MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON May 29, 2024 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 29th day of May, 2024. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2024. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence to remember the passing of residents Jane E. Kinney-Bruhn and Dennis Mullins. APPROVAL OF MINUTES Mr. Range moved approval of the Executive Minutes of April 8, 2024. Ms. Ehrlich seconded the motion, which passed with a unanimous voice call vote recorded. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley stated that he was installed as the President of New Jersey Conference of Mayors on May 22, 2024. He had the honor of Congresswoman Mikie Sherrill administering the Oath of Office. Leading the oldest and largest Mayor’s Conference will give him the chance to support the work of Mayors across the state, especially as it relates to lobbying for our communities in Trenton. The first Farmers and Artisans Market of the new season was held on its new day, Saturday. Judging by the turnout and activity at each vendor’s booth, it was clear that the new day will be a great success. Due to the threat of severe weather the annual Memorial Day parade was cancelled. A ceremony for those who made the ultimate sacrifice for our country and to preserve our freedom was held at the Hartley Dodge Building. Mayor Conley thanked the Patriotic Celebrations Committee for all their hard work. Earlier today, the Borough hosted Congress Members Mikie Sherrill and Jamie Raskin for a discussion on the Constitution, A look back and a Look Forward. We were joined by the family of Brian Sicknick. Brian lost his life defending our Capital on January 6. It was such an honor to meet Brian’s family and to hear the expertise that Congressman Raskin had on the history and future of our Constitution. On Saturday, June 1, 2024, at 9:00 a.m., there will be a ribbon cutting at the ne MRC trails in honor of National Trail Day. Mayor Conley presented the following proclamation: Proclamation Madison Historic Preservation Commission In Honor of Martin Heller Mayor Conley, along with members of the Historic Preservation Commission presented the following: PAGE 2 OF 19 Regular Meeting Minutes – May 29, 2024 Proclamation of the Borough of Madison In Recognition of Mr. Martin Heller for his $1,000,000 Donation for the Purchase, Preservation and Repurposing of the Madison Masonic Lodge #93 WHEREAS, the Madison Historic Preservation Commission was established in 1993 to encourage preservation of sites of historic, archaeological, cultural, scenic and architectural significance and to provide architectural advice and recommendations on plans submitted for renovations to the facades of properties not only in the historic district but also throughout the Borough of Madison; and WHEREAS, the Madison Masonic Lodge #93 at 170 Main Street was built by the Presbyterian Church of Chatham Township c.1825, as Madison and Chatham were then part of Chatham Township. In 1846, it became the Presbyterian Church of Madison and it was used by the Congregation until 1930 when it was sold to the Masons who used it as their lodge until 2022 when they put it up for sale; and WHEREAS, immediately, preservation-minded residents, groups, and the Borough Council looked for ways to purchase this important piece of Madison history which is on both the National and New Jersey Historic Registers. In addition, it has the distinction of being the first brick building in Madison and the oldest brick building in Morris County; and WHEREAS, the Borough was able to secure commitments of close to $600,000 from the New Jersey Historic Preservation Trust and the Morris County Board of County Commissioners. At the October 11, 2023 Council meeting, Mr. Heller became the hero we needed when he presented a $1,000,000 check toward the purchase of the building with the agreement that it would be renovated and not demolished; and WHEREAS, the building will be used as a senior center and space for other community groups and will be known as, “The Peggy Heller Senior Center of Madison” in honor of Mr. Heller's late wife, Margaret, and will be dedicated to Mr. Heller’s late son Mark, who passed away in 2023; and WHEREAS, the Madison Historic Preservation Commission applauds Mr. Heller for his dedication to preserving historic Madison. NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby recognize Mr. Martin Heller, for his financial support for the purchase, renovation, and repurposing of the Masonic Lodge and for his continued commitment to Madison and its historic preservation. _____________________________ Robert H. Conley, Mayor May 29, 2024 PAGE 3 OF 