MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON January 22, 2024 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 22nd day of January, 2024. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2024. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Ms. Ehrlich seconded the motion, which passed with a unanimous voice call vote recorded. Mr. Range moved approval of the Regular Meeting Minutes of December 11, 2024, with the following amendment: Page 5 of 9, 12/11/2023-1 PILOT ELECTRIC GRID STUDY PRESENTATION Ms. Ehrlich provided the final presentation in the Climate Action process for 2023. The Climate Action Committee recommendation for 2024 is to pursue an electric utility grid pilot program to document infrastructure as demands on the grid grow. A $10,000 grant is available from NJ BPU for a study to be incorporated into a Community Energy Plan. The Committee is preparing a Community Energy Plan based on goals and actions adopted in 2023 through the Climate Action Report and Recommendations. The governing body supported the use of the grant money to develop a pilot program for grid documentation and analysis. Ms. Ehrlich seconded the motion, which passed with a unanimous voice call vote recorded. Mr. Range moved approval of the Executive Minutes of January 8, 2024. PAGE 2 OF 25 Regular Meeting Minutes – January 22, 2024 GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley presented a Certificate of Participation to members of the Madison YMCA Youth in Government present at this evening’s Council meeting. Medallion Presentations Mayor Conley presented medallions to Board and Committee members stepping down after five or more years of service. Cathy Coultas received a medallion for Parks Advisory Committee membership from 1980 to 2023. Melissa Honohan received a medallion for Open Space, Recreation and Historic Preservation Advisory Committee from 2012 to 2023. John J. Forte received a medallion for both Planning Board 2008 to 2023 and Historic Preservation Commission 2004 to 2023. REPORTS OF COMMITTEES Public Safety Mr. Range, Chair of the Committee, made the following comments: On January 18, 2024 Det/Sgt. Ken Shannon took part in a presentation titled “Hidden in Plain Sight” at the Chatham Middle School. The presentation is intended for adults who care for children, providing an opportunity to explore trends in teen substance abuse, signs, symptoms, and lingo, in an effort to raise awareness regarding substance abuse disorders. The event also provides resources and tools to parents to identify prevention and treatment options. Sgt. Shannon takes part in these presentations, held by the U.S. Drug Enforcement Administration (D.E.A.), as a local representative on a panel to discuss local trends. On January 19th, Detective Jerry Mantone graduated as a D.A.R.E. instructor school following two-week in service training. Det. Mantone will immediately be assigned to a 5th grade Madison elementary school class to have as his own. DARE (Drug Abuse Resistance Education) is taught to all 5th grade Madison classes by trained Madison officers and gives the kids the skills they need to avoid involvement in drugs, gangs, and violence. The Madison Fire Department reports that in the month of January in the department responded to seventeen general alarms, eleven still alarms, twenty-five investigations. And forty-four medical calls for a total of ninety-seven calls. The Fire Department would like to remind everyone that if you think you have a gas leak call 911. When you call PSE&G direct, they will call us and ask us to respond as we are much faster. The Department staff has discovered many out-of-date smoke and carbon monoxide detectors. If it is older than 10 years old, it needs to be replaced. If you are a senior citizen the fire department has a program that will replace them for you. This service is free of charge and sponsored by the American Red Cross. Contact the fire department to set up an appointment. The Fire Department is in the final stages of completing its partnership with the Madison Volunteer Ambulance Corps. Finance and Borough Clerk Ms. Ehrlich, Chair of the Committee, made the following comments: The Tax Collector’s office reminds property owners that the first quarter property taxes are due on February 1st. Property owners are reminded to mail their payment PAGE 3 OF 25 Regular Meeting Minutes – January 22, 2024 or use the on-line portal which can be found on rosenet.org. While the Council has already had multiple financial presentations over the last few months, tonight Council starts the budget process in earnest. This evening a report regarding the financial performance of the water and electric utility will be presented. The Electric Utility Superintendent, Jim Mattina and the Public Works Director, Ken O’Brien will present their annual reports. Tonight’s presentation will include steps utility staff are taking to maintain and improve the distribution systems. Finally, voting