MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON December 11, 2023 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 11th day of December, 2023. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2023. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence in remembrance of Madison resident Erminia A. Rossi. APPROVAL OF MINUTES – None GREETINGS TO PUBLIC Mayor Conley made the following comments: Friends of the Drew Forest Holiday Song Member of the Friends of the Drew Forest sang the tune Over the River and Through the Woods for the Forest we need to save. Mayor Conley thanked the members for the song and all their efforts to save the forest. Madison Police Department Officers Swearing in Ceremony Mayor Conley administered the Oath of Office to recently appointed Police Officers Thomas Meder, Jr. and Santiago Rendon, who were surrounded by family. There was a long round of applause. Probationary Firefighter Swearing in Ceremony Mayor Conley administered the Oath of Office to recently appointed Probationary Firefighter Patrick Colligan, who was surrounded by family. There was a long round of applause. REPORTS OF COMMITTEES Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: Please visit the holiday village at the Train Station this season once again, provided through the generosity of the Madison Christmas Committee. Visits with Santa will again be booked through www.rosecitychristmas.com. There are two more Saturdays for the Secret Santa Giveaway and downtown caroling. Look for them on PAGE 2 OF 23 Regular Meeting Minutes – December 11, 2023 December 16th and 23rd. The Downtown Development Commission will meet on Thursday, December 14th, at 7:15 in the 2nd Floor Committee Room at the Hartley Dodge Memorial Building. This meeting is open to the public, and all are invited to attend. The Madison Area Chamber of Commerce is thrilled to announce the release of Madopoly, a limited-edition board game tailored exclusively for Madison, NJ. Priced at $40, Madopoly is now available at the following locations: Alfred’s Sport Shop, Madison Pharmacy, Museum of Early Trades & Crafts, The Nature of Reading Bookshop, The Pink Pear, and Tons of Toys. Supplies are limited. The Madison Weekend of Dance was held at the Arts Center from Thursday, November 30th, through Sunday, December 3rd. Two of the four performances were sold out. Another dance event is planned in the spring. The Morris County Mostly Dance Festival from April 25th through May 5th will include dance companies and dance performances, films on dance, a play about dance, and two days of music. As part of this, the Drew University Dance Department will present its spring dance concert on-site for three performances and use both the inside and outside spaces. The Music Open Mic continues its monthly run on Wednesday, December 13, 2023 at 7:00 pm. Spotlight Kids will present Madeline’s Christmas from December 15th to December 17th. Tickets are available at https://www.madisonartsnj.org/mcac/. The year 2023 was an excellent one for the Madison Community Arts Center. It is estimated that 16,700 people will have attended events at the center in 2023. There have been a total of 778 separate events. Public Works and Engineering Ms. Ehrlich, Chair of the Committee, made the following comments: The Engineering department reports that the Library interior demolition has been completed and construction materials are onsite. The Borough has received a municipal grant for reconstruction of Longview and Valley Roads. The Department of Public Works continues to pick up leaves around town. As soon as they finish with the bulk of the leaves, they will send the vacuums around and the street sweeper. Next the department will be moving on to leaf collection at the municipal parks. The ice rink will be set up for ice skating as weather permits. If there is a solid below freezing cold spell the rink will be filled. Utilities Mr. Landrigan, Chair of the Committee, made the following comments: The Electric Department installed a new 200 amp 3 Phase temporary service at 120 Madison Avenue, the site of the new Mosque. The Department has started the semi-annual Underground Transformer Vault and Manhole maintenance where debris and storm water is removed, and staff checks the equipment, connections, and gauges. Ed Jinks, the Consulting Engineer, conducted Arc Flash Training for the Electric Department personnel at both the James Park and Kings Road Substations. The