19 Regular Meeting Minutes – May 29, 2024 REPORTS OF COMMITTEES Public Safety Mr. Range, Chair of the Committee, made the following comments: Mr. Range stated that listed on the Consent Agenda is a resolution authorizing a (6) six-year agreement between the Borough of Madison and the Superior Officers Association. Mr. Range thanked both the Borough Administration and SOA negotiation teams for their hard work to reach an agreement which is beneficial to both the members of the SOA and the taxpayers of Madison. This agreement which adopts the offer from the fall of 2023 is being voluntarily accepted by both parties after extensive discussions with our Arbitrator Brian Kronick without the need for him to impose a final ruling. All bargaining units in Madison are now under contract. On June 1, 2024, the Madison Police Department will begin their annual Bike Helmet Awards Program. The program, sponsored by DeFalco’s Towing and in conjunction with McCool’s Ice Cream, raises awareness of bicycle safety. Each young bike rider observed by a Madison Police officer wearing their helmet will be issued a “ticket”, which is good for one small ice cream at McCool’s. Please be on the lookout for our officers and please wear your helmet. On June 3rd, members of the Madison Police Traffic Safety Unit and Community Relations Unit will take part in a Bicycle Rodeo at the Central Avenue School. Students from third through fifth grades will be part of the event which will teach bike riding safety, wearing your helmet, and a “tune up” will be performed on each bike. On June 5th, newly hired officers, and Madison residents, Thomas (TJ) Meder and Santiago Rendon will graduate from the Essex County Police Academy with honors. Both recruits were Squad Leaders of their respective recruit class which placed them in a supervisory role based on their leadership and hard work. The academy training was (6) six months long and both officers will now be assigned to the patrol division to begin their field training endeavors. Flexible bollards to prevent left turns out of 6 Main Street have been installed. Mr. Range reminded all residents to please obey traffic signs and speed limits. The Fire Department continues to increase its call volume month after month and to date it has answered over 750 calls. On May 23, 2024, the Fire Chief attended the Madison Rotary Club meeting to discuss the Fire Department’s new EMS program. The Fire Department has implemented a new Knox Box Electronic Key System and the department is now equipped with a new secure Digital Vault that holds the keys located at schools, churches, apartment building and most commercial building in town. Also, the Fire Department will be introducing a Residential Knox Box program that will help us protect our most vulnerable residents which will offer First Responder a faster access in case of medical emergency without damaging the home. More information on this program will be forthcoming. Finance and Borough Clerk Ms. Ehrlich, Chair of the Committee, made the following comments: The Finance Department reports that the Audit Committee had their first meeting on May 15, 2024. The committee discussed new accounting rules that the Auditors will be focusing on this year. There will be a follow up meeting to review the draft Audit with the Auditors on Monday, June 3, 2024. Resolutions 172-2024 and 173-2024 on the Consent Agenda insert items of revenue into the 2024 municipal budget. These are ministerial but important actions that must be taken. A State statue allows us to modify the adopted Municipal Budget during the year so that the Borough can accept and spend grant funds. Our municipal budget has sections for Grant Revenue and Grant Appropriations. Tonight, the Council will be approving a grant from Morris County for $3,900.00 that will be used by the Health Educator for Drug and Alcohol education program. The second is a Clean Community grant for PAGE 4 OF 19 Regular Meeting Minutes – May 29, 2024 $38,768.81 and will be used for sidewalk trash cans and Sidewalk Sweepers equipment. Public Works and Engineering Mr. Landrigan, Chair of the Committee, made the following comments: The Department of Public Works has hung flower baskets downtown and are ready for summer. The new electric mower is back and is out mowing daily with the other machines. Mulch has been spread throughout town. The Shade Tree Board reminds residents if you want a tree, please call Public Works at 973-593-3088 to be added to the list for fall planting. DPW removed a slide at Lucy D Playground and a new one will be installed in the next couple of weeks. The old slide was out of compliance with insurance safety regulations. Utilities