MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON December 10, 2018 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 10th day of December, 2018. Mayor Conley called the meeting to order at 6:30 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 11, 2018. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. APPROVAL OF MINUTES Mr. Rowe moved approval of the Executive Minutes of October 22, 2018, November 12, 2018, November 26, 2018 and Special Executive Meeting Minutes of November 27, 2018. Proclamation of the B o r o u g h o f M a d i s on In Recognition of 60 Green Avenue, Madison, New Jersey WHEREAS, the Madison Historical Preservation Commission was established in 1993 by Ordinance #31 to encourage preservation of sites of historic, archaeological, cultural, scenic and architectural significance and to provide architectural advice and recommendations on plans submitted for renovations to the façade of properties not only in the historic district but also throughout the Borough of Madison; and PAGE 2 OF 13 Regular Meeting Minutes – December 10, 2018 WHEREAS, 60 Green Avenue in Madison was constructed in 1889 for Judge George Helm Yeaman by E. L. Cook, a local builder, using a “pattern book” or published design; and WHEREAS, owners Janice Davey and Barry Kizmann have recently restored their home with great attention to the design detail of the American Queen Anne period; and WHEREAS, 60 Green Avenue has a high, straight mansard roof with the exception of a corner tower which features an ogee-curved roofline; and WHEREAS, the original published design of this house was modified slightly to extend the front porch to wrap around the north side of the home; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby recognize the meticulous preservation of 60 Green Avenue which contributes to the character of the Borough of Madison as a place of beauty and architectural value. Proclamation of the B o r o u g h o f M a d i s on In Recognition of The Bottle Hill Tavern WHEREAS, the Madison Historical Preservation Commission was established in 1993 by Ordinance #31 to encourage preservation of sites of historic, archaeological, cultural, scenic and architectural significance and to provide architectural advice and recommendations on plans submitted for renovations to the façade of properties not only in the historic district but also throughout the Borough of Madison; and WHEREAS, Bottle Hill Tavern is located at 13 Waverly Place in a 19th century building in the downtown historic district; and WHEREAS, owners Peter Flemming, Tom Haralampoudis, Marty Horn and Charlie Horsey decided to celebrate the great history of the Borough of Madison by renaming the recently purchased establishment after the original Bottle Hill Tavern, which was built in 1812; and WHEREAS, renovations to 13 Waverly Place included removing the 1970’s façade and returning the exterior to its original design by merging the two storefronts into one and adding gas lanterns on either side of the replaced front door; PAGE 3 OF 13 Regular Meeting Minutes – December 10, 2018 NOW, THEREFORE, I, Robert H. Conley Mayor December 10, 2018 EMPLOYEE OF THE MONTH FOR DECEMBER: The Employee of the Month for December is Custodian Lou Ammirato for his dedication and commitment when he stopped by the building each day over the Thanksgiving weekend while the building was closed to confirm that the boilers which were repaired the day before the holiday were up and running and the building’s heating system was working. REPORTS OF COMMITTEES Health Mr. Rowe, Chair of the Committee, made the following comments: The Health Department’s annual Free Rabies Clinic was held this past Saturday, at the Public Works garage. Approximately 120 pets were immunized. Cat and Dog License Renewals have been mailed to pet owners who have previously registered a pet. Residents are reminded that the renewals are due by January 31, 2019. License applications for residents who have not e previously registered a pet can be found on the borough’s website, Rosenet.org. All Retail Food Establishment License Renewals have also been sent and are due by January 10, 2019. Please call the Health Department if you have any questions. Public Works and Engineering Mrs. Vitale, Chair of the Committee, made the following comments: Mrs. Vitale reported that the Central Avenue milling is completed and paving began today. Ray Palmer Associates, Inc. of Dover, N.J. has completed the improvements to Wells A & B. