MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON June 10, 2024 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 10th day of June, 2024. Acting Mayor Range called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2024. GREETINGS TO PUBLIC Acting Mayor Range presented the following Proclamations: Pride Month June 2024 Proclamation – presented to Madison resident Valentino Palazzo Proclamation of the B o r o u g h o f M a d i s on Proclaiming Pride Month June 2024 WHEREAS, our nation was founded on the principle of equal rights for all people and some of the most inspiring moments in our history have arisen from the various civil PAGE 2 OF 14 Regular Meeting Minutes – June 10, 2024 rights movements that have brought one group after another from the margins to the mainstream of American society; and WHEREAS, in the movement toward equal rights for lesbian, gay, bisexual, transgender and queer (LGBTQ) people, an historic turning point occurred on June 28, 1969, in New York City, with the onset of the Stonewall Riots. During these riots, LGBTQ citizens rose up and fought against the discriminatory criminal laws that have since been declared unconstitutional; and WHEREAS, LGBTQ individuals and their allies have had immeasurable impact to the cultural, civic and economic success of our country; and WHEREAS, the Borough of Madison is committed to supporting visibility, dignity and equality for LGBTQ people in our diverse community; and WHEREAS, while society at large increasingly supports LGBTQ equality, it is essential to acknowledge that the need for education and awareness remains vital; and WHEREAS, celebrating Pride Month brings awareness and provides support and advocacy for Madison’s LGBTQ community and is an opportunity to take action and engage in dialogue to strengthen alliances, build acceptance and advance equal rights; and WHEREAS, it is imperative that young people in our community, regardless of sexual orientation, gender identity and expression, feel valued, safe, empowered, and supported by their peers and community leaders; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim the month of June 2024 as Pride Month in the Borough of Madison in support of the LGBTQ community and to recognize all LGBTQ residents whose influential and lasting contributions to our neighborhoods make Madison a vibrant community in which to live, work and visit. ______________________________________ Robert H. Conley, Mayor June 10, 2024 Proclamation Recognizing Juneteenth, Wednesday, June 19, 2024 – presented to Kenisha Tucker and fellow Madison residents Proclamation of the Borough of Madison Recognizing WEDNESDAY, JUNE 19, 2024 AS JUNETEENTH PAGE 3 OF 14 Regular Meeting Minutes – June 10, 2024 WHEREAS, on June 19, 1865, two and a half years after President Lincoln issued the Emancipation Proclamation, Union Soldiers, led by Major General Gordon Granger, arrived at Galveston, Texas with news that the Civil War was over and that enslaved people were now free; and WHEREAS, with its origin in Texas in 1866, Juneteenth is the oldest nationally celebrated commemoration of the ending of slavery in the United States. Since then, Juneteenth has been celebrated in communities across the United States, providing an opportunity to mark the emancipation of enslaved people; and WHEREAS, Juneteenth continues to be the most recognized African American holiday observance, also known as Emancipation Day, Emancipation Celebration, Freedom Day and Jun-Jun; and WHEREAS, Juneteenth symbolizes for many African Americans what the Fourth of July does for all Americans – liberty, freedom and justice for all; and WHEREAS, Juneteenth is a day for us to reflect on the suffering caused by slavery and commit to being allies of our African American friends, family and neighbors; and WHEREAS, Juneteenth commemorates the strength and resolve of African Americans throughout our history and serves as an opportunity to celebrate the rich and numerous contributions of African Americans; and WHEREAS, Juneteenth is an opportunity for Madison residents of all races, nationalities and religions to acknowledge the painful history and lasting, systemic impact of slavery and racial injustice in the United States. NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby recognize Wednesday, June 19, 2024 as Juneteenth to acknowledge the historical significance of the day and recommit to working toward the dismantling of institutionalized racism. ______________________________________ Robert H. Conley, Mayor June 10, 2024 REPORTS OF COMMITTEES Public Safety Mr. Range, Chair of the Committee, made the following comments: On Wednesday June 5th Chief Miscia and Mayor Conley, along with the Police Department command staff, attended the Essex County Basic Police Academy Graduation at the Cathedral Basilica of the Sacred Heart in Newark. Patrolmen Thomas (TJ) Meder Jr. #169 and Santiago (Santi) Rendon #170 were among the 69 recruits that graduated following 22 weeks of basic training. Mayor Conley was in attendance and along with Chief Miscia presented Meder and Rendon with their PTC certificates. Last week, Patrolman Brandon Lake #171 completed his waiver PAGE 4 OF 14 Regular Meeting Minutes – June 10, 2024 training at the Morris County Public Safety Training Academy. Lake has already been in field training and is expected to complete the police department’s field training program shortly. This past Friday, June 7th, members of the Madison Police Department joined surrounding towns: of Hanover Township, East Hanover, Livingston and Florham Park to once again run in this year 41st Anniversary of the Law Enforcement Torch Run [Route 1A]. The Special Olympics of New Jersey