The Planning Commission, serving as the Local Planning Agency of the City of Madeira Beach,
Florida will meet at the City of Madeira Beach Patricia Shontz Commission Chambers located at
300 Municipal Drive, Madeira Beach, FL 33708, to conduct Public Hearings on the following City
business.

III. APPROVAL OF THE MINUTES –
Chairman Noble – Approval of the minutes of the last meeting.
Linda Portal – The minutes will be in next meeting packet we had trouble getting the recordings on paper last
week the computer ate.
Chairman Noble – We will scratch item three from the record and we will approve the minutes at the next
meeting when the printer is repaired.
Chairman Noble – Agenda number four. New Business. A: Comprehensive Planning Presentation &
Commission Discussion.
IV. NEW BUSINESS
A. Presenter Lina Portal – Plan for tonight since we have no items and we are all very interested in getting
started and thinking of the Comprehensive Planning process because it is coming upon us I wanted to
run through Comprehensive Planning and what the state requirements are. What a community planning
process is like and what you are going to need to know to get through the process. The city of madeira
like everybody else in the state has a requirement to update the Comprehensive Planning and our next
due date and complete update April 2022. There are statutory requirements not everybody in the country
has to do this but in Florida we do have requirements under the state, land law management act and

the state comprehensive planning act to provide plans we have to meet all conditions ease these four
chapters. In the most part our activity comes under forth group chapter 163 part 2 that involves the local
planning land government regulations and you probably have refer to 163 process land use
requirements it is a huge chapter this is part 2 specifically refers to local government planning. All local
governments are to have comprehensive planning set of principles and standards that state set at a
minimum so that we are all addressing the similar principles and guidelines and strategies getting here
to the future. A balance of quality of life economics, social, physical, environmental development in the
area and specifically talking about it a few if people can remember back in the days 70’s and 80’s in
particular it was growing at 5000 people a week they were popping up little cities, subdivisions in the
hinterlands and there had be no regulations as to how the development would progress and because of
that they had been spreading out all over resulting in local government having trouble meeting the needs
like water and road capacity, landfills and other preservation issues. Everything we use potentially
everything we are doing in the state threatens the water supply in the entire state. Most of our water we
draw on is thru inter-connected artesian wells and aquafer and we were drawing water down so rapidly
that at some point the aquafer dropped so low that it was pushing on the water from the ocean which
intern will force its way into our aquafer and once it gets into it you can’t get it back out then it’s no longer
drinkable. We really have some critical planning issues that are threating our survival as a state here.
So, the land and water act was intended to require local governments coordinate with each other what
they are providing to make sure the services are being met for these populations before improving the
population its self. You can see that in the requirements in roadways out all over the place into areas
that necessarily did not want it which created more problems. With this it was to avoid rural sprawl so
that we could make better use of the facilities already have invested in. that way using the populations
money to pay for the facilities already there. The purpose of using uniform is to make it that smaller
communities are not robbed by the larger communities of water for instance. We must make sure that
we are all playing by the same rules and not leaving others behind in the dust.
Commissioner Preston – How would you relate this to the City of Madeira Beach?
Linda Portal – We had the added catch that we are pretty much built out. Madeira Beach was built as a
sub-division it was not built as a city really. Like a vacation spot. It has taken the city to get governing
under its feet. It could get its services elsewhere. We will have to figure out how dense we want our
community based on what we can support with the resources and facilities we have and how much
money we can put into them. Any decision we make we must consider how much population we are
expecting and explain that we can’t handle any more and that we have the population we can handle.
What kind of population we will have permanent vs temporary in the future and based on that what kind
of services we want and provide and how much money will be coming in to support that? We as a city
are at a complex time living around water, with the sea levels rising.
Commissioner Preston - Have you received the new study that Pinellas County as far as water level
rising?
Linda Portal – We have but we have our own, one specifically that impacts our facilities in our city.
Commissioner Preston – Their study’s estimate is by the year 2100 it will be 3 feet high that it is right
now.
Linda – Correct. They’re not using the low end of the curve anymore because it has been blown out of
the water because the sea levels have come up faster than expected. So, they are now using the
medium to high because the ice packs are melting at a faster pace. We will be doing inundation studies
as part of our comprehensive plan process. We know that it will be shocking to people, but we will need
to propose a plan to address these issues. We have a specific process here in Florida that other doesn’t.
Generally, there’s a community planning process to get the community involved, and underlaying