on the budget is one of the most important actions that Council takes. The Borough utilities billed over $24.5 million dollars in 2023. The single largest budget line in the municipal budget document is the procurement of electricity, which is purchased and then distribute to residents and businesses. The utilities performed well last year, but that there are two significant issues ahead. First we have costly but much needed capital projects that must be addressed. Second, is that the cost of electricity has gone up significantly. While we won’t feel that cost in 2024, effects will definitely be felt in 2025. The governing body works to be transparent and to make information available to residents. Tonight is the first of four scheduled budget presentations. On February 12th, there will be discussion of the municipal budget. On February 26th department head will make annual presentations. On March 11th Council will discuss the budget again and review strategic planning guidelines. Then, on March 25th, there will be one final discussion on the budget, along with the introduction of the official state budget document. As per state statute, there is a four week break so that residents have the opportunity to review the budget document. On April 22nd there will be a hearing and vote to adopt the budget. As a reminder, all budget information is available on the Annual Budget Process page on rosenet.org. Public Works and Engineering Mr. Landrigan, Chair of the Committee, absent. Utilities Mr. Haralampoudis, Chair of the Committee, made the following comments: Mr. Haralampoudis reported that the Electric Department crews disconnected a temporary meter at a home on Belmont Avenue, after a house demolition, as the homeowner and contractor did not have the appropriate permits. At 16 Waverly Place, was getting water into his underground electrical service. Crews re-foamed the pipe in the manhole to make it water tight, and pumped holes at the commercial district vaults. On Academy Road, the Electric Department responded to call for “no power” due to two squirrels on the transformer. Department crews responded to a call of “no power” at the intersection of Central Avenue and Elmer Street. Power was restored in approximately one and half hours. The Electric Department continues to respond to typical monthly activities as well. Community Affairs Ms. Honohan, Chair of the Committee, made the following comments: The Downtown Development Commission plans to reinvent the Madison Farmers Market for the 2024 season. It will now be called the Madison Farm & Artisan Market and will be held on Saturdays from May 25 through December 14 in the Prospect Street Parking Lot, from 10:00 am until 3:00 pm. The hope is that the new format will allow for greater participation closer to the heart of Madison. More information will be available before the end of this month. The Taste of Madison returns at the Madison Hotel on Monday, March 18, 2024. More information will be released shortly. The Chamber of Commerce announces, “After the Holidays Party” to be held this Wednesday, January 24th, at 6:00 p.m. in Encore Speakeasy at Shanghai Jazz Restaurant & Bar. There is no admission fee for the event. Food and PAGE 4 OF 25 Regular Meeting Minutes – January 22, 2024 drinks will be available for purchase. The Chamber introduced a brand new downtown event, the Rose City Chocolate Walk. This event will be held on Saturday, February 10th, and will kick off at 1:00 pm. Local businesses will provide shoppers with chocolate products as they shop, dine, and discover the best Madison has to offer. Two chocolate-making sessions will be offered at the Museum of Early Trades & Crafts from 1:00 - 2:00 pm and 2:30 - 3:00 pm. The cost will be $10 per family. In addition, there will be two screenings of "Willy Wonka & The Chocolate Factory" (1971) at the Madison Community House at 1:00 pm and 3:00 pm. The Madison Arts and Culture Alliance will hold its Madison Broadway Cabaret Fundraiser from 4:00 p.m. to 6:00 p.m. this Sunday. Tickets are available and can be purchased at madisonartsnj.org. The new literary arts organization Yes & will hold its first workshop and open mic of the year this Wednesday starting at 6:00 pm. Ysabel Gonzales, the Dodge Foundation Poetry Festival Creative Officer, heads up the program. Spotlight Kids will hold their second Weekend Workshop on January 26-28, featuring prominent Broadway Actors presenting workshops and demonstrations. Information is on the Spotlight Kids website. A Work of Heart Productions will hold a Bringing Broadway Home Concert on Saturday, February 3rd, from 7:00-9:00 pm. The Summit Film Society will screen the French film Driving Madeleine (with subtitles) on Friday, February 2, 2024. A 2:00 pm matinee has been added to the scheduled 7:30 pm screening. The New Jersey Jazz Society will present the Lance Bryant Trio on Sunday, February 4, 2024, at 3:00 pm. Tickets are available on the MCAC website. Also