THE CITY OF MADEIRA BEACH, FLORIDA PUBLIC NOTICE BOARD OF COMMISSIONERS WORKSHOP MEETING The Board of Commissioners of the City of Madeira Beach, Florida will meet at City Hall, located at 300 Municipal Drive, Madeira Beach, Florida to discuss the agenda items of City Business listed at the time indicated below. 2:00P.M. TUESDAY, JULY 22, 2014 AUDITORIUM REVISED AGENDA ON JULY 21, 2014 CALL TO ORDER-The meeting was called to order at 2:08 p.m. ROLL CALL MEMBERS PRESENT: Travis Palladeno, Mayor Nancy Hodges, Vice-Mayor Terry Lister, Commissioner District 1 Elaine Poe, Commissioner District 3 Pat Shontz, Commissioner District 4 STAFF PRESENT: Shane Crawford, City Manager (CM) Tom Gonzalez, City Labor Attorney (CLA) Aimee Servedio, City Clerk (CC) Dave Marsicano, Central Services Director (CSD) Vince Tenaglia, Finance Director (FD) STAFF ABSENT: Thomas Trask, City Attorney (CA) 1. TOPICS: A. DISCUSSION ON CITY EMPLOYEE BUYOUT Shane B. Crawford, City Manager Tom Gonzalez, City Labor Attorney CM: This has been discussed among the staff and board. He feels that the press went with a notion that this was designed to get rid of a disgruntled employee and this is not the case. This was designed to help those who felt stuck in their jobs and wanted t9 move on but were not able to for one reason or another. There were four employees that were initially interested and since then, others have shown interest. The Board needs to decide if they want to reopen this or not. The CM and the CA have put together a "buyout" for employees to have six months after the new st budget takes effect on October 1 • This is a cost-neutral plan; it will not cost the taxpayers anything extra. Attorney Gonzalez will go through the contract and help explain it to the interested employees. City Labor Attorney Tom Gonzalez: What we are talking about is a reduction in force. This is not a severance pay plan. The legislature passed Statue 215.125 in response to situations in which a county administrator and city attorney were terminated under contract. You don't get severance pay when you resign, only if terminated by the employer. There was nothing in the law that prevented contracts and BOC Workshop Meeting 07/25/2014 would have a right to sue on that contract. In the context of what the CM has been describing, employees who were given the opportunity would not be fired to get severance. The contract would look like a very simple resignation, where once you signed it and its benefits it would go into effect and you could not renege on that agreement. The signing of the agreement would also prevent those employees that agreed from seeking employment with the City again. CM: The Board needs to decide if they want to extend this to the end of the week. He thinks some were initially concerned there would some repercussions and that is understandable. If there are positions that need to be filled immediately, that will be dealt with. Mayor Palladeno: You are the CM and the employee's work for you. Commissioner Shontz: She doesn't want this going on their personnel file and acting as a black mark on their record for any future job opportunity. CM: Of the initial four that showed interest, he would have no problem writing a letter of recommendation for any of them. This happens in cities and they are always structured a little bit differently, but this is not a new concept. CLA: This would show up as a resignation in their file and could be accompanied by a disclosure of what transpired with the buyout. CM: Do you want to extend this? It's a slippery slope and considering what happened in the past, it could be difficult. When asked his opinion on the extension, he doesn't think it's unfair to extend the offer to Friday. Commissioner Lister: Could we open it back up with slightly less offered? CM: It would be better to keep the deal the same, and offer it to all employees to avoid any kind of discrimination. He doesn't necessarily like the extension, but he thinks the absolute deadline should be by Friday to give those who were more wary to take advantage of the offer. Commissioner Poe: She is torn between Commissioner Lister's opinion and Commissioner Shontz's. CM: These employees also have lived through a lot of tumultuous changes and cuts in the past. He understands why some would be more wary. Consensus was to extend the deadline to inform interest to the City Manager by Friday, July 25, 2014. B. DISCUSSION ON FY 2015 PROPOSED BUDGET Shane B. Crawford, City Manager Vincent Tenaglia, Finance Director CM: The FD is here to answer any and all questions. This was put on to allow the Board a chance to bring up any other concerns they may have. BOC Workshop Meeting 07/25/2014 Dick Lewis: Thinks a lot of work went into this budget and his is mostly pleased with it. There are a few minor comments he has. During the review of the last budget, he suggested that he include an organizational chart to help citizens understand the hierarchy and posted on the bulletin board as well. The City portion of support of the Gulf Beaches Public Library is listed as a donation, he thinks it should be categorized somewhere else since it may give the wrong impression of the use of that money. Lastly, the City has been continuing the $1,700.00 donation to the Senior Club. The fact is, in terms of the socio-economic membership of this organization, they are not in need of donations. This is not a government purpose and does not think the City should donate that. CM: The City just added two personnel to the roster and an organizational chart will be posted. The chart is currently being revised and the most current one will be posted. C. DISCUSSION ON SPECS FOR DOCK AT MARINA Shane B. Crawford, City Manager Dave Marsicano, Central Services Director CM: The RFP is in front of you and that will serve as the spec list - we need to change a spec on the fuel dock. Through working on the project, staff recommends changing a spec from a composite plastic floating dock to an aluminum floating dock. When approved we will come back to you with a bid award. CSD: This will be a new fixed dock. This B Dock configuration will be the same as it is now. There will be transient docking on the east side and seven lifts on the west side (one on the east as well). All of the electrical and fire service will be upgraded. One of the biggest requirements is that there is a $2 million blanket liability protection for the electrical contractors for this job. Electric is what burns down your dock a majority of the time. This is permanent - we were able to push this all through. CM: All of this has been budgeted and partially paid for by a grant. This project itself will be bid out in its entirety. Today all you are doing is approving the spec. CSD: We will also be buying materials direct. It is going to be much safer - it will allow us to push the boats in and out much faster in the high weekend traffic. CM: This is also where you get your additional lifts. There is a market and an economic demand for those. CSD: There will be 10 total, we already have two in place. The rental fees range from $13,000 to $30,000 and ALL have already been rented out. These floating docks are very durable. He has installed these same docks in Tampa Bay Yacht and Country Club - the best example is that of the McDonald's floating dock. It has been there as long as he can remember. The aluminum really holds up over time. He is very confident in this product. Consensus was to change the specs from composite plastic to an aluminum floating dock. 31 BOC Workshop Meeting 07/25/2014 2.
