MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON October 28, 2019 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 28th day of October, 2019. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2019. Mrs. Vitale seconded the motion, which passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Ms. Byrne, Mr. Hoover, Ms. Coen Nays: None Absent: Mr. Rowe GREETINGS TO PUBLIC Cathie Coultas Volunteer Recognition PAGE 2 OF 12 Regular Meeting Minutes – October 28, 2019 Mayor Conley called forward resident and volunteer Cathie Coultas and presented the following Proclamation: Proclamation of the B o r o u g h o f M a d i s on Proclaiming CATHIE COULTAS Day October 28, 2019 WHEREAS, Cathie Coultas is a lifelong resident of the Borough of Madison and a graduate of Madison High School and Hood College; and WHEREAS, born into the prominent Ruzicka rose growing family, Cathie is a member of the Madison Garden Club and an award-winning member of the Garden Club of America; and WHEREAS, Cathie and her husband of sixty years, Bob Coultas, have been active members of the Rotary for many years with Cathie having served as recording secretary and youth exchange officer; and WHEREAS, a longtime member of the Madison Historical Society, Cathie served on the Board of Trustees and in the positions of president, vice president/program chair and secretary; and WHEREAS, also a member of the Madison Arts and Culture Alliance, Cathie served as a round table facilitator and secretary; and WHEREAS, a dedicated volunteer, Cathie has shared her passion for trees as a member of the Friends of the Madison Shade Trees since 1994, serving as secretary and tree nursery coordinator; and WHEREAS, a Parks Advisory Committee member since 1980, Cathie chaired the committee from 1988 to 2000 and then served as secretary, as well as being the Parks Advisory Committee representative to the Open Space Committee; and WHEREAS, in 1977, Cathie encouraged the development of the Nature Nuts program, a five-week summer youth program that teaches children in the first to sixth grades about nature and protecting the environment, a program Cathie devotedly continues to oversee 42 years later; and WHEREAS, on October 23, 2019, Cathie was recognized for her dedicated service receiving the Outstanding Community Volunteer award from the Morris Park Alliance, in conjunction with the Morris County Park Commission; NOW, THEREFORE, I, Robert H. Conley, Mayor October 28, 2019 Mayor Conley called forward resident Eva Bolstad, a Central Avenue School third grader, who has offered to decorate benches at the Canterbury Pocket Park: R 305-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PAINTED BENCHES PROJECT AT THE CANTERBURY POCKET PARK WHEREAS, Eva Bolstad, a Central Avenue School third grader, has offered to decorate benches at the Canterbury Pocket Park; and WHEREAS, the Council wishes to approve such request. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey that the replacement of benches and allowing Eva Bolstad to decorate the benches at the Canterbury Pocket Park as described herein is hereby approved, subject to any requirements of the Madison Borough Public Works Department and any other governmental approvals. Ms. Baillie moved approval of Resolution 305-2019, authorizing painted benches at Canterbury Pocket Park. Former Governor, Senator Richard Codey made notice to Mayor and Council regarding Madison as a Stigma Free Community. Senator Codey also presented a check for $500,000 from the State of new Jersey, Green Acres Program. REPORTS OF COMMITTEES Public Safety Ms. Baillie, Chair of the Committee, made the following comments: The Borough of Madison’s new emergency alert system will begin on November 1st. Residents are encouraged to sign up for notifications. On Saturday, October 19th the Madison Fire Department had all large diameter supply hose tested at their designed manufactured pressure to ensure reliability and safety. A third party company did the testing. Reporting for Utilities, Ms. Baillie noted that the Electric Department Standby Crew was called out for “No Power” on Seven Oaks Circle on October 16th. Due to high winds, a large limb had come down on the wires taking electric services off of two houses. The Standby Crew removed the limb and set-up PAGE 4 OF 12 Regular Meeting Minutes – October 28, 2019 temporary service to both houses. On October 19, 2019, the