on February 4th, Arts by the People will present the launch of a new book, Grand Street Revisited by Paul Rabinowitz and Anna Hershinow. Events for the entire year can be viewed on the MCAC landing page at madisonartsnj.org/mcac. Health Mr. Forte, Chair of the Committee, made the following comments: Mr. Forte, reporting for Public Works and Engineering, noted that the Department of Public Works managed a minor snowstorm last week and did not have any major breakdowns. The mechanical staff works hard on the maintenance of our equipment and this is a major factor. The Borough has had a tremendous amount of rain in the last couple of weeks and the Sewer Department was in overnight cleaning drains and maintaining pump stations. With the upgrades the staff has been doing on the pumps stations, we are handling high flow times much better and are seeing less emergencies. Christmas tree pick up continues until the end of the month. Please put your Christmas trees out on by the curb and the Public Works Department will pick up. Residents can also drop off Christmas trees at the recycling center during normal operating hours. The Madison Board of Health held their annual reorganization meeting last week. The Health Department has an important message for resident. Radon is detected in high levels in about 10% of homes in the State. January is Radon Awareness Month, and the department has posted information on the Borough’s Facebook page regarding testing kits. Mr. Forte also noted members of the Madison YMCA Youth in Government program present at tonight’s Council meeting. Mr. Forte stating he began in the same program in high school and it’s great to have members at tonight’s meeting. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email dated January 9, 2024 from David Steketee, Fairwood Road, regarding Frank Iannarone’s participation on the Madison Alliance Addressing Substance Abuse Committee - MAASA. PAGE 5 OF 25 Regular Meeting Minutes – January 22, 2024 INVITATION FOR COMMENT (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Astri Baillie; East Lane, spoke in support of the Dodge Field playground renovation, noting that the time has come to update the playground. New playground proposed plans will be ADA compliant and all inclusive, and asked Council to support the NJ DEP Green Acres funding application. Deb Starker; Beverly Road, Director of the Museum of Early Trades & Craft, thanked the Mayor and Council for their support regarding an application for a National Endowment for the Arts grant for a community wide effort to support literacy. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 01/22/2024-1 NJDEP GREEN ACRES JAKE’S LAW DODGE FIELD ALL ACCESSIBLE PLAYGROUND FUNDING APPLICATION Dennis Harrington, Assistant Borough Engineer presented information regarding an application for NJ DEP Green Acres Jake’s Law Accessible Playground funding, noting that this opportunity, once only available to counties, is now available to municipalities. Mr. Harrington explained that the playground at Dodge Field is now more than twenty years old and in need of upgrading to current playground standards, including both physical and sensory needs. The Borough has worked with several suppliers and visited other inclusive playgrounds. The impact of the playground construction to the environment will be minimal, with minor excavation and minimal noise impact. Construction should take approximately ten weeks to complete. Mayor Conley opened the hearing to the public for any comments. Suzanne Whitehorn; Vinton Road, supporting reconstruction of the Dodge Field playground, noted that her special needs child and many other friends love to use the playground and will thrive with new improvements to the playground. Many local children will benefit. Astha Chouhan; Beverly Road, offered her support for the NJ DEP Green Acres accessible playground grant application, noting that a new playground will be inclusive for the whole community. Since no member of the other public wished to be heard, the invitation for comments was closed. 01/022/2024-2 BUDGET HEARING – ELECTRIC UTILITY, WATER UTILITY AND PUBLIC WORKS Mr. Burnet provided a presentation regarding Public Works, Utilities and Utilities Financial Performance. Ken O’Brien, Director of Public Works and Jim Mattina, Electric Utilities Superintendent explained their department’s 2023 accomplishments, 2024 goals and capital budgets. Mr. Burnet noted that the municipal budget includes three entities, current fund, electric utility and water utility. PAGE 6 OF 25 Regular Meeting Minutes – January 22, 2024 Mr. Burnet noted that the Administration is not making recommendations, or asking for decisions this evening. The draft municipal budget will be presented on February 12th and Administration will have recommendations regarding the dividend program at that time. ADVERTISED HEARINGS The ordinance scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on January 8, 