MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 13, 2019 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 13th day of November, 2019. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2019. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. The Pledge of Allegiance was recited by all. APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley congratulated Ms. Byrne and Councilmember elect Rachel Ehrlich on their election to Council and thanked Mr. Rowe for his service on the Borough Council. Mayor Conley also noted that the National Weather Service (Mt. Holly) has determined that the municipality was impacted by an Enhanced Fujita 1 tornado with max wind speeds of 100 miles per hour, on the evening of October 31st. Mayor Conley thanked the staff of the Electric Utility and Public Works Department. EMPLOYEE OF THE MONTH FOR NOVEMBER: Lou Ammirato, Custodian for the Hartley Dodge Memorial, for his dedication and hard work cleaning and maintaining the Community Arts Center, as well as his assistance on Bottle Hill Day and with the storage of equipment for the Farmers Market. PROCLAMATION: Proclaiming November 2019 as Pancreatic Cancer Awareness Month Mayor Conley presented World Pancreatic Cancer Day Proclamation to Dennis Salko. Proclamation of the B o r o u g h o f M a d i s on Proclaiming World Pancreatic Cancer Day November 21, 2019 WHEREAS, in 2019, an estimated 55,400 people will be diagnosed with pancreatic cancer in the United States and 44,330 will die from the disease; and WHEREAS, pancreatic cancer is one of the deadliest cancers, is currently the third leading cause of cancer death in the United States and is projected to become the second leading cause around 2020; and WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate in the single digits, at just nine percent; and WHEREAS, when symptoms of pancreatic cancer present themselves, it is generally in later stages and only ten percent of pancreatic cancer patients are diagnosed when the disease is confined to their pancreas, and 91 percent of pancreatic cancer patients die within the first five years; and WHEREAS, approximately 1,290 deaths will occur in New Jersey in 2019; and WHEREAS, pancreatic cancer is the seventh most common cause of cancer-related death across the world; and WHEREAS, there will be an estimated 480,000 new pancreatic cancer cases diagnosed worldwide in 2020; and WHEREAS, the good health and well-being of the residents of Madison are enhanced as a direct result of increased awareness about the symptoms and risks of pancreatic cancer and research into early detection, causes and effective treatments; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim November 21, 2019 as World Pancreatic Cancer Day in the Borough of Madison. _____________________________ Robert H. Conley, Mayor November 13, 2019 REPORTS OF COMMITTEES Public Safety Ms. Baillie, Chair of the Committee, made the following comments: Ms. Baillie thank residents that have registered for the new emergency alert system, and encouraged resident to sign up. Ms. Baillie thanked all veterans who have sacrificed and served this great nation. We would especially like to honor our own two officers who are currently on active deployment; Cpl. Sean McCarthy badge#138 who is currently deployed as a part of Operation Enduring Freedom with the United States Army in Djibouti, Africa, and Ptl. Kyle McDermott badge#156 who is currently deployed in Helmand Providence in Afghanistan with the Fox Company, 2nd Battalion, 25th Marines, 4th Marine Division as a part of a security contingency. Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: Tonight, the CFO will discuss budget transfers and a new utility billing platform with InvoiceCloud. Veterans’ Day Ceremonies held this past Monday, were well attended, and thanked the members of the Patriotic Celebrations Committee. Utilities Mr. Rowe, Chair of the Committee, made the following comments: The Electric Department was able to quickly restore services to the areas devastated by the tornado, and noted that the permanent fixes will take the balance of 2019, if not longer to repair. The Water Department has been shutting down water services in our parks to prepare for the winter and they want to remind residents to shut down all outside water services including sprinkler systems. Please remove hoses from any outside faucet as water in the hose may freeze and damage the fixture even if the water is properly shut off. Public Works and Engineering Ms. Byrne, Chair of the