MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 27, 2017 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 27th day of November, 2017. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 5, 2017. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley made the following comments: Councilmember Robert Landrigan has resigned from the Council effective November 15, 2017 and Mayor Conley noted that Mr. Landrigan will be honored at the January 3rd Reorganization meeting. Mayor Conley also noted the large crowd attending the annual Christmas Parade held Friday, November 24th, and thanked the Dean Family for their donation of this year’s Christmas tree. Oath of Office - Volunteer Firefighter Michael J. Coyne Mrs. Vitale moved adoption of Resolution 300-2017. Mr. Wolkowitz seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe, Ms. Byrne Nays: None R 300-2017 RESOLUTION OF THE BOROUGH OF MADISON CONFIRMING MEMBERSHIP OF MICHAEL J. COYNE IN THE MADISON HOOK & LADDER COMPANY #1 WHEREAS, the Fire Chief has advised that Michael J. Coyne was voted into the Madison Hook & Ladder Company #1 as a volunteer firefighter; and WHEREAS, Section 18-27 of the Madison Borough Code requires that each person so voted shall be confirmed as a member of such division by the Council of the Borough of Madison. Coyne is hereby confirmed as a member of the Madison Hook & Ladder Company #1 effective immediately. Mayor Conley administered the oath of office to Volunteer Firefighter Michael J. Coyne. REPORTS OF COMMITTEES Public Works and Engineering Mrs. Vitale, Chair of the Committee, made the following comments: Mrs. Vitale noted that leaf collection continues through the Borough. Cifelli Construction completed 2017 Road Reconstruction work. BRAUSA Construction Co. has completed its construction contract for the MRC Rebound Wall Rapid Pump has completed its contract for North Street Pump Station last week and will be delivering maintenance bonds and closeout documentation within the next two weeks. General Contractor JoMed will attend a preconstruction meeting for the Central Avenue water main replacement in the next two weeks. Bid documents for the Summerhill Park Trails Improvements will be finalized as a result of a funding approval from the County of Morris and the DPW will commence foundation construction on the Memorial Park rink support building this week. Public Safety Mr. Landrigan, Chair of the Committee, no report. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: Ms. Baillie noted that the 2018 budget process continues and the 5 year Capital Plan, as well as the proposed road improvements program will be discussed at the December 11th Council meeting. Ms. Baillie also noted that information regarding filing for Tax Appeal forms are available in the Borough Clerk’s Office. Utilities Mr. Wolkowitz, Chair of the Committee, made the following comments: Mr. Wolkowitz noted that the Electric Utility staff raised the Borough Christmas tree and installed wreaths on all post lights. Crews were called in early one morning for a house fire on Pomeroy Road to cut power, and continue meter installations at the KRE site. The Water Department staff is working with PSE& G on improvements on Main Street and continues hydrant flushing. Health Mr. Rowe, Chair of the Committee, made the following comments: Mr. Rowe noted that last Tuesday, the Board of Health has passed an ordinance regulating invasive plants including bamboo. The ordinance will take effect after 180 days. Community Affairs Ms. Byrne, Chair of the Committee, made the following comments: Ms. Byrne stated no report for Public Safety, and noted the success of the Christmas Parade, thanking all volunteers. Ms. Byrne also noted the “Rosie the Reindeer” program, spot Rosie at any one of the businesses, to receive a store stamp or signature. With least 8 different store stamps/signatures collected, bring PAGE 3 OF 14 Regular Meeting Minutes – November 27, 2017 the card to Tons of Toys, 64 Main Street or the Madison Pharmacy, 66 Main Street, where a special prize can be collected. He/she shall limit his/her statement to three (3) minutes or less. Ron Hendrickson; Green Avenue, raised concern regarding future sewer capacity. AGENDA DISCUSSIONS 11/27/2017-1 CANCELLATION OF CAPITAL ORDINANCES Mr. Burnet explained the administrative process for cancellation of Capital Ordinances completed an annual basis. Resolution 304-2017 is listed on the Consent Agenda. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on November 13, 2017, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 45-2017 ORDINANCE OF THE BOROUGH OF MADISON RESCINDING CHAPTER 134-9 OF THE BOROUGH CODE ENTITLED “PARKING OF RECREATIONAL VEHICLES” PERMITTING RECREATIONAL VEHICLE PARKING AT THE PUBLIC WORKS FACILITY WHEREAS, Chapter 134, Section 9 of the Borough Code, adopted July 9, 2001, permitted residents to park recreational vehicles at the Public Works Yard on Johns Street; and WHEREAS, the Borough Administrator has recommended that Section 134- 9 be rescinded effective March 31, 2018, due to a need by the Borough to utilize the property for government use. NOW, THEREFORE BE IT RESOLVED, by the Council of the Borough of Madison , in the County of Morris and the State of New Jersey that Section 134-9 of Chapter 134 of the Borough Code be rescinded; and PAGE 4 OF 14 Regular Meeting Minutes – November 27, 2017 BE IT FURTHER RESOLVED, by the Council of the Borough of Madison, in the County of Morris and the State of New Jersey, as follows: SECTION 1: That Chapter 134, Section 9 entitled "Recreational Vehicle Parking" of the Borough code be amended to remove Chapter 134, Section 9 in its entirety. