MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON December 9, 2019 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 9th day of December, 2019. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2019. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. The Pledge of Allegiance was recited by all. APPROVAL OF MINUTES Ms. Baillie moved approval of the Regular Meeting Minutes of October 28, 2019. Mr. Rowe seconded the motion, which passed a unanimous voice call vote recorded. Ms. Baillie moved approval of the Executive Minutes of November 13, 2019. Mr. Rowe seconded the motion, which passed a unanimous voice call vote recorded. Ms. Baillie moved approval of the Regular Meeting Minutes of November 13, 2019. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley noted a second December meeting of the Council to be held on December 19th at 6:00 p.m. Mayor Conley also announced that the 2020 Reorganization meeting will be held on Sunday, January 5th, with Governor Phil Murphy administrating the oaths of office. Mayor Conley noted the enormous turnout for the November 29th Holiday Parade and Tree Lighting, thanking Carmen and Marie Toto and all the volunteers that make it happen. Mayor Conley presented a proclamation to resident and business owner John Caparoso “Johnny Cap” on the 50th Anniversary of the Esquire Barber Shop. Employee of the Month for December: PAGE 2 OF 42 Regular Meeting Minutes – December 9, 2019 P.O. Michael Clancy of the Madison Police Department has been selected as the Employee of the Month for December for stopping to help a stranded motorist in the Madison High School parking lot at 10:00 p.m. and changing a flat tire. Anniversary for the Month for December: Marlene Dolan of the Health Department – 25th Anniversary on December 20th. PROCLAMATION: Mayor Conley presented a Radon Awareness Month- January 2020 Proclamation to Health Officer Michael Fitzpatrick. Proclamation of the Borough of Madison Proclaiming Radon Awareness Month January 2020 WHEREAS, elevated radon gas within homes has been identified as a significant Public Health concern; and WHEREAS, radon is a naturally occurring radioactive gas that is the second leading cause of lung cancer, causing as many as 500 lung cancer deaths annually in New Jersey; and WHEREAS, elevated radon levels are found in one in fifteen homes across the United States and pose a serious health threat to families residing in these homes; and WHEREAS, any home may have high levels of radon, even if neighboring homes do not; and WHEREAS, radon testing is easy and inexpensive, and elevated levels of radon can be effectively reduced at the cost of a typical home repair; and WHEREAS, a measurable number of homes in Madison are likely to have elevated levels of radon; and WHEREAS, if all New Jersey homes with radon concentrations at or above 4 pCi/L were mitigated, about 83 lives could be saved this year. NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim the month of January 2020 as Radon Awareness Month and call upon all residents who have not yet done so to test their homes for radon and to reduce radon levels if elevated levels are found to protect their families from the serious health risk of radon. Conley, Mayor December 9, 2019 REPORTS OF COMMITTEES Public Safety Ms. Baillie, Chair of the Committee, made the following comments: Ms. Baillie announced that both active duty Madison Police Officers are safely back in the United States after serving the nation abroad. Ptl. Kyle McDermott who was deployed to Helmand Providence Afghanistan will be returning back to work in the weeks to come, and Cpl. Sean McCarthy, who was serving in Africa, will also be returning to work in the near future. Madison Police would like to alert residents about a US Postal Service insurance fraud scam. Residents may receive a package with another person's name on it at their address. The mail may be a package containing blank index cards or another items of no value. Within a few days, a letter from the US Postal Service Domestic Claims Accounts Payable Branch will arrive containing instructions for processing a lost or damaged article claim, and reference an "Article Number" which will match the tracking number on the previously received package. The US Postal Inspector Service advises that this is an insurance fraud scam they are familiar with. The scammer will purchase insurance for a package with minimal value (i.e. index cards), then mail it to a random address with the intent of filing a false "lost article" claim. Please contact Postal authorities if you receive such a package. The Madison Police Department has received federal funding in the amount of $3,018.04 for the replacement of body armor. The Fire Department reports 41 general alarms, 8 still alarms, 25 investigations, 28 EMS calls, for a total of 112 calls in the month of November. Ms. Baillie also noted several project requests received by the Open Space, Recreation and Historic Preservation Advisory Committee for the coming year including restoration of the Hartley Dodge Memorial Plaza and East Wing, an additional turf field at the Madison High School facility, playgrounds and trails at the Madison recreation Complex. Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: Mrs. Vitale noted the introduction of a Bond Ordinance for improvements at the Madison Chatham Joint Meeting, listed on tonight’s agenda, with a hearing scheduled for December 19th. The 2020 Road Improvements presentation will also take place this evening, as well as Cancellation of Capital Ordinances. Utilities Mr. Rowe, Chair of the Committee, made the following comments: The Water Department closed the valve at the Rosedale Skating Rink that retains the water for winter skating. The valve was closed early this year in hopes that Mother Nature will help fill the rink instead of using drinking water to fill, and at this time it is about half full, with another couple of rains it should be full by the time it is cold enough to freeze. It takes about 275,000 gallons to 300,000 gallons of water to fill the rink, which is equivalent to about one-half of one of our water tanks. PAGE 4 OF 42 Regular Meeting Minutes – December 9, 2019 Public Works and Engineering Ms. Byrne, Chair of the Committee, made the following comments: Ms. Byrne noted a public information meeting regarding reconstruction of Burnet Road held earlier this evening. The Department of Public Works continues leaf and snow removal. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: Mr. Hoover noted that the Rotary Club of Madison has Christmas trees for sale at Dodge field. The Senior Citizens Advisory Committee is recruiting volunteers for the telephone reassurance program. Meals on Wheels program, along with two area churches is working on identifying residents for the telephone reassurance program. Congresswoman Mikie Sherrill’s office case workers team is working on reducing tax payments for Disabled Veterans regarding their disability payments. Mr. Hoover reminds residents that there are two dates left for the Holiday Market at the Madison Community Arts Center. The Chamber of Commerce has Holiday Ornaments available at $20 each, featuring the Museum of Early Trades & Crafts. The search for Rosie the Rose City Reindeer Scavenger Hunt began on Saturday, November 30th and ends on Monday, December 16th. The Recreation Advisory Committee is finalizing schedules for spring and summer sports. Anyone interested in field rentals should contact Recreation Director Zach Ellis. Health Ms. Coen, Chair of the Committee, made the following comments: Ms. Coen noted that residents are still able to obtain flu vaccines at the Health Department. Please call for more information. Ms. Coen congratulated Public Health Nursing Supervisor, Marlene Dolan on reaching her 25th anniversary with the Borough. Pet licensing is underway for 2020, residents should look for renewals in the next few weeks. Registrar and Board of Health Secretary Joanne Grillo is retiring this week. Ms. Coen thanked her for her service to the residents of the Borough of Madison and her professionalism and dedication. Radon Awareness Month is in January, and the Mayor and Council will be presenting a proclamation this evening. Radon testing kits are available from the Health Department free of charge. COMMUNICATIONS AND PETITIONS- None INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. PAGE 5 OF 42 Regular Meeting Minutes – December 9, 2019 Cassandra Sherman, Myrtle Avenue; raised concern regarding proposed road reconstruction on Burnet Road and the impact to surrounding streets. Ms. Sherman asked that sidewalks be extended on Myrtle Avenue. Since no other member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 12/09/2019-1 MADISON CHATHAM JOINT MEETING FINANCING/ BOND ORDINANCE Mr. Codey explained a bond to authorize debt and appropriate funds as recommended for additional funding for major renovation at the Madison Chatham Joint Meeting, noting introduction this evening of an ordinance for $ 1,272,000 for a portion of the funds needed. The proposed hearing and adoption will be held at the December 19th Special Council meeting. Ordinance 56-2019 is listed for Introduction. 12/09/2019-2 AFFORDABLE HOUSING UPDATE Mayor Conley provided an update on Affordable Housing litigation noting the Borough continues working toward an agreement and that immunity from builder’s remedy is still in place. Mayor Conley noted a compliance hearing with Judge Michael C. Gaus to be held January 10th and listed on tonight’s agenda is a resolution to authorize recording of deed restrictions on several affordable housing properties. Additional updates will be provided as litigation advances. Resolution 342-2019 is listed on the Consent Agenda. 12/09/2019-3 MAYOR AND COUNCIL BYLAWS Mrs. Vitale noted that the committee convened by Mayor Conley to work on the boards and committees has suggested minor changes to the Council Bylaws regarding liaison assignments. A resolution with proposed changes will be listed on the next Council meeting consent agenda. 12/09/2019-4 CAPITAL ORDINANCE CANCELLATIONS Mr. Codey explained the administrative process for cancellation of Capital Ordinances completed an annual basis. Resolution 349-2019 is listed on the Consent Agenda. 