MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON July 27, 2015 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 27th day of July, 2015. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 8, 2015. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Mr. Wolkowitz seconded the motion, which passed with the following roll call vote recorded: Yeas: Mr. Catalanello, Mr. Landrigan, Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz Absent: Mr. Rowe Nays: None GREETINGS TO PUBLIC Mayor Conley made the following comments: The Library and Madison Senior Center continue to co-sponsor Summer Seminars held at the Library on Monday afternoons and Thursday mornings. Upcoming Seminars are James Michael, Broadway baritone, on July 30th; Madelyn Ferrans speaking on the Supreme Court on August 3rd and Dr. Roger Knowles speaking on Effective Treatments for Alzheimer ’s disease on August 6th.This Wednesday night at 7:00 pm the film “Slumdog Millionaire” will be shown. On August 1st the Library will celebrate the finale of the Summer Reading Program with a Hero Story Festival for all ages. The Library anticipates that the Picture Book Room renovation will begin in late August. The first step of the process will be a ceiling abatement project which will involve closing the Library. Mayor Conley announced the third annual QuestCare Charity Softball Game, Tuesday, July 28th, 5:30pm at Dodge Field. Proceeds benefit the American Cancer Society, and Project Community Pride. Proclamation of the B o r o u g h o f M a d i s on Presented to MARY MARANO 2015 National Crossing Guard of the Year WHEREAS, Mary Marano, a crossing guard for the Borough of Madison, was named 2015 National Crossing Guard of the Year by Advanced Safety LLC; and WHEREAS, a long-time Madison resident, Mary has been a crossing guard for the Borough for 17 years; and WHEREAS, Mary is also the field training instructor for new crossing guards, who log hours on the job with Mary before working at their individual posts: and WHEREAS, stationed at Central Avenue and Brittin Street, one of the busiest posts in Madison, Mary was nominated for this honor by fellow crossing guard, Andy Cobb, and received recommendations from the Madison Police Department and her peers; and WHEREAS, Mary’s reliability and competency are greatly appreciated by both parents and staff at Central Avenue School; and WHEREAS, devoted to the children she crosses, Mary knows the names of all the current students, as well as remembering the names of former students and younger siblings; and WHEREAS, working in all kinds of weather, Mary Marano is a dependable crossing guard who takes her responsibilities very seriously; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby extend sincere congratulations to Mary Marano as recipient of the 2015 National Crossing Guard of the Year award and express appreciation for her dedication and commitment to the children of the Borough of Madison. Mayor Conley presented a proclamation to Thomas Sych for being awarded the Congressional Award Gold Medal. Proclamation of the B o r o u g h o f M a d i s on Presented to PAGE 3 OF 17 Regular Meeting Minutes – July 27, 2015 THOMAS SYCH Congressional Award Gold Medalist WHEREAS, the Congressional Award, recognizing hundreds of hours of community service, is awarded by the United States Congress to qualifying young Americans ages 14 to 23 years old; and WHEREAS, the program consists of six levels Bronze, Silver and Gold Congressional Award Certificates and Bronze, Silver and Gold Congressional Award Medals; and WHEREAS, each level involves setting goals in four program areas: Volunteer Public Service, Personal Development, Physical Fitness and Expedition or Exploration; and WHEREAS, on June 17, 2015 at the United States Capitol in Washington, D. C., 267 young adults from across America received the Congressional Award Gold Medal, Congress’ highest award for youth; and WHEREAS, at the ceremony, Thomas Sych, a 2013 Madison High School graduate, was presented the Congressional Award Gold Medal by New Jersey Congressman Rodney Frelinghuysen; and WHEREAS, to achieve this award, Thomas first focused on his Physical Fitness goal to overcome health issues; and WHEREAS, Thomas dedicated over 700 hours to help develop an annual Blood Drive with multiple locations for Voluntary Public Service; and WHEREAS, to accomplish his Personal Development goal, Thomas