MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON September 13, 2021 - 6 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 13th day of September, 2021. Mayor Conley called the meeting to order at 6:00 p.m. via Teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2021. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of Silence for the passing of resident Carmine Toto, Jr., noting that Mr. Toto, a lifelong Madison resident, died peacefully at his home on the morning of Sunday, September 12, 2021 surrounded by his family. Among his other contribution to Madison, Mr. Toto built several versions of the “Santa House” by hand during the Christmas season. He loved the smiles and joy it brought to everyone. He was also responsible for the construction of several floats that are used in parades in Madison during holidays, such as Thanksgiving, Christmas and Memorial Day. Mr. Toto was instrumental in organizing in Madison’s annual Memorial Day Parade each year. APPROVAL OF MINUTES Ms. Baillie moved approval of the Executive Minutes of August 9, 2021. GREETINGS TO PUBLIC Mayor Conley made the following comments: EMPLOYEE OF THE MONTH FOR SEPTEMBER: Patrolman Patrick Strafaci from the Police Department has been selected as the Employee of the Month for September. On August 14, Madison Police received a 9-1- 1 call regarding a man who had collapsed on the sidewalk on Main Street. Patrolman Strafaci was nearby and arrived within seconds. He assessed the patient, notified Madison Dispatch and began performing lifesaving measures. With the help of an RN who was passing by, the Morris County EMS, and the Fire Department, the 53 year old Madison resident was resuscitated and transported to the hospital to complete his recovery. Patrick’s quick actions and coordination of resources led to a successful outcome. PAGE 2 OF 19 Regular Meeting Minutes – September 13, 2021 ANNIVERSARY FOR THE MONTH OF SEPTEMBER: On September 10th, School Crossing Guard Hadvab Miroslav celebrated his 20th anniversary with the Borough. PROCLAMATIONS: Mayor Conley presented the MHS Interact Club proclamation to MHS student Elisabetta Araya and other students. Proclamation of the B o r o u g h o f M a d i s on In Recognition of Madison High School Interact Club WHEREAS, Interact Clubs are an important branch of the Rotary organization which encourages students to focus on “Service-Above-Self” through community service projects; and WHEREAS, in 2020, the Madison High School Interact Club came together with Madison Rotary to develop a plan to support families struggling during the pandemic; and WHEREAS, the Interact Cub connected with Pastor Dunn from the Madison First Baptist Church to confirm that the food pantry at the church would be able to accept and distribute all donated food; and WHEREAS, more than 80 generous Madison families donate on a bimonthly basis and their donations go directly to the food pantry at the Church; and WHEREAS, since the collection service started, more than 1700 bags of food have been donated, collected and delivered to the pantry; and WHEREAS, the Interact Club has also collected over $3800 which was donated to the Interfaith Food Pantry; and WHEREAS, the students also organized three in-person food collections which benefited Nourish NJ and participated in several Madison Rotary packaged food distributions; and WHEREAS, on July 24, 2021, the Interact Club celebrated their one year anniversary of the food collection program. NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, recognize the Madison High School Interact Club’s achievements in fighting food insecurity in our community and thank them for their dedication to this program. PAGE 3 OF 19 Regular Meeting Minutes – September 13, 2021 National Suicide Prevention Awareness Month was presented to Karin Szotak . Proclamation of the B o r o u g h o f M a d i s on Proclaiming National Suicide Prevention Awareness Month September 2021 WHEREAS, September is known around the United States as National Suicide Prevention Awareness Month and is intended to help promote awareness surrounding each of the Suicide Prevention resources available to us and our community. The simple goal is to learn how to help those around us and how to talk about suicide without increasing the risk of harm; and WHEREAS, the Borough of Madison is committed to increasing awareness of suicide prevention and wishes to recognize the importance of suicide awareness in our community; and WHEREAS, suicidal thoughts can affect anyone regardless of age, gender, race, orientation, income level, religion, or background; and WHEREAS, according to the CDC, each year more than 41,000 people die by suicide; and