MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 27, 2023 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 27th day of November, 2023. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2023. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Mc Sherry APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley made the following comments: Honor New Jersey State District 27 Representatives Mayor Conley called forward Assemblyman John F. McKeon, Madison State representative for the last twelve years, to present a silver box from the citizens of Madison, presented with great thanks to Assemblyman McKeon. Mayor Conley also recognized former governor Richard J. Codey and Assemblywoman Mila M. Jasey, who could not be present. Resident Guillermo Gil, President of the Qunidianos Unidos por Columbia, presented Mayor Conley and Council Members with medallions, thanking them for their support of the Columbian community in Madison. REPORTS OF COMMITTEES Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: Please visit the holiday village at the Train Station this season, provided through the generosity of the Madison Christmas Committee. Visits with Santa will again be booked through www.rosecitychristmas.com. The Annual Menorah Lighting will take place on Sunday, December 10th, at 5:00 pm at the Madison Train Station. Once again, two more holiday favorites, the Secret Santa Giveaway and downtown caroling, will return in December. Look for them on Saturdays through December 23, 2023. The Search for Rosie the Rose City Reindeer begins Friday, November 24th, and ends Saturday, December 16th. Participation cards are available at Tons of Toys and Madison Pharmacy. The Grand Prize drawing will be live on ILoveMadisonNJ Facebook on Monday, December 18th. The event is free of charge, open to the public, and exclusively designed for children. The Taste of Madison date has been changed to Monday, March 18th, and will be held at the Madison Hotel. The Madison Holiday Arts Festival was held on Friday and Saturday, November 24th and 25th. Over the two days, there were 22 performances. The Madison Weekend of Dance will be held at the Arts Center from Thursday, November 30th, through Sunday, December 3rd. More information is available at www.madisonartsnj.org. Four groups will perform Thursday through Sunday: The Drew Dance Department, Alborada Spanish Dance Theatre, Extensions Dance Project (run by former FDU students), and Carolyn Dorfman Dance. Sunday's Carolyn Dorfman performance is sold out. Arts by the People will present their monthly Literary Open Mic: Platform on Wednesday, December 6, 2023 at 7:00 pm. Before the reading, there will be a free writing workshop. The New Jersey Jazz Society will present the Royal Bopsters, a vocal Jazz Group, on Sunday, December 10, 2023. Public Works and Engineering Ms. Ehrlich, Chair of the Committee, made the following comments: The Engineering Department provided several updated on projects in progress, the Dodge playground renovation project will begin with demolition in mid-February and an anticipated three months of construction to complete this project. The Cook Avenue Parking Lot reconstruction project is being revised to reduce costs with a reduction is scope, eliminating the primary underground electrical wiring. Several grants are being applied for including Phase 3 of the Memorial Park Trails grant, in the amount of $42,000 matching grant, connecting Memorial Park with Delbarton Park to Staples Plaza. And three Green Acres projects including $700,000 for MRC Debt relief, $5.5 million for acquisition of the Drew Forest and $400,000 for the Dodge Field All Accessible Playground. From the Department of Public Works, beginning October 12th, leaf pick up began and will continue until the end of the season. Leaf bags are available at Borough Hall and the DPW office on John Avenue. The Department also assisted the Madison Police department with the Holiday Parade on November 24th. Utilities Mr. Landrigan, Chair of the Committee, made the following comments: The Electric Department cut down the Xmas Tree for this year. Mr. Landrigan thanked St. Vincent Martyr Church for donating another beautiful tree. The Department decorated the tree and installed all the wreaths. The department hooked temporary service for 284 Main St, Madison Mall Apartments. On Monday November 13th, stand-by crew was called for an emergence mark out at Wholefoods. On Wednesday, November 15th, the stand- by crew was called to Wholefoods to assist with repairing the roadway. November 20th, the stand-by crew was called to a car pole accident. The crew had to replace the broken pole and fix underground service that feeds the Madison golf course. Public Safety Mr. Range, Chair of the Committee, made the following comments: The Madison Police Department-Community