MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 25, 2019 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 25th day of November, 2019. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2019. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. The Pledge of Allegiance was recited by all. APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley noted the retirement of Police Detective Paul Kosakowski. The Borough has once again received Silver Status from Sustainable Jersey. Mayor Coley thanked the members of the Sustainable Madison Advisory Committee. Mayor Conley noted that a Special Meeting of the Council will be held on Thursday, December 19, 2019 and the Reorganization meeting of the Borough Council will be held on Sunday, January 6, 2020 at 6:00 p.m. REPORTS OF COMMITTEES Public Safety Ms. Baillie, Chair of the Committee, no report. Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: The Finance Department has begun work on the 2020 municipal budget reviewing expenditure and revenues. At the next meeting of the Mayor and Council, a review of the proposed capital budget will be presented. Contracts for garbage and recycling materials will also be considered. Utilities Mr. Rowe, Chair of the Committee, made the following comments: The Electric Department has assisted the Department of Public Works with cutting and removing storm damaged trees and picking them up with our digger. Last Thursday, the Public Works Department hung 100 wreathes on the Victorian Lamp Posts in town in preparation for the holiday season. The Water Department is working on the Community Place project of installing a new 8” Water Main with a new Hydrant has been completed. Residents are reminded to shut down their irrigation/sprinkler systems and outside hose faucets for the winter. The Water Department assisted the Electric Department with the removal of the tree stump at 7 Toothe Place and assisted in the planting of a new tree. The residents graciously donated their 35-foot Blue Spruce to serve as the 2019 Madison Xmas Tree. Public Works and Engineering Ms. Byrne, Chair of the Committee, made the following comments: PAGE 2 OF 13 Regular Meeting Minutes – November 25, 2019 The Public Works Department continues to pick up leaves, the Parks Department Cut and weeded lawns and Maintained Parks cleanliness. The Engineering Department reports that Cifelli & Son Contracting completed sidewalk, curb and drainage improvements on Community Place and will be paving the road tomorrow, Tuesday November 26th prior to the Thanksgiving weekend. Solar crosswalk signs are being installed with the cooperation of DPW and the electric department this week. The Hartley Dodge Memorial Plaza Restoration REBID contract documents have been publicly advertised and are due December 12th. Madison Chatham Joint Meeting took bids for the capacity assurance / phosphorous reduction project. This Saturday is ‘Small Business Saturday’, please shop locally. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The Office of Business Development has assumed responsibility for parking permits. Please remember to apply for renewal of your permit before December 1st. The Museum of Early Trades and Crafts will hold a Holiday Arts Festival, Holiday Walk December 7th and 8th. Health Ms. Coen, Chair of the Committee, made the following comments: The Madison Health Department will hold a free rabies clinic on Saturday, December 7th from 10:00 a.m. until noon. Residents are reminded that influenza vaccines are still available. COMMUNICATIONS AND PETITIONS- None INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. AGENDA DISCUSSIONS 11/25/2019-1 YMCA PRESENTATION Diane Mann, President and CEO, of the Madison YMCA presented a report to the Borough Council regarding the Teen Programs and Services in Madison, noting the goals, participation statistics and costs of the program. Mayor Conley noted that with a better understanding of the services provided a flat fee will be considered during the 2020 municipal budgeting process. ADVERTISED HEARINGS Ordinance 53-2019 has a hearing scheduled for December 9, 2019. INVITATION FOR DISCUSSION (2 of 2) Mayor opened the meeting to the public for their opportunity to ask questions and make comments on any subject. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of December 9, 2019 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 54-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $363,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR FACILITY IMPROVEMENTS TO DODGE FIELD WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to construct a new multi-purpose bathroom/storage building at Dodge Field; and WHEREAS, the Borough Council has determined that the Borough should appropriate $363,000.00 from the Open Space Trust Fund for this purpose; and WHEREAS, the Open Space Advisory Committee has unanimously recommended the full funding of this request; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $363,000.00 for this purpose in the Open Space Trust Fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $363,000.00 is hereby appropriated from the Open Space Trust Fund towards the cost of construction of a new multi-purpose bathroom/storage building at Dodge Field. SECTION 2: This Ordinance shall take effect as provided by law. Ms. Baillie moved that Ordinance 54-2019, which the Borough Clerk read by title, be adopted. Mr. Rowe seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: PAGE 4 OF 13 Regular Meeting Minutes – November 25, 2019 Yeas: Mrs. Vitale, Ms. Baillie, Mr. Rowe, Ms. Byrne, Mr. Hoover, Ms. Coen Nays: None ORDINANCE 55-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $85,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR ADDITIONAL REMEDIATION TESTING AT THE REAR OF THE HARTLEY DODGE MEMORIAL WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to conduct additional remediation testing at the rear of the Hartley Dodge Memorial; and WHEREAS, the Borough Council has determined that the Borough should appropriate $85,000.00 from the General Capital Improvement Fund for this purpose; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $85,000.00 for this purpose. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $85,000.00 is hereby appropriated from the General Capital Improvement Fund for additional remediation testing at the rear of the Hartley Dodge Memorial. SECTION 2: This Ordinance shall take effect as provided by law. Ms. Baillie moved that Ordinance 55-2019, which the Borough Clerk read by title, be adopted. Mr. Rowe seconded the motion. FOR THREE YEARS WHEREAS, the Borough of Madison publicly advertised for bids for solid waste collection and disposal (the “Contract”) in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, the only bid was submitted by Suburban Disposal, Inc. in the amount of $1,442,000.00 for three years; and WHEREAS, the Qualified Purchasing Agent/Personnel Director has recommended that the Borough Council award the contract to Suburban Disposal, Inc. in the amount of $1,442,000.00 for three years; and WHEREAS, the Chief Financial Officer/Assistant Borough Administrator has attested that funds will be available in an amount not to exceed $1,442,000.00 for this purpose, contingent upon funding therefore in the 2020, 2021, and 2022 municipal budgets. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The contract for solid waste collection and disposal is hereby awarded to Suburban Disposal, Inc. based upon its bid in the amount of $1,442,000.00 for three years, contingent upon adequate funding therefor being available in the municipal budget for each year of the contract. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to enter into the contract with Suburban Disposal, Inc. in a form acceptable to the Borough Attorney. R 324-2019 RESOLUTION OF THE BOROUGH OF MADISON PERMITTING RESTAURANT-BARS AND TAVERNS TO REMAIN OPEN UNTIL 2:00 A.M. ON THURSDAY, NOVEMBER 28, 2019 WHEREAS, as part of the Thanksgiving Holiday Weekend, the Restaurant- Bars of Madison have requested permission to remain open on Wednesday, November 27, 2019, for the sale of alcoholic beverages for consumption on premises, until 2:00 A.M., Thursday, November 28, 2019; and PAGE 6 OF 13 Regular Meeting Minutes – November 25, 2019 WHEREAS, the Borough Code provides for a weekday closing time of 1:00 A.M.; NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that Restaurant-Bars and Taverns shall be permitted to remain open on Wednesday, November 27, 2019, for the sale of alcoholic beverages for consumption on premises, until 2:00 A.M., Thursday, November 28, 2019. R 325-2019 RESOLUTION OF THE BOROUGH OF MADISON AWARDING PROFESSIONAL SERVICES CONTRACT TO MIANECKI CONSULTING ENGINEERS FOR WETLAND PERMITTING AND ASSOCIATED ENGINEERING SERVICES WHEREAS, the Assistant Borough Engineer has recommended contracting with a licensed engineering and wetland consulting specialist for the preparation of a NJDEP permit application for construction of the Memorial Park Trails System (hereinafter the “Contract”); and WHEREAS, said services would constitute professional services for which a contract may be awarded without the need of competitive bidding pursuant to N.J.S.A. 40A:11-5; and WHEREAS, the Borough Administrator has recommended that the Borough Council award the Contract to Mianecki Consulting Engineers in the amount of $49,750.00 for Wetland Engineering Services; and WHEREAS, Mianecki Consulting Engineers, has submitted to the Borough Purchasing Agent the required documents to satisfy the requirements of N.J.S.A. 19:44A-20.5, since this matter may be awarded without competitive bidding; and WHEREAS, the Chief Financial Officer has attested that funds will be available in an amount not to exceed $49,750.00 for this purpose in Ordinance 52-2019. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The Mayor and Borough Clerk are hereby authorized to execute, on behalf of the Borough, a professional service contract with Mianecki Consulting Engineers for Wetland Specialist Engineering Services in an amount not to exceed $49,750.00, such contract to be in a form approved by the Borough Attorney. 2. The Borough Clerk is hereby directed to publish notice of the adoption of this resolution in the official newspaper of the Borough of Madison within ten (10) days of its adoption pursuant to N.J.S.A. 40A:11-5. PAGE 7 OF 13 Regular Meeting Minutes – November 25, 2019 R 326-2019 RESOLUTION OF THE BOROUGH OF MADISON AWARDING PROFESSIONAL SERVICES CONTRACT TO OMLAND & OSTERKORN CONSULTING ENGINEERS & SURVEYORS, LTD, IN AN AMOUNT NOT TO EXCEED $12,975.00 TO PROVIDE FIELD SURVEYS FOR RECONSTRUCTION OF VARIOUS ROADS WHEREAS, the Madison Borough Engineer has advised the Borough Council that professional design and engineering services are needed to prepare surveys for reconstruction of various roads in the 2021Capital budget; and WHEREAS, the Borough Engineer has recommended that Omland & Osterkorn Consulting Engineers & Surveyors, professional engineers, be awarded a professional contract for these services at a cost not to exceed $12,975.00, based on their written proposal dated November 12, 2019; and WHEREAS, said services would constitute professional services for which a contract may be awarded without the need for competitive bidding pursuant to N.J.S.A. 40A:11-5; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $12,975.00 for this purpose, in Ordinance 1-2019 or such other account designated by the Borough Chief Financial Officer. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey that the Mayor and Borough Clerk are hereby authorized to execute on behalf of the Borough a professional services contract with Omland & Osterkorn Consulting Engineers & Surveyors, in an amount not to exceed $12,975.00 to perform the design and engineering services to prepare surveys for reconstruction of various roads including all of the work to be done as set forth in the written proposal dated November 12, 2019 and provided such contract is in a form approved by the Borough Attorney. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough Clerk is hereby directed to publish notice of adoption of this resolution in the official newspaper of the Borough of Madison within ten (10) days of its adoption pursuant to N.J.S.A. 40A:11-5. R 327-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING REDUCTION OF SURETY AND CASH BOND TO UNIVERSITY MEADOWS- HARDING FOR CONSTRUCTION OF THE LOANTAKA TERRACE CUL-DE-SAC WHEREAS, the Assistant Borough Engineer has recommended that the surety bond ($122,320.80) and cash bond ($15,862.20) for University Meadows – PAGE 8 OF 13 Regular Meeting Minutes – November 25, 2019 Harding Homes be reduced in connection with site improvements completed on Loantaka Terrace; and WHEREAS, the Assistant Borough Engineer advises that compliance with approved site plans has been completed. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that reduction of the surety bond ($122,320.80) and cash bond ($15,862.20), including accrued interest, is hereby approved. R 328-2019 RESOLUTION OF THE BOROUGH OF MADISON CONFIRMING MEMBERSHIP OF JOHN W. DOWNS IN THE MADISON HOOK & LADDER COMPANY #1 WHEREAS, the Fire Chief has advised that John W. Downs was voted into the Madison Hook & Ladder Company #1 as a volunteer firefighter; and WHEREAS, Section 18-27 of the Madison Borough Code requires that each person so voted shall be confirmed as a member of such division by the Council of the Borough of Madison. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that John W. Downs is hereby confirmed as a member of the Madison Hook & Ladder Company #1 effective immediately. R 329-2019 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING WILLIAM DIMARTINO AND JOHN GIANCAMILLO TO THE POSITION OF SUBSTITUTE CROSSING GUARDS WHEREAS, the QPA/Personnel Director has recommended appointing William DiMartino and John Giancamillo to the position of Substitute Crossing Guard; and WHEREAS, the Chief Financial Officer has attested that funds are available for this purpose in the 2019 Police Department Budget # 240, Operating Account for Part-time Help # 130. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey that upon satisfactory completion of a background check William DiMartino and John Giancamillo are each appointed to the position of Substitute Crossing Guard for the Borough of Madison for the school year commencing upon the effective date of this resolution and PAGE 9 OF 13 Regular Meeting Minutes – November 25, 2019 ending June 15, 2020, unless the school year is extended due to winter weather closings BE IT FURTHER RESOLVED, that William DiMartino and John Giancamillo each be compensated in accordance with the Borough Resolution establishing the salaries for part-time, substitute school crossing guards. R 330-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE SALE OF SURPLUS PROPERTY OF THE BOROUGH AND OF THE MADISON PUBLIC LIBRARY NO LONGER NEEDED FOR PUBLIC USE ON AN ONLINE AUCTION WEBSITE WHEREAS, the Borough of Madison and the Madison Public Library have determined that surplus property on the attached schedule is no longer needed for public use; and WHEREAS, the Borough of Madison intends to utilize the online auction services of Municibid to auction the surplus property. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Borough is hereby authorized to sell the surplus property as indicated on an online auction website entitled Municibid.com; and BE IT FURTHER RESOLVED that the terms and conditions of the State Contract T-2581/Vendor ID V00018618 for online auction services is available in the Borough Clerk’s office; and BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded by the Borough Clerk to the State of New Jersey Division of Local Government Services. R 331-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A ROAD OPENING PERMIT TO ALLOW UTILITY CONNECTIONS FOR MINOR SUBDIVISION AT 36 LATHROP AVENUE WHEREAS, Chapter 166-23 of the Borough Code provides that following the construction of new pavement surface, no openings will be permitted for a period of five (5) years thereafter; and WHEREAS, Michael Savercool of The Trademark Company, LLC has requested that the Borough Council waive this requirement in order to permit lot 2 in block 4309 fronting on Lathrop Avenue to be connected for a minor subdivision; and WHEREAS, the Borough Council is agreeable to permitting the requested street opening in consideration of Mr. Savercool paying to the Borough the sum of $500.00 in consideration for the disturbance of the street prior to the expiration of PAGE 10 OF 13 Regular Meeting Minutes – November 25, 2019 the 5-year period and the Contractor shall abide by all regulations of Chapter 166 of the Borough Code, including paving the disturbed section curb to curb. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that Michael Savercool shall be granted a street opening permit for his property located on Lathrop Avenue in consideration of the payment to the Borough of $500.00 in addition to the customary fee for a street opening permit. R 332-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEMBERSHIP IN THE NATIONAL PURCHASING ALLIANCE (NCPA) COOPERATIVE PRICING COUNCIL WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration; and WHEREAS, the National Purchasing Alliance Cooperative Pricing Council has offered voluntary participation in a Cooperative Pricing System for purchase of goods and services. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey as follows: 1. This Resolution shall be known and may be cited as a National Purchasing Alliance Cooperative Pricing Council Purchasing Resolution of the Borough of Madison. 2. Pursuant to the provisions of N.J.S.A. 40A:11-11(5), the Mayor is hereby authorized to enter into a Cooperative Purchasing Agreement with the National Purchasing Alliance Cooperative Pricing Council. 3. The National Purchasing Alliance Cooperative Pricing Council shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the revised statutes of the State of New Jersey. 4. The Resolution shall take effect immediately upon passage. R 333-2019 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2019 WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available PAGE 11 OF 13 Regular Meeting Minutes – November 25, 2019 by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison will receive $9,427.74 from the State of NJ, Division of Highway Traffic Safety, Drunk Driving Enforcement Fund and wishes to amend its 2019 Budget to include this amount as revenue. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Madison in the County of Morris and State of New Jersey hereby requests the Director of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2019 in the sum of $9,427.74, which item is now available as a revenue from the state of N. J.
