MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 13, 2017 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 13th day of November, 2017. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 5, 2017. Proclamation of the B o r o u g h o f M a d i s on Proclaiming WORLD PANCREATIC CANCER DAY November 16, 2017 PAGE 2 OF 25 Regular Meeting Minutes – 13, 2017 WHEREAS, in 2017, an estimated 53,670 people will be diagnosed with pancreatic cancer in the United States and 43,090 will die from the disease; and WHEREAS, pancreatic cancer is one of the deadliest cancers, is currently the third leading cause of cancer death in the United States and is projected to become the second leading cause around 2020; and WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate in the single digits, at just nine percent; and WHEREAS, when symptoms of pancreatic cancer present themselves, it is generally in later stages and 71 percent of pancreatic cancer patients die within the first year of their diagnosis, while 91 percent of pancreatic cancer patients die within the first five years; and WHEREAS, approximately 1,270 deaths will occur in New Jersey in 2017; and WHEREAS, pancreatic cancer is the seventh most common cause of cancer-related death across the world; and WHEREAS, there were an estimated 367,000 new pancreatic cancer cases diagnosed in 2015; and WHEREAS, the good health and well-being of the residents of Madison are enhanced as a direct result of increased awareness about the symptoms and risk factors of pancreatic cancer and research into early detection, causes, and effective treatments; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim November 16, 2017 as World Pancreatic Cancer Day in the Borough of Madison. _____________________________ Robert H. Conley, Mayor November 13, 2017 REPORTS OF COMMITTEES Public Works and Engineering Mrs. Vitale, Chair of the Committee, made the following comments: Cifelli Construction completed Kings Road sidewalk and light conduit improvements between Prospect Street and Maple Avenue. Special thanks to Madison Electric for working with the contractor to assure the conduit, foundation and pole locations were completed correctly. Cifelli also completed punch list items for the 2017 Road Reconstruction work. BRAUSA Construction Co. has nearly completed construction for MRC Rebound Wall. Rapid Pump installed the wet well access door for North Street Pump Station last week and site improvements such as paving, curb and sidewalk have also been installed. The Greenwood Avenue Phase 1 plans and specifications were reviewed by NJDOT in order to authorize bid in February. Additional improvement to the 124/Greenwood cross walks were recommended by the state. The plans for 2016 Road Reconstruction projects are being drafted in preparation for bids in February. PAGE 3 OF 25 Regular Meeting Minutes – 13, 2017 Public Safety Mr. Landrigan, Chair of the Committee, no report. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: The Finance Department continues work on the 2018 municipal budget and noted that a presentation on the proposed 2018 Capital budget will be made at the next Council meeting. The Board of Health has introduced an ordinance addressing invasive plants and will hold a hearing at the next scheduled meeting on November 21st. The annual Rabies Clinic will be held on Saturday, December 9th at the Public Works yard on John Avenue. Utilities Mr. Wolkowitz, Chair of the Committee, made the following comments: The Electric Department continues installation of meters at KRE and completing of mark outs. On Kings Road, they have installed piers and post lights, between Prospect Street and Maple Avenue, and set a new pole on Cook Avenue . The Borough Christmas tree will be cut down this week and wreaths will be put on all post lights Health Mr. Rowe, Chair of the Committee, absent. Community Affairs Ms. Byrne, Chair of the Committee, made the following comments: Ms. Byrne noted that the Annual Christmas Parade will be held on Friday, November 24th with Madison Arts and Cultural Alliance providing music. The Madison Area Chamber of Commerce is inviting children to participate in a month long scavenger hunt to "Find Rosie the Rose City Reindeer" this holiday season. Beginning on Friday, November 24th, residents can pick up a participation card at any one of the businesses involved in the "Find Rosie the Rose City Reindeer" scavenger hunt. When participants spot Rosie at any one of the businesses, they receive a store stamp or signature on the card. When at least 8 different store stamps/signatures are collected, bring the card to Tons of Toys, 64 Main Street or the Madison Pharmacy, 66 Main Street. where a special prize can be collected. Prizes are being donated by Tons of Toys. Watch the live feed of the Grand Prize drawing on the ILoveMadisonNJ Facebook page on Monday, December 18th at 4:00 pm. PAGE 4 OF 25 Regular Meeting Minutes – 13, 2017 AGENDA DISCUSSIONS 11/13/2017-1 ELECTRIC UTILITY QUARTERLY REPORT Mr. Burnet provided a report regarding the performance of the Electric Utility noting tonight’s presentation will be posted on the Borough website. Mr. Burnet also noted the cool summer, resulting in lower collection and electric costs. Surplus balance will show little change. Mr. Burnet explained proposed self generation in Madison and noted that additional information