responsibility with the state and coordination county in the region and there are steps we must have in
our plan to address. We get to address them locally but there are minimum standards we must meet
that helps our focus in our effort it’s not all about design. The state requires programs that insure
implementation. You must set goals that are measurable with timeline, describe the local activities and
land development will be initiated, modified and continued use implementation consistent over time. It
must identify programs and activity land development will be amended and implemented in order to
make sure it is carried out, and meaningful measurement for the impact progress and guidelines exactly
on how they will be re-written to support your plan. The review requirements are important if your plan
isn’t living it’s not working. For example, the environment is changing rapidly, and we will keep on it to
keep ahead of it. We will need to identify a process and evaluated it, in this case the state does this for
us by telling us what we must put in the evaluation and appraisal reports and when to turn them in. There
are capital improvement updates and amendments every year. Also, coordinate if there are any land
use change processes. In our case we have legislation that stipulates lands in Pinellas County be
consistent with each other with comprehensive plans of the county use similar categories of land use
and impact. Data analyses is what we must base our plan on, and The City of Madeira Beach has
updated your plan every 5 years as the law requires. However, your data analyses have not been
updated since 1987 which is out of date. Not much has changed in the city’s boundaries or population
density, but it does need to be updated with the situation of the environment, the demographics have
changed, the mix of people, age and income have an impact on land use and of level of services that it
will have to provide. We also, need to look at all the facilities areas there are set level of services
attainable that leave adequate levels of services. The city will need to do survey’s studies , collect data,
analysis of data as backup plan professionally sourced, collect data for seasonal and permanent
population, use medium projections that come from the office of economic and demographic research
as they will check that the city has done this professionally and best available data. The city will have to
protect growth of facility demand and capital funding to meet those demands. For the 5- and 10-year
projected plan at the minimum with the tenuous sea level rise, the city will need to plan for at least a 20-
year rise plan.
Commissioner Preston – For example 140th and Bay Point Drive at what point does the city say we can
do anything about the water in the streets is this a decision that the Commission makes or is it that
Planning makes?
Linda Portal – On a policy like this the community will ultimately be the one to make the decision, but
you will recommend with the information that we know what options to make a recommendation to talk
about it because it will be a very big policy that you will have to confront. Each plan will require a certain
number of requirements according to the State, future land use, transportation, sanitary use of solid
waste, conservation natural resource management, recreation and open space, housing, coastal
management, government coordination, capital improvements and concurrency management. A
handout was given of 163 to show how big the section is for just the planning elements are and the
amount of research and detail Comprehensive Planning policies is significant. I will help you get through
the process. Linda has also given a how to list on getting to get what is needed to get what they want to
move the city forward in the planning process.
Chairman Noble – Nice
Commissioner Kerr – Will this presentation be online to review.
Linda Portal – Yes, we will send it out to you.

Commissioner Wycoff – Asked if Linda had created an itinerary timeline. That will help the commission.
Linda Portal – Not yet.
The Planning Commission has asked for assistance in the processes.
Linda Portal-Suggests that the Planning Commission investigate stake holders that are in the community
are. So that each Commissioner come back and report what the interests of their community issues are
to one another.
Commissioner Michael Wycoff- Has assumed that there has not been any itinerary since the last one
Duaney version of the Comp Plan?
Linda Portal-Stated that Duaney did an urban design. Also, stated that the Commission could include
that into their Comp Plan even Land regs. Also informed the board that it only seemed that the data
analysis had not been viewed and that the policies were the only thing updated.
Commissioner Michael Wycoff-Asks what it will look like at end of process and the next steps after that.
He was also concerned about it going through all the processes and there is a problem and or a conflict.
Linda Portal-Explained that if there was a conflict between Comprehensive Plan and Land Development
that general what is used is the plan because it is an adopted policy and might need to ask the land use
attorney.
Chairman Mike Noble-Asked if anyone had questions and there was silence, so he moved onto Old
Business #V on the agenda.
B. OLD BUSINESS-
Commissioner Raymond Kerr-In the last meeting we had Jerry Murphy present on impact fees and since
then we voted to recommend to the Board and part of that study was for transportation. Linda correct
me if I am wrong, It appears that Pinellas County assesses an impact fee for transportation and Madeira
Beach wouldn’t.
Linda Portal-Explained that Pinellas County only assesses for major roads and most goes to FDOT
because Madeira has mostly major roads. What was asked at the meeting though was for local smaller
roads that the city owns’.
Commissioner Raymond Kerr- So that is for the residential area roads? Reached out to Leila Varcoe of
Development Review Services Supervisor for Pinellas County, she stated that if you did a remodel on
your home and tore down within FEMA guidelines……..I wanted to get an idea…..We were talking about
1000 square feet home and you tore it down and to rebuild the same identical home to meet FEMA it
had to be raised. Commissioner was questioning in order to have access you need a set of stairs that
you would be charged an additional fee because increase of square footage with the inclusion of stairs.
Linda-She explained that locally the Commissions’ will be the ones to decide. Also, that city doesn’t have
to use their standard.

