MINUTES OF A SPECIAL MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON May 1, 2020 - 3 p.m. via teleconference CALL TO ORDER The Special Meeting of the Mayor and Council of the Borough of Madison was held on the 1st day of May, 2020 Mayor Conley called the meeting to order at 3 p.m. via teleconference. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by forwarding a copy of this Special Meeting notice to the Madison Eagle on April 28, 2020, filing a copy with the Daily Record and Star Ledger, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk. Copies of said Notice were made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Conley Council Members, via telephone: Council Members: Carmela Vitale Astri J. Baillie Maureen Byrne John F. Hoover Debra J. Coen Absent: Rachel F. Ehrlich, excused Also Present: Raymond M. Codey, Borough Administrator James E. Burnet, Assistant Borough Administrator Elizabeth Osborne, Borough Clerk AGENDA REVIEW There was approval of the Special Meeting Agenda. ITEMS OF BUSINESS Mayor Conley opened the meeting by giving the public an opportunity to ask questions and make comments on any subject. The Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed Special Meeting Minutes – May 1, 2020 Mayor Conley explained that Governor Phil Murphy signed Executive Order 130, to permit municipalities to extent the 2nd quarter tax payment due date until June 1st. If residents fail to pay by the June 1st deadline, interest will be calculated back to May 1st. Mr. Burnet noted that reminders will be sent to those who have not paid by May 10th. Mrs. Vitale moved adoption of Resolution 133-2020, as listed. Ms. Baillie seconded the motion. There was no further Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Ms. Byrne Mr. Hoover, Ms. Coen, Ms. Ehrlich Nays: None R 133-2020 RESOLUTION OF THE BOROUGH OF MADISON RESCINDING R 100-2020 AND CHANGING THE GRACE PERIOD FOR SECOND QUARTER REAL PROPERTY TAXES TO JUNE 1, 2020 WHEREAS, Executive Order 130 was issued by Governor Phillip D. Murphy on April 28, 2020 which allows towns to adopt a resolution instituting a grace period for Second Quarter 2020 real property tax payments due on May 1, 2020 to a date concluding no later than June 1, 2020; and WHEREAS, Executive Order 130 also prohibited any political subdivision of the state from enacting or enforcing any order, rule, regulation, ordinance or resolution that will or might conflict in any way with any of the provisions of the Order or that will in any way interfere with or impede its achievement, which shall include, but not be limited to, any attempt to provide an additional extension of the installment date or grace period for the payment of property taxes and any attempt to otherwise temporarily fix, reduce, or retroactively modify the rate of interest charged for failure to make timely payment, thus voiding Madison Resolution 100- 2020; and WHEREAS, pursuant to Executive Order 130, the grace period for 2020 Second Quarter real property taxes is allowed to be extended up to June 1, 2020; and WHEREAS, real property tax payments not paid by June 1, 2020 will be considered delinquent and interest will be charged back to May 1, 2020 in accordance with N.J.S.A. 54:4-66 and 67 and Resolution 12-2020 previously adopted. PAGE 2 OF 3 Special Meeting Minutes – May 1, 2020 NOW THEREFORE BE IT RESOLVED by the Council of the Borough of Madison, County of Morris, State of New Jersey as follows: 1) Pursuant to Executive Order 130 the grace period for 2020 Second Quarter real property tax payments shall be extended until June 1, 2020 2) Resolution 100-2020 is hereby rescinded in its entirety. 3) The interest chargeable on delinquent real property taxes shall be in accordance with N.J.S.A. 54:4-66 and 67 and Madison Resolution 12-2020 previously adopted.