Water Department repaired a leaking hydrant on Park Lane and the Skating Rink is ready to be filled with water with the arrival of colder weather. The Water Department was busy with water utility location mark-outs due to PSE&G’s renewal of their gas mains and services in the Morris Place and Fairwood Road section of town. Public Safety Mr. Range, Chair of the Committee, made the following comments: On Sunday December 10th, Madison Police were represented at the Menorah lighting celebration hosted by Chabad of Southeast Morris County on the front lawn of Madison Train Station. On December 20th police personnel will be taking part in the Winter Solace on Waverly Place at 6:00 pm. The event is hosted by The Interfaith Council and it represents the longest night of the year. Directly following PAGE 3 OF 23 Regular Meeting Minutes – December 11, 2023 the Christmas Parade, it is a yearly tradition to award our Chief Vincent D. Chirico Officer of the Year. This year Patrolman Renato Capillas was the recipient of the award, which is voted on by the members of the police department. We congratulate Patrolman Capillas for his hard work and dedication to the department and to the citizens of Madison. The Fire Department reports for the month of November, the fire department responded to twenty six general alarms, eighteen still alarms, nineteen investigations and sixty-seven medical calls for a total of 130 calls. So far this year the fire department has responded to 1,320 emergency calls. One December 1st, the Fire Department responded to a reported fire at 41 Prospect Street. Firefighters found a dumpster on fire which started to extend into the house that was under construction. Firefighters quickly extinguished the fire in the dumpster and stopped the fire that had extended into the house. On December 4th the fire department responded to a car fire on Route 24, and on December 9th the Fire Department responded to a structure fire in Whippany. In an unusual event today on Wyndehurst Drive, a Rumba Robot vacuum drove itself into an active fireplace where it ignited. The homeowner was able to extinguish the robot before the fire department arrived. Sadly, the robot did not survive. The Fire Department along with some members of the Police Department completed the NJ Transit Rail Safety for the 1st responder course. Some members traveled to the NJ Transit yard in Kearney where they did hands-on training with the locomotives and passenger cars. Health Mr. Haralampoudis, Chair of the Committee, made the following comments: The staff of the Bloomfield Health Department are working with the staff of the Westfield Health Department coordinating paperwork regarding grants. All grants will be honored by the State, transferred to Westfield. On December 6th the department held a Blood Pressure screening clinic and on December 12th at the Redford Tucker Senior Housing. The department will hold an additional clinic. A rabies vaccination clinic was held December 2nd, with 77 vaccines administered. In 2024, the Board of Health will conduct a community health assessment, and the Board asks that as many residents as possible participate. Finance and Borough Clerk Ms. Honohan, Chair of the Committee, made the following comments: There are three important Finance Department items on the agenda. First, there is a short discussion by the Chief Financial Officer on the Five Year Capital Plan. The plan is available for viewing on Rosenet under the Annual Budget Process page. The CFO, Administrator, Tax Collector and Engineer have worked with the various department heads to develop the comprehensive plan. Increased costs due to supply chain issues and inflation, along with other budgetary pressures are forcing causation with municipally funded capital projects. This is a plan and it is not set in stone. In order for a project to receive funding, the Council must take action at two separate Council meetings. The Five Year Capital Plan is just that, a plan, and it helps the Borough manage and understand upcoming capital projects. The second capital item on the agenda is Budget Transfers. State Statute permits transfer of funds from one budget line to another during the last two months of the current budget year and the first three months of the following year. There are a number of statutory cap related restrictions on how funds can be transferred. The third item on for this evening is the funding of the solar carport. The upcoming