Relations Unit, along with other members of the department, took part in a Thanksgiving Outreach program with St. Vincent’s Church on November 20th. The officers took receipt of over 30 Thanksgiving dinners and delivered them to residents of the Madison Housing Authority. The police department has been participating in this program for over 15 years and delivering food to families during the holidays. Last week, Madison Police Command Staff and School Resource Officers sat with Madison Public School officials as part of their monthly school security meetings to discuss continued PAGE 3 OF 18 Regular Meeting Minutes – November 27, 2023 strengthening of security in all school buildings. Further, Command Staff officers met with representatives at St. Vincent’s school to discuss the same issues. We are constantly working with our public and private schools to ensure that they are the most safest and secure. As of November 22, 2023 the fire department responded to a total of ninety-seven calls for the month of November. In the past week the fire department has responded to two major motor vehicle crashes. On November 20th there was a single car crash on Green Avenue which took down a utility pole near the golf course. Extrication tools were needed to remove a door to get the driver out of the car. The two occupants in the car were transported to the hospital. On November 21st a head on collision took place on Park Avenue. One of the cars was an electric vehicle. Firefighters found the driver of the EV still in the vehicle with the car still in drive. Our new EV “Emergency Plug” was deployed which goes into the charging socket of the car. As a result of this the car thinks it is being charged and a mandatory built-in safety feature prevents it from being able to move. The fire department also utilized state of the art software that just by entering the license plate number all the precautions of that vehicle can be found. This includes battery locations, power disconnects, emergency operations and airbag locations. The two people in the accident were transported to the hospital. The Fire Department along with members of the police department started the NJ Transit Rail Safety for the 1st responder course. There is one more classroom session then hands on training will start at a selected NJ Transit Rail Yard. There Madison 1st responders will get hands on rescue training on rail equipment that serves Madison. The fire department is looking for volunteers. Health Mr. Haralampoudis, Chair of the Committee, made the following comments: The Madison Alliance Addressing Substance Abuse, MAASA, held a meeting on November 17th and announce grant applications accepted by Morris County. The Madison Health Department held an influenza vaccine clinic on November 16th and a blood pressure screening clinic on November 21st. The Department reminds residents the COVID testing kits are available at the Health Department. The Health department is working with the Police Department to employ the NJ Arrive Program, to provide mental health services, assisting the Police Department beginning in January. Finance and Borough Clerk Ms. Honohan, Chair of the Committee, made the following comments: From the Tax Department, the Tax Sale will be held on December 7th. The tax sale process is a way for municipalities in New Jersey to obtain the full amount of property taxes and other charges needed to support the annual budget, while providing the property owner with additional time to pay off what they owe. The Borough has advertised what parcels are scheduled to go on Tax Sale in the Madison Eagle. The property owners have the opportunity to pay off the liability before the December 7th Tax Sale. Also, the deadline for filing the ANCHOR benefit application is December 29, 2023. This program replaces the Homestead Benefit program. Unlike Homestead, the ANCHOR is paid by direct deposit or check, not as a credit off of your property taxes, and it is available to both homeowners AND renters or tenants. Homeowners with income under $250,000 and renters with income under $150,000 are eligible. From the Finance Department, Resolution 327—2023 is on the consent agenda this evening which cancels electric capital ordinances. After a capital PAGE 4 OF 18 Regular Meeting Minutes – November 27, 2023 project is completed, there are typically excess funds in the ordinance. Those ordinances are then officially cancelled via resolution so that money can be available for future ordinances and projects. This evening, we are introducing an ordinance for another important project for the Electric Utility, specifically a SCADA system. SCADA stands for Supervisory Control And Data Acquisition. This new system will help us better monitor the performance of our substations and electric distribution system. By cancelling