Standby Crew was called out for an “Emergency Mark-Out” at Staples Plaza due to a water main break on their Fire Line. On Saturday, October 19th, the Water Department also responded to Madison Plaza for a water main break. The break caused substantial damage to Karl’s Appliance and Stryxe Bowling Alley. The leak expelled an estimated 600,000 gallons of water. The Madison Water Department was called to shut off the water, so a private contractor could make the necessary repairs. On Thursday, October 24th, two 6” valves near Anthony Drive and East Street broke in the off position, while the Water Department was attempting a shut down for private contractor, Jo-Med. Jo-Med was hired to replace two 12” valves on Loveland and East, near the Well “D” Treatment Station. While the water was off, the two companies worked side-by-side on the same block to restore water to the consumers within the scheduled time frame. Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: Mrs. Vitale reminded residents that 4th quarter property taxes are due before November 15th. The Chief Financial Officer will discuss the Borough’s Best Practices inventory, which will be submitted to the state by October 31st. Mrs. Vitale also noted several resolutions to be approved this evening, including authorizing medical plans offered to full time employees and the use of a system for electronic payments including credit cards. Utilities Mr. Rowe, Chair of the Committee, absent. Public Works and Engineering Ms. Byrne, Chair of the Committee, made the following comments: Cifelli & Son Contracting will begin sidewalk, curb and drainage improvements on Community Place as soon as water service replacements are complete. Contract documents for Glenwild Road Reconstruction MA19 have been sent to NJDOT, and design work for the 2020 Road Improvement programs will be available for public review before the end of the year. Matina & Son Utility Contractors will work on punch list items on Grove Street this week. The Public Works Department will continue leaf collection and ask that leaves be place for collection before December 14th. The Borough of Madison has attained Silver Status through Sustainable New Jersey and Ms. Byrne thanked the members of the Sustainable Madison Advisory Committee. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The Senior Citizen Advisory Committee continues work on identifying participating groups, Meals on Wheels lists and garden plans for the Spring. The DDC will be holding an indoor/outdoor Holiday Market for six weeks on Thursdays November 7, 14, 21 and December 5,12,19. The Market will be held in the Madison Community Arts Center at 10 Kings Road. the hours will be from 2:00-6:00 pm. This market will be a great place to shop for holiday gifts and items for holiday entertaining. The office of Business Development has assumed responsibility for all Borough of Madison Parking Permits. Commuter Resident Parking Permit renewal applications have been sent to all current (2019) holders who will have until December 1 to complete the process. After this date remaining permits will be made available to those on the waiting list while available. Merchant/Employee and Residential Tenant renewal applications will be sent before mid-November. The Chamber of Commerce will hold the annual Rosie the Rose City Reindeer Scavenger Hunt beginning PAGE 5 OF 12 Regular Meeting Minutes – October 28, 2019 Saturday, November 30th and ending on Monday, December 16th. The 2020 Taste of Madison is scheduled for Monday, March 23 at Brooklake Country Club and the 2020 Madison Camp Fair is scheduled for March 15, 2020. Plastic eggs and plastic bags will not be part of the 2020 Easter Fun Fest. The Recreation Advisory Committee is finalizing user fee ordinance recommendations and will reach out to the Board of education for a new member. Health Ms. Coen, Chair of the Committee, made the following comments: Residents are encouraged to receive influenza vaccine if they have not already received one. Health Department has limited doses available for residents for residents who may have missed October’s scheduled clinics. Residents are encouraged to update their dog/cat rabies immunizations as needed at the upcoming rabies clinics sponsored by the Health Department. Madison’s annual clinic will be on Saturday December 7th from 10:00 to 12:00 at the Public Works garage at 34 John Avenue. Please call the health Department if you have any questions. AGENDA DISCUSSIONS 10/28/2019-1 CANTERBURY PARK BENCHES 10/28/2019-2(a) CY2019 BEST PRACTICES INVENTORY -AUTHORITIES Mr. Burnet explained that the 2019 Best Practiced Inventory requires municipalities to discuss Authorities at least annually at a public meeting, noting the Madison Chatham Joint Meeting, Housing Authority, New Jersey Public Power Association and the Public Power Authority of New Jersey. 