Commissioner Raymond Kerr-States that in accordance to Pinellas County its charges strictly per
square foot. Also, stated that per the City of Madeira Beach it already adheres to the counties building
permit the city uses the counties standards.
Linda Portal-The city does not charge an impact fee per residential inside here, they do charge for water,
sewer and a storm water along with on the ground areas (impervious ground) fees.
Commissioner Raymond Kerr-Stated that some of what has been explained seemed to be confusing
and just wanted to get some more clarity on the fees. Also, with a discussion with an architect stated
that the county,(pause) City of Madeira Beach already charges impact fees but it’s through the county.
Linda Portal-States that the county charges a user’s fee for stormwater. It’s not a one-time fee it is an
ongoing user’s fee. The City of Madeira Beach will not be adding to those fees we would only be
charging for those fees that others are not charging for.
Commissioner Raymond Kerr- The second point would be does it make sense to create more roadblocks
for people to improve?
Linda Portal-That is a policy issue. It is a complex process to go through to adopt impact fee and that is
something that the policy makers will have to decide. The bigger chunk of the City of Madeira Beaches
revenue comes through parking which is paid through tourism and the locals park for free. This is a
dangerous way to receive revenue. Since you will be talking about capital improvements and funding, it
is very dangerous to do it that way running the government through parking. It is a better bet to run the
government off of alarum and use parking for capital improvements in your changes. The Planning
Commission will have continued discussions for long term analysis.
Chairman Mike Noble-Alright are there any other old business? Since nothing was brought up, he went
onto agenda…..

Commissioner Michael Wyckoff-What is the Cities take on the state trying to do away with home rule?
Does the city have a position?
Linda Portal-if you get to the point that you cannot regulate zoning there’s not much you can control. It
is a big expense for local governments when large portions of neighborhoods become transient because
it increases the ware and tare on the neighborhood it reduces the property value and it always includes
more police because of more crime, hard on the elderly because of not feeling safe, the stability of
neighborhoods. Also, if you begin with losing home rule on one thing you lose home rule on a lot of other
things.
Commissioner Raymond Kerr-I have one question and Mr. Wyckoff can help with this question. A lot of
our properties are becoming investment properties. How can we purpose to get those people involved
as the will become outspoken eventually because they don’t like what’s going on and the work, we have
put into it will be all for not?

Linda Portal-We do have mailing lists and we could consider sending out contacts. If they are rental,
they should have a business license this is where we can collect where the homeowner lives.
Commissioner Michael Wyckoff-A lot of the people that have bought investment property feel that they
really don’t have a voice in what is going on here. I am glad to hear that you do have a mailing list and
that there is an effort in contacting the homeowners on any one issue. Also has brought up timing on
issues and the owners getting to voice their opinion because they are only here part of the year. Renters
owners all need to be in on the process.
Linda Portal-That is something that needs to be address seasonal and non-seasonal. There are a lot of
part-time residence that make their voices heard.
Commissioner Mary Ann Hearn-Don’t you think that this is and issue for most coastal communities?
Also, a lot of people become Florida residence.
Commissioner Robert Preston-Season is from November 1 thru March 31 a five-month period.
Commissioner Michael Wyckoff- Feels that it’s changing to the first week in January thru Spring Break.
Also wants the Commission to get the best out of the community when the majority are in town.
Linda Portal-Maybe we should do a survey when the part-time residence come back and a timeline.
Commission Raymond Kerr-Askes if the elements defined in the current comprehensive plan?
Linda Portal-Yes, Land use, transportation, conservation, recreation, public utilities, capital
improvements, coastal management, and inter-governmental coordination.
Commission Raymond Kerr-The elements to the comprehensive plan will they be split up amongst
everyone? When trying to coordinate with the community and breaking up the elements are you trying
to set up four or five meeting?
Linda Portal-Some but others not so much. I would suggest getting a hold of a steak holder group to
begin hashing out a plan getting together some issues it is tricky. You will need to get a list of steak
holder groups, data collection and getting information gathering.
The Commissioners understand the urgency of getting a plan together sooner than later.
Chairman Mike Noble-This would be done as a workshop meeting during our regular Planning
Commission Meeting.
Linda Portal-Yes
Commissioner Robert Preston- I assume you will try to have something for the next meeting?
Linda Portal- Yes
Commissioner Robert Preston- You said service that people want So part of what Jerry is doing in
relation to impact fees what services the Commission want to give there is a connecting point.

Linda Portal-Yes, He will have to purpose amendments to comp plan that will support impact fee data
he develops.
