand to serve their guests. Commissioner Descoteaux reminded them to follow the state mandates and guidelines. Commissioner Howe made a motion approve the application for a special one-day license to sell/dispense malt beverages and wines only, or either one, for Edward Crockett and Elysia Niemi to hold their wedding on Saturday, October 2, 2021, from 3 p.m. to 10 p.m. at Rogers Fort Hill Park, 53 Park Avenue East; seconded by Commissioner Donahue. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED Lowell License Commission • 165 Merrimack Street • Lowell, MA 01852 (Page 3 of 3) 6. Discussion of 2021 license fees. Commissioner Descoteaux asked the other Commissioners how they wanted to proceed regarding license fees. He stated that he Commission had waived the fee for the first three (3) months of 2021 due to the restrictions that have been put in place due to the pandemic. He stated that they could continue to waive the fees or do nothing at all. He asked what the wish of the Commission was. Commissioner Howe stated that the city is receiving $53 million dollars in stimulus funds and that the Commission needs to know how the city plans to use this money with regards to restaurants/bars and package stores. Commissioner Howe made a motion to further the discussion with the City Manager or the City Solicitor about the $53 million dollar stimulus funds that the City is receiving and who that money is earmarked for with regards to restaurants/bars (not including the Package Stores). Also, beginning April 1, 2021 all License Fees will be reinstated for all Package Stores; seconded by Commissioner Krieger. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED ADJOURNMENT – Commissioner Krieger made a motion to adjourn at 6:15 p.m.; seconded by Commissioner Howe. 4 yeas, 1 absent (Commissioner McCarthy) APPROVED Submitted by: Mary E.