Mr. Haralampoudis, Chair of the Committee, made the following comments: Mr. Haralampoudis expressed best wishes to Chief Lineman Joel Phillips. There are several personnel changes in the Electric Department on tonight’s agenda. A resolution appointing Vincent Patti as Chief Lineman replacing Joel Phillips who retired after (26) twenty-six years of service and later in the year on December 1, 2024, Superintendent James Mattina will be retiring. Jim has dedicated (38) thirty- eight years of service and we wish him well. On Wednesday, June 5, 2024, at 7:00 p.m. the Utility Advisory Committee will be meeting to discuss Well B and the Cook Avenue Parking Lot projects. Bids are due on June 13, 2024, for the MRC Solar Carport Project. The bid documents were revised to encourage multiple submissions and competitive pricing. The Board of Education has been briefed on the project schedule, for parking concerns. The project phasing schedule will allow that half of the parking lot will continue to facilitate student parking. The Borough will be requesting a meeting with First Energy Corp and JCP&L officials to discuss potential future load estimates, regarding current and future projected development. The Borough will continue to monitor current and future Energy Markets regarding a potential electric purchase, subject to finalizing green energy protocols. Electric Utility crews have been busy energizing Well B to meet residential demands for water service and installing new electric infrastructure to support the Borough sponsored Walnut Street and Community Place Affordable Housing Development Project. On tonight’s agenda there is a resolution awarding a contract to Meter Tech to provide installation services for automated water meters throughout the Borough. There are about (600) six hundred meters remaining to be installed. The Borough encourages water conservation during the summer months. Community Affairs Ms. Honohan, Chair of the Committee, made the following comments: The Downtown Development Commission kicked off the 2024 Farmers and Artisans Market this Saturday and will be running through December 14, 2024. Held at its new location at the Prospect Street Parking Lot from 9:00 a.m. to 2:00 p.m. Planning is underway for Bottle Hill Day, scheduled for Saturday, October 5, 2024. The Chambers of Commerce Fire Extinguisher inspections will be held on June 4, 2024, from 11:30 a.m. to 3:30 p.m. and the annual Awards Dinner will be held on June 11, 2024 at the Madison Hotel. Madison Community Arts Center events including Comedy will take the stage this Friday at 8:00 p.m., and (6) six films will be presented this June. Wednesday “Open Mic” night continues. The Madison Public Library will hold a Craft Night for adults on June 10, 2024. The center has many other events, please visit the website for the most updated schedule. PAGE 5 OF 19 Regular Meeting Minutes – May 29, 2024 Health The Health Department reminds residents that warm weather brings ticks and mosquitos. Residents are encouraged to protect themselves from ticks by avoiding areas with tall grass, weeds, brush and staying in the center when on the trails. Check yourselves for ticks after spending time outdoors and shower within (2) two hours. Mosquitos carry many diseases including West Niles Virus. The Health Department recommends wearing an EPA approved repellant containing Picaridin or Lemon Eucalyptus Oil and wearing long pants and sleeves. Residents are encouraged to rid their properties of standing water and declutter their yards. May is Melanoma Awareness Month, residents are reminded to wear SPF 30 sunscreen and visit a dermatologist for a screening. May is also Mental Health Awareness Month, a time dedicated to fostering empathy, support and understanding on mental well-being. This time is an opportunity to break down barriers, challenge misconceptions and promote pathways to healing and resistance. Lastly, although there is low human infections of the highly pathogenic Avian Influenza Virus (Bird Flu) everyone should take precautions to avoid contact with poultry, wild birds or other animals that appear sick or dead. Avoid undercooked poultry meat and eggs and only drink pasteurized milk. Residents are reminded to wash hands and surfaces thoroughly after handling poultry meat and eggs. COMMUNICATIONS AND PETITIONS Email dated May 21, 2024, from Mary Jane Switek of Rosewood Drive regarding construction occurring in her neighborhood. AGENDA DISCUSSIONS - None ADVERTISED HEARINGS Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on May 13, 2024, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 17-2024 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $55,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF AUTOMATED LINCENSE PLATE READERS (ALPR), SECURITY CAMERAS, WIRING AND OTHER RELATED SECURITY EQUIPMENT PAGE 6 OF 19 Regular Meeting Minutes – May 29, 2024 WHEREAS, the Police Chief has recommended that the Borough Appropriate $55,000.00 from the General Capital Improvement Fund towards the purchase of Automated License Plate Readers (ALPR), security cameras, wiring and other related security equipment for the Police Department; and WHEREAS, funds are available in the General Capital Improvement Fund and the availability of funds has been certified by the Chief Financial Officer; and, WHEREAS, the Borough Council has determined that the Borough should appropriate $55,000.00 from the General Capital Improvement Fund towards the purchase of Automated License Plate Readers (ALPR), security cameras, wiring and other related security equipment for the Police Department. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $55,000.00 is hereby appropriated from the General Capital Improvement Fund for the purchase of Automated License Plate Readers (ALPR), security cameras, wiring and other related security equipment for the Police Department. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 17-2024. Since no member of the public wished to be heard, the public hearing was closed. Mr. Range moved that Ordinance 17-2024, which was read by title, be finally adopted. Ms. Ehrlich seconded the motion. ORDINANCE 18-2024 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $25,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF VIDEO AND RECORDING EQUIPMENT FOR POLICE HEADQUATERS PAGE 7 OF 19 Regular Meeting Minutes – May 29, 2024 WHEREAS, the Police Chief has recommended that the Borough appropriate $25,000.00 from the General Capital Improvement Fund for video and recording equipment for Police Headquarters; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $25,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $25,000.00 from the General Capital Improvement Fund for video and recording equipment. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $25,000.00 is hereby appropriated from the General Capital Improvement Fund for video and recording equipment. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 18-2024. Since no member of the public wished to be heard, the public hearing was closed. Mr. Range moved that Ordinance 18-2024, which was read by title, be finally adopted. Ms. Ehrlich seconded the motion. Mary Jane Switek, Rosewood Drive, voiced her concerns about how all the construction on Rosewood Drive is having a negative impact and changing the aesthetics the neighborhood. PAGE 8 OF 19 Regular Meeting Minutes – May 29, 2024 Brian Martensen, Myrtle Avenue, stated that the new battery-operated lawn mower is a great success and creates less pollution. He thanked the Council for the good work that they are doing. Mary Jane Lundt, Highview Terrace, Friends of the Drew Forest were at the hearing representing the trees. Since no other member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES - None CONSENT AGENDA RESOLUTIONS The Clerk made the following statement: Consent Agenda Resolutions will be enacted with a single motion; any Resolution requiring expenditure is supported by a Certification of Availability of Funds; any Resolution requiring discussion will be removed from the Consent Agenda; all Resolutions will be reflected in full in the minutes. Mr. Range moved adoption of the Resolutions listed on the Consent Agenda. Ms. Ehrlich seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Ms. Ehrlich, Mr. Range, Mr. Landrigan, Mr. Haralampoudis, Ms. Honohan, Mr. Forte Nays: None Absent: None R 158-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING LIEUTENANT JAMES BLAIR TO THE POSITION OF FIRE CAPTAIN IN THE PAID DIVISION OF THE MADISON FIRE DEPARTMENT IN THE BOROUGH OF MADISON WHEREAS, the Madison Borough Fire Chief has recommended that Lieutenant James Blair be appointed to the position of Captain in the paid division of the Madison Fire Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Lieutenant James Blair to the position of Captain in the paid division of the Madison Fire Department in the Borough of Madison NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that James Blair is hereby appointed to the position of Captain in the Madison Fire Department effective immediately, to be compensated in accordance with the current FMBA Collective Bargaining Agreement. R 159-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING FIRST CLASS LINEMAN VINCENT PATTI TO THE POSITION OF CHIEF LINEMAN PAGE 9 OF 19 Regular Meeting Minutes – May 29, 2024 