10/28/2019-2(b) CY2019 BEST PRACTICES INVENTORY Mr. Burnet also noted the Best Practices Inventory highlighting Madison’s affirmative response to 42 out of 46 questions. Negative answers address the annual audit comment regarding segregation of duties, the use of electric vehicles and an Accumulated Absences Trust Fund. 10/28/2019-3 OPEN SPACE FUNDING – MEMORIAL PARK Ms. Baillie provided explanation of a request for $50,000.00 for trail improvements at Memorial Park, noting this will be a multi-year project. Ordinance 52-2019 is listed for Introduction. ADVERTISED HEARINGS Hearing for Ordinances 49-2019 and 50-2019 will be held Wednesday, November 13, 2019. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of November 13, 2019 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 51-2019 Item Removed and the # Retired ORDINANCE 52-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $50,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR PROFESSIONAL SERVICES, NJDEP PERMITS AND TRAIL IMPROVEMENTS TO MEMORIAL PARK WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to construct a trail at Memorial Park; and WHEREAS, the Borough of Madison will be formally applying to the Morris County Trails Construction Grant Program for funding to develop a trail at Memorial Park; and WHEREAS, the Borough Council has determined that the Borough should appropriate $50,000.00 from the Open Space Trust Fund towards the match requirement for the construction of a trail at Memorial Park; and WHEREAS, the Open Space Advisory Committee has unanimously recommended the full funding of this request; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $50,000.00 for this purpose in the Open Space Trust Fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: PAGE 7 OF 12 Regular Meeting Minutes – October 28, 2019 SECTION 1: The amount of $50,000.00 is hereby appropriated from the Open Space Trust Fund towards the cost of professional services, NJDEP permits and construction of a fully handicap accessible trail at Memorial Park. SECTION 2: This Ordinance shall take effect as provided by law. Ms. Baillie moved that Ordinance 52-2019, which the Borough Clerk read by title, be adopted. Mrs. Vitale seconded the motion. R 306-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEDICAL AND PRESCRIPTION DRUG PLAN OFFERINGS UNDER THE STATE HEALTH BENEFIT PROGRAM OF THE STATE OF NEW JERSEY PAGE 8 OF 12 Regular Meeting Minutes – October 28, 2019 WHEREAS, Chapter 78, P.L. 2011 requires a Local Government employer participating in the New Jersey State Health Benefits Plan to offer employees a minimum of three (3) coverage levels options plus a high deductible health plan; and WHEREAS, the Borough of Madison is choosing to satisfy the Chapter 78, P.L. 2011 prescribed minimum by offering the following four (4) plans for the Plan Year 2020 to its eligible employees/eligible dependents.  NJ Direct 15  NJ Direct 1525  Horizon OMNIA  Horizon HD4000 NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1) The Borough shall offer the above four (4) New Jersey State Health Benefit Plans offerings to eligible employees and their dependents. 2) The above four (4) New Jersey State Health Benefit Plan offerings will be the sole offerings for the 2020 Plan Year with these plan offerings to remain fixed and in effect until the earlier of the following: a. Change in New Jersey State Health Benefit Plan offerings b. Change in premiums such that the offerings that are in addition to the NJ Direct 15 carry with them higher premiums than the NJ Direct 15 plan. c. Borough of Madison withdrawal from the New Jersey State Health Benefit Plan program d. Such other changes as may be mutually agreed through the collective bargaining process. R 307-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE SUBMISSION OF THE SUSTAINABLE JERSEY GRANT APPLICATION WHEREAS, a sustainable community seeks to optimize quality of life for its residents