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: The Division of Local Government Services issued guidelines for this year’s budget deadlines. The municipal budget will be introduced at the March 25th meeting and hearing an adoption is scheduled for April 22nd. Borough Purchasing has closed as of December 7th until January to close the books for 2018. Public Safety Mr. Wolkowitz, Chair of the Committee, made the following comments: The Fire Department responded to a total of 86 calls in the Month of November. On Thursday afternoon, November 29th the Fire Department responded to the Hall of Science building at Drew University for a “stranger odor” in some of the labs and classrooms. The building was evacuated and no occupants of the building became ill or were injured. Madison Fire Department was assisted by the Whippany Fire Department’s HazMat team. After a complete search of the building by fire personnel it was determined to be safe and allowed to be reoccupied after the source of the odor was found and corrected. PAGE 4 OF 13 Regular Meeting Minutes – December 10, 2018 Community Affairs Ms. Byrne, Chair of the Committee, made the following comments: Ms. Byrne report that the Senior Citizen Advisory Committee will work with the Friends of the Seniors on programs and fund raising. The Madison Farmers’ Market will continue for two more weeks, at the Community Art Center on Kings Road. The Museum of Early Trades and Crafts and MACA will hold the annual art auction this Saturday, December 15th. Utilities Mr. Hoover, Chair of the Committee, made the following comments: The staff of Water Department assisted the Public Works Department with leaf pick- up. The Madison Pool water service line was shut down for the winter and as part of the remodeling of the A/B Wells Treatment Plant, the chlorine injector lines have been re-piped. The Electric Department has installed new service to a home at 5 East Lane and One West End Avenue, a new pole for the sewer pumping station was installed. A new sign was mounted at the Rosedale skating ring and American Electrical Testing completed testing the Vacuum Circuit Breaker at the Kings Road substation. The Electric Department painted the flag pole at the Post Office on Lincoln Place. AGENDA DISCUSSIONS 12/10/2018-1 AFFORDABLE HOUSING PRESENTATION Borough Planner Susan Blickstein and Consultant Elizabeth McManus, PP joined the Council meeting to provide an update on Affordable Housing. Ms. McManus provided the history of Affordable Housing in New Jersey and Ms. Blickstein provided Madison’s history, as well as prior round and proposed future obligations. Louis Riccio, Director of the Madison Housing Authority noted Madison’s tradition of providing affordable housing since 1979. Following discussion Mayor Conley opened the meeting for public comment. PAGE 5 OF 13 Regular Meeting Minutes – December 10, 2018 The following residents raised concern regarding proposed construction of affordable housing on Chateau Thierry, property owned by the Madison Housing Authority, noting excessive building in the neighborhood: Dave Carver; Belleau Avenue Janice Olear; Belleau Avenue Saverio Allocca; Belleau Avenue Carolyn Bambaci; Belleau Avenue Lorenzo D’Amato; Belleau Avenue Cristina D’Amato; Belleau Avenue Samer Nassoura; Belleau Avenue Greg Olear; Belleau Avenue 12/10/2018-2 MADISON HOUSING AUTHORITY FUNDING REQUEST – JOHN AVENUE MHA Director Louis Riccio addressed the Council seeking endorsement of a grant application for the Morris County HOME Program, as well as funds from the Affordable Housing Trust Fund for rehabilitation of two four-bedroom units at 28A and 28B John Avenue, converting the units to four two-bedroom units. Following discussion there was consensus to amend the proposed resolution to support the application and release up to $100,000.00 from the Affordable Housing Trust Fund for this project. Resolution 320-2018 is listed on the Consent Agenda. 12/10/2018-3 2019 CAPITAL BUDGET PLAN FOR ROAD RECONSTRUCTION, MILLING AND OVERLAY Borough Engineer Robert Vogel provided an overview of capital projects for 2019, noting that Council will vote to approve each project. Mr. Vogel also noted that in anticipation of early bidding, an ordinance will be proposed in January for road reconstruction projects. Mr. Vogel presented the roads program, as well as milling and overlay projects proposed, noting Sayre Court, Ross Court, Vinal Place Bruns Street and Community Place are included in the five year capital plan, as well as a second phase for Greenwood Avenue. