MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON July 27, 2020 - 6 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 27th day of July, 2020. Mayor Conley called the meeting to order at 6:00 p.m. via Teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2020. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley noted that today is National New Jersey Day. Mayor Conley noted a community conversation meeting to discuss thoughts and ideas on diversity and inclusion in Madison, held Saturday July 18th at Dodge Field. On July 23rd the Mayor and Council presented lifelong resident Rose Zipper with a proclamation and roses for the celebration of her 100th birthday. Mayor Conley reminded residents that there will be only one Council meeting in August held on the 10th at 7:00 p.m. Regular Council meetings should resume in September. REPORTS OF COMMITTEES Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: Estimated tax bills have been sent to property owners, due to the delay of the tax rate certification from Morris County. Bills for the remained of the tax year will be sent later this summer. The school board tax went up 2.44% and the county tax went up 2.84%. It is important to note that the County tax is based on equalization of our tax base with the other municipalities in the county. As such, the county’s 0% budget increase resulted in Madison paying 2.84% more this year. Residents should call the Tax Collector, if they have question regarding tax bills. PAGE 2 OF 14 Regular Meeting Minutes – July 27, 2020 Public Safety Ms. Baillie, Chair of the Committee, made the following comments: Three Volunteer Firefighters that joined last year will begin Firefighter 1 training classes at the Morris County Fire Academy in August. The Borough of Madison has been awarded a Covid-19 FEMA re-imbursement Grant in the amount of $13,883.46 for equipment and supplies purchased prior to May 15, 2020 specifically for the Covid-19 epidemic. Thank you to Lt. Kyle Wickman for putting the Grant application together and submitting it for the Borough. Volunteer Firefighters are needed. Public Works and Engineering Ms. Byrne, Chair of the Committee, made the following comments: The Mechanics Department installed computer mounts in Police Department vehicles, serviced and repaired police vehicles. The Parks Department continues to water flower baskets, cut, trimmed and weeded grass around town, bridges and parks and perform general park maintenance. Midwest Construction completed curb, drainage and sidewalk work on Glenwild Road and will likely complete work this week. Storm sewer replacement began on Albright Circle and Beverly Road, as well. The Dodge Field House construction began. Videoconferencing tools were used to hold public meetings of the Planning Board and for the Zoning Board. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The METC/DDC Downtown Concert Series continues on August 7th, August 21st, August 28th, and September 4th, at 6:00 p.m. The Concerts are free and open to the public. Please bring your own chair or blanket to sit on as the museum will not be providing chairs this season due to COIVD-19 concerns. While attending the concert, please maintain social distancing and wear masks. Please support one of the many great restaurants in downtown Madison for takeout. The Madison Farmers Market is open, very Thursday through November 19th. The Market is located at Dodge Field. The hours will remain the same, 2:00 to 7:00 pm. Customer health and safety guidelines are posted at the entrances. The first drive-in concert in Madison on Saturday July 25 was a great success. The attendance was 42 cars. The Museum of Early Trades & Crafts will be opening August 5th by appointment and a new exhibit will be shown in the windows of the Annex. The Recreation Committee reports that the summer season sports are ending this week and Fall Season sports to begin in August. More information is available on the Borough’s website. Health Ms. Coen, Chair of the Committee, made the following comments: A Community Conversation held Saturday, July 18th, was very well attended. Planning for a second session in August at 4:00 p.m. is underway, with work on a group mission statement. Residents are asked to contact the Motor Vehicle Commission before arriving. There have been many news reports of cluster outbreaks in New Jersey, and a travel advisory issued for 31 states. Residents must quarantine if traveling to and from these states. Residents are reminded to stay home and contact their doctor if they have symptoms. Continue social distancing, wear face masks, wash your hands often, don’t touch your face and parents are asked to communicate guidelines to their children. PAGE 3 OF 14 Regular Meeting Minutes – July 27, 2020 Utilities Ms. Ehrlich, Chair of the Committee, made the following comments: Last Sunday, July 19th, the stand-by crew was called out three times for low power or no power, and one large branch on the service wires to a home on Ridgedale Avenue. The Electric Department did not trim trees this week, due to the extreme heat conditions. The Water Quality Report with 2019 water testing results was sent out to Borough water customers last month. As shown in the report, the contaminants found in our drinking water are well below the State’s mandated Action Level. Madison Water Department began testing for PFAS chemicals in our water in January of this year, in accordance with new State standards. These results will be published in next year’s Report, which will contain 2020 testing results. Because our water is from the Buried Valley Aquifer, and not surface water, the results are below the Action Level of 13 & 15 PPT (parts/per/trillion). These results may be found online; to access the