WHEREAS, suicide is the 10th leading cause of death among adults in the US, and the 2nd leading cause of death among people aged 10-24; and WHEREAS, the Borough of Madison is no different than any other community in the country, but chooses to publicly state and place our full support behind local educators, mental health professionals, athletic coaches, pack leaders, police officers, and parents, as partners in supporting our community in simply being available to one another; and WHEREAS, local organizations like the American Foundation for Suicide Prevention and the National Alliance on Mental Illness (NAMI) are on the front lines of a battle that many still refuse to discuss in public, as suicide and mental illness remain too taboo a topic to speak on; and WHEREAS, every member of our community should understand that throughout life’s struggles we all need the occasional reminder that we are all silently fighting our own battles; and WHEREAS, we encourage all residents to take the time to check in with their family, friends, and neighbors and to genuinely convey their appreciation for their existence by any gesture they deem appropriate. A simple phone call, message or hug can go a long way toward helping someone realize that suicide is not the answer. NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim September 2021 as National Suicide Prevention Awareness Month in the Borough of Madison. PAGE 4 OF 19 Regular Meeting Minutes – September 13, 2021 Mayor Conley presented a proclamation celebrating Hispanic Heritage Month to resident Cari Reyes. Proclamation of the B o r o u g h o f M a d i s on Proclaiming HISPANIC HERITAGE MONTH SEPTEMBER 15, 2021 - OCTOBER 15, 2021 WHEREAS, for more than 30 years, Hispanic Heritage Month has been celebrated across the United States; and WHEREAS, beginning with the recognition of September 15 as the independence day of five Central American countries – Costa Rica, El Salvador, Guatemala, Honduras, and Nicaragua – Hispanic Heritage Month is an opportunity to honor the traditions and countless artistic, scientific, political, and cultural contributions of Madison residents who trace their roots to Spain, Mexico, Puerto Rico, and the Spanish-speaking nations of Central America, South America and the Caribbean; and WHEREAS, as of 2020, the U.S. Census Bureau estimates that Hispanic Americans comprise 18.7 percent of the U.S. population, 22 percent New Jersey’s population and 9.50 percent of Madison’s population; and WHEREAS, Hispanic Americans have fought in every war since the Revolutionary War, and 60 Hispanic Americans have received the Congressional Medal of Honor, our nation’s highest military award for valor in action against an enemy force; and WHEREAS, Hispanic Americans fuel our economy through entrepreneurship and continued contributions to industry, the arts, agriculture, civil society, academia, healthcare services and more; WHEREAS, we appreciate and honor the countless achievements of our Hispanic neighbors and continue our efforts to ensure that Madison is a welcoming and inclusive community. NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim September 15, 2021 to October 15, 2021 as Hispanic Heritage Month and recognize the cultural heritage, collective resilience and countless contributions of Hispanic Americans to Madison. REPORTS OF COMMITTEES Public Safety Ms. Byrne, Chair of the Committee, made the following comments: During the month of August the Fire Department responded to a total of 110 calls. On Tuesday August 17th, around 5:10 p.m. the Fire Department responded to a PAGE 5 OF 19 Regular Meeting Minutes – September 13, 2021 structure fire at 265 Kings Road. This fire was called in by off duty Police Captain Joe Longo. It was reported that the occupant of the house was still inside. With smoke and flames pushing out the rear door of the house, three Madison Firefighters entered with a charged hose line to start extinguishing the fire and to search for the occupant. The occupant was found unconscious on the first floor. Firefighters radio their find and that they were unable to get to the door where they made entry. Firefighters removed the window and the occupant was handed out to EMS, Police, and Paramedics and later transported to the Hospital. Madison Firefighters then exited the window to safety while other firefighters continued to extinguish the fire. Due to heroic and gallant efforts by Madison Firefighters Barrios, Norek and DeRosa the rescued occupant is alive and recovering. The fire was not suspicious in nature. Madison Police and Madison Ambulance Squad also responded and assisted at this fire. On Wednesday evening, September 1, Hurricane Ida hit our