by ensuring that its environmental, economic and social objectives are balanced and mutually supportive; and WHEREAS, the Borough of Madison strives to save tax dollars, assure clean land, air and water, improve working and living environments; and WHEREAS, the Borough of Madison is participating in the Sustainable Jersey Program; and WHEREAS, one of the purposes of the Sustainable Jersey Program is to provide resources to municipalities to make progress on sustainability issues, and they have created a grant program called the Sustainable Jersey Grants Program for Energy Projects Funded by the Gardinier Environmental Fund; PAGE 9 OF 12 Regular Meeting Minutes – October 28, 2019 NOW THEREFORE BE IT RESOLVED, that the Borough of Madison has determined that an application should be submitted for the aforementioned Grant. BE IT FURTHER RESOLVED, that the Council of the Borough of Madison in the County of Morris and State of New Jersey, authorize the submission of the aforementioned Sustainable Jersey Grant. R 308-2019 GRANT AGREEMENT BETWEEN THE BOROUGH OF MADISON AND THE STATE OF NEW JERSEY BY AND FOR THE DEPARTMENT OF ENVIRONMENTAL PROTECTION - GRANT IDENTIFIER: AQ20-031 R 309-2019 RESOLUTION OF THE BOROUGH OF MADISON REJECTING BID FOR COLLECTION AND HAULING OF RECYCLABLE MATERIALS AND AUTHORIZATION FOR REBID WHEREAS, the Borough of Madison publicly advertised for bids for the Collection and Hauling of Recyclable Materials in accordance with Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and WHEREAS, one (1) bid was received from Suburban Disposal, Inc. and the Borough Attorney and Qualified Purchasing Agent have determined that the sole bid exceeds the cost estimate for these services; and WHEREAS, the Qualified Purchasing Agent/Personnel Officer has recommended that the bid be rejected pursuant to N.J.S.A. 40A:11-13.2(a) and rebid; NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris and State of New Jersey that the sole bid received from Suburban Disposal, Inc., on October 3, 2019 for the Collection and Hauling of Recyclable Materials is hereby rejected for the reasons set forth herein and the Borough Administrator is authorized to solicit new bids. R 310-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING REDUCTION OF RESTORATION BOND TO 4 GIRALDA FARMS (ATLANTIC HEALTH), ON BLOCK 3202, LOT 1 WHEREAS, the Assistant Borough Engineer has recommended that the Restoration Bond for 4 Giralda Farms (Atlantic Health) in the amount of $150,880.29 be reduced to $6,191.55, in connection with site improvements completed at 4 Giralda Farms, Block 3202, Lot 1; and WHEREAS, the Assistant Borough Engineer advises that compliance with approved site plans has been completed. PAGE 10 OF 12 Regular Meeting Minutes – October 28, 2019 NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Restoration Bond described herein be reduced and released to 4 Giralda Farms (Atlantic Health). R 311-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE USE OF A SYSTEM TO ACCEPT ELECTRONIC PAYMENTS, INCLUDING CREDIT CARD PAYMENT, AND AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH MUNICIPAY TO PROVIDE SUCH SERVICES WHEREAS, the Chief Financial Officer/Assistant Borough Administrator has recommended that the Borough authorize the use of electronic payments for certain permits and fees; and WHEREAS, the Borough Council wishes to authorize the use of electronic payments, including credit card payments for certain permits and fees, as well as authorize an agreement with Municipay for such services; and WHEREAS, associated fees will be passed on to the card holder as a convenience fee of 2.65% for credit card holders, at a $3.00 per transaction minimum, and a flat fee of $1.50 for online ACH payments. NOW THEREFORE BE IT RESOLVED, that the Council of the Borough of Madison, in the County of Morris and State of New Jersey hereby authorizes the use of electronic payments, including credit card payments for certain permits and fees, as well as authorize an agreement with Municipay for the use of electronic payment services, in a form to be approved by the Borough Attorney. UNFINISHED BUSINESS - None APPROVAL OF VOUCHERS On motion by Ms. Baillie, seconded by Mrs. Vitale and carried, the following vouchers of the Borough of Madison were approved for payment, and the supporting documentation of said vouchers was made part of the Supplemental Minute Book.