the ordinances with Resolution 327-2023, we are freeing up funds so we can dedicate them to the new SCADA system. Administration also plans on having a resolution on the December Council Meeting to cancel certain balances in previously funded general capital and water capital ordinances. The Municipal Budget Season is here. We anticipate having our first budget presentation at the next Council meeting. As we have done for the past few years, we will discuss capital items during our December Council meeting. No action will be taken, but this will give Council and the public an opportunity to see the five year capital plan and the projects that will hopefully be funded and completed in 2024. AGENDA DISCUSSIONS 11/27/2023-1 PREQUALIFICATIONS FOR RESTORATION OF HDM EAST WING Tyler Merson, HDM Trustees representative, explained the proposed East Wing project, providing details of the construction plan including creation of 3000 sqft of office space, the Madison Historical Society museum on the second floor and the addition of an elevator and updated HVAC, plumbing and electrical systems. Mayor Conley opened the meeting to the public for comments. Since no member of the public wished to be heard, the invitation for comments was closed. Resolution 319-2023 is listed on Consent Agenda. ADVERTISED HEARINGS The ordinances scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on November 13, 2023, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: PAGE 5 OF 18 Regular Meeting Minutes – November 27, 2023 ORDINANCE 56-2023 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $125,000.00 FROM THE MUNICIPAL OPEN SPACE, RECREATION AND HISTORIC PRESERVATION TRUST FUND TOWARDS THE PURCHASE OF THE MADISON MASONIC LODGE, 170 MAIN STREET WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to purchase the Madison Masonic Lodge, 170 Main Street; and WHEREAS, the Borough has previously been generously awarded a $1,000,000.00 grant from resident Martin Heller for the purchase of the Masonic Lodge; and WHEREAS, the Borough Council has determined that the Borough should appropriate $125,000.00 from the Open Space, Recreation and Historic Preservation Trust Fund for this purpose; and WHEREAS, the Open Space Advisory Committee has unanimously recommended the full funding of this request; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $125,000.00 for this purpose in the Open Space Recreation and Historic Preservation Trust Fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $125,000.00 is hereby appropriated from the Open Space, Recreation and Historic Preservation Trust Fund towards the cost of purchasing the Madison Masonic Lodge. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance x-2023. Since no member of the public wished to be heard, the public hearing was closed. Mr. Hoover moved that Ordinance 56-2023, which was read by title, be finally adopted. Ms. Ehrlich seconded the motion. Kathleen Caccavale, Central Avenue, congratulated the Mayor and Council for their efforts in attaining a grant to save the Drew Forest from the Morris County Open Space Trust fund, as well as an award from the New Jersey Municipal Managers Association NJMMA for consistency in supporting staff members. Since no other member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of December 11, 2023 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 57-2023 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $230,000.00 FROM THE ELECTRIC CAPITAL IMPROVEMENT FUND FOR THE DESIGN AND INSTALLATION OF A SCADA SYSTEM AND ACCESSORIES FOR THE ELECTRIC DISTRIBUTION SYSTEM WHEREAS, the Electric Utility Superintendent has recommended that the Borough appropriate $230,000.00 from the Electric Capital Improvement Fund for the design and installation of a SCADA (Supervisory Control and Data Acquisition) System and Accessories for the Electric Distribution System; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the Electric Capital Improvement Fund in an amount not to exceed $230,000.00 for this purpose; and PAGE 7 OF 18 Regular Meeting Minutes – November 27, 2023 WHEREAS, the Borough Council has determined that the Borough should appropriate $230,000.00 from the Electric Capital Improvement Fund for the design and installation of a SCADA system. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $230,000.00 is hereby appropriated from the Electric Capital Improvement Fund for the design and installation of a SCADA System and Accessories for the Electric Distribution System at the Kings Road and James Park Substations. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mr. Landrigan moved that Ordinance 57-2023, which the Borough Clerk read by title, be adopted. Mr. Range seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mr. Hoover, Ms. Ehrlich, Mr. Landrigan, Mr. Range, Mr. Haralampoudis, Ms. Honohan Nays: None R 313-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AN AGREEMENT FOR HEALTH SERVICES WITH THE TOWN OF WESTFIELD WHEREAS, the Borough of Madison wishes to contract with the Town of Westfield for health services of a technical and professional nature as hereinafter set forth, in consideration of payment as hereinafter provided, all according to N.J.S.A. 26:3A2-1 et seq.; and PAGE 8 OF 18 Regular Meeting Minutes – November 27, 2023 WHEREAS, the Borough Council has determined to approve an agreement with the Town of Westfield; and NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison County of Morris, State of New Jersey, that the Administrator and Chief Financial Officer are hereby authorized to negotiate a three-year contract for health services and the Mayor and Borough Clerk are authorized to execute an Agreement with the Town of Westfield for Health Services in a form approved by the Borough Attorney. R 314-2023 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING THE IRREVOCABLE RESIGNATION OF FIREFIGHTER LUCAS MCCORRY EFFECTIVE JANUARY 5, 2024 WHEREAS, Firefighter Lucas McCorry has advised the Borough in writing of his irrevocable resignation effective January 5, 2024. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that the irrevocable resignation of Firefighter Lucas McCorry is hereby acknowledged and accepted with appreciation for his public service. R 315-2023 RESOLUTION OF THE MADISON BOROUGH COUNCIL APPOINTING PATRICK COLLIGAN TO THE POSITION OF PROBATIONARY FIREFIGHTER WHEREAS, the Acting Fire Chief has recommended the appointment of Patrick Colligan to the position of probationary firefighter in the paid division of the Madison Borough Fire Department in recognition of the Fire Department assuming EMS Services; and WHEREAS, the Personnel Director has certified that Patrick Colligan is a fully qualified firefighter and is the number one candidate on the current hiring list; and WHEREAS, the Mayor and Council have reviewed the recommendation and accept the representations that Patrick Colligan has met all requirements to be a probationary firefighter in the paid division. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Patrick Colligan is PAGE 9 OF 18 Regular Meeting Minutes – November 27, 2023 hereby appointed to the position of probationary firefighter in the paid division of the Madison Borough Fire Department. BE IT FURTHER RESOLVED, that he be compensated in accordance with the terms of the Collective Bargaining Agreement between the Firemen’s Mutual Benevolent Association Local No. 74 and the Borough. The effective starting date to be November 28, 2023 or as determined by the Acting Fire Chief. R 316-2023 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING THOMAS A. MEDER, JR. TO THE POSITION OF PROBATIONARY POLICE OFFICER WHEREAS, the Madison Borough Chief of Police has recommended that Thomas A. Meder, Jr. be appointed to the position of Probationary Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Thomas A. Meder, Jr. to the position of Probationary Police Officer in the Madison Police Department. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Thomas A. Meder, Jr. is hereby appointed to the position of Probationary Police Officer in the Madison Police Department effective immediately, to be compensated in accordance with the Police Benevolent Association Collective Bargaining Agreement and subject to the terms of the attached executed employment offer. R 317-2023 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING SANTIAGO RENDON TO THE POSITION OF PROBATIONARY POLICE OFFICER WHEREAS, the Madison Borough Chief of Police has recommended that Santiago Rendon be appointed to the position of Probationary Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Santiago Rendon to the position of Probationary Police Officer in the Madison Police Department. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Santiago Rendon is hereby appointed to the position of Probationary Police Officer in the Madison Police Department effective immediately, to be compensated in accordance with the Police PAGE 10 OF 18 Regular Meeting Minutes – November 27, 2023 Benevolent Association Collective Bargaining Agreement and subject to the terms of the attached executed employment offer. R 318-2023 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING BRANDON LAKE TO THE POSITION OF PROBATIONARY POLICE OFFICER WHEREAS, the Madison Borough Chief of Police has recommended that Brandon Lake be appointed to the position of Probationary Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Brandon Lake to the position of Probationary Police Officer in the Madison Police Department. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Brandon Lake is hereby appointed to the position of Probationary Police Officer in the Madison Police Department effective immediately, to be compensated in accordance with the Police Benevolent Association Collective Bargaining Agreement and subject to the terms of the attached executed employment offer. R 319-2023RESOLUTION OF THE BOROUGH OF MADISON ADOPTING PREQUALIFICATION REGULATIONS WHEREAS, on November 27, 2023, the Borough Council of the Borough of Madison conducted a public hearing to consider the terms and conditions of the Prequalification Regulations for the restoration of the East Wing of the Hartley Dodge Memorial Building; and WHEREAS, the Prequalification Regulations were prepared by the Borough Engineer for the project; and WHEREAS, the Borough Council has reviewed the Prequalification Regulations and has made a determination that the requirements will insure that the restoration of the East Wing of the Hartley Dodge Memorial Building is performed by a contractor having knowledge and experience in historic restoration. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Prequalification Regulations attached hereto are hereby approved and adopted. PAGE 11 OF 18 Regular Meeting Minutes – November 27, 2023 R 320-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AN AGREEMENT BETWEEN THE BOROUGH OF MADISON POLICE DEPARTMENT AND THE MENTAL HEALTH ASSOCIATION TO ESTABLISH JOINT PARTICIPATION IN THE ARRIVE TOGETHER PROGRAM WHEREAS, the Madison Police Chief has recommended that the Borough Council approve execution of a Memorandum of Understanding to establish joint participation in the Arrive Together Program to enhance and support response to certain behavioral health crisis calls, along with members of participating Police Departments; and WHEREAS, the Borough Council has determined to approve the execution of the Memorandum of Understanding attached hereto. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, and State of New Jersey, that the Police Chief is hereby authorized to execute on behalf of the Borough of Madison the Memorandum of Understanding with the Mental Health Association, in a form approved by the Borough Attorney. R 321-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING FINAL PAYMENT AND CHANGE ORDER REQUEST FROM NATIONAL WATER MAIN CLEANING CO. IN THE AMOUNT OF $10,313.45 FOR SEWER LINING REPLACEMENT PROJECT WHEREAS, a contract for Sewer Lining Repair was awarded to National Water Main Cleaning Company, Inc. of Caton, Massachusetts, in the amount of $337,777.00., by Resolution 128-2023; and WHEREAS, the Borough Engineer has recommended approval of a change order to the contract for changes that were encountered during the storm sewer replacement, bringing the contract total to $348,090.45; and WHEREAS, the Borough Engineer has advised that the project has been completed and has recommended approval of final payment including the change order to National Water Main Cleaning Co., in an amount not to exceed $10,313.45; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount sufficient for this purpose, which funds were appropriated by Ordinance 7-2023. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the final payment and change order request from National Water Main Cleaning Co. of Caton, PAGE 12 OF 18 Regular Meeting Minutes – November 27, 2023 Massachusetts, in the total amount not to exceed $10,313.45 for the storm sewer lining project is authorized. R 322-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE NEW JERSEY DEPARTMENT OF COMMUNITY AFFAIRS FOR PROTECTIVE EQUIPMENT FOR FIREFIGHTERS Whereas, the Borough of Madison desires to apply for and obtain a grant from the New Jersey Department of Community Affairs for approximately $75,000 to carry out a project to purchase personnel protective equipment for firefighters. Now Therefore, Be It RESOLVED, 1) hat the Borough of Madison does hereby authorize the application for such a grant; and, 2) that the Borough of Madison recognizes and accepts that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey Department of Community Affairs, does further authorize the execution of any such grant agreement; and also, upon receipt of the fully executed agreement from the Department, does further authorize the expenditure of funds pursuant to the terms of the agreement between the Borough of Madison and the New Jersey Department of Community Affairs. Be it further RESOLVED, that the persons whose names, titles, and signatures appear below are authorized to sign the application, and that they or their successors in said titles are authorized to sign the agreement, and any other documents necessary in connection therewith: R 323-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A CONTRACT TO FACILITIES SOLUTIONS GROUP (FSG) UNDER THE INTERLOCAL PURCHASING SYSTEM NATIONAL COOPERATIVE “TIPS” FOR THE PURCHASE OF LED LIGHT FIXTURES WHEREAS, the Borough of Madison