presentation will show the project cashflows along with the expected rebates and savings. The governing body introduced ordinance 33-2023 at the May 8, 2023 Council meeting and there was a hearing and adoption of the ordinance at the May 22nd meeting. This was a bond ordinance to appropriate funds for the project. The funds are in PAGE 4 OF 23 Regular Meeting Minutes – December 11, 2023 place and the construction documents are near completion, so Administration will be asking for permission to move this project forward and go out to bid. The hope is to have construction over the summer. The annual Tax Sale was held on Thursday December 7th. One parcel had a lien sold to an outside bidder. The winning bid came with a premium of $115,000. This is an extra amount the bidder pays that is kept in a trust. The Borough is able to earn interest on this premium while the lien exists, and a refund of the original premium is returned to the bidder when the lien is redeemed. As a reminder, the Borough holds an annual tax sale for all prior year utility and property tax delinquencies. After the property tax sale occurs, the lien holder pays off the outstanding prior year delinquency. Performing annual tax sales helps make sure that the Borough does not have multiple years of delinquent taxes and utility bills on the books. COMMUNICATIONS AND PETITIONS – None INVITATION FOR COMMENT (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Kenneth Spencer; Chapel Street, raise concern regarding fencing at Dodge Field and asked that additional staff be hired for the Department of Public Works. Claire Whitcomb; Fairwood Road thanked the mayor and council for approving a resolution for funding of the Drew Forest. Since no other member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 12/11/2023-1 PILOT ELECTRIC GRID STUDY PRESENTATION Ms. Ehrlich provided the final presentation in the Climate Action process for 2023. The Climate Action Committee recommendation for 2024 is to pursue an electric utility grid pilot program to document infrastructure as demands on the grid grow. A $10,000 grant is available from NJ BPU for a study to be incorporated into a Community Energy Plan. The Committee is preparing a Community Energy Plan based on goals and actions adopted in 2023 through the Climate Action Report and Recommendations. The governing body supported the use of the grant money to develop a pilot program for grid documentation and analysis. 12/11/2023-2 MRC SOLAR CARPORT NEXT STEPS Mr. Burnet introduced Mr. Peter Fried, Climate Action Committee and Sustainable Madison Advisory Committee member, who provide information on the process for solar carport construction, including the financial incentives from the State and Federal governments and the steps necessary for a typical Federal Elective Pau ITC timeline. The committee has asked Council to approve moving forward with bidding the solar carport at the MRC, following State procurement regulations. There was no objection to the request to authorize funding. PAGE 5 OF 23 Regular Meeting Minutes – December 11, 2023 12/11/2023-3 BUDGET TRANSFER & FIVE-YEAR CAPITAL PLAN Mr. Burnet noted a resolution authorizing budget transfers permissible by State statute. A resolution is listed on the Consent Agenda. Mr. Burnet also noted that the 5 year capital plan is available on rosenet.org, which contains purchases and projects compiled by Administration and Department Heads. Mr. Burnet pointed out that there are no new road improvements project included. Resolution 331-2023 listed on the Consent Agenda ADVERTISED HEARINGS The ordinance scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on November 27, 2023, was introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinance 57-2023 for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 57-2023 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $230,000.00 FROM THE ELECTRIC CAPITAL IMPROVEMENT FUND FOR THE DESIGN AND INSTALLATION OF A SCADA SYSTEM AND ACCESSORIES FOR THE ELECTRIC DISTRIBUTION SYSTEM WHEREAS, the Electric Utility Superintendent has recommended that the Borough appropriate $230,000.00 from the Electric Capital Improvement Fund for the design and installation of a SCADA (Supervisory Control and Data Acquisition) System and Accessories for the Electric Distribution System; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the Electric Capital Improvement Fund in an amount not to exceed $230,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $230,000.00 from the Electric Capital Improvement Fund for the design and installation of a SCADA system. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $230,000.00 is hereby appropriated from the Electric Capital Improvement Fund for the design and installation of a SCADA System and Accessories for the Electric Distribution System at the Kings Road and James Park Substations. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Since no member of the public wished to be heard, the public hearing was closed. Mr. Landrigan moved that Ordinance 57-2023, which was read by title, be finally adopted. Mr. Range seconded the motion. Kayla Peng, Warren Place, Ridgewood, NJ, noted information regarding using green bonds to finance solar power systems, stating solar energy systems, financed using green bonds, can generate positive cash flow even in the case of a town that does not have the upfront capital to fund a solar project. R 333-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION GREEN ACRES ENABLING RESOLUTION AND APPLICATION (DREW FOREST ACQUISITION - $5,500,00.00) WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and WHEREAS, Madison Borough has previously obtained a Green Acres grant of $4,875,000 from the State to fund the following project(s): #1417-04-009 Madison Borough Open Space Acquisition PAGE 9 OF 23 Regular Meeting Minutes – December 11, 2023 WHEREAS, Madison borough desires to further the public interest by requesting an additional Green Acres grant of $5,500,000 to fund the acquisition of the following project: Drew Forest, 50.9 acres, Part of Block 3001, Lot 1 WHEREAS, the State shall determine if the supplemental funding request is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and WHEREAS, the applicant is willing to use the State’s funds in accordance with its rules, regulations and applicable statutes, and is willing to enter into an Amendment of the Agreement with the State for the above-named project; NOW, THEREFORE, the governing body/board resolves that: 1. Robert Conley, or the successor to the office of Mayor, is hereby authorized to: (a) request such a grant, (b) provide additional information and furnish such documents as may be required, and (d) act as the authorized correspondent of Madison Borough; and 2. The Borough agrees to provide the local government/nonprofit share if a match is required. 3. R 334-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SUBMISSION OF GRANT APPLICATION TO STATE OF NEW JERSEY GREEN ACRES PROGRAM FOR THE DODGE FIELD ALL ACCESSIBLE PLAYGROUND (75% OF PROJECT COST) WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and WHEREAS, the Borough of Madison desires to further the public interest by obtaining grant funding in the amount of $ 517,500.00, from the State to fund the following project: Dodge Field All Accessible Playground at a cost of $ 690.000.00 (total project cost); WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and PAGE 10 OF 23 Regular Meeting Minutes – December 11, 2023 WHEREAS, the applicant is willing to use the State’s funds in accordance with such rules, regulations, and applicable statutes, and is willing to enter into an agreement with the State for the above-named project; NOW, THEREFORE, the governing body/board resolves that: 1. Robert Conley, or the successor to the office of Mayor, is hereby authorized to: (a) make application for such a grant, (b) provide additional information and furnish such documents as may be required, and (e) act as the authorized correspondent of Madison Borough; and 2. The Borough agrees to provide the local government/nonprofit share if a match is required, in the amount of $ 172,500.00. 3. In the event the State’s funds are less than the total project cost specified above, the Borough has the balance of funding necessary to complete the project; The Borough agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project. 