Committee, absent Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: Mr. Hoover thanked the members of the Public Works and Electric Departments for their work with the storm clean up, as well as Michael Pellessier, Communications Director, for their effort during and after the storm. Reporting for Public Works and Engineering, Mr. Hoover noted that road reconstruction work continues on Community Place. Denville Line and Striping completed traffic calming measures and the Candlewood pump station emergency repairs continued last week with replacement of the second pump. The Hartley Dodge Memorial Plaza Restoration REBID contract documents will be publicly advertised and are due December 12th. The next meeting of the Senior Citizen Advisory Committee will be held November 14th. A cookie swap is scheduled for December 19th. Please join the Madison Downtown Development Commission to get our downtown ready for the holidays. On Saturday, November 16th at the Waverly Clock and the historic lamp posts will be wrapped with white lights. The office of Business Development has assumed responsibility for all Borough of Madison Parking Permits. Commuter Resident Parking Permit renewal applications have been sent to all current (2019) holders who will have until December 1st to complete the process. After this date remaining permits will be made available to those on the waiting list while available. Questions regarding parking can be sent to parking@rosenet.org. Merchant/Employee and Residential Tenant renewal applications will be sent before the end of this week. Madison High School Art students will be painting approximately 15 store windows for the holiday season. Painting will be complete by the Christmas parade. Rosie the Rose City Reindeer Scavenger Hunt will begin on Saturday, November 30th and end on Monday, December 16th. Mr. Hoover noted that the skating pond at Memorial Park will be flooded in early December. Health Ms. Coen, Chair of the Committee, made the following comments: The Madison Health Department will be sponsoring a Free Rabies Clinic on Saturday, December 7, 2019 from 10:00 a.m. – 12:00 noon at the public works garage at 34 John Avenue. There is a supply of flu vaccines still available. Residents who wish to be immunized should call the Health Department for an appointment. COMMUNICATIONS AND PETITIONS – None INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. AGENDA DISCUSSIONS 11/13/2019-1 2019 BUDGET TRANSFERS Mr. Burnet explained that N.J.S.A. 40A:4-58 permits the transfer of funds at year end and/or the beginning of the new year. Transfers are cash neutral as one budget appropriation line item is offset by a decrease in another line item. Vote must be by two-third majority of the Governing Body. Resolution 320-2019 is listed on the Consent Agenda. 11/13/2019-1 UTILITY BILLING PLATFORM Mr. Burnet provided information on a new utility billing platform noting a proposed contract with Invoice Cloud for an online billing platform, as the preferred provider for electric and water bills Mr. Burnet also noted the $3.95 fix fee to the user of a credit cards up to $350.00. ADVERTISED HEARINGS The Borough Clerk made the following statement: The ordinances scheduled for hearing were introduced by title and passed on first reading at regular meetings of the Council held on Wednesday, October 16, 2019 and Monday, October 28, 2019; were posted and filed according to law, and copies were made available to the general public requesting same. Mayor Conley calls up Ordinances for second reading and asks the Clerk to read said ordinances by title: ORDINANCE 49-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $140,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE CONSTRUCTION OF THE MADISON POLICE FIREARMS TRAINING FACILITY WHEREAS, the Police Chief has recommended that the Borough appropriate $140,000.00 from the General Capital Improvement Fund for the Police Department Firearms Training Facility; and WHEREAS, funds are available in the General Capital Improvement Fund and the availability of funds has been certified by the Chief Financial Officer; and WHEREAS, the Borough Council has determined that the Borough should appropriate $140,000.00 from the General Capital Improvement Fund for the Police Department Firearms Training Facility. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $140,000.00 is hereby appropriated from the General Capital Improvement Fund for the Police Department Firearms Training Facility. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 49-2019. Since no member of the public wished to be heard, the public hearing was closed. Ms. Baillie moved that Ordinance 49-2019, which was read by title, be finally adopted. Mr. Rowe seconded the motion. Ordinance 51-2019 – Item removed and the # Retired ORDINANCE 52-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $50,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR PROFESSIONAL SERVICES, NJDEP PERMITS AND TRAIL IMPROVEMENTS TO MEMORIAL PARK WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to construct a trail at Memorial Park; and WHEREAS, the Borough of Madison will be formally applying to the Morris County Trails Construction Grant Program for funding to develop a trail at Memorial Park; and WHEREAS, the Borough Council has determined that the Borough should appropriate $50,000.00 from the Open Space Trust Fund towards the match requirement for the construction of a trail at Memorial Park; and WHEREAS, the Open Space Advisory Committee has unanimously recommended the full funding of this request; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $50,000.00 for this purpose in the Open Space Trust Fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $50,000.00 is hereby appropriated from the Open Space Trust Fund towards the cost of professional services, NJDEP permits and construction of a fully handicap accessible trail at Memorial Park. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 52-2019. INTRODUCTION OF ORDINANCES The Borough Clerk made the following statement: Ordinances scheduled for first reading have a hearing date set for December 9, 2019; all will be published in the Madison Eagle, posted on the Bulletin Board and made available to members of the public requesting copies. Mayor Conley called up Ordinances for first reading and asked the Borough Clerk to read said ordinances by title: ORDINANCE 53-2019 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 136, OF THE CODE OF THE BOROUGH OF MADISON ENTITLED “PARKS,” REGARDING USER FEES FOR BOROUGH RECREATION PROGRAMS WHEREAS, the Recreation Director, in consultation with the Recreation Advisory Committee, has recommended amending Sections 136-36(D) and (E) of the Borough Code entitled “Fees”; and WHEREAS, the Borough Council is in agreement with said recommendation. NOW, THEREFORE, BE IT ORDAINED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey as follows: Section 1: Sections 136-36(D) and (E) of the Borough Code entitled “Fees” are hereby amended as follows: (D) There shall be a $25 user fee per player per season for the use of the Madison Recreation Complex Fields 1 and 2 ("turf fields”) by the following recreation and/or travel sports programs, which are recognized by the Borough Recreation Department: boys’ and girls’ soccer, boys’ and girls’ lacrosse, girls field hockey, girl’s softball, boys football, boys Little League Baseball, and any other sports that use fields for scheduled practices or games as determined by the Recreation Director. (E)There shall be a user fee of $40 per player per sport per season for any nonresident participant in any Borough recreation program that uses Borough fields; however, the Administrator, with the advice of the Recreation Director, may reduce this rate to $25 per player per sport, provided the nonresident's municipality offers field space or other meaningful enhancement to the Borough recreation program. Section 2: This Ordinance shall take effect for the Spring 2020 season as provided by law. Mr. Hoover moved that Ordinance 53-2019, which the Borough Clerk read by title, be adopted. MEDER, JR. TO THE POSITION OF PER DIEM DISPATCHER WHEREAS, the Chief of the Madison Police Department recommends the appointment of Thomas A. Meder, Jr. to the position of Per Diem Dispatcher; and WHEREAS, the Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that Thomas A. Meder, Jr. is hereby appointed to the position of Per Diem Dispatcher effective immediately; and BE IT FURTHER RESOLVED, that Thomas A. Meder, Jr. be compensated at the rate of $22.50 per hour. R 313-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AWARD OF CONTRACT TO ELT SYSTEMS GROUP FOR THE PURCHASE OF A CUSTOM STORAGE RACK SYSTEM FOR THE ELECTRIC DEPARTMENT BUTLER BUILDING WHEREAS, the Borough of Madison desires to award a contract for the purchase of a custom Storage Rack System for the Electric Department Butler Building; and WHEREAS, the Electric Utility Superintendent has recommended that the Borough award a contract for the purchase of a custom Storage Rack System in an amount not to exceed $16,008.60 to ELT Systems Group; and  WHEREAS, funds are available in Ordinance 40-2019 or in any other account that may be deemed appropriate by the Chief Financial Officer or his designee. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract for the purchase of a custom Storage Rack System for the Electric Department Butler Building is hereby awarded to ELT Systems Group at a total aggregate price not to exceed $16,008.60. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to ELT Systems Group for the purchase of a custom Storage Rack System for the Electric Department Butler Building at a total price not to exceed $16,008.60, in a form acceptable to the Borough Attorney. R 314- 2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AWARD OF CONTRACT TO EASTERN LIFT TRUCK COMPANY, INC. FOR THE PURCHASE OF A 6000LB NOMINAL CAPACITY LIFT TRUCK FOR THE ELECTRIC DEPARTMENT BUTLER BUILDING WHEREAS, the Borough of Madison desires to award a contract for the purchase of a 6000 lb Nominal Capacity Lift Truck for the Electric Department Butler Building; and WHEREAS, the Electric Utility Superintendent has recommended that the Borough award a contract for the purchase of a 6000 lb Nominal Capacity Lift Truck in an amount not to exceed $30,450.00 to Eastern Lift Truck Company, Inc.; and WHEREAS, funds are available in Ordinance 40-2019 or in any other account that may be deemed appropriate by the Chief Financial Officer or his designee. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract for the purchase of a 6000 lb Nominal Capacity Lift Truck for the Electric Department Butler Building is hereby awarded to Eastern Lift Truck Company, Inc. at a total aggregate price not to exceed $30,450.00. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Eastern Lift Truck Company, Inc. for the purchase of a 6000 lb Nominal Capacity Lift Truck for the Electric Department Butler Building at a total price not to exceed $30,450.00, in a form acceptable to the Borough Attorney. R 315-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING FINAL CHANGE ORDER REQUEST FROM JOMED CONTRACTING, INC., IN THE AMOUNT OF $41,867.89 BRINGING TOTAL AUTHORIZED FINAL PAYMENT TO $634,849.06 FOR THE 2019 ROAD IMPROVEMENT PROGRAM WHEREAS, a contract for the 2019 Road Reconstruction Program, in an amount not to exceed $592,981.17 was awarded to JoMed Contracting, Inc., of Elizabeth, New Jersey, by Resolution 119-2019; and WHEREAS, the Borough Engineer has recommended approval of a change order to the contract for field changes that were encountered during the construction and larger quantities under the unit pricing and final payment of $41,867.89 bringing the revised contract total to $634,849.06; and WHEREAS, the Borough Engineer has advised that the project has been completed and has recommended approval of the change order amending Resolution 120-2018 to JoMed Contracting, Inc. of Nutley, New Jersey in an additional amount of $41,867.89 so that final payment may be processed and the contract completed; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an additional amount not to exceed $41,867.89 for this purpose, which funds were appropriated by Ordinance 1-2019 in the amount of $1,068,000.00 and Ordinance 2-2019 in the amount of $880,000.00 and the existing ordinances contain sufficient funds to include this final payment and change order. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the final payment and change order request from JoMed Contracting, Inc. of Nutley, New Jersey, in the total amount not to exceed $634,849.06 for the 2019 Road Improvement Program is authorized. R 316-2019 RESOLUTION OF THE BOROUGH OF MADISON AWARDING PROFESSIONAL SERVICES CONTRACT TO OMLAND & OSTERKORN CONSULTING ENGINEERS & SURVEYORS, LTD, IN AN AMOUNT NOT TO EXCEED $19,950.00 FOR THE REDESIGN OF THE COOK AVENUE PARKING LOT WHEREAS, the Madison Borough Engineer has advised the Borough Council that professional design and engineering services are needed to prepare the redesign of the Cook Avenue Parking Lot; and WHEREAS, the Borough Engineer has recommended that Omland & Osterkorn Consulting Engineers & Surveyors, professional engineers, be awarded a professional contract for these services at a cost not to exceed $19,950.00, based on their written proposal; and WHEREAS, said services would constitute professional services for which a contract may be awarded without the need for competitive bidding pursuant to N.J.S.A. 40A:11-5; and  WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $19,950.00 for this purpose, in Ordinance 1-2019. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey that the Mayor and Borough Clerk are hereby authorized to execute on behalf of the Borough a professional services contract with Omland & Osterkorn Consulting Engineers & Surveyors, in an amount not to exceed $19,950.00, to redesign of the Cook Avenue Parking Lot as set forth in the written proposal referenced above and provided such contract is in a form approved by the Borough Attorney. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Borough Clerk is hereby directed to publish notice of adoption of this resolution in the official newspaper of the Borough of Madison within ten (10) days of its adoption pursuant to N.J.S.A. 40A:11-5. R 317-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXECUTION OF THE STATE HEALTH BENEFITS PROGRAM FOR 2020 WHEREAS, the Borough of Madison (“Borough”) wishes to offer employees health plans offered by the State Health Benefits Program; and WHEREAS, the QPA/Personnel Director, Borough Administrator and Assistant Borough Administrator /Chief Financial Officer recommend entering into an agreement. NOW THEREFORE BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris in the State of New Jersey that Linda Sawyer, QPA/Personnel Director is hereby authorized to execute the attached State Health Benefits resolution. R 318-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CHANGE ORDER REQUEST FROM CIFELLI & SON GENERAL CONTRACTING, INC., IN THE AMOUNT OF $1,500.00 AND FIRST PAYMENT FOR THE COMMUNITY PLACE RECONSTRUCTION PROJECT WHEREAS, a contract for the Reconstruction of Community Place, in an amount not to exceed $199,235.00 was awarded to Cifelli & Son, Inc., of Nutley, New Jersey, by Resolution 198-2019; and WHEREAS, the Assistant Borough Engineer has recommended approval of a change order to the contract for field changes that were encountered during construction for changes in the amount of $1,500.00 bringing the revised contract total to $200,735.00; and WHEREAS, the Chief Financial Officer has attested to the availability of funds for this purpose, which funds were appropriated by Ordinance 18-2018.  NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the first payment of $75,332.00and change order request of $ 1,500.00 from Cifelli & Son General Contracting, Inc. of Nutley, New Jersey, in the total amount not to exceed $76,832.00 for the Reconstruction of Community Place is authorized. R 319-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CHANGE ORDER REQUEST FROM DENVILLE LINE PAINTING, INC. IN THE AMOUNT OF $20,000.00 BRINGING TOTAL CONTRACT AMOUNT TO $45,000.00 FOR THE ROAD RESTRIPING IMPROVEMENT PROGRAM WHEREAS, a contract for the 2019 Road Improvement Program, in an amount not to exceed $25,000.00 was awarded to Denville Line Painting, Inc., of Rockaway, New Jersey; and WHEREAS, the Borough Engineer has recommended approval of a change order to the contract for field changes that were encountered during the construction and additional road striping of $20,000.00, bringing the revised contract total to $45,000.00; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an additional amount not to exceed $45,00.00 for this purpose, which funds were appropriated by Ordinance 1-2019 in the amount of $1,068,000.00 and a supplementary Ordinance 1-2017, which contain sufficient funds to include this change order. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the $20,000.00 change order request from Denville Line Painting, Inc. of Denville, New Jersey, in the total amount not to exceed $45,000.00 for the 2019 Road Improvement Program is authorized. R 320-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING 2019 BUDGET TRANSFERS WHEREAS, certain transfers of funds for various 2019 budget appropriations are necessary to cover anticipated expenditures; and WHEREAS, N.J.S.A. 40A:4-58 provides for transfer of appropriations with an excess over and above the amount deemed necessary to fulfill their purposes to those appropriations deemed to be insufficient; and WHEREAS, the appropriations subject to fund transfers hereby are not within those restricted by N.J.S.A. 40A:4-58 for transfer purposes. R 322-2019 RESOLUTION OF BOROUGH OF MADISON AUTHORIZING EXECUTION OF AN AGREEMENT WITH INVOICECLOUD FOR AN ONLINE UTILITY BILLING PLATFORM WHEREAS, the Chief Financial Officer/Assistant Borough Administrator has recommended the use of electronic payments for utility billing; and WHEREAS, the Borough Council wishes to authorize the use of electronic payments, including credit card payments through an online billing platform offer through InvoiceCloud.