became a Madison volunteer firefighter; and WHEREAS, for his Expedition, Thomas, a member of Venture Crew 77 sponsored by Madison Elks Lodge #1465, completed a backpacking trek at Philmont Scout Ranch in New Mexico and received the 50 Miler Award and the Venturing Silver Medal; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby extend sincere congratulations to Thomas Sych as recipient of the Congressional Award Gold Medal and wish him continued success in his future endeavors. Mayor Conley presented a proclamation to Five (5) Eagle Scouts (Jared Finnerty, Nicholas Johansen, Nicholas Lami, William Nixon and Kevin Thompson) from Boy Scout Troop #7. Proclamation PAGE 4 OF 17 Regular Meeting Minutes – July 27, 2015 of the B o r o u g h o f M a d i s on Presented to The Eagle Scouts of Boy Scout Troop 7 WHEREAS, introduced in 1911, the Eagle Scout is the highest rank in the Boy Scouts of America; and WHEREAS, to achieve the rank of Eagle Scout, a scout must live by the principles of the Scout Oath and Scout Law, earn a total of 21 merit badges and demonstrate service and leadership, including completion of an extensive service project; and WHEREAS, five scouts of Boy Scout Troop 7 have achieved the rank of Eagle Scout by completing the following projects; and WHEREAS, Jared Finnerty refurbished an outdoor courtyard area including landscaping and building benches and picnic tables at Madison High School; and WHEREAS, Nicholas Johansen renovated the rectory basement classroom at Saint Vincent Martyr Church by building tables and chairs, installing new lights, painting and cleaning the carpet; and WHEREAS, Nicholas Lami refurbished an outdoor recreation area for the Tucker Apartments/Senior Housing including landscaping, building benches and installing a handrail; and WHEREAS, William Nixon produced educational videos demonstrating social skills for special needs children at the Early Care and Learning Council of New Jersey; and WHEREAS, Kevin Thompson refurbished an outdoor classroom by improving the ground cover and pond access and designing and building birdhouses to be placed around the campus at Newark Academy; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby commend these Eagle Scouts for their efforts and dedication to these projects and express best wishes on achieving the rank of Eagle Scout. ___________________________________ Robert H. Conley, Mayor July 27, 2015 REPORTS OF COMMITTEES Community Affairs Ms. Baillie, Chair of the Committee, made the following comments: The Madison Farmers' Market, located on Central Avenue between Main Street and Cook Avenue, is held each Thursday from June 4th to October 15th, from PAGE 5 OF 17 Regular Meeting Minutes – July 27, 2015 2:00 to 7:00 pm. The Madison Sidewalk Gallery banners are on display in the downtown district and Bottle Hill Day, will be held Saturday, October 3, 2015. Public Safety Mr. Catalanello, Chair of the Committee, made the following comments: Reporting for Mr. Rowe, Mr. Catalanello noted a preconstruction meeting with Cifelli Construction to be held on Thursday to review the Ridgedale Avenue reconstruction project schedule. Staff is working on the 2016 Road Improvement projects, anticipating early spring bids next year. The state aid eligible projects such as Prospect Street and Greenwood Avenue will also be completed later this fall, in preparation for summer bids. Sewer lining work begins on July 28th. Efforts will include work authorized in both the 2014 & 2015 budgets. Work has been advance over the last two weeks to replace vertical shaft pumps and the cominutor grinder at Candlewood Pump Station. The survey of Well E is complete. Bids are being received for the generator equipment on August 5th and the results of the bid will determine the schedule for construction. A preconstruction meeting with Desesa Engineering and Construction will be held on Tuesday to review the Rooftop Mechanical replacement contract and schedule for the Library HVAC replacement project. Quotes have been assembled from six contractors for two projects at the Memorial Park skating rink and soccer field. KRE GVR Redevelopment Engineers have submitted a draft state application to the Bureau of Safe Drinking Water for authorization by Madison Water. This application is under review by staff and consultants and may be the subject of a future endorsement resolution. Utilities Mrs. Vitale, Chair