2024, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 1-2024 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 195-32.4 OF THE MADISON BOROUGH CODE ENTITLED “CBD-1, CBD- 2 CENTRAL BUSINESS DISTRICT ZONES REGULATIONS” WHEREAS, pursuant to N.J.S.A. 40:55D-62, the Borough of Madison, in the County of Morris, State of New Jersey (the “Borough”) may adopt or amend Zoning Regulations by Ordinance relating to the nature and extent of the uses of land and of buildings and structures thereon; and WHEREAS, the Borough Council acknowledges the need to accommodate parking within structures in mixed-use buildings in the CBD-1, CBD-2 Central Business District Zones, consistent with the 2022 Zoning Board of Adjustment Annual Report; and WHEREAS, the Land Use Element of the 2020 Borough Master Plan encourages combined residential and commercial development in the CBD, downtown living opportunities, a broad range of well-patronized retail businesses, and pedestrian activity with the aim of fostering a vibrant downtown environment; and WHEREAS, the Borough Master Plan also encourages design elements and attributes that preserve the physical character of the downtown, while ensuring that infill development reflects the context of existing surrounding structures. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison and the County of Morris and State of New Jersey that Chapter 195-32.4 of the Land Development Ordinance of the Borough of Madison, is hereby amended as follows: Section 1 (proposed amendments are indicated in italics and underlined and deletions are struck through): § 195-32.4, CBD1, CBD-2 Central Business District Zones regulations, is hereby amended to read as follows: PAGE 7 OF 25 Regular Meeting Minutes – January 22, 2024 A. Section 2. The Borough Clerk is directed to give notice at least ten (10) days prior to a hearing on the adoption of this Ordinance to the Borough of Madison PAGE 8 OF 25 Regular Meeting Minutes – January 22, 2024 Planning Board and to all other persons or entities entitled thereto pursuant to N.J.S.A. 40:55D-26 and N.J.S.A. 40:55D-64. The Planning Board is directed to make and transmit to the Borough Council, within thirty-five (35) days after referral, a report including identification of any provisions in the proposed Ordinance that are inconsistent with the Master Plan and recommendations concerning any inconsistencies and any other matter as the Borough Council deems appropriate. Section 3. Any and all prior Zoning Regulations of the Borough that are inconsistent with this Ordinance are superseded by the Zoning Regulations adopted by this Ordinance. Section 4. If any part of this Ordinance shall be deemed to be unconstitutional, preempted by federal or state law, or otherwise invalid by any court of competent jurisdiction, such parts shall be severed and the invalidity thereby shall not affect the remaining parts of this Ordinance. Section 5. A copy of this Ordinance and the Zoning Regulations shall be available for public inspection at the office of the Borough Clerk during regular business hours. Section 6. This Ordinance shall take effect in accordance with all applicable laws. Mayor Conley opened up the public hearing on Ordinance 1-2024. Since no member of the public wished to be heard, the public hearing was closed. Mr. Range moved that Ordinance 1-2024, which was read by title, be finally adopted. Ms. Ehrlich seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Ms. Ehrlich, Mr. Range, Mr. Haralampoudis, Ms. Honohan, Mr. Forte Nays: None Absent: Mr. Landrigan Mayor Conley declared Ordinance 1-2024 adopted and finally passed and ordered the Clerk to publish the notice thereof in the newspaper and to record the ordinance as required by law. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of February 12, 2024 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. PAGE 9 OF 25 Regular Meeting Minutes – January 22, 2024 Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 2-2024 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $650,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE 2024 COOK AVENUE PARKING LOT RECONSTRUCTION PROJECT REBID WHEREAS, the 2024 Cook Avenue Parking Lot Reconstruction Project Rebid on July 7, 2023 resulted in three bids exceeding budgets with the apparent low bidder “Riverview” submitting a bid in the amount of $1,419,910.50; and WHEREAS, the Borough Engineer has “value engineered” the project scope; and WHEREAS, the Borough Council previously appropriated $650,000.00 from the General Capital Improvement Fund (Ord. 1202023) and $150,000.00 from the Electric Capital Improvement Fund (Ord. 13-2023) for the project: and WHEREAS, the Assistant Borough Engineer has recommended that the Borough appropriate an additional $650,000.00 from the General Capital Improvement Fund for the 2024 Cook Avenue Parking Lot Reconstruction project rebid; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $650,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate an additional $650,000.00 from the General Capital Improvement Fund for the 2024 Cook Avenue Parking Lot Reconstruction project rebid. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $650,000.00 is hereby appropriated from the General Capital Improvement Fund for the 2024 Cook Avenue Parking Lot Reconstruction project rebid. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mr. Range moved that Ordinance 2-2024, which the Borough Clerk read by title, be adopted. Mr. Forte seconded the motion. The promotional process shall be on the basis of merit, experience, education, demonstrated ability, competitive examinations and an interview. No person shall be eligible for promotion to Fire Chief unless he or she shall have served as a full-time firefighter in the Borough of Madison Fire Department for a period of 10 years or more. Promotions to the rank of Fire Chief shall be open to members in compliance with the Fire Department Rules and Regulations Section 300-2 (Qualifications), unless the Mayor and Council, in the best interest of the Department, choose to test a wider pool of candidates, in which case they may open testing to the next lower rank and/or reduce the length of time requirement in rank. 2. The Personnel Director shall announce the promotional process to members of the Department at least 30 days before any written examination is to be given. The announcement shall be posted in common areas of the Department accessible to all members. Candidates who qualify shall notify the Personnel Director of his or her interest in taking the examination by submitting a letter of interest no later than 10 calendar days after the promotion announcement. The promotional testing procedure for the Borough of Madison Fire Department shall consist of the following: a written examination, a record review, and an interview with the Mayor and Council. The Mayor and Council reserve the right to waive the written examination and shall so notify any applicant when the initial announcement for the promotional process is posted. a.Written examinations. The written examination shall be supplied by the Borough of Madison. To proceed to the record review, a candidate must achieve a minimum score of 70% on the written examination. b. Record review and interview by the Mayor and Council. Candidates that successfully achieve a minimum score of 70% on the written examination shall proceed to the next steps in the promotional process, the review of service record and interview. The interview shall be conducted by the Mayor and Council. The record review shall be conducted by the Borough Administrator and the Assistant Borough Administrator/CFO. 1. The interview with the Mayor and Council shall focus on, but not be limited to, leadership and management skills, knowledge of the Borough of Madison's form of government, knowledge of the Fire Department Rules and Regulations, familiarity with the municipal budget process, the Fire Department budget in particular, and staff/resource allocations. The Mayor and Council shall grade each candidate on a forty-point scale and shall ask each candidate the identical questions, and the Borough Clerk will keep written records of each candidate's responses to same. 2. The Borough Administrator and Assistant Borough Administrator/CFO shall examine the personnel jacket of each candidate and give specific weight to each category and grade each candidate on a thirty-point scale. R 56-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION GREEN ACRES ENABLING RESOLUTION AND APPLICATION (MADISON PLANNING INCENTIVE GRANT - $6,636,767.85) WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and WHEREAS, the Borough of Madison has previously obtained a Green Acres grant of $4,875,000.00 from the State to fund the following project: 1417-04-009, Madison Planning Incentive Grant WHEREAS, the Borough of Madison desires to further the public interest by requesting an additional Green Acres grant of $ 6,636,767.85 to fund the project; and PAGE 22 OF 25 Regular Meeting Minutes – January 22, 2024 WHEREAS, the State shall determine if the supplemental funding request is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and WHEREAS, the applicant is willing to use the State’s funds in accordance with its rules, regulations and applicable statutes, and is willing to enter into an Amendment of the Agreement with the State for the above-named project; NOW, THEREFORE, the governing body/board resolves that: 1. Robert Conley, or the successor to the office of Mayor, is hereby authorized to: (a) request such a grant, (b) provide additional information and furnish such documents as may be required, and (c) act as the authorized correspondent of Madison Borough; and 2. The Borough agrees to provide the local government/nonprofit share if a match is required. 3. The Borough agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project. 4. This resolution shall take effect immediately.