site search “NJ drinking water watch” The Department also urges everyone to abide by the voluntary water restrictions: Odd and Even watering days based on house number. Avoid daytime watering, since 50% of the water is lost to evaporation. Please consider installing sprinkler rain sensors or having them calibrated, to avoid watering on rainy days or just after a storm. The Water Department installed a new water service at a 38 Lathrop Avenue for a newly built home. The Department also rebuilt a Chlorine Pump at one of the Well sites. The pump is used to inject CL2 in to the water system for disinfection purposes. COMMUNICATIONS AND PETITIONS- None INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS - None ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on July 13, 2020, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 21-2020 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 155 OF THE MADISON BOROUGH CODE ENTITLED “SEWER” TO UPDATE THE SEWER CONNECTION FEE SCHEDULE PAGE 4 OF 14 Regular Meeting Minutes – July 27, 2020 WHEREAS, the Borough Engineer and Borough Auditor have recommended that the Borough amend Chapter 155 of the Madison Borough Code entitled “Sewer” to include an updated sewer connection fee schedule; and WHEREAS, Nisivoccia and Company, LLP, Certified Public Accountants and consultant to the Borough, has performed a study of the capital costs and interest on debt service together with the number of equivalent users at December 31, 2019, and based on such study has recommended a sewer connection fee in the amount of $6,293.00 for new customers; and WHEREAS, such sewer connection fee is authorized by N.J.S.A. 40A:26A- 11 entitled “Municipal and County Sewerage Facilities”. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: Chapter 155-4A of the Madison Borough Code, currently entitled “Connection expenses; responsibility for maintenance, repair and replacement of laterals” is hereby amended as follows: §155-4 Connection fees; connection expenses; responsibility for maintenance, repair and replacement of laterals. A. Sewer connection fees. There shall be a basic connection fee established in accordance with N.J.S.A. 40A:26A-11. The fee shall be effective August 1, 2020and shall be: 1. For single family dwelling units, $6,293.00, and for multiple dwelling units, $6,293.00 per unit. 2. In the case of any building or portion thereof to be used for industrial, commercial, educational or other than dwelling purposes, the Borough Engineer shall determine by accepted standards the number of units to be connected or added to an existing connection; where a unit equals an annual average daily flow of 246 gallons or fraction thereof: $6,293.00 per unit. This fee shall, pursuant to statute, be recalculated at the end of each budget year and may be reset by ordinance of the Borough Council after public hearing, on a yearly basis. The sewer connection fee is based upon the usage of a single dwelling unit or equivalent discharge. The sewer connection PAGE 5 OF 14 Regular Meeting Minutes – July 27, 2020 fee shall be payable in full to the Borough of Madison at the time a building sewer permit is issued for connection to the public sanitary sewer by the Borough of Madison. SECTION 2: This Ordinance shall take effect on August 1, 2020. Mayor Conley opened up the public hearing on Ordinance 21-2020. Since no member of the public wished to be heard, the public hearing was closed. Ms. Ehrlich moved that Ordinance 21-2020, which was read by title, be finally adopted. Ms. Baillie seconded the motion. ORDINANCE 22-2020 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $25,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF NEW BULLET PROOF VESTS, BODY ARMOR AND OTHER SAFETY EQUIPMENT FOR THE POLICE DEPARTMENT WHEREAS, the Chief of Police has recommended that the Borough appropriate $25,000.00 from the General Capital Improvement Fund for the purchase of all necessary safety equipment for the Police Department; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $25,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $25,000.00 from the General Capital Improvement Fund for the purchase of all necessary safety equipment for the Police Department. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $25,000.00 is hereby appropriated from the General Capital Improvement Fund for the purchase of all necessary safety equipment for the Police Department. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $40,000.00 is hereby appropriated from the General Capital Improvement Fund for the purchase and installation of a pipe ceiling grid system for the Madison Community Arts Center. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Ms. Byrne, Mr. Hoover, Ms. Coen, Ms. Ehrlich Nays: None R 200-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PURCHASE OF TWO (2) POLICE VEHICLES FROM BEYER FORD OF MORRISTOWN, NEW JERSEY WHEREAS, the Borough of Madison desires to purchase two (2) vehicles for the Police Department from an authorized vendor under the Morris County Cooperative Pricing Council Contract #15A, Item #2; and WHEREAS, the purchase of goods and services through County agencies by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-12, et seq; and WHEREAS, Beyer Ford, 170 Ridgedale Avenue, Morristown, New Jersey has been awarded Morris County Cooperative Pricing Council Contract #15A; and WHEREAS, the Chief of Police has recommended that the Borough Council utilize this contract for two (2) police vehicles, and accessory equipment in the amount of $85,007.20; and WHEREAS, the Chief Finance Officer has attested that funds will be available in an amount not to exceed $85,007.20 for this purpose in the Police Outside Duty account. The purchase of two (2) police vehicles and accessory equipment from Beyer Ford, at a total price not to exceed $85,007.20 is hereby approved under the Morris County Cooperative Pricing Council Contract #15A. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Beyer Ford for the purchase of a police vehicle and accessory equipment at a total price not to exceed $85,007.20, in a form acceptable to the Borough Attorney. R 201-2020 RESOLUTION OF THE BOROUGH OF MADISON SUPPORTING NJ LEGISLATIVE BILLS S-232/ A-2212 REQUIRING THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION TO EVALUATE ENVIRONMENTAL AND PUBLIC HEALTH IMPACTS OF CERTAIN FACILITIES ON OVERBURDENED COMMUNITIES WHEN REVIEWING CERTAIN PERMIT APPLICATIONS WHEREAS, the bill S-232/A-2212 concerns environmental permits in overburdened communities, and WHEREAS, this bill would require a person seeking a permit for a new facility, or for the expansion of an existing facility, located in an overburdened community, to meet certain additional requirements before they can obtain the permit, and WHEREAS, “facility” is defined as any: (1) major source of air pollution; (2) resource recovery facility or incinerator; (3) sludge processing facility, combustor, or incinerator; (4) sewage treatment plant with a capacity of more than 50 million gallons per day; (5) transfer station or other solid waste facility, or recycling facility intending to receive at least 100 tons of recyclable material per day; (6) scrap metal facility; (7) landfill, including, but not limited to, a landfill that accepts ash, construction or demolition debris, or solid waste; or (8) medical waste incinerator, and WHEREAS, an overburdened community is defined as any census block group, as determined in accordance with the most recent United States Census, in which: (1) at least 35 percent of the households qualify as low-income households; (2) at least 40 percent of the residents identify as minority or as members of a State recognized tribal community; or (3) at least 40 percent of the households have limited English proficiency, and WHEREAS, NJDEP would not be permitted to grant certain environmental permits unless the permit applicant first: 1. prepares a report assessing the environmental impact of the proposed new or expanded facility on the overburdened community, PAGE 10 OF 14 Regular Meeting Minutes – July 27, 2020 2. makes the assessment report available to the public at least 30 days prior to a public meeting, and 3. organizes and conducts a public hearing in the overburdened community, and WHEREAS, under the bill S-232/A-2122, the DEP would have the authority to deny a permit application in an overburdened community upon a finding that the cumulative impacts posed by the proposed new or expanded facility, would constitute an unreasonable risk to the health of the residents of the overburdened community and to the environment in that community. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Madison, County of Morris, State of New Jersey urges the State Legislature to pass the bill S-232/A-2122 and 1. Does hereby support S-232/A-2122, requiring the DEP to evaluate environmental and public health impacts of certain facilities on overburdened communities when reviewing certain permit applications. 2. Will provide a copy of this resolution to our local NJ Senate and Assembly representatives, State Senator Richard J. Codey, Assembly Representative John McKeon, and Assembly Representative Mila Jasey, R 202-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PURCHASE OF POLICE VEHICLE ACCESSORIES FOR THE POLICE DEPARTMENT THROUGH THE NEW JERSEY COOPERATIVE PRICING SYSTEM WHEREAS, the Borough of Madison desires to award a contract for the purchase of police vehicle accessories through the New Jersey Cooperative Pricing System program; and WHEREAS, the purchase of goods and services by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Beyer Ford, has been awarded the New Jersey Cooperative Pricing System contract number 17-Fleet-00768, Police Vehicle Accessories; and WHEREAS, the Acting Purchasing Agent has recommended that the Borough Council utilize this contract for the purchase of police vehicle accessories; and WHEREAS, funds are available in Police Outside Duty Account, or in any other account that may be deemed appropriate by the Chief Financial Officer or his designee. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: PAGE 11 OF 14 Regular Meeting Minutes – July 27, 2020 1. A contract with Beyer Ford, Morristown, N.J. for the purchase of police vehicle accessories for the Police Department, in an amount not to exceed $4,316.80 is hereby approved. 2. The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute a purchase order and contract to Beyer Ford, Morristown, N.J., for the purchase of police vehicle accessories for the Police Department, in a form acceptable to the Borough Attorney. No. 1505 Off-premise 50/50 December 17, 2020 R 204-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE SETTLEMENT OF CERTAIN TAX APPEALS WHEREAS, the Borough has received appeals of the real property tax assessment of the following properties: PROPERTY OWNER BLOCK LOT ADDRESS Meehan, John and Deborah 3502 3 11 Green Hill Road Watts, David and Gina S. 3601 12 5 Wilson Lane Oyer, Amy Factor 4903 9 22 Dellwood Parkway South Arnold, Edward and Keri 4601 19 20 Park Lane Radcliff, Timothy and Caitlin 3802 41 90 Pomeroy Road ; and WHEREAS, the Acting Borough Tax Assessor is of the opinion that the settlement is in the best interest of the Borough to settle this appeal; and WHEREAS, as per Resolution 137-2020, the Acting Borough Tax Assessor is required to obtain Council approval for settlements that exceed the lesser of 15% of the original assessment or $3,000.00 annually in property taxes.