6. IN THE AMOUNT OF $10,331.42 BRINGING THE TOTAL AUTHORIZED PAYMENT TO $339,253.95 FOR THE MADISON RECREATION PICKLEBALL/BASKETBALL COMPLEX PROJECT WHEREAS, a contract for the Madison Recreation Complex Multipurpose Court Project, in an amount not to exceed $328,450.00 was awarded to Halecon, Inc., of Bridgewater, New Jersey, by Resolution R 161-2023; and WHEREAS, the Borough Engineer has recommended approval of an additional $10,313.45 change order to reflect increased quantities over the bid amounts in the contract in order to complete the project bringing the contract total to $339,253.95; and WHEREAS, the Borough Engineer has advised the project has been completed and has recommended approval of final payment including the final change order to Halecon, Inc. of Bridgewater, New Jersey; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an additional amount not to exceed $10,331.42 for this purpose, which funds were appropriated by Ordinances 9-2023 and 34-2023 in the amount of PAGE 11 OF 23 Regular Meeting Minutes – December 11, 2023 $340,000.00 and the ordinances contain sufficient funds to include this final payment and change order; NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the final payment and change order request from Halecon, Inc. of Bridgewater, New Jersey, in the total contract amount not to exceed $339,253.95 for the Samson Avenue Improvements Project is authorized. R 338-2023 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING CYNTHIA MAHAFFEY TO THE POSITION OF PART-TIME VIOLATIONS CLERK WHEREAS, the Joint Municipal Court Administrator and the Borough Administrator have recommended that Cynthia Mahaffey be appointed to the position of Part-time Violations Clerk, effective immediately; and WHEREAS, the Borough Council agrees with this recommendation. R 339-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CONTRACT EXTENSION FOR ELECTRIC LINE CLEARANCE SERVICES TO ASPLUNDH TREE EXPERT, LLC OF CEDAR KNOLLS, LLC WHEREAS, a contract for Electric Line Clearance services was awarded by Resolution 94-2023 to Asplundh Tree Experts, LLC, of Cedar Knolls, NJ as a result of public bidding, which contract expires December 31, 2023; and WHEREAS, the bid specifications allowed for a one-year extension of the contract at the request of the Borough; and WHEREAS, the Qualified Purchasing Agent has recommended that the PAGE 13 OF 23 Regular Meeting Minutes – December 11, 2023 Borough award an extension of the contract for preventative maintenance/repair services for an additional one year. R 340-2023 RESOLUTION OF THE BOROUGH OF MADISON SUPPORTING NEW JERSEY LEAGUE OF MUNICIPALITIES CONFERENCE RESOLUTION OPPOSING ASSEMBLY BILL 5659 WHEREAS, local Government is facing the largest budget increase for property/casualty insurance since the mid-1980s; and WHEREAS, the property/casualty budget for the typical municipality has already experienced a 20% to 25% increase since 2021 and will experience another 12% to 20% increase in 2024; and WHEREAS, New Jersey now has the highest workers’ compensation premium rates in the country based on data from the U.S. Bureau of Labor Statistics; and WHEREAS, Workers’ Compensation escalated because New Jersey judges are now reopening cases up to four and five times, whereas in the past they rarely reopened a case more than once; and WHEREAS, Workers’ Compensation costs also escalated because of a 2021 Department of Labor decision that directed workers’ compensation to pay many accidental disability claims that previously were paid by the pension plans; and WHEREAS, another recent law created a presumption that firefighters diagnosed with cancer are eligible for workers’ compensation; and WHEREAS, during the COVID-19 Pandemic, the Legislature approved a law that made COVID contracted by first responders and essential employees compensable under New Jersey’s workers’ statute resulting in the COVID cost per employee being the second highest in the country; and WHEREAS, liability has increased because of the erosion of Title 59 protections in New Jersey’s courts. Judges are now reluctant to grant summary judgement motions dismissing even frivolous claims because of the 2021 New Jersey Supreme Court decision in Gonzalez v. Jersey City; and PAGE 14 OF 23 Regular Meeting Minutes – December 11, 2023 WHEREAS, the recent amendment in the sexual molestation Statute of Limitations also increased Title 59 liability costs. In some cases, towns are being sued based on allegations going back to the 1970s; and WHEREAS, property premiums are increasing rapidly because the world- wide frequency of large natural disasters has almost tripled since 2000. New Jersey alone was hit with Hurricane Irene in 2011, Superstorm Sandy in 2012 and Tropical Storm Ida in 2021; and WHEREAS, property insurance premiums are also indexed to replacement values that have jumped because of supply chain issues and the labor shortage; and WHEREAS, cyber liability premiums have more than doubled in recent years. Organizations without strong cyber risk controls are finding it difficult to purchase any coverage. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that: 1) The Legislature is urged to adopt budget and levy cap exemptions for property/casualty insurance and claims; and 2) The Administration and the Legislature should not adopt additional legislation or regulations that will increase municipal claims without a thorough and complete analysis of the cost; and 3) The New Jersey Department of Labor, the New Jersey Department of Banking and Insurance and the New Jersey Department of Community Affairs should meet with representatives of municipal government to discuss ways to reduce property/casualty costs. R 341-2023 RESOLUTION OF THE MADISON BOROUGH COUNCIL AUTHORIZING A CONTRACT WITH ASPLUNDH ENGINEERING SERVICES FOR THE DESIGN AND INSTALLATION OF A SCADA SYSTEM AND ACCESSORIES FOR THE ELECTRIC DISTRIBUTION SYSTEM WHEREAS, the Electric Utility Superintendent has recommended the execution of a professional service contract with Asplundh Engineering Services, for the design and installation of a SCADA (Supervisory Control and Data Acquisition) System and Accessories for the Electric Distribution System; and WHEREAS, such services constitute professional services for which a contract may be awarded without the need for competitive bidding in accordance with N.J.S.A 40A:11-5(a)(i); and PAGE 15 OF 23 Regular Meeting Minutes – December 11, 2023 WHEREAS, the Chief Financial Officer has attested to the availability of funds in the amount of $202,200.00, which funds were appropriated by Ordinance 57-2023 in the amount of $230,000.00. R 342-2023 RESOLUTION OF THE BOROUGH OF MADISON AWARDING ELECTRIC MATERIAL BIDS TO ANIXTER INC. IN THE AMOUNT OF $49,051.00 AND TO TURTLE & HUGHES IN THE AMOUNT OF $84,900.00 WHEREAS, the Borough of Madison publicly advertised for bids for the purchase of Electric Department materials in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, two bids were received for various electric materials for the Electric Department; and WHEREAS, qualified bids were received from Anixter Inc. of Greenwood, Delaware, and Turtle and Hughes of Bridgewater, New Jersey; and WHEREAS, the Electric Utility Superintendent, Qualified Purchasing Agent, and Borough Attorney have recommended that the Borough Council award a contract for certain electric materials for the Electric Department to Anixter Inc. in an amount not to exceed $49,051.00, and a contract for certain electric materials to Turtle & Hughes in an amount not to exceed $84,900.11; and WHEREAS, the Chief Financial Officer has attested that funds will be available in an amount not to exceed $311,951.11 for this purpose, in Electric Utility Operations Account 502, sub-account 200. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. WHEREAS, the Borough of Madison publicly advertised for bids for the purchase of new Pad-Mount Transformers in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, the submission of the apparent low bidder, EB Solutions, LLC is hereby rejected, on the advice of the Borough Attorney, due to their failure to acknowledge the receipt of the (2) two issued addenda which is an incurable defect; and, WHEREAS, the lowest qualified bid was submitted by underbidder Anixter Inc. in the amount of $204,738.00; and, WHEREAS, the Qualified Purchasing Agent, Borough Electric Utility Superintendent and Borough Attorney have recommended that the Borough Council award the contract to Anixter, Inc., in the amount of $204,738.00; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $204,738.00 for this purpose in Ordinance 46-2023. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The contract for the purchase of new unused transformers is hereby awarded to Anixter, Inc. based upon its bid in the amount of $204,738.00. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to enter into the contract with Anixter, Inc., in a form acceptable to the Borough Attorney. R 344-2023 RESOLUTION OF THE BOROUGH OF MADISON TO AMEND THE RULES AND REGULATIONS OF THE MADISON FIRE DEPARTMENT’ WHEREAS, Chapter 18, Section 2 of the Borough Code authorizes the Council to adopt, amend and repeal Regulations of the Madison Fire Department; and WHEREAS, the Chief of the Fire Department has recommended that the Council adopt new rules and regulations of the Madison Fire Department entitled “Madison Fire Department Rules & Regulations” a copy of which was presented to the Borough Council and is attached hereto; and PAGE 17 OF 23 Regular Meeting Minutes – December 11, 2023 WHEREAS, the Borough Council agrees with this recommendation. R 345-2023 RESOLUTION OF THE BOROUGH OF MADISON, COUNTY OF MORRIS, STATE OF NEW JERSEY CANCELING TAXES FOR THE PROPERTY LOCATED AT BLOCK 4501, LOT 3 WHEREAS, the Tax Assessor of the Borough of Madison has deemed that the property located at Block 4501, Lot 3 on the Borough Tax Map, with a street address of 203 Green Ave (‘Subject Property’), was, for Tax Years 2022 and 2023, used by a religious corporation in accordance with N.J.S.A. 54:4-3.6 and therefore is 100% exempt from property taxes for said Tax Years; and WHEREAS, the Subject Property had previously, for Tax Years 2022 and 2023, been assessed as ‘taxable’; and WHEREAS, for Tax Years 2022 and 2023, the outstanding taxes, interest, and penalties currently owing in connection with the Subject Property amount to $48,495.08; and WHEREAS, it is the recommendation of the Tax Assessor that taxes, interest, and penalties assessed to the Subject Property for Tax Years 2022 and 2023 should now be canceled; and WHEREAS, the Borough Council agrees with this recommendation. R 346-2023 RESOLUTION OF THE BOROUGH OF MADISON APPROVING PROPERTY TAX EXEMPTION STATUS FOR TAX BLOCK 3701, LOT 11 EFFECTIVE DECEMBER 4, 2023 FOR WARTIME SERVICE-CONNECTED DISABILITY WHEREAS, the owner of Tax Block 3701, Lot 11 of the taxing district of PAGE 18 OF 23 Regular Meeting Minutes – December 11, 2023 the Borough of Madison is a citizen and resident of the State of New Jersey, who served in the United States military in time of war; and WHEREAS, the owner of Tax Block 3701, Lot 11 of the taxing district of the Borough of Madison has been honorably discharged from the United States military and has been found by the United States Department of Veterans Affairs to have a 100% service-connected, permanent disability; and WHEREAS, N.J.S.A. 54:4-3.30 provides that the dwelling house of any citizen of this State, who is honorably discharged from active military service in time of war and is declared to be 100% permanently disabled by the United States Veterans Administration or its successor, shall be exempt from property taxation; and WHEREAS, the Borough Tax Assessor has determined that the property owner is eligible for the tax exemption beginning December 4, 2023, pursuant to N.J.S.A. 54:4-3.30. R 350-2023 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AMENDING MEMORANDUM OF UNDERSTANDING WITH THE TOWNSHIP OF CHATHAM FOR STYROFOAM AND FOOD WASTE RECYCLING WHEREAS, the Borough of Madison (“Borough”) wishes to amend a Shared Service Agreement with the Township of Chatham facilitating Styrofoam recycling and food waste composting including compost bins located at the Kings Road parking at the Madison Department of Public Works recycling center; and WHEREAS, Chatham Township residents will continue to bring Styrofoam and food scraps to the Madison Department of Public Works yard for recycling; and WHEREAS, an annual fee of $1,500.00 will be billed to the Township of Chatham within the first quarter to offset Styrofoam Recycling costs from Long Hill Township; and WHEREAS, the Borough Administrator recommends amending the agreement. NOW THEREFORE BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris in the State of New Jersey that Raymond M. Codey, Borough Administrator is hereby authorized to amend the Memorandum of Understanding. R 352-2023 RESOLUTION OF THE BOROUGH OF MADISON WAIVING OF PERMIT AND INSPECTION FEES FOR THE BOROUGH’S AFFORDABLE HOUSING PROJECT WHEREAS, Walnut Street, L.P. will construct affordable apartment units at Walnut Street and Community Place, known as Block 1601 Lot 42 and Lot 1.01; and WHEREAS, said property is to be purchased from the Borough of Madison and a Development Agreement was entered into with the Borough of Madison in regard to development of low income housing on said property; and WHEREAS, the Development Agreement previously executed obligates the Borough of Madison to waive permit and inspection fees; and WHEREAS, the affordable apartments are to be developed for one hundred- percent-affordable housing which is an inherently beneficial use. THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Madison, in the County of Morris and State of New Jersey that the municipal permit and inspection fees are hereby waived for this project based on the foregoing considerations.