will be provided at future Council meetings. ADVERTISED HEARINGS The Clerk made the following statement: Ordinance 42-2017 scheduled for hearing was introduced by title and passed on first reading at a regular meeting of the Council held on Wednesday, October 11, 2016; Ordinance 44-2017 was introduced by title and passed on first reading at a regular meeting of the Council held on Monday, October 23, 2017; all were posted and filed according to law, and copies were made available to the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 42-2017 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $25,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND TO PURCHASE WINDOWS AND RELATED IMPROVEMENTS FOR THE CIVIC CENTER WHEREAS, the Superintendent of Public Works has recommended that the Borough appropriate $25,000.00 from the General Capital Improvement Fund to purchase windows and related improvements for the Civic Center; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $25,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $25,000.00 from the General Capital Improvement Fund to purchase windows and related improvements for the Civic Center. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $25,000.00 is hereby appropriated from the General Capital Improvement Fund to purchase windows and related improvements for the Civic Center. Ordinance 43-2017 Item Removed and the # Retired ORDINANCE 44-2017 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $ 41,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR RADIOS FOR THE FIRE DEPARTMENT WHEREAS, the Fire Chief has recommended that the Borough appropriate $41,000.00 from the General Capital Improvement Fund for the purchase of radios and related equipment for the Fire Department; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $41,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $41,000.00 from the General Capital Improvement Fund for the purchase of radios and related equipment. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $41,000.00 is hereby appropriated from the General Capital Improvement Fund for the purchase of radios and related equipment for the Fire Department. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Barbara Hughes; Glenwild Road, raise concern regarding litter in public spaces in the Borough, asking everyone to be aware, for fear that residents will become use to trash. Jesse Esposito; Community Place, provided photos of a neighbor’s trash filled dumpster and noted continuing parking issues on Community Place. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of November 27, 2017 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 45-2017 ORDINANCE OF THE BOROUGH OF MADISON RESCINDING CHAPTER 134-9 OF THE BOROUGH CODE ENTITLED “PARKING OF RECREATIONAL VEHICLES” PERMITTING RECREATIONAL VEHICLE PARKING AT THE PUBLIC WORKS FACILITY WHEREAS, Chapter 134, Section 9 of the Borough Code, adopted July 9, 2001, permitted residents to park recreational vehicles at the Public Works Yard on Johns Street; and WHEREAS, the Borough Administrator has recommended that Section 134- 9 be rescinded effective March 31, 2018, due to a need by the Borough to utilize the property for government use. PAGE 7 OF 25 Regular Meeting Minutes – 13, 2017 NOW, THEREFORE BE IT RESOLVED, by the Council of the Borough of Madison , in the County of Morris and the State of New Jersey that Section 134-9 of Chapter 134 of the Borough Code be rescinded; and BE IT FURTHER RESOLVED, by the Council of the Borough of Madison, in the County of Morris and the State of New Jersey, as follows: SECTION 1: That Chapter 134, Section 9 entitled "Recreational Vehicle Parking" of the Borough code be amended to remove Chapter 134, Section 9 in its entirety. SECTION 2: This Ordinance shall take effect as provided by law. Mrs. Vitale moved that Ordinance 45-2017, which the Borough Clerk read by title, be adopted. Ms. Baillie seconded the motion. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $100,000.00 is hereby appropriated from the General Capital Improvement Fund for the 2017 Sanitary Sewer Improvements program. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $320,000.00 is hereby appropriated from the General Capital Improvement Fund for the Elmer Street Sewer Improvements program. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Mr. Landrigan, Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Ms. Byrne Nays: None Absent: Mr. Rowe ORDINANCE 48-2017 ORDINANCE OF THE BOROUGH OF MADISON AUTHORIZING THE PRIVATE SALE OF CERTAIN PROPERTY OWNED BY THE BOROUGH OF MADISON NOT REQUIRED FOR PUBLIC PURPOSES PURSUANT TO N.J.S.A. 40A:12-13(b) PAGE 9 OF 25 Regular Meeting Minutes – 13, 2017 WHEREAS, N.J.S.A. 40A:12-13(b)(5) authorizes local governmental units to sell real property owned by the governmental unit, not needed for public use, by private sale, to the owner of the real property contiguous to the real property being sold provided that the property being sold is less than the minimum size required for development under the Borough’s zoning ordinance and is without any capital improvement thereon; and WHEREAS, when there is more than one continuous property owner, N.J.S.A. 40A:12-13(b)(5) requires a local governmental unit to first offer to sell the real property to the highest bidder from among all such contiguous property owners; and WHEREAS, the