WHEREAS, Chief Lineman Joel Phillips has retired and his terminal leave ended on May 1, 2024; and WHEREAS, the Electric Utility Superintendent and Personnel Director have recommended promoting Vincent Patti to the position of Chief Lineman in the Electric Utility Department to fill the position formerly held by Joel Phillips; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, County of Morris, State of New Jersey, that First Class Lineman Vincent Patti is hereby appointed to the position of Chief Lineman in the Electric Utility Department, effective immediately, to be compensated in accordance with the current Collective Bargaining Agreement for Electric Utility Department Employees. R 160-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING PARTICIPATION IN THE 2024-2025 EMPLOYEE WELLNESS PROGRAM THROUGH THE MADISON YMCA WHEREAS, the Personnel Director recommends that the Borough continue to offer employees and volunteers opportunities for wellness including assistance to become healthier and more productive employees and volunteers; and WHEREAS, the Borough of Madison desires to contract with the Madison YMCA for a partially subsidized employee and volunteers wellness program, to offer the benefit of a discounted membership to employees and volunteers. Participating employees and volunteers would pay a portion of the membership fees. The Borough contributions would not exceed $500 per employee and volunteer/family and not exceed a total of $25,000 in any calendar year; and WHEREAS, it is anticipated that a healthier work force will increase productivity, improve employee morale and reduce future insurance premiums, and encourage volunteerism; and WHEREAS, the Chief Financial Officer has certified that funds are available in Account 229, subaccount 528 for this purpose. This agreement is contingent upon adequate funding therefore in the 2025 Municipal Budget. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the Mayor and Borough Clerk are hereby authorized to execute an agreement for subsidized employee and volunteer membership with the Madison YMCA. PAGE 10 OF 19 Regular Meeting Minutes – May 29, 2024 R 161-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE RELEASE OF THE CASH BOND GUARANTEE FOR PARK VALLEY MADISON, LLC ON BLOCK 1501, LOT 4 (ALSO KNOWN AS 4 COMMUNITY PLACE) WHEREAS, the Assistant Borough Engineer has recommended that the Cash Bond for a total of $7,500.00 be released to Park Valley Madison, LLC, as all required items have been addressed; and WHEREAS, the Assistant Borough Engineer advises that the property is substantially complete. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the Cash Bond, in the amount of $7,500.00, described herein be released to Madison Park Valley, LLC. R 162-2024 RESOLUTION OF THE BOROUGH OF MADISON REAPPOINTING JACQUELINE CARDINI TO THE POSITION OF BOROUGH TAX ASSESSOR WHEREAS, Jacqueline Cardini was appointed on April 13, 2020 as Borough Tax Assessor in accordance with N.J.S.A. 40A:9-146 et seq.; and WHEREAS, the governing body recommends the reappointment of Jacqueline Cardini to the position of Borough Tax Assessor effective July 1, 2024 in accordance with N.J.S.A. 40A:9-146.et seq.; and WHEREAS, this appointment has occurred within sixty (60) days of the expiration of the original appointment term referenced above. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey that the Garden Club of Madison has permission to borrow sixty (60) folding chairs, with delivery and pick-up with the assistance of the Director of Public Works and his staff. R 168-2024 RESOLUTION OF THE BOROUGH OF MADISON PROCLAIMING SATURDAY, OCTOBER 5, 2024 AS BOTTLE HILL DAY AND AUTHORIZING BEER GARDEN WHEREAS, the Mayor and Council of the Borough of Madison have supported the celebration of Bottle Hill Day for the last forty-two years; and WHEREAS, Bottle Hill was the name given the community formed in Madison prior to the American Revolution; and WHEREAS, celebrations commemorating Bottle Hill have been an integral part of the history of Madison; and PAGE 13 OF 19 Regular Meeting Minutes – May 29, 2024 WHEREAS, Bottle Hill Day provides an excellent opportunity for all members of Madison families to participate in a Borough recreational activity. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that October 5, 2024 is hereby proclaimed as BOTTLE HILL DAY. BE IT FURTHER RESOLVED, that the following activities are hereby authorized between the hours of 10 a.m. and 6 p.m.: (1) Merchants contiguous to the sidewalks along the north and south sides of Main Street between Community Place and Greenwood Avenue, both sides of Green Village Road from Kings Road to Main Street, Central Avenue and Waverly Place shall be permitted to sell their merchandise on the sidewalks assuming they provide clear access for pedestrians. (2) Vendors, entertainment and activities shall be allowed to set up at various locations that are approved by the Police Department and the Director of Business Development, on the western portion of Lincoln Place, both sides of Waverly Place, both sides of Central Avenue (from Main Street to Brittin Street), and Green Village Road between the James Building and the Museum of Early Trades and Crafts, which streets shall be closed to motor vehicle traffic during the event. (3) The Downtown Development Commission together with the Madison Main Street Foundation shall be permitted to operate a beer garden on Kings Road, subject to such restrictions or conditions as may be required by the Madison Chief of Police and Borough Risk Manager. Alcohol is permitted only in the beer garden on Kings Road. The location of the beer garden on Kings Road shall be determined by the Director of Business Development. R 169-2024 RESOLUTION OF THE BOROUGH OF MADISON AMENDING RESOLUTION 63-2023 AWARDING A CONTRACT TO TTI ENVIRONMENTAL, INC. OF MOORESTOWN, NEW JERSEY IN THE AMOUNT OF $30,950.00 FOR THE MADISON PUBLIC LIBRARY INTERIOR RENOVATION ABATEMENT PROJECT WHEREAS, Resolution 65-2023 awarded a contract to TTI Environmental, Inc. of Moorestown, New Jersey in the amount of $30,950.00, for asbestos abatement during renovation at the Madison Public Library; and WHEREAS, the Library Director has recommended that the Borough amend Resolution 65-2023 to increase the award amount by $4,000.00 to $34,950.00 for abatement of additional asbestos; and PAGE 14 OF 19 Regular Meeting Minutes – May 29, 2024 WHEREAS, the Chief Financial Officer has attested that funds will be available in an additional amount not to exceed $34,950.00, which funds are available in the 2024 operating budget, and/or Library Construction Capital account. Resolution 65-2023 is amended to increase the contract award amount by an additional amount of $4,000.00 to $34,950.00. 2. The Mayor and Borough Clerk are hereby authorized to execute, on behalf of the Borough, an amended purchase order and contract with TTI Environmental, Inc. of Moorestown, New Jersey, for professional services at a total price not to exceed $34,950.00, in a form acceptable to the Borough Attorney. R 170-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A COLLECTIVE BARGAINING AGREEMENT WITH THE MADISON SUPERIOR OFFICERS ASSOCIATION LOCAL NO. 92 (SOA) WHEREAS, the Borough of Madison (“Borough”) commenced collective negotiations with the Local 92 SOA bargaining unit; and WHEREAS, the Borough was able to successfully negotiate a Memorandum of Agreement/Understanding with the SOA for the period January 1, 2022 to December 31, 2027; and WHEREAS, the Mayor and Council have considered the specific terms and conditions contained in the Memorandum of Agreement for the above noted bargaining unit. NOW THEREFORE BE IT RESOLVED as follows: 1. The Mayor and Council approve the attached Memorandum of Agreement for the above-bargaining unit and the terms and conditions specifically set forth in the agreement; and 2. The Mayor and Council hereby authorize the Borough Administrator, Mayor and Borough Clerk to execute the Memorandum of Agreement; and 4. The Mayor and Council authorize the Borough Administrator and CFO to effectuate the collective bargaining agreement. R 171-2024 RESOLUTION OF THE BOROUGH OF MADISON APPROVING SPECIAL EVENT PERMIT FOR THE “CARS & COFFEE SHOWCASE” TO BE HELD ON KINGS ROAD FRIDAY, JUNE 7, 2024 PAGE 15 OF 19 Regular Meeting Minutes – May 29, 2024 WHEREAS, Sunday Motor Co. has requested permission to close a portion of Kings Road to hold a “Cars & Coffee Showcase”, on Friday, June 7, 2024; and WHEREAS, the event will be held along Kings Road between Green Village Road and 14 Kings Road; and WHEREAS, Police Chief Miscia recommends approval of this request. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the request of Sunday Motor Co. to hold a “Cars & Coffee Showcase” on Friday, June 7, 2024, as described herein is hereby approved, subject to any safety requirements imposed by the Madison Police Department, including hiring two (2) uniformed off duty officers for traffic control and the road closure hours being established by the Madison Police Department to reduce the impact on adjacent businesses. R 172-2023 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2024 - DMHAS WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison received $3,900.00 in Morris County DMHAS Municipal Alliance funds and wishes to amend its 2024 Budget to include this amount as revenue.
