OLD BUSINESS A. ORDINANCE NO. 2019-14 A City sponsored ordinance amending City of Madeira Beach, Code of Ordinances, Article IV.- Special Exception Uses, To provide for the possibility of a Board of Adjustment; Sec. 110-124(a).- Standards and Requirements, to remove the duplicative quasi-judicial review by the local planning agency, and, adding Sec. 110-125 to provide an appeals process. B. ORDINANCE NO. 2019-16 A City sponsored ordinance amending City of Madeira Beach Code of Ordinances, Article VIII- Special Magistrate to correct grammar and provide more inclusive language throughout; Sec. 2-501 and 2-503(e), To specify limits on the authority of the special magistrate as relates to licensed and certified decisions; section 2-503(C) to expand the radius of notification; section 2-503(D)(1) to establish cost recovery fee for applicants failure to attend; Section 2-503(G) Transferring clerical and administrative support from the Board of Commissioners to the City Manager in keeping with professional standards and practice and stating performance standards for the Special Magistrate; Section 2-506(C)Specifying the application of the Land Development code and removing the duplicative quasi-judicial review of the local planning agency; Section 2-507 (B) Strengthening the standard for review of Variances to ensure full compliance with local standards. C. ORDINANCE NO. 2019-15 A City sponsored Ordinance to Amend City of Madeira Beach Code of Ordinances Division 13- Adult Entertainment Establishments, Subdivision III – variances to replace references to City Board Adjustment with Special Magistrate. ADJOURNMENT One or More Elected Or Appointed Officials May Be In Attendance Any person who decides to appeal any decision of Planning Commission serving as the Local Planning Agency with respect to any matter considered at this meeting will need a record of the proceedings and for such purposes may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon with the appeal is to be based. This is a quasi-judicial proceeding. Any affected person may become a party to this proceeding and be entitled to present evidence at the hearing including the sworn testimony of witnesses and relevant exhibits and other documentary evidence and to cross-examine all witnesses by filing a notice of intent to be a party with the city clerk not less than five days prior to the hearing. The law does not requires the City Clerk to transcribe verbatim minutes; therefore, the applicant must make the necessary arrangements with a private reporter or private reporting firm and bear the resulting expense.