12/09/2019-5 2020 CAPITAL BUDGET PLAN FOR ROAD RECONSTRUCTION, MILLING AND OVERLAY Borough Engineer Robert Vogel provided an overview of road improvement and milling and overlay projects proposed for 2020, noting an early start to the bidding process, so that construction can begin early in the year. Mr. Vogel noted reconstruction of Glenwild Road, Glenwild Circle and Albright Circle, Beverly and Burnet Roads. Milling and overlay is planned on several Borough roadways. Appropriation ordinances will be introduced at the first Council meeting in January. PAGE 6 OF 42 Regular Meeting Minutes – December 9, 2019 12/09/2019-6 BOROUGH MASTER PLAN Ms. Baillie explained the need to prepare a new Master Plan for the Borough, noting the current Master Plan was written in 1992. Ms. Baillie explained that the cost of $135,500.00 will be funded over three budget years. Resolution 347-2019 is listed on Consent Agenda. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on November 25, 2019, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 53-2019 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 136, OF THE CODE OF THE BOROUGH OF MADISON ENTITLED “PARKS,” REGARDING USER FEES FOR BOROUGH RECREATION PROGRAMS WHEREAS, the Recreation Director, in consultation with the Recreation Advisory Committee, has recommended amending Sections 136-36(D) and (E) of the Borough Code entitled “Fees”; and WHEREAS, the Borough Council is in agreement with said recommendation. NOW, THEREFORE, BE IT ORDAINED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey as follows: Section 1: Sections 136-36(D) and (E) of the Borough Code entitled “Fees” are hereby amended as follows: (D) There shall be a $25 user fee per player per season for the use of the Madison Recreation Complex Fields 1 and 2 ("turf fields") by the following recreation and/or travel sports programs, which are recognized by the Borough Recreation Department: boys and girls’ soccer, boys and girls’ lacrosse, girls field hockey, girls softball, boys football, boys Little League Baseball, and any other sports that use fields for scheduled practices or games as determined by the Recreation Director. PAGE 7 OF 42 Regular Meeting Minutes – December 9, 2019 (E)There shall be a user fee of $40 per player per sport per season for any nonresident participant in any Borough recreation program that uses Borough fields; however, the Administrator, with the advice of the Recreation Director, may reduce this rate to $25 per player per sport, provided the nonresident's municipality offers field space or other meaningful enhancement to the Borough recreation program. Section 2: This Ordinance shall take effect for the Spring 2020 season as provided by law. Mayor Conley opened up the public hearing on Ordinance 53-2019. Since no member of the public wished to be heard, the public hearing was closed. Mr. Hoover moved that Ordinance 53-2019, which was read by title, be finally adopted. Ms. Coen seconded the motion. ORDINANCE 54-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $363,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR FACILITY IMPROVEMENTS TO DODGE FIELD WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to construct a new multi-purpose bathroom/storage building at Dodge Field; and WHEREAS, the Borough Council has determined that the Borough should appropriate $363,000.00 from the Open Space Trust Fund for this purpose; and WHEREAS, the Open Space Advisory Committee has unanimously recommended the full funding of this request; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $363,000.00 for this purpose in the Open Space Trust Fund. PAGE 8 OF 42 Regular Meeting Minutes – December 9, 2019 NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $363,000.00 is hereby appropriated from the Open Space Trust Fund towards the cost of construction of a new multi-purpose bathroom/storage building at Dodge Field. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 54-2019. Since no member of the public wished to be heard, the public hearing was closed. Ms. Baillie moved that Ordinance 54-2019, which was read by title, be finally adopted. Mr. Rowe seconded the motion. ORDINANCE 55-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $85,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR ADDITIONAL REMEDIATION TESTING AT THE REAR OF THE HARTLEY DODGE MEMORIAL WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to conduct additional remediation testing at the rear of the Hartley Dodge Memorial; and WHEREAS, the Borough Council has determined that the Borough should appropriate $85,000.00 from the General Capital Improvement Fund for this purpose; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $85,000.00 for this purpose. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 56-2019 BOND ORDINANCE TO APPROPRIATE AN ADDITIONAL SUM OF $1,272,000 FOR THE FUNDING OF A PORTION OF THE COST OF THE IMPROVEMENT OF THE MADISON-CHATHAM JOINT MEETING'S MOLITOR WATER POLLUTION CONTROL FACILITY BY AND FOR THE BOROUGH OF MADISON, IN THE COUNTY OF MORRIS, STATE OF NEW PAGE 10 OF 42 Regular Meeting Minutes – December 9, 2019 JERSEY, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH ADDITIONAL APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS WHEREAS, the Borough of Madison, in the County of Morris, State of New Jersey (the "Borough"), and the Borough of Chatham, in the County of Morris, State of New Jersey, jointly operate a sanitary sewerage treatment system as members of the Madison-Chatham Joint Meeting (the "Joint Meeting"), with each municipality being financially responsible for a proportionate share of the cost and debt service for the improvement hereinafter described – Madison's share being 63.6% and Chatham's being 36.4%; and WHEREAS, the Borough Council of the Borough has heretofore authorized and provided for financing the improvement of the Molitor Water Pollution Control Facility located in the Borough of Chatham and owned and operated by the Joint Meeting and appropriated the sum of $4,770,000 therefor (with Chatham funding $2,730,000 of the $7,500,000 total original estimated project costs) pursuant to ordinance no. 50-2018 adopted by the Borough Council of the Borough on November 26, 2018; and WHEREAS, the Borough Council now finds and determines that the additional sum of $1,272,000 of the total additional estimated project costs of $2,000,000 (with Chatham funding the $728,000 balance) is required to be funded for such improvement; and WHEREAS, the Joint Meeting has heretofore authorized the filing of a loan application for the financing of allowable costs of the aforesaid project PAGE 11 OF 42 Regular Meeting Minutes – December 9, 2019 with the New Jersey Environmental Infrastructure Financing Program (the "State Program"); NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Madison, in the County of Morris, State of New Jersey, as follows: Section 1. The additional sum of $1,272,000 is hereby appropriated to the payment of the Borough's share of the cost of the improvement (the "purpose") authorized by ordinance no. 50-2018 adopted by the Borough Council of the Borough on November 26, 2018 (the "Prior Ordinance"). Said additional appropriation shall be met from the proceeds of the sale of the bonds authorized by this ordinance. No down payment is required pursuant to the provisions of N.J.S.A. 40A:2- 11(c) because this ordinance involves an environmental infrastructure project to be funded by loans pursuant to the State Program. Any of said loan funds received shall be applied as set forth in Section 8 hereof. Said improvement has been and shall be made as a general improvement and no part of the cost thereof has been nor shall be assessed against property specially benefited. Section 2. It is hereby determined and stated that (1) the making of such improvement is not a current expense of the Borough, and (2) it is necessary to finance said purpose by the issuance of obligations of the Borough pursuant to the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond Law"), and (3) the estimated cost of said purpose is $6,042,000, including the sum of $4,770,000 appropriated by the Prior Ordinance and the PAGE 12 OF 42 Regular Meeting Minutes – December 9, 2019 $1,272,000 appropriated by this ordinance, and (4) the estimated maximum amount of bonds or notes necessary to be issued for said purpose is $6,042,000, including the $4,770,000 authorized by the Prior Ordinance and the $1,272,000 hereinafter authorized, and (5) the cost of such purpose includes the aggregate amount of $959,600, including the sum of $896,000 stated in the Prior Ordinance and the sum of $63,600 hereby stated, which is estimated to be necessary to finance the cost of such purpose, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law. Section 3. To finance said purpose, bonds of the Borough of an aggregate principal amount not exceeding $1,272,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted. Section 4. To finance said purpose, bond anticipation notes of the Borough of an aggregate principal amount not exceeding $1,272,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be PAGE 13 OF 42 Regular Meeting Minutes – December 9, 2019 issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 5. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law, and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of the Borough and attested by the Borough Clerk or Deputy Borough Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance, and also the power to sell said notes, is hereby delegated to the Chief Financial Officer, who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the Borough Clerk of the Borough, and that such statement so filed shows that the gross debt of the Borough, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $1,272,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 8. Any funds received from private parties, the County of Morris, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purpose (except any funds received as loans from the State Program, which shall be applied to the payment of the cost of such purpose or to the payment of any outstanding bond anticipation notes, but shall not reduce the amount of bonds authorized for such purpose), shall be applied to the payment of the cost of such purpose, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purpose shall be reduced accordingly. If the Borough or the Joint Meeting incurs such costs prior to the issuance of such bonds or notes, the Borough hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this ordinance. Section 11. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the Borough, and the Borough shall levy ad valorem taxes upon all the taxable real property within the Borough for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. In the event that the Mayor fails to make a PAGE 28 OF 42 Regular Meeting Minutes – December 9, 2019 nomination at least 15 days prior to the date of the second regular public meeting of the Council after a position becomes vacant or the Borough Council fails to confirm a nomination, then the appointment shall be made by the Borough Council by the vote of a majority of the members present at the meeting, provided that at least three affirmative votes shall be required, with the Mayor to have no vote thereon except in the case of a tie. § 136-38(8) Reporting responsibilities. I. A Parks Management plan shall be created and updated every five (5) years, in order to plan routine maintenance and phase in special projects. J. The Committee shall submit an annual report to Mayor and Council. § 136-38(9) Conflict of interest. K. Disclosure of interest. No Committee member shall have or shall acquire any interest, direct or indirect, personal or financial, in any project which the Committee is promoting or in any contract or proposed contract for materials or services or in any lease, mortgage, sale or contract of any nature whatsoever relating to any such project or to the Committee without forthwith making written disclosure to the Committee of the nature and extent of the interest. Such disclosure shall be entered in writing upon the minutes of the Committee. L. Voting. No Committee member having an interest as described herein shall vote on matters directly relating to such interest. Section 2. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance, which shall otherwise remain in full force and effect. Section 3. REPEALER. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. Section 4. EFFECTIVE DATE. R 336-2019 RESOLUTION OF THE BOROUGH OF MADISON RECOGNIZING THE GOVERNOR’S COUNCIL ON ALCOHOLISM AND DRUG ABUSE FISCAL GRANT CYCLE JULY 2020 TO JUNE 2025 WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse established the Municipal Alliances for the Prevention of Alcoholism and Drug Abuse in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent alcoholism and drug abuse in communities throughout New Jersey. WHEREAS, the Borough Council of the Borough of Madison, County of Morris, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and, WHEREAS, the Madison Borough Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and, WHEREAS, the Madison Borough Council has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Morris; NOW, THEREFORE, BE IT RESOLVED by the Borough of Madison, County of Morris, State of New Jersey hereby recognizes the following: 1. PAGE 40 OF 42 Regular Meeting Minutes – December 9, 2019 R 349-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PURCHASE OF A BUILDING DEPARTMENT VEHICLE UNDER EDUCATIONAL SERVICES COMMISSION OF NJ ESC CO-OP#65MCESCCPS - ESCNJ 17/18-44 WHEREAS, the Borough of Madison desires to award a contract for the purchase of a Building Department vehicle under the New Jersey State Contract program; and WHEREAS, the purchase of goods and services by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Beyer Ford, 170 Ridgedale Avenue Morristown, New Jersey, 07960 has been awarded Educational Services Commission of NJ ESC Co- op#65MCESCCPS - ESCNJ 17/18-44; and WHEREAS, the Building Code Offical and Qualified Purchasing Agent have recommended that the Borough Council utilize this contract for purchase of a Building Department vehicle as follows; under contract NJ ESC Co- op#65MCESCCPS - ESCNJ 17/18-44, one pickup truck and accessories in the amount of $42,810.81; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $42,810.81 for this purpose, which funds are available in the Building Department Operating budget. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract for the purchase of a Building Department vehicle and accessories, for $42,810.81 is hereby approved. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Beyer Ford, 170 Ridgedale Avenue, Morristown, New Jersey, 07960, for the purchase of a Building Department vehicle and accessories at a total price not to exceed $42,810.81, in a form acceptable to the Borough Attorney. UNFINISHED BUSINESS - None APPROVAL OF VOUCHERS On motion by Ms. Baillie, seconded by Mrs. Vitale and carried, the following vouchers of the Borough of Madison were approved for payment, and the PAGE 41 OF 42 Regular Meeting Minutes – December 9, 2019 supporting documentation of said vouchers was made part of the Supplemental Minute Book.