area. Madison Firefighters pumped out over 70 flooded basements and responded to three alarm activations over a 22 hour period. Late in the afternoon on September 2nd, Madison Administrator Ray Codey contacted Chief DeRosa with a request from Milburn for any portable pumps. Three large gasoline trash pumps and two large electric pumps were loaned to Millburn. All pumps were returned on Saturday, September 4th. On Friday evening, September 10th at approximately 6:40 p.m. Madison Fire Department, along with other Fire Departments, responded to Chatham Township for a residential structure fire on Susan Drive. Today, at approximately 7:54 a.m., the Fire Department was dispatched to a reported structure fire as a caller reported seeing smoke coming from the roof of the apartment complex located at 292 Main Street. A fire was found in the attic above a 2nd floor apartment. A hand line was stretched and the ceiling in a bedroom had to pull down to extinguish the fire. There were no injuries and the fire is not suspicious. The Madison Police Department purchased 120 stuffed Police dogs to donate to RWJ Barnabas Pediatric Burn Unit and for patrol officers to provide to children at medical and other service calls. Cpl. Aquino took the lead and organized the project. Acting Chief Miscia graduated August 2nd from the 496th class of Northwestern University-School of Police Staff and Command. Members of the Madison Police Department will join Mayor Conley and members of Borough Council, along with Madison Fire Department and Madison Ambulance at the 20th anniversary ceremony of the September 11th attacks. The memorial ceremony will be held at the Madison 9/11 Memorial at James Park. On September 18th, members of the Madison Police Department and the Community Relations Unit will join with Madison First Baptist Church in holding a block party held behind the Civic Center at 28 Walnut Street. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: Ms. Baillie noted that the Senior Freeze program deadline is November 11, 2021. The Tax Collector held the annual Tax Sale with one parcel tax liability sold to a third party. The Borough’s tax collection rate for the third quarter is at 97.5%. The Finance Department will wire approx. 4 million dollars to the Madison Board of Education for as the monthly payment. The 2022 municipal budget season has begun, with Department Heads providing proposed budgets to the Administrators that will remain flat for 2022. A five-year capital budget presentation will be held at a Council meeting by the end of the year. Public Works and Engineering Mr. Hoover, Chair of the Committee, made the following comments: Reporting for the Engineering Department, Mr. Hoover noted that the HDM Plaza reconstruction project contractor has removed, reformed, reinforced and repoured PAGE 6 OF 19 Regular Meeting Minutes – September 13, 2021 the upper, lower and East Wing stair foundations. The next phase of construction will involve resetting granite stair treads on the upper stair foundations in a sand and mortar base. Then the upper plaza granite will be reset. Please note all general public access to the Municipal Building continues through the west wing courtroom ramp for the duration of the project. AC Schultes provided a crane at the Well AB Treatment facility to remove the pump and motor. The company successfully transported the pump to their facility, completed the rebuilding process and reinstalled the vertical turbine pump. Montana Construction provided an emergency response to debris buildup in the culvert between Keep Street and Kings Road across from the YMCA and NJ Transit Rail properties. Initial debris removal has been completed and coordination with NJ Transit Rail in progress. The Department of Public Works prepared for flooding ahead of Hurricane Ida and assisted Millburn with recovery. They continue sewer jetting and vehicle maintenance as well. The Shade Tree management Board has planted an additional fourteen trees. Residents who would like a new tree can contact the Department of Public Works. The Recreation Advisory Committee reports that baseball fields will be regraded and reseeded, now that the season has ended. Fall sports are now under way. Winter sports schedules will be listed soon on the Borough’s website. The Madison Environmental Commission noted that the Eco House/Garden tour was a success. Thanks to the volunteers. Community Affairs Ms. Coen, Chair of the Committee, made the following comments: Residents are encouraged to continue to visit the Farmers’ Market each Thursday through November, as new vendors are participating. Bottle Hill Day is scheduled for Saturday, October 2nd. The annual Beer