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe, Ms. Byrne, Mr. Hoover Nays: None R 317-2018 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXECUTION OF A HISTORIC PRESERVATION EASEMENT AGREEMENT WITH THE COUNTY OF MORRIS FOR BLOCK 1504, LOT 2 (MUSEUM OF EARLY TRADES & CRAFTS) IN THE BOROUGH OF MADISON WHEREAS, the Borough Administrator has recommended the execution of a Historic Preservation Agreement with the County of Morris for the Museum of Early Trades & Crafts as required by the previously executed Grant Agreements with the County of Morris; and WHEREAS, the Council of the Borough of Madison agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Mayor and Borough Clerk are authorized to execute a Historic Preservation Easement Agreement between the County of Morris and the Borough of Madison as described herein in a form approved by the Borough Attorney. R 318-2018 RESOLUTION OF THE MADISON BOROUGH COUNCIL AWARDING ELECTRIC MATERIALS BID TO TURTLE AND HUGHES IN THE AMOUNT OF $27,805.57 AND IRBY UTILITIES IN THE AMOUNT OF $39,421.87 WHEREAS, the Borough of Madison publicly advertised for bids for the purchase of Electric Department materials in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, two (2) bids were received for various electric materials for the Electric Department; and WHEREAS, the Electric Utility Superintendent, Qualified Purchasing Agent and Borough Attorney have recommended that the Borough Council award a contract for certain electric materials for the Electric Department to Turtle and Hughes in the amount of $27,805.57, and Irby Utilities in the amount of $39,421.87; and PAGE 7 OF 13 Regular Meeting Minutes – December 10, 2018 WHEREAS, the Chief Financial Officer has attested that funds will be available in an amount not to exceed $80,000.00 for this purpose, in Electric Utility Operations Account 502, sub-account 315. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The contract for the purchase of certain electric materials for the Electric Department is hereby awarded to each of the following: Turtle and Hughes in the amount of $27,805.57, and Irby Utilities in the amount of $39,421.87. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to enter into contracts with Turtle and Hughes and Irby Utilities, in a form acceptable to the Borough Attorney. R 319-2018 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING CHRIS MAHON TO THE POSITION OF SKI PROGRAM COORDINATOR BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey that Chris Mahon is hereby appointed to the part-time position of Ski Program Coordinator, effective December 11, 2018, at the rate of $24.00 per hour, with no benefits. R 321-2018 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PURCHASE OF A CONSTRUCTION DEPARTMENT VEHICLE UNDER NEW JERSEY STATE CONTRACT NUMBER T2100/88727 WHEREAS, the Borough of Madison desires to award a contract for the purchase of a Construction Department vehicle under the New Jersey State Contract program; and WHEREAS, the purchase of goods and services by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Beyer Ford, 31 Williams Parkway, 175 Route 10, East Hanover, New Jersey, 07936 has been awarded New Jersey State Contract number T2100/A88727; and WHEREAS, the Construction Code Official and Qualified Purchasing Agent have recommended that the Borough Council utilize this contract for purchase of a Construction Department vehicle as follows; under contract T2100/A88727, one pickup truck and accessories in the amount of $44,925.50; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $44,925.50 for this purpose, which funds are available in the Construction Department Operating budget. PAGE 8 OF 13 Regular Meeting Minutes – December 10, 2018 NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract for the purchase of a Construction Department vehicle and accessories, for $44,925.50 is hereby approved. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Beyer Ford, 31 Williams Parkway, East Hanover, New Jersey, 07936, for the purchase of a Construction Department vehicle and accessories at a total price not to exceed $44,925.50, in a form acceptable to the Borough Attorney. R 322-2018 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SUBMISSION OF A SUSTAINABLE JERSEY GRANT WHEREAS, a sustainable community seeks to optimize quality of life for its residents by ensuring that its environmental, economic, and social objectives are balanced and mutually supportive; and WHEREAS, the Borough of Madison strives to save tax dollars, assure clean land, air and water, improve working and living environments; and WHEREAS, the Borough of Madison is participating in the Sustainable Jersey Program; and WHEREAS, one of the purposes of the Sustainable Jersey Program is to provide resources to municipalities to make progress on sustainability issues, and they have created the Sustainable Jersey Small Grants Program for this purpose. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Borough of Madison should apply for the aforementioned Grant. BE IT FURTHER RESOLVED that the Borough Council of the Borough of Madison, State of New Jersey, hereby authorizes the submission of the aforementioned Sustainable Jersey Grant in the amount of $20,000.00, contingent upon approval of the grant application by the Borough Administrator. R 323-2018 RESOLUTION OF THE BOROUGH OF MADISON CONFIRMING FINAL PAYMENT AND CHANGE ORDER #7 TO JTG CONSTRUCTION, INC. FOR THE PLAIN STREET RECONSTRUCTION PROJECT WHEREAS, the Assistant Borough Engineer has advised the Council that changes in project striping and release of held retainage during the Plain Street Reconstruction project have generated this payment obligation; and PAGE 9 OF 13 Regular Meeting Minutes – December 10, 2018 WHEREAS, the Assistant Borough Engineer has recommended that based on said change order, the base contract with JTG Construction, Inc. shall be increased by (6.26%) which results in no additional appropriation being needed; and WHEREAS, the Council wishes to authorize disbursement for Final Payment and Change Order #7 in the cumulative amount of $6,925.93; and WHEREAS, the Chief Financial Officer has confirmed that adequate funds for this purpose are contained in Ordinance 1-2018 and Ordinance 18-2018. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that payment in the amount of $6,925.93 to JTG Construction, Inc. for the Plain Street Reconstruction project is approved. R 324-2018 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AN EXTENSION OF THE NON-DISCLOSURE AGREEMENT WITH TANGENT ENERGY SOLUTIONS FOR A POSSIBLE ELECTRIC ENERGY GENERATION PROJECT WHEREAS, the Borough of Madison (“Borough”) entered into a non- disclosure agreement with Tangent Energy Solutions for a possible electric energy generation project on January 17, 2018; and WHEREAS, the Borough Administrator and Assistant Borough Administrator/Chief Financial Officer recommend extending the term of the agreement; and WHEREAS, the Borough would like to extend the agreement for an additional one (1) year period, as noted in the agreement. NOW THEREFORE BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris that the non-disclosure agreement with Tangent Energy Solutions is hereby extended for a one (1) year term. R 325-2018 RESOLUTION OF THE BOROUGH OF MADISON CANCELING COMPLETED CAPITAL IMPROVEMENT ORDINANCES WHEREAS, the Chief Financial Officer has reviewed a list of open capital projects and has determined that certain capital projects have been completed and the improvement authorization accounts should be closed; and WHEREAS, the Chief Financial Officer has recommended that the Council adopt a Resolution canceling the open dollar balances in such completed projects; and PAGE 10 OF 13 Regular Meeting Minutes – December 10, 2018 WHEREAS, the Borough Council has determined to make such cancellation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the list of open capital ordinances annexed hereto are hereby cancelled. R 326-2018 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE SALE OF SURPLUS PERSONAL PROPERTY NO LONGER NEEDED FOR PUBLIC USE ON AN ONLINE AUCTION WEBSITE WHEREAS, the Borough of Madison has determined that the property described on Schedule A attached hereto and incorporated herein is no longer needed for public use; and WHEREAS, the Local Unit Electronic Technology Pilot Program and Study Act (P.L. 2001, c.30) authorizes the sale of surplus property no longer needed for public use through the use of an online