MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 23, 2020 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 23rd day of November, 2020. Mayor Conley called the meeting to order at 7:00 p.m. via Teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2020. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. The Pledge of Allegiance was recited by all. APPROVAL OF MINUTES Ms. Baillie moved approval of the Executive Minutes of October 26, 2020. Mrs. Vitale seconded the motion, which passed with a unanimous voice call vote recorded. Ms. Baillie moved approval of the Regular Meeting Minutes of October 26, 2020. Ms. Ehrlich seconded the motion, which passed with a unanimous voice call vote recorded. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley congratulated Council Members-Elect John Hoover and Robert Landrigan. Mayor Conley noted a Special Council Meeting held November 16th regarding Affordable Housing and the announcement of a site for construction of Affordable units on Walnut Street and Community Place, in order to meet the Borough’s affordable housing obligation. Mayor Conley also noted that this year’s Christmas Tree to be placed on Waverly Place was donated by St. Vincent Martyr Church. Lighting of the annual tree will be virtual this year, due to the pandemic. REPORTS OF COMMITTEES Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: Mrs. Vitale reported that the Administration is preparing the 2021 Capital and Operating budgets. Revenue shortfalls are estimated at approximately 1.5%. The Senior Freeze has been extended to December 31, 2020. The Borough has implemented a phone app to screen employees for COVID-19 symptoms before reporting to work each day. Public Safety Ms. Baillie, Chair of the Committee, made the following comments: On November 9, 2020 Lt. John Miscia and Lt. Joe Longo gave a presentation to the Rosary Society on the history of the Madison Police Department. During the week of November 10th the Madison Police Department hosted training for the Morris County Critical Incident Debriefing Team. This debriefing team was developed by professionals who were acutely aware of the painful toll stressful events have on all PAGE 2 OF 13 Regular Meeting Minutes – November 23, 2020 first responders. Ms. Baillie noted a letter received from the Maldonado Family of Delbarton Drive thanking the Madison Fire Department for their quick response to a garage fire. The Madison Planning Board will hold a Special public hearing on the Master Plan on December 15th. A copy of the proposed plan is on the Borough’s website. Public Works and Engineering Ms. Byrne, Chair of the Committee, made the following comments: The Public Works Department and the Parks Department have been very busy the last few weeks picking up leaves on Madison streets. They have made two sweeps of the town, and anticipate making two more. In addition to the leaf work, the Parks Department repaired the Dodge Field fence; blew leaves at James St Park, Dodge Field Basketball Court, Morris Place and Summerhill Park (sidewalks). The Mechanics Department continues work maintaining the Borough’s fleet, including the Police Dept. vehicles, the street sweeper, the parks and roads vehicles, including the backhoe. The Sewer Department performed daily operation and maintenance, including mark outs for contractor excavations. From the Engineering Department, final striping on Albright Circle and Beverly Road was completed last week. Paving at Lucy D Basketball courts was completed last week as well. Schifano Construction is planning a one-day mill and overlay on Highland Avenue between Rosedale and Britten to resurface the road following a water main replacement. Plans for the 2021 Road Improvement Program are nearing completion. A grant application for Green Avenue bump out/curb extensions was approved by NJDOT in the amount of $192,000. Dodge Field Restroom Building final inspections and contract closeout will be completed next week. Plans to improve Dodge Field Playground are in progress for awards next year. The pump removal from Well AB Treatment Plant was completed for inspection and repair work last Friday. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The Senior Citizen Advisory Committee is working on assessing the needs and desires of senior residents. The Team has identified several groups to distribute a survey including the Library and the Madison YMCA. The Museum of Early Trades & Crafts is now open on a limited basis, with a new exhibit “Home for the Holiday” Health Ms. Coen, Chair of the Committee, made the following comments: Ms. Coen encouraged residents to limit gathering this holiday season, as the numbers of positive COVID-19 cases continue to increase. As of this meeting there are 274 total cases of Covid-19 in Madison, 28 open cases. Winter sports have been postponed by the Health Officer at this time. Residents are encouraged to limit interstate travel. Pet vaccines will be by appointment this year. Please contact the Madison Health Department. Utilities Ms. Ehrlich, Chair of the Committee, made the following comments: The Electric Department has completed Line Clearance on Shunpike Road and Garfield Avenue. The Department installed and completed the new Underground Electrical Service to the new Dodge Field Playground field house. Between November 13th and 16th, there were several calls for storm and storm-debris- related outages on Greenwood Avenue, Pomeroy Road, Samson Avenue, Bardon Street, and Central Avenue. The Electric Department cut down the annual Christmas Tree, donated by St. Vincent’s Church, and installed it on Waverly Place. PAGE 3 OF 13 Regular Meeting Minutes – November 23, 2020 The Department will be stringing the lights. We thank St. Vincent Martyr and Fr. George for the generous donation of this beautiful tree. The Water Department made fire hydrant repairs based on the findings of the annual hydrant flushing program, and has placed a hydrant on Prospect Street back in service as a result. The Water Department assisted the Electric Department at the new Dodge Field Playground Building by digging and installing underground conduit for the Electric Service to the building. The Electric Department assisted the Water Department by helping to install a new 2” water service line that will supply water to the new Building as well as the irrigation system to the Baseball and Football fields. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email dated November 16 2020, from the Maldonado Family, Delbarton Drive thanking the Madison Fire Department Firefighters for their response to a house fire. Email dated November 18, 2020, John Heenehan, Kensington Road, regarding the police response at a neighbor’s home. INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 11/23/2020-1 OPEN SPACE TRUST FUND REQUESTS Ms. Baillie noted that the Open Space Committee met and recommends funding of the restoration of the east wing and plaza of the Hartley Dodge Memorial. There was agreement to list ordinances for introduction. Ordinances 41-2020 and 42-2020 are listed for Introduction. 11/23/2020-2 CAPITAL ORDINANCE CANCELLATIONS Mr. Burnet explained the annual action to review and cancel completed project ordinances. Any excess funds revert back to capital. There was agreement to cancel completed ordinances. Resolution 288-2020 is listed on the Consent Agenda. ADVERTISED HEARINGS The Clerk made the following statement: The ordinances scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on November 9, 2020, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Since no member of the public wished to be heard, the public hearing was closed. Ms. Byrne moved that Ordinance 40-2020, which was read by title, be finally adopted. Mr. Hoover seconded the motion. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of x, 2020 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 41-2020 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $250,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR RENOVATIONS AND RESTORATION OF THE EAST WING OF THE HARTLEY DODGE MEMORIAL WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to continue the renovations and restoration of the East Wing of the Hartley Dodge Memorial; and WHEREAS, the Open Space Advisory Committee has recommended the full funding of this request; and WHEREAS, the Borough Council has determined that the Borough should appropriate $250,000.00 from the Open Space Trust Fund for renovations and restoration of the East Wing of the Hartley Dodge Memorial and other related work; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $250,000.00 for this purpose in the Open Space Trust Fund. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Ms. Byrne, Mr. Hoover, Ms. Coen, Ms. Ehrlich Nays: None R 285-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING ACCEPTANCE OF A SETTLEMENT AGREEMENT WHEREAS, certain matters have arisen pertaining to V.D.’s employment with the Borough of Madison (“Borough”); and WHEREAS, V.D. has agreed to a Settlement Agreement and Release and executed same on November 10, 2020; and WHEREAS, V.D. agreed to and provided an irrevocable letter of resignation effective November 13, 2020; and WHEREAS, the Borough Council has reviewed the Settlement Agreement and Release and irrevocable letter of resignation and seeks to accept and agree to the terms of same. NOW, THEREFORE BE IT RESOLVED, by the Borough Council of the Borough of Madison, County of Morris, State of New Jersey, as follows: 1). The Borough hereby accepts and ratifies the terms and conditions of the Settlement Agreement and Release executed by V.D. on November 10, 2020; and 2.) The Borough of Madison hereby accepts the irrevocable resignation of V.D. effective November 13, 2020; and 2). The Borough Council hereby authorizes the Mayor to execute the Settlement Agreement and Release; and 3). That this resolution shall take effect immediately. R 286-2020 RESOLUTION OF THE BOROUGH OF MADISON REJECTING NON- RESPONSIVE BIDS FOR THE 2020 REMOVAL AND PROPER RECYCLE OF LEAVES WHEREAS, the Borough of Madison publicly advertised for bids for removal and proper recycle of leaves in accordance with Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and PAGE 9 OF 13 Regular Meeting Minutes – November 23, 2020 WHEREAS, the Borough issued an addendum answering questions and providing clarification that should have been published; and WHEREAS, the Acting Purchasing Agent and Borough Attorney have opined that this is a material defect and recommend that all bids be rejected. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris and State of New Jersey that the bids for removal and proper recycle of leaves are hereby rejected for the reasons set forth in the attached legal opinion. BE IT FURTHER RESOLVED that the Borough Council authorizes the 2020 removal and Proper Recycling of Leaves be rebid. R 287-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING APPOINTMENT OF CORPORAL BARTLOMIEJ GLAB AS SERGEANT IN THE MADISON POLICE DEPARTMENT EFFECTIVE NOVEMBER 24, 2020 WHEREAS, the Borough Council, after due consideration, has determined to appoint Corporal Bartlomiej Glab to the position of Sergeant in the Madison Police Department effective November 24, 2020; NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Bartlomiej Glab is hereby appointed to the position of Sergeant in the Madison Police Department, effective November 24, 2020, to be compensated in accordance with the Superior Officers Collective Bargaining Agreement. R 288-2020 RESOLUTION OF THE BOROUGH OF MADISON CANCELING COMPLETED CAPITAL IMPROVEMENT ORDINANCES R 289-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEMBERSHIP IN THE TEXAS INTERLOCAL PURCHASING SYSTEM (TIPS) WHEREAS, the Chief Financial Officer has reviewed a list of open capital projects and has determined that certain capital projects have been completed and the improvement authorization accounts should be closed; and WHEREAS, the Chief Financial Officer has recommended that the Council adopt a Resolution canceling the open dollar balances in such completed projects; and WHEREAS, the Borough Council has determined to make such cancellation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the list of open capital ordinances annexed hereto are hereby cancelled. PAGE 10 OF 13 Regular Meeting Minutes – November 23, 2020 R 289-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEMBERSHIP IN THE TEXAS INTERLOCAL PURCHASING SYSTEM (TIPS) WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration; and WHEREAS, the Texas Interlocal Purchasing System (TIPS) has offered voluntary participation in a Cooperative Pricing System for purchase of goods and services; and WHEREAS, on November 23, 2020, the governing body of the Borough of Madison, County of Morris, State of New Jersey duly considered participation in the Texas Interlocal Purchasing System (TIPS) for the provision and performance of goods and services. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey as follows: 1. This Resolution shall be known and may be cited as a Texas Interlocal Purchasing System (TIPS) Purchasing Resolution of the Borough of Madison. 2. Pursuant to the provisions of N.J.S.A. 40A:11-11(5), the Mayor is hereby authorized to enter into a Cooperative Purchasing Agreement with the Texas Interlocal Purchasing System (TIPS). 3. The Texas Interlocal Purchasing System (TIPS) shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the revised statutes of the State of New Jersey. 4. The Resolution shall take effect immediately upon passage. R 290-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING RENEWAL OF A MEMBERSHIP WITH THE NORTH JERSEY MUNICIPAL EMPLOYEES BENEFITS FUND WHEREAS, a number of public entities in the State of New Jersey have joined together to form the North Jersey Municipal Employee Benefits Fund, hereafter referred to as the “FUND”, as permitted by N.J.S.A. 11:15-3, 17:1-8.1 and 40A:10-36 et seq.,; and WHEREAS, the FUND was approved to become operational by the Departments of Insurance and Community Affairs; and WHEREAS, the statutes and regulations governing the creation and operation of a joint insurance fund, contain certain elaborate restrictions and PAGE 11 OF 13 Regular Meeting Minutes – November 23, 2020 safeguards concerning the safe and efficient administration of the public interest entrusted to such a FUND; and WHEREAS, the governing body of the Borough of Madison, hereafter referred to as the “Borough of Madison” has determined that continued membership in the FUND is in the best interest of the Borough of Madison NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: i. The Borough of Madison shall remain a member of the FUND for the period outlined in the Borough of Madison’s Indemnity and Trust Agreements ii. The Borough of Madison will participate in the following type(s) of coverage(s); a.) Dental Insurance as defined pursuant to N.J.S.A. 17B:17-4, the FUND’s Bylaws and Plan of Risk Management. iii. The Borough of Madison adopts and approves the FUND’s Bylaws. iv. The Borough of Madison hereby authorizes the execution of a renewal application for membership and any accompanying certifications. R 291-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE N.J. FOREST SERVICE TO CONDUCT A PRESCRIBED BURN AT THE MADISON RECREATION COMPLEX (MRC) WHEREAS, the Borough of Madison has determined that a prescribed burn is necessary to remove invasive plans and revitalize the soil in the meadow at the MRC; and WHEREAS, the Borough Council of Borough of Madison agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the N.J. Forest Fire Service is hereby authorized to conduct a prescribed burn at the MRC meadow area to remove plants and revitalize the soil. R 292-2020 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING USE OF COMMUNITY POOL PUBLIC PARKING LOT BY THE BOY SCOUTS PATRIOTS’ PATH # 358 WHEREAS, Boy Scouts Patriots’ Path # 358 has requested permission to use the public parking lot at the Madison Community Pool and Memorial Park Fire Pit area PAGE 12 OF 13 Regular Meeting Minutes – November 23, 2020 on November 23, 2020, December 14, 2020 and December 19, 2020 between the hours of 4:00 p.m. and 8:00 p.m. for scout meetings; and WHEREAS, the Borough Administrator has recommended that such permission be granted; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Boy Scouts Patriots’ Path # 358 is hereby given permission to hold scout meetings at the Madison Community Pool public parking lot and Memorial Park Fire Pit area on November 23, 2020, December 14, 2020 and December 19, 2020 between the hours of 4:00 p.m. and 8:00 p.m. subject to such safety requirements as may be directed by the Madison Police Department and/or Fire Department.