Garden will not be held this year. Utilities Ms. Ehrlich, Chair of the Committee, made the following comments: On Wednesday, September 1st and Thursday, September 2nd, Hurricane Ida hit Madison. The Electric Department had no power outages caused by the storm. On Thursday, the Department inspected lines for damage and found that the lines had not sustained any damage, although they did have to remove branches from the lines and cut back a tree on Danforth Road. From Friday, September 3rd through Sunday, September 5th the Madison Electric Department offered JCP&L mutual aid to assist with power outages. The Crews worked in Bernardsville, Harding, Morristown, and Summit, setting utility poles and hanging wire. Aside from the storm response, in the last month there were three calls to the Stand-by Crew for no power, low power, and one emergency mark-out. In addition to trouble calls, the Department continues to complete daily work orders, including new service installations and disconnects. The Water Department continues the installation of new water meters with automated readers. If anyone outside of the Madison Commons area is interested in having their water meter updated, please call the Madison Water Department at (973) 966-7330 to schedule an appointment. Health Mr. Landrigan, Chair of the Committee, made the following comments: The Health Department reports fourteen additional case of COVID-19 since September 1st, noting that the variant is still dominant. A third booster shot of the vaccine has not yet been approved by the FDA. The annual flu clinics will be held this fall, with more information to follow. PAGE 7 OF 19 Regular Meeting Minutes – September 13, 2021 COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email dated August 27, 2021 from Catherine Vander Meulen of Wisteria Court regarding property maintenance at 160 Madison Avenue. Email Dated September 2, 2021 from Mary Ann Olivieri of North Street thanking the Madison Fire Department for their assistance with her flooded home after Hurricane Ida. Tom Haralampoudis; Pomeroy Road, commented on Resolution 233-2021, listed on the Consent Agenda, appointing Christian Riedenger, as part-time unpaid Intern for the Madison Police Department. AGENDA DISCUSSIONS 09/13/2021-1 AFFORDABLE HOUSING PROJECT PRESENTATION Michael Hong, Kevin Shelly, John Carlton and Joaquin Bouzas, with RPM Development Group presented preliminary renderings and explanation of the planned 44 unit affordable housing project to be constructed on Walnut Street and Community Place, providing elevations and drawings of proposed buildings, in compliance with a settlement agreement between the Borough of Madison and Fair Share Housing Center. Resolution 230-2021 is listed on the Consent Agenda. ADVERTISED HEARINGS The Clerk made the following statement: The ordinance scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on August 9, 2021, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 38-2021 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $75,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR PROFESSIONAL SERVICES FOR WAVERLY PLACE IMPROVEMENTS WHEREAS, the Borough Engineer has recommended that the Borough appropriate $75,000.00 from the General Capital Improvement Fund for professional PAGE 8 OF 19 Regular Meeting Minutes – September 13, 2021 services and certain construction costs regarding the Waverly Place Improvements; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $75,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $75,000.00 from the General Capital Improvement Fund for professional services and certain construction costs regarding the Waverly Place Improvements. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $75,000.00 is hereby appropriated from the General Capital Improvement Fund to fund professional services and certain construction costs regarding the Waverly Place Improvements. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 38-2021. Since no member of the public wished to be heard, the public hearing was closed. Mr. Hoover moved that Ordinance 38-2021, which was read by title, be finally adopted. Ms. Coen seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Ms. Baillie, Ms. Byrne, Mr. Hoover, Ms. Coen, Ms. Ehrlich, Mr. Landrigan Nays: None Mayor Conley declared Ordinance 38-2021 adopted and finally passed and ordered the Clerk to publish the notice thereof in the newspaper and to record the ordinance as required by law. Sara Webb: Barnesdale Road, noted that, should the Drew Forest be developed flooding similar to the recent Hurricane Ida, would be much worse town wide. Gene Cracovia; Barnesdale Road, Chairman of the Shade Tree Management Board (STMB), provided an update on trees at Drew University, noting early August the STMB was notified of tree removal on the Drew campus. The Borough arborist PAGE 9 OF 19 Regular Meeting Minutes – September 13, 2021 agreed that 65 dead or dying trees needed to be removed. The STMB has recommended that trees be replace with native hardwoods and fertilized regularly. Christine Hepburn: Harding Township, noted that the recent storm event and flooding in Madison is all the reason to save the Drew Forest. Tom Haralampoudis; Pomeroy Road, asked for explanation of proposed Ordinance 39-2021, listed for introduction, and noted that the 9/11 Memorial Service held last Saturday was very nicely organized. Mr. Haralampoudis also raised concern regarding idling vehicles at Borough Schools. Since no other member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES The Clerk made the following statement: The ordinance scheduled for introduction and first reading tonight will have a hearing during the meeting of September 27, 2021 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinance will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinance39-2021 for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 39-2021 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $30,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR PROFESSIONAL SERVICES RELATED TO THE INSTALLATION OF A NEW RADIO SYSTEM FOR POLICE, FIRE, AMBULANCE, DPW AND ELECTRIC UTILITY WHEREAS, the CFO/Assistant Borough Administrator has recommended that the Borough appropriate $30,000.00 from the General Capital Improvement Fund for professional services related to the installation of a new radio system for Police, Fire, Ambulance, DPW and Electric Utility; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $30,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $30,000.00 from the General Capital Improvement Fund for professional services related to the installation of a new radio system for Police, Fire, Ambulance, DPW and Electric Utility. (hereinafter referred to as the “Sponsor”) proposes to develop a 44-unit family affordable housing development (hereinafter referred to as the “Project”) pursuant to the provisions of the New Jersey Housing and Mortgage Finance Agency Law of 1983, as amended (N.J.S.A. 55:14K-1 et seq.), the rules promulgated thereunder at N.J.A.C. 5:80-1.1 et seq., and all applicable guidelines promulgated thereunder (the foregoing hereinafter collectively referred to as the “HMFA Requirements”) within the Borough of Madison (hereinafter referred to as the “Municipality”) on sites described as Lot 1.01, Block 1601 and Lot 42, Block 1601 as shown on the Official Tax Map of the Borough of Madison, more commonly known as Community Place and 28 Walnut Street respectively; and PAGE 11 OF 19 Regular Meeting Minutes – September 13, 2021 WHEREAS, the Project will be subject to the HMFA Requirements and the mortgage and other loan documents executed between the Sponsor and the New Jersey Housing and Mortgage Finance Agency (hereinafter referred to as the “Agency”); and WHEREAS, pursuant to the HMFA Requirements, the governing body of the Municipality hereby determines that there is a need for this housing project in the Municipality. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Madison (the “Council”) that: (1) The Borough Council finds and determines that the 44-unit affordable Project proposed by the Sponsor meets or will meet an existing housing need; and (2) The Council does hereby adopt the within Resolution and makes the determination and findings herein contained by virtue of, pursuant to, and in conformity with the provisions of the HMFA Law to enable the Agency to process the Sponsor’s application for Agency funding to finance the Project. R 231-2021 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CONTRACTS TO RIO SUPPLY, INC. UNDER THE MORRIS COUNTY COOPERATIVE PRICING COUNCIL (“MCCPC”) CONTRACT #47: WATER METERS/DATA RECORDERS & RADIO FREQUENCY METER INTERFACE UNITS WHEREAS, the Borough of Madison may by resolution and without advertising for bids, purchase any goods or services under a cooperative pricing system of which the Borough is a member; and WHEREAS, the purchase of goods and services by a local contracting unit through a cooperative pricing system is authorized by Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Rio Supply, Inc. of Sicklerville, New Jersey has been awarded the Morris County Cooperative Pricing Council Contract #47: Water Meters/Data Recorders & Radio Frequency Meter Interface Units; and WHEREAS, the Borough of Madison anticipates entering into contract, individually or in the aggregate, in excess of $17,500.00.