may by resolution and without advertising for bids, purchase any goods or services under a cooperative pricing system of which the Borough is a member; and WHEREAS, the purchase of goods and services by a local contracting unit through a cooperative pricing system is authorized by Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and PAGE 13 OF 18 Regular Meeting Minutes – November 27, 2023 WHEREAS, Facilities Solutions Group (FSG), Inc. of Perth Amboy, New Jersey has been awarded The Interlocal Purchasing System (TIPS) contract # 21060101: Penn Globe LED Light fixtures for lampposts; and WHEREAS, the Borough of Madison anticipates entering into contract, individually or in the aggregate, in an amount not to exceed $85,000.00. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: The Borough Administrator is hereby authorized and directed on behalf of the Borough to execute contracts to Facilities Solution Group (FSG), Inc. in an amount not to exceed $85,000.00 under The Interlocal Purchasing System (TIPS) Contract #21060101, contingent on availability of funds. R 324-2023 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2023 WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison will receive $30,179.92 from the National Opioids Settlement Fund Trust and wishes to amend its 2023 Budget to include this amount as revenue. R 325-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEMBERSHIP IN THE PASSAIC COUNTY COOPERATIVE PRICING SYSTEM ID#38PCCP WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration; and WHEREAS, the County of Passaic, hereinafter referred to as the ‘Lead Agency’ has offered voluntary participation in a Cooperative Pricing System for purchase of goods and services; and WHEREAS, on November 27, 2023, the governing body of the Borough of Madison, County of Morris, State of New Jersey duly considered participation in a Cooperative Pricing System for the performance of goods and services. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey as follows: 1. This Resolution shall be known and may be cited as the Passaic County Cooperative Pricing System Resolution of the Borough of Madison. 2. Pursuant to the provisions of N.J.S.A. 40A:11-11(5), the Mayor is hereby authorized to enter into a Cooperative Purchasing Agreement with Lead Agency. 3. The Lead Agency shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the revised statutes of the State of New Jersey. 4. The Resolution shall take effect immediately upon passage. R 326-2023 RESOLUTION OF THE BOROUGH OF MADISON CONFIRMING MEMBERSHIP OF ROBERT KELLY IN THE MADISON HOSE COMPANY #1 WHEREAS, the Acting Fire Chief has advised that Mr. Robert Kelly was voted into the Madison Hose Company #1 as a volunteer firefighter; and WHEREAS, Section 18-27 of the Madison Borough Code requires that each person so voted shall be confirmed as a member of such division by the Council of the Borough of Madison. R 327-2023 RESOLUTION OF THE BOROUGH OF MADISON CANCELING COMPLETED ELECTRIC CAPITAL IMPROVEMENT ORDINANCES WHEREAS, the Chief Financial Officer has reviewed a list of open Electric Capital projects and has determined that certain Electric Capital projects have been completed and the improvement authorization accounts should be closed; and WHEREAS, the Chief Financial Officer has recommended that the Council adopt a Resolution canceling the open dollar balances in such completed projects; and WHEREAS, the Borough Council has determined to make such cancellation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the list of open Electric Capital ordinances annexed hereto are hereby cancelled. R 329-2023 RESOLUTION OF THE BOROUGH OF MADISON RATIFYING APPOINTMENT OF INTERN MEGAN COLLINS AS PART-TIME, UNPAID INTERN FOR THE FIRE DEPARTMENT WHEREAS, the Acting Fire Chief has recommended the appointment of Megan Collins as part-time unpaid Intern for the Madison Fire Department; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the appointment of Megan Collins, as part-time unpaid Intern for the Madison Fire Department, is hereby approved. R 330-2023 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING JANET WAGSTAFF TO THE POSITION OF SENIOR OFFICE ASSISTANT IN THE CLERK’S OFFICE TO SUPPORT THE HEALTH DEPARTMENT WHEREAS, the Borough Administrator has recommended appointing Janet Wagstaff to the position of Senior Office Assistant in the Clerk’s Office to support the Health Department at her current salary; and WHEREAS, Ms. Wagstaff has agreed to pursue obtaining her Certified Municipal Registrar (CMR) License within 9 months and Registered Municipal Clerk (RMC) License as soon as possible thereafter; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that Janet Wagstaff is hereby appointed to the position of Senior Office Assistant in the Clerk’s Office to support the Health Department.