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 45-2017. Since no member of the public wished to be heard, the public hearing was closed. Mrs. Vitale moved that Ordinance 45-2017, which was read by title, be finally adopted. Mr. Rowe seconded the motion. ORDINANCE 46-2017 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $100,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE 2017 SANITARY SEWER IMPROVEMENTS PROGRAM WHEREAS, the Borough Engineer has recommended that the Borough appropriate $100,000.00 from the General Capital Improvement Fund for the 2017 Sanitary Sewer Improvements program; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $100,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $100,000.00 from the General Capital Improvement Fund for the 2017 Sanitary Sewer Improvements program. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $100,000.00 is hereby appropriated from the General Capital Improvement Fund for the 2017 Sanitary Sewer Improvements program. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. Since no member of the public wished to be heard, the public hearing was closed. Mrs. Vitale moved that Ordinance 46-2017, which was read by title, be finally adopted. Mr. Rowe seconded the motion. Mayor Conley provided a brief explanation of the sewer process, noting two systems, collection and treatment. Elected officials of the Borough of Madison and the Borough of Chatham meet monthly. There is proposed expansion, in part, due to NJEPA regulation. Ms. Baillie noted that the Planning Board and Joint Meeting monitor capacity. Ms. Byrne noted that phosphorus levels, as well as capacity, are part of the facility upgrade. ORDINANCE 47-2017 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $320,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE ELMER STREET STORM SEWER IMPROVEMENTS WHEREAS, the Borough Engineer has recommended that the Borough appropriate $320,000.00 from the General Capital Improvement Fund for the Elmer Street Storm Sewer Improvements program; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $320,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $320,000.00 from the General Capital Improvement Fund for the Elmer Street Sewer Improvements program. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $320,000.00 is hereby appropriated from the General Capital Improvement Fund for the Elmer Street Sewer Improvements program. Jesse Esposito; Community Place, thanked Borough Officials for help in getting a dumpster removed and noted continuing parking issues on Community Place. Ron Hendrickson; Green Avenue, raised concern regarding street repairs after public gas repairs. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of December 11, 2017 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 49-2017 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $42,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND TO PURCHASE ONE PICKUP TRUCK WHEREAS, the Director of Public Works has recommended that the Borough appropriate $42,000.00 from the General Capital Improvement Fund to purchase one pickup truck for use by the Public Works Department; and PAGE 7 OF 14 Regular Meeting Minutes – November 27, 2017 WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $42,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $42,000.00 from the General Capital Improvement Fund to purchase one pickup truck. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $42,000.00 is hereby appropriated from the General Capital Improvement Fund to purchase one pickup truck. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe, Ms. Byrne Nays: None ORDINANCE 50-2017 ORDINANCE AMENDING CHAPTER 34, OF THE CODE OF THE BOROUGH OF MADISON ENTITLED “POLICE DEPARTMENT,” ESTABLISHING PROMOTION PROCEDURES FOR REVIEW OF THE RANKING OF CANDIDATES WHEREAS, the Mayor and Council of the Borough of Madison support and encourage efficiency within the Madison Police Department; and WHEREAS, the Mayor and Council of the Borough of Madison have determined that it would be in the best interest of the citizens of the Borough to establish a promotion practice based upon merit for the positions of Police Chief, Captain, Lieutenant and Sergeant when there is a vacancy in said position; and WHEREAS, the Borough of Madison further desires to establish appropriate hiring criteria based on merit, experience, moral character and sufficient physical health when hiring police officers; NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Borough of Madison as follows: Chapter 34 of the Code of the Borough of Madison entitled “Police Department” is hereby amended as follows: PAGE 8 OF 14 Regular Meeting Minutes – November 27, 2017 SECTION 1: Article 34-2 APPOINTMENT Revise the record review section of the process for the promotion to the position of Police Chief, Captain, Lieutenant and Sergeant to provide that any points assessed under the “Disciplinary Actions” section shall be deducted from the candidates score. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe, Ms. Byrne Nays: None R 301-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE CHIEF FINANCIAL OFFICER TO SIGN AN AGREEMENT WITH CAPTUREPOINT.COM FOR ONLINE PROGRAM MANAGEMENT SERVICES WHEREAS, the Borough of Madison requires a new online program management service for use by the Senior Center and Recreation Departments; and WHEREAS, the Borough Council has determined it is appropriate to authorize the Chief Financial Officer to sign an agreement with CapturePoint of Ridgewood, NJ for online program management services. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris in the State of New Jersey that the Chief Financial Officer is hereby authorized and directed on behalf of the Borough to sign an agreement with CapturePoint of Ridgewood, NJ for online program management services. R 302-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SETTLEMENT AND RELEASE AGREEMENT WITH JERSEY CENTRAL POWER & LIGHT COMPANY TO SETTLE FERC DOCKET NO. ER17-217 PAGE 9 OF 14 Regular Meeting Minutes – November 27, 2017 WHEREAS, the Borough’s Special Rate Counsel has negotiated a settlement with Jersey Central Power & Light Company in the matter of FERC Docket No ER17-217; and WHEREAS, the Borough Administrator and Assistant Administrator/CFO have recommended that the final settlement of the matter. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The Settlement and Release Agreement as described herein is approved and the Mayor, Borough Clerk, and Special Rate Counsel are authorized to execute same. 2. The form of the Settlement and Release Agreement shall be approved by the Borough Attorney and Special Rate Counsel. R 303-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING FINAL CHANGE ORDER REQUEST FROM CIFELLI & SON GENERAL CONTRACTING, INC., IN THE AMOUNT OF $216,822.36 BRINGING TOTAL AUTHORIZED FINAL PAYMENT TO $1,404,481.52 FOR THE 2017 ROAD IMPROVEMENT PROGRAM WHEREAS, a contract for the 2017 Road Improvement Program, in an amount not to exceed $1,187,659.16 was initially awarded to Cifelli & Son, Inc., of Nutley, New Jersey, by Resolution 114-2017; and WHEREAS, the Borough Engineer has recommended approval of a change order to the contract for field changes that were encountered during the construction and larger quantities under the unit pricing and final payment of $216,822.36 bringing the revised contract total to $1,404,481.52; and WHEREAS, the Borough Engineer has advised that the project has been completed and has recommended approval of the change order amending Resolution 114-2017 to Cifelli & Son General Contracting, Inc. of Nutley, New Jersey in an additional amount of $74,406.36 so that final payment may be processed and the contract completed; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an additional amount not to exceed $216,822.36 for this purpose, which funds were appropriated by Ordinance 1-2017 in the amount of $1,330,000.00 and Ordinance 3-2017 in the amount of $400,000.00 and the existing ordinances contain sufficient funds to include this final payment and change order; NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the final payment PAGE 10 OF 14 Regular Meeting Minutes – November 27, 2017 and change order request from Cifelli & Son General Contracting, Inc. of Nutley, New Jersey, in the total amount not to exceed $1,404,481.52 for the 2017 Road Improvement Program is authorized. R 304-2017 RESOLUTION OF THE BOROUGH OF MADISON CANCELING COMPLETED CAPITAL IMPROVEMENT ORDINANCES WHEREAS, the Chief Financial Officer has reviewed a list of open capital projects and has determined that certain capital projects have been completed and the improvement authorization accounts should be closed; and WHEREAS, the Chief Financial Officer has recommended that the Council adopt a Resolution canceling the open dollar balances in such completed projects; and WHEREAS, the Borough Council has determined to make such cancellation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the list of open capital ordinances annexed hereto are hereby cancelled. R 305-2017 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2017 WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison will receive $2,749.66 from the 2017 State Body Armor Replacement Fund (BARF) Program and wishes to amend its 2017 Budget to include this amount as revenue. R 306-2017 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2017 WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison will receive $2,000.00 from the Morris County Supplemental Alliance Funding Grant and wishes to amend its 2017 Budget to include this amount as revenue. R 307-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PURCHASE OF WATER METERS/DATA RECORDERS AND RADIO FREQUENCY METER INTERFACE UNDER MORRIS COUNTY COOPERATIVE PRICING COUNCIL PAGE 12 OF 14 Regular Meeting Minutes – November 27, 2017 WHEREAS, the Borough of Madison has a contract for the purchase of Water Meters/Data Recorders and Radio Frequency meter interface under the Morris County Co-Operative Pricing Council program; and WHEREAS, the purchase of goods and services by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Rio Supply, Inc., 100 Allied Parkway, Sicklerville, New Jersey, 08094 has been awarded Morris County Co-Operative Pricing Council contract number #47; and WHEREAS, Resolution 211-2017 authorized the purchase of Water Meters/Data Recorders and Radio Frequency meter interface at a total price not to exceed $30,941.00; and WHEREAS, the Public Works Superintendent has recommended that the Borough Council utilize these contracts for the purchase of Water Meters/Data Recorders and Radio Frequency meter interface under contract #47, in an additional amount not to exceed $33,181.00; and WHEREAS, the Chief Financial Officer has attested that funds will be available in an amount not to exceed $33,181.00 for this purpose in the Water Department operating account. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract for the purchase of Water Meters/Data Recorders and Radio Frequency meter interface, is hereby ratified, for an amount not to exceed $33,181.00. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Rio Supply, Inc., 100 Allied Parkway, Sicklerville, New Jersey, 08094, for the purchase of Water Meters/Data Recorders and Radio Frequency meter interface at a total price not to exceed $33,181.00, in a form acceptable to the Borough Attorney. R 308-2017 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING THOMAS DEBIASSE III TO THE POSITION OF PART-TIME SEASONAL LABORER IN THE DEPARTMENT OF PUBLIC WORKS WHEREAS, the Qualified Purchasing Agent/Personnel Director recommends the appointment of Thomas DeBiasse III to the position of Part-Time Seasonal Laborer in the Department of Public Works; and WHEREAS, the Council agrees with this recommendation.