sale price shall be for not less than the fair market value of said real property; and WHEREAS, the Borough is the owner of real property identified as Block 3801, Lot 1.02 (“the Property”) on the Official Tax Map of the Borough of Madison; and WHEREAS, the Governing Body has determined that the Property is not needed for public use; and WHEREAS, an appraisal report prepared for the Property determined that the Property’s fair market value is ninety thousand dollars ($90,000.00), that the Property is less than the minimum size required for development under the Borough’s zoning ordinance, and is without any capital improvement thereon; and WHEREAS, the Borough has offered to sell the Property to the contiguous owners and only 117 Kings Road LLC (Currey Automotive), the property owner of Block 3801, Lot 2, has expressed interest in purchasing the Property; and WHEREAS, in accordance with N.J.S.A. 40A:12-13(b)(5), the Borough will sell the Property to 117 Kings Road LLC (Currey Automotive), the property owner of Block 3801, Lot 2, for ninety thousand dollars ($90,000.00). NOW THEREFORE BE IT ORDAINED, by the Governing Body of the Borough of Madison, the County of Morris, in the State of New Jersey, as follows: Section 1. (a) The Governing Body hereby declares that the Property is no longer needed for public use and should be sold in accordance with N.J.S.A. 40A:12-1, et seq. (b) The Governing Board hereby authorizes the sale of the Property to 117 Kings Road LLC (Currey Automotive), the property owner of Block 3801, Lot 2, for ninety thousand dollars ($90,000.00). PAGE 10 OF 25 Regular Meeting Minutes – 13, 2017 (c) In the event the Borough is unable to convey marketable title, insurable at regular rates by a title insurance company licensed to do business in the State of New Jersey, the Borough will forthwith return to the purchaser any and all deposit moneys previously submitted by the purchaser, and neither party shall have any further rights against the other. The acceptance of a quitclaim deed by the purchaser from the Borough shall extinguish any claims that said purchaser may have against the Borough in connection with the quality of title conveyed. (d) The Property herein sold is subject to existing encumbrances, liens, easements, zoning ordinances, other restrictions of record, such facts as an accurate survey would reveal and any present or future assessments for the construction of improvements benefiting said property. The Borough makes no representations as to the presence or absence of wetlands or any other environmental conditions on the property and the purchaser assumes the risk of any such condition, all property being sold “as is.” A prospective purchaser shall have examined the Property or otherwise waived the right to examine the Property prior to submitting the stated bid to the Borough. The Borough does not make any representations, express or implied, that the Property is buildable or usable for any purpose whatsoever. (e) This Property will merge with Block 3801, Lot 2. The sale of this Property by the Borough shall in no way be construed as an indication that a construction permit can be secured for the property. (f) All conveyances by the Borough shall be made by quitclaim deed. (g) The successful bidder shall indemnify and hold the Borough harmless from any claim whatsoever arising out of the Borough’s ownership interest including but not limited to environmental cleanup costs. (h) The sale of the Property shall be subject to the purchaser complying with all terms and conditions of the Resolution of the Planning Board for the Borough of Madison, Case No. P-17-004, memorialized July 18, 2017. (i) Purchaser shall erect a fence to separate Block 3801, Lots 1.01 and 1.02 within thirty (30) days of closing. Seller’s attorney will hold the deed in escrow until the fence is erected. Section 2. NOTICE. The Borough Clerk shall post and advertise copies of this ordinance as required by N.J.S.A. 40A:12-13(b)(5). A copy of this Ordinance shall also be sent by the Borough Clerk to each contiguous property owner. Section 3. AUTHORIZATION. The Mayor, Clerk, Borough Attorney, and such other officials as may be necessary are authorized to prepare and execute a deed and all other necessary documents to convey the Property to 117 Kings Road LLC, subsequent to the Governing Body adopting a resolution authorizing same. Section 4. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such PAGE 11 OF 25 Regular Meeting Minutes – 13, 2017 decision shall not affect the remaining portions of this Ordinance, which shall otherwise remain in full force and effect. Section 5. REPEALER. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. Section 6. EFFECTIVE DATE. This Ordinance shall take effect after final passage as provided by law. Ms. Baillie moved that Ordinance 48-2017, which the Borough Clerk read by title, be adopted. Mrs. Vitale seconded the motion. R 285-2017 RESOLUTION OF THE BOROUGH OF MADISON AWARDING A CONTRACT TO ROUTE 23 AUTOMALL LLC OF BUTLER, NJ FOR TWO (2) NEW UNUSED BUCKET TRUCKS FOR THE ELECTRIC DEPARTMENT IN THE AMOUNT OF $407,254.20 WHEREAS, the Borough of Madison publicly advertised for bids for the purchase of two (2) new, unused bucket trucks and two year warranty (the “Contract”) in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, the lowest qualified bid was submitted by Route 23 AutoMall, LLC, of Butler, New Jersey, in the amount of $407,254.20; and WHEREAS, the Qualified Purchasing Agent/Personnel Director has recommended that the Borough Council award the contract to Route 23 AutoMall, LLC. in the amount of $407,254.20; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $407,254.20 for this purpose in Ordinance 9-2017. PAGE 17 OF 25 Regular Meeting Minutes – 13, 2017 R 286-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PARTICIPATION IN THE JOINT MUNICIPAL COURT WHEREAS, the Borough of Chatham, the Township of Chatham, the Township of Harding and the Township of Morris have all indicated a desire to continue participation in a Joint Municipal Court agreement with the Borough of Madison for use of the court facilities at the Hartley Dodge Memorial at Kings Road in Madison effective January 1, 2018; and WHEREAS, the Borough Administrator and Joint Court Administrator recommend that the Borough Council authorize entry into an agreement for the Joint Municipal Court; and WHEREAS, the agreement is subject to the concurrence of the Assignment Judge, Superior Court of New Jersey, Morris County; and WHEREAS, the Borough Council deems it appropriate to authorize entry into an agreement for a Joint Municipal Court with the Borough of Chatham, the Township of Chatham, the Township of Harding and the Township of Morris. R 288-2017 RESOLUTION OF THE BOROUGH OF MADISON REJECTING BID FOR MULTI-USE HOOK LOADER WITH ACCESSORIES WHEREAS, the Borough of Madison publicly advertised for bids for the purchase of a mulit-use hook loader and accessories in accordance with Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and WHEREAS, the Borough received one bid from Mid-Atlantic Truck Center, which bid substantially exceeded the budget appropriations for the project; and WHEREAS, the Borough Administrator, Borough Attorney and the Public Works Director have all recommended that this bid be rejected, pursuant to N.J.S.A. 40A:11-13.2(b), and that the project be re-advertised. R 296-2017 RESOLUTION OF THE BOROUGH OF MADISON APPROVING TRANSFER OF 2017 LIVERY OWNER’S LICENSE FOR MADISON LIMOUSINE SERVICE WHEREAS, any license issued for any taxicab or livery may be transferred to a substitute vehicle in accordance with the provisions of Chapter 173-7 of the Borough of Madison Code after approval of the Council and upon the payment to the Borough of a transfer fee of $10.00 for each vehicle for which the license is to be transferred; and WHEREAS, prior to the approval or disapproval by the Council of the transfer of the license to permit the operation of such substituted vehicle, the owner may operate such substituted vehicle or cause the same to be operated, subject to the other provisions of Chapter 173-7; and WHEREAS, Madison Limousine Service has made application to transfer Livery Owner’s License No. 2017-4 to a substitute vehicle and, at the same time, has provided proof of insurance and paid the appropriate transfer fee; NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, County of Morris, State of New Jersey, to approve the license transfer request from Madison Limousine Service. R 297-2017 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING TERRY D. EARLE TO THE POSITION OF PART-TIME SENIOR CITIZEN VAN DRIVER WHEREAS, the QPA/Personnel Director has recommended the appointment of Terry D. Earle to the position of part-time Senior Citizen Van Driver. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, and State of New Jersey, that Terry D. Earle is hereby appointed to the position of part-time Senior Citizen Van Driver, contingent upon a satisfactory criminal background check, motor vehicle abstract and employment reference verification. PAGE 23 OF 25 Regular Meeting Minutes – 13, 2017 BE IT FURTHER RESOLVED, that Terry D. Earle shall be compensated at a salary in the amount of $15.60 per hour. R 298-2017 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING LISA ELLIS TO THE FULL-TIME POSITION OF DIRECTOR OF BUSINESS DEVELOPMENT WHEREAS, the Qualified Purchasing Agent/Personnel Director has recommended the appointment of Lisa Ellis, to the full time position of Director of Business Development; and WHEREAS, the Borough Administrator has certified that Lisa Ellis, was determined to be the most qualified for the position and all background checks have been completed; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that Lisa Ellis, is appointed to the full time position of Director of Business Development. BE IT FURTHER RESOLVED, that Lisa Ellis, be compensated at an annual salary of $59,000.00. R 299-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING ANNUAL MADISON CHRISTMAS COMMITTEE PARADE WHEREAS, the Madison Christmas Committee has requested permission to hold their annual parade on Friday, November 24, 2017, beginning at 5:30 p.m. on a route from Prospect Street to Main Street to Green Village Road or as otherwise approved by the Police Department; and WHEREAS, the Assistant Business Administrator/CFO recommends approval of this request. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris, and State of New Jersey, that the request of the Madison Christmas Committee to hold their annual parade in Madison on Friday, November 24, 2017, as described herein is hereby approved, subject to any safety requirements that are imposed by the Madison Police Department.