auction service; and WHEREAS, the Borough of Madison intends to utilize the online auction services of GovDeals.com; and NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Borough is hereby authorized to sell the surplus personal property as indicated on Schedule A on an online auction website entitled GovDeals.com; and BE IT FURTHER RESOLVED that the terms and conditions of the agreement entered into between GovDeals.com and the Borough of Madison are available at GovDeals.com and in the Borough Clerk’s office; and BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded by the Borough Clerk to the State of New Jersey Division of Local Government Services. R 327-2018 RESOLUTION OF THE BOROUGH OF MADISON RATIFYING APPOINTMENT OF JAMES DATTILO AS an INTERN IN THE FINANCE AND ELECTRIC UTILITY DEPARTMENTS WHEREAS, the Assistant Borough Administrator/CFO has recommended the appointment of student James Dattilo, as a part-time unpaid Intern in the Finance and Electric Utility Departments; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the appointment of PAGE 11 OF 13 Regular Meeting Minutes – December 10, 2018 James Dattilo, as a part-time unpaid Intern in the Finance and Electric Utility Departments, is hereby approved. Mr. Rowe moved adoption of Resolution 320-2018 listed on the Consent Agenda. Mrs. Vitale seconded the motion. Ms. Byrne raised concern regarding the proposed plans for renovation to apartments on John Street. Mr. Codey noted that the grant application can be approved and specific renovation plans discussed with Housing Director Louis Riccio at a later date. There was no further Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe, Ms. Byrne, Mr. Hoover Nays: None R 320-2018 RESOLUTION OF THE BOROUGH OF MADISON ENDORSING HOME APPLICATION TO MORRIS COUNTY COMMUNITY DEVELOPMENT AND APPROVING RELEASE OF FUNDS FROM THE AFFORDABLE HOUSING TRUST FUND UP TO $100,000.00 WHEREAS, the Madison Affordable Housing Corporation is submitting a HOME application to Morris County Community Development for $400,000.00 in grant funding under the Home Investments Partnership Program for the rehabilitation of two (2) four bedroom affordable housing units on John Avenue into four (4) two bedroom units; and WHEREAS, the Madison Affordable Housing Corporation requests that the Council authorize the Mayor to sign the grant application to confirm the Borough Council discussed this application at a public meeting; and WHEREAS, this matter has been considered at the Regular Public Meeting of the Borough Council on December 10, 2018; and WHEREAS, the Affordable Housing Administrator/Municipal Housing Liaison has requested the release of up to $100,000.00, on a reimbursement basis, from the Affordable Housing Trust Fund (AHTF) for the rehabilitation two (2) four-bedroom units on John Avenue into four (4) two bedroom units; and WHEREAS, the Affordable Housing Administrator/Municipal Housing Liaison has advised the Borough that the funds from the Affordable Housing Trust Fund will be used in accordance with the prior rules and regulations promulgated by the Council On Affordable Housing (“COAH”) for the development of affordable housing; and WHEREAS, the rehabilitated units shall be eligible for maximum COAH credits; and WHEREAS, the property will be Deed-restricted for a minimum period of thirty (30) years for affordable housing with the Borough having the option to require the extension of the restriction period for an additional period after thirty (30) years; and WHEREAS, all funds disbursed from the AHTF will be on a reimbursement basis for the scope of the work approved by the Borough, satisfactorily completed and paid for by the Madison Affordable Housing Corporation. PAGE 12 OF 13 Regular Meeting Minutes – December 10, 2018 NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris and State of New Jersey, that the Borough of Madison supports and endorses the above-described HOME application to Morris County Community Development by the Madison Affordable Housing Corporation., and the Mayor is authorized to sign the application on behalf of the Borough of Madison and that up to $100,000.00 from the Affordable Housing Trust Fund be disbursed on a reimbursement basis for the purposes requested herein, to be used in accordance with the prior rules and regulations promulgated by COAH in accordance with the Borough’s approved spending plan.