of the Committee, made the following comments: The upcoming weather forecast includes high temperatures and high consumption of electricity. The Borough asks that residents and businesses voluntarily reduced their electric consumption for just a few hours on the hottest days of the year. The Electric Department reports that staff have began installation of new poles on Dogwood Drive and has installed and transferred three new poles at Park Avenue and installed new secondary cable, as well. The Department has also installed a new pole at 37 Cross Gates Road for service. Finance and Borough Clerk Mr. Landrigan, Chair of the Committee, made the following comments: The preliminary tax rate should be received this week and property owners will have until August 31st to make payments. The Borough will accept bids for the sale of $1,520,000 in Bond Anticipation Notes next week, with a closing date of August 14, 2015. Health Mr. Wolkowitz of the Committee made the following comments: August is immunization month, and the safest most effective way to fight various diseases is to be immunized. Adults should be aware of vaccines available as well. Please check with your health care provider for more information. Public Works and Engineering Mr. Rowe, Chair of the Committee, absent. AGENDA DISCUSSIONS 07/27/2015-1 OPEN SPACE, RECREATION, AND HISTORIC PRESERVATION ADVISORY COMMITTEE QUARTERLY REPORT Committee member, Mr. Peter Hiscano, presented a quarterly report from the Open Space, Recreation and Historic Preservation Committee, noting inflows and outflows. Mr. Hiscano also noted that the Open Space Trust fund account balance as of June 30, 2015 as $314,011.00. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on July 13, 2015, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 46-2015 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 190 OF THE MADISON BOROUGH CODE ENTITLED “WATER” TO UPDATE THE WATER CONNECTION FEE SCHEDULE WHEREAS, the Borough Engineer and Borough Auditor have recommended that the Borough amend Chapter 190 of the Madison Borough Code entitled “Water” to include an updated water connection fee schedule; and WHEREAS, Nisivoccia and Company, LLP, Certified Public Accountants and consultant to the Borough, has performed a study of the capital costs and interest on debt service together with the number of equivalent users at December 31, 2014, and based on such study has recommended a water connection fee in the amount of $3,088.00 for new customers; and WHEREAS, such water connection fee is authorized by N.J.S.A. 40A:31-11 entitled “County and Municipal Water Supply”. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: PAGE 7 OF 17 Regular Meeting Minutes – July 27, 2015 SECTION 1: Chapter 190-11.2 of the Madison Borough Code, currently entitled “Connection fee” is hereby amended as follows: §190-11.2 Connection fee There shall be a water connection fee established in accordance with N.J.S.A. 40A:31-11 in addition to the fees for department services set forth in Section 190-33. The water connection fee for the remainder of 2015 shall be: A. For single family dwelling units, $3,088.00, and for multiple dwelling units, $3,088.00 per unit. B. In the case of any building or portion thereof to be used for industrial, commercial, educational or other than dwelling purposes, the Borough Engineer shall determine by accepted standards the number of units to be connected or added to an existing connection; where a unit equals an annual average daily flow of 248 gallons or fraction thereof: $3,088.00 per unit. This fee shall, pursuant to statute, be recalculated at the end of each budget year and may be reset by ordinance of the Borough Council after public hearing, on a yearly basis. The water connection fee shall be payable in full to the Borough of Madison at the time a building water connection permit is issued for connection to the municipal water system by the Borough of Madison. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 46-2014. Since no member of the public wished to be heard, the public hearing was closed. Mrs. Vitale moved that Ordinance 46-2014, which was read by title, be finally adopted. Ms. Baillie seconded the motion. PAGE 8 OF 17 Regular Meeting Minutes – July 27, 2015 ORDINANCE 47-2015 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $90,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING AND DESIGN SERVICES FOR IMPROVEMENTS TO PROSPECT STREET AND GREENWOOD AVENUE WHEREAS, the Borough Engineer has recommended that the Borough award a professional services contract for engineering and design services in regard to the improvement of Prospect Street and Greenwood Avenue in preparation of the 2016 Road Improvements Program; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $90,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $90,000.00 from the General Capital Improvement Fund for a professional services contract for engineering and design services in regard to the improvement of Prospect Street and Greenwood Avenue in preparation of the 2016 Road Improvements Program; and NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $90,000.00 is hereby appropriated from the General Capital Improvement Fund for a professional services contract for engineering and design services in regard to the improvement of Prospect Street and Greenwood Avenue in preparation of the 2016 Road Improvements Program. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 47-2014. Since no member of the public wished to be heard, the public hearing was closed. Mr. Catalanello moved that Ordinance 47-2014, which was read by title, be finally adopted. Ms. Baillie seconded the motion. Said ordinance will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 48-2015 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 155 OF THE MADISON BOROUGH CODE ENTITLED “SEWER” TO UPDATE THE SEWER CONNECTION FEE SCHEDULE WHEREAS, the Borough Engineer and Borough Auditor have recommended that the Borough amend Chapter 155 of the Madison Borough Code entitled “Sewer” to include an updated sewer connection fee schedule; and WHEREAS, Nisivoccia and Company, LLP, Certified Public Accountants and consultant to the Borough, has performed a study of the capital costs and interest on debt service together with the number of equivalent users at December 31, 2014, and based on such study has recommended a sewer connection fee in the amount of $5,182.00 for new customers; and WHEREAS, such sewer connection fee is authorized by N.J.S.A. 40A:26A- 11 entitled “Municipal and County Sewerage Facilities”. This fee shall, pursuant to statute, be recalculated at the end of each budget year and may be reset by ordinance of the Borough Council after public hearing, on a yearly basis. The sewer connection fee is based upon the usage of a single dwelling unit or equivalent discharge. The sewer connection fee shall be payable in full to the Borough of Madison at the time a building sewer permit is issued for connection to the public sanitary sewer by the Borough of Madison. SECTION 2: This Ordinance shall take effect as provided by law. Mr. Catalanello moved that Ordinance 48-2015, which the Borough Clerk read by title, be adopted. Ms. Baillie seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mr. Catalanello, Mr. Landrigan, Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz Absent: Mr. Rowe Nays: None R 224-2015 RESOLUTION OF THE BOROUGH OF MADISON RATIFYING THE AWARD OF A CONTRACT FOR THE PURCHASE OF A DUMP TRUCK WITH ACCESSORIES TO HOOVER TRUCK CENTERS OF FLANDERS, NJ, UNDER THE SOMERSET COUNTY COOPERATIVE PRICING COUNCIL PROGRAM WHEREAS, the Borough of Madison desires to award a contract to purchase a dump truck with accessories to an authorized vendor under the Somerset County Co-Operative Pricing Council program; and WHEREAS, the purchase of goods and services by a local contracting unit is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Hoover Truck Centers, of Flanders, NJ, has been awarded Somerset County Co-Operative Pricing Council Contract cc-9002-14 for the purchase of a dump truck with accessories; and WHEREAS, the Superintendent of Public Works has recommended that the Borough Council utilize this contract for the purchase of a dump truck with accessories in the amount of $175,216.00; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $175,216.00 for this purpose in appropriation Ordinance 21-2015. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that a contract be awarded to Hoover Truck Centers, of Flanders, NJ for the purchase of a dump truck with accessories at a total price not to exceed $175,216.00 under the Somerset County Co-Operative Pricing Council Contract cc-9002-14 and same is hereby ratified and approved. R 225-2015 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SUBMISSION OF RECYCLING TONNAGE GRANT APPLICATION WHEREAS, the Mandatory Source Separation and Recycling Act, P.L. 1987, c.102, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs; and PAGE 12 OF 17 Regular Meeting Minutes – July 27, 2015 WHEREAS, it is the intent and spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and expand existing programs; and WHEREAS, the New Jersey Department of Environmental Protection has promulgated recycling regulations to implement the Mandatory Source Separation and Recycling Act; and WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including, but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and WHEREAS, a resolution authorizing the Borough of Madison to apply for such tonnage grants will memorialize the commitment of the Borough of Madison to recycling and affirms the assent of the Council of the Borough of Madison, to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and WHEREAS, such a resolution should designate the individual authorized to ensure that the application is properly completed and timely filed. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the Borough of Madison hereby endorses the submission of a Municipal Recycling Tonnage Grant Application to the New Jersey Department of Environmental Protection, Office of Recycling, and hereby designates James Burnet, Assistant Borough Administrator/Certified Municipal Recycling Coordinator of the Borough of Madison, as the individual authorized to ensure that said Application is properly filed. R 226-2015 RESOLUTION OF THE BOROUGH OF MADISON RATIFYING SALARY INCREASE TO CONFIDENTIAL EMPLOYEE THERESA M. RIZZO EXCLUDED FROM UNION PARTICIPATION WHEREAS, the Borough Administrator has recommended approving a $1,000.00 salary increase to confidential employees excluded from union participation to maintain parity with the union employees; and WHEREAS, Deputy Court Administrator Theresa M. Rizzo, non-union confidential employees, effective July 15, 2015. R 229-2015 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A SPECIAL EVENT PERMIT TO ALLOW THE USE OF PUBLIC PARKING LOT NUMBER ONE BY THE MADISON VOLUNTEER AMBULANCE CORPS FOR A SPECIAL EVENT ON SEPTEMBER 19, 2015 WHEREAS, the Madison Volunteer Ambulance Corps has requested permission to use public parking lot number one on Saturday, September 19, 2015, between the hours of 5:00 p.m. and 10:00 p.m. for a Pig Roast; and WHEREAS, the Borough Administrator has recommended that such permission be granted; and WHEREAS, the Madison Volunteer Ambulance Corps has submitted a Special Event Permit Application to the Borough Clerk as well as a Certificate of Liability Insurance naming the Borough of Madison as an additional insured; and WHEREAS, the Borough Council agrees with this recommendation. Joseph Longo recommends approval of this request. R 232-2015 RESOLUTION OF THE BOROUGH OF MADISON CERTIFYING SUBMISSION OF EXPENDITURE FOR RECYCLING TAXES PURSUANT TO P. L. 2007, CHAPTER 311 WHEREAS, the Recycling Enhancement Act, P.L.2007, chapter 311, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs; and WHEREAS, there is levied upon the owner or operator of every solid waste facility (with certain exceptions) a recycling tax (REA) of $3.00 per ton on all solid waste accepted for disposal or transfer at the solid waste facility; and WHEREAS, whenever a municipality operates a municipal service system for solid waste collection, or provides for regular solid waste collection service under a contract awarded pursuant to the “Local Public Contracts Law”, the amount of grant monies received by the municipality shall not be less than the annual amount PAGE 16 OF 17 Regular Meeting Minutes – July 27, 2015 of recycling tax paid by the municipality except that all grant moneys received by the municipality shall be expended only for its recycling program. NOW, THEREFORE, BE IT ORDAINED, by the Borough of Madison that the Borough of Madison hereby certifies a submission of expenditure for taxes paid pursuant to P.L.2007, chapter 311, in 2014 in the amount of $13,687.23. Documentation supporting this submission is available at Borough of Madison, Hartley Dodge Memorial Building, 50 Kings Rd, Madison, NJ 07940, and shall be maintained for no less than five years from this date. The REA Tax has been certified by James Burnet, Assistant Borough Administrator/ Certified Municipal Recycling Coordinator.