Torch Run is on the move with law enforcement officers carrying the Flame of Hope over twenty-six routes totaling approximately 750 miles throughout New Jersey. The Torch Run raises funds and awareness for the Special Olympics of New Jersey. Collectively, Madison and our law enforcement partners have raised over 16k this year. Madison Police Department is proud to have once again partnered with Defalco's Automotive & Towing and McCool’s to promote school aged children wearing a helmet while riding a bicycle. Madison Police Officers will be on patrol looking for children who make the right choice of wearing a helmet while riding a bicycle and if observed, they might be issued a reward ticket for one free Junior Soft Serve Ice Cream with one topping at McCool’s (26 Main Street, Madison). A special thanks to the Rempfer Family, Defalco's Automotive & Towing, Madison Police Community Service Bureau (Cpl. Aquino) and McCool’s Ice Cream & Frozen Yogurt Shop for making this possible. The Madison Police Department has instituted a Crime Prevention Unit following the training of six police officers. Residents can make a request to have members of the Crime Prevention Unit to come to their homes and make a home security assessments. The unit will also provide recommendations to further secure their homes. There will be more to come in the next several weeks, however a new rosenet webpage has been developed to provide residents with crime prevention information and be able to register for this security assessment. For the month of May the Fire Department responded to 180 calls. This included 73 fire calls and 107 EMS calls. 94 People were transported to the hospital. The fire department and the EMS division also responded to 7 motor vehicle accidents. On a lighter note, a Fire Chief from the Honolulu Fire Department contacted the Madison Fire Chief. He had come across pictures of the Madison Fire Department’s confined space/trench rescue trailer that the Madison Firefighters had fabricated in house. He was impressed and reached out to get more information. Soon the Honolulu Fire Department will have two trailers just like Madison. Finance and Borough Clerk Ms. Ehrlich, Chair of the Committee, made the following comments: The Audit Committee met on Monday June 3rd. The only audit comment in the report was the ‘segregation of duties’ item which is a repeat comment. Many smaller towns have this issue, which is caused when a department collects payments and issues permits or other documents for residents. The appropriate practice would be for the customer to go to the department, get an invoice, go to a central payment window to make payment, and then take the receipt from that window to the department so they could finally pick up the permit or paperwork. Given the decentralized setup of the Borough with departments on different floors and in different buildings, it has been determined that it would be too costly to resolve this minor issue. The committee also discussed a new accounting rule called GASB 96, which requires the Borough to list all subscription contracts that are longer than one year. An example of a subscription would be our utility billing software or the software used to issue building permits. The audit will be finalized in the coming weeks and the results will be discussed at an upcoming council meeting. PAGE 5 OF 14 Regular Meeting Minutes – June 10, 2024 Public Works and Engineering Mr. Landrigan, Chair of the Committee, made the following comments: Mr. Landrigan noted that the Department of Public Works has distributed cones and barricades at various locations in preparation for and cleaned up after Memorial Day Parade, handled various issues related to recent power outage. The Parks Department continually works on recreations fields so that they are playable for all the sports teams and Mechanical Services installed new radar board with Police Department on Ridgedale Avenue and Central Avenue. Utilities Mr. Haralampoudis, Chair of the Committee, made the following comments: Mr. Haralampoudis reported that the Madison Water Department is checking water wells daily and repaired water lines at Valevue Road. The Electric Department repaired electric lines damaged by a fallen tree and continues to work with Asplundh Tree Service on tree clearing. The Recreation Advisory Committee notes this is the final week of all spring sports and summer sports will begin as of June 17th. Mr. Haralampoudis noted that the Recreation Director reports that the Borough received over $52,000 in field rental fees this season. Community Affairs Ms. Honohan, Chair of the Committee, made the following comments: The Downtown Development Commission has reinvented the Madison Farmers Market for the 2024 season. It is now called the Madison Farm & Artisan Market and is open for business every Saturday through December 14, 2024, in the Prospect Street Parking Lot from 9:00 am until 2:00 pm. Please check out all the great new and returning vendors, great music, and a sense of community. Planning is underway for Bottle Hill Day 2024, scheduled for Saturday, October 5th. The Downtown Development Commission Regular June Meeting has been canceled, and the DDC will meet again on July 18 at 7:15 pm in the 2nd Floor Committee Room in the Hartley Dodge Memorial Building. The Chamber of Commerce annual awards dinner will be held on June 11th, beginning at 6:00 pm. The monthly Music Open Mic at the Madison Community Arts Center is scheduled for Wednesday, June 12th, at 7:30 pm. The monthly Comedy Open Mic is scheduled for Wednesday, June 19th, at 7:30 pm. The Film Society of Summit will screen Taking Venice on Friday, June 14th, at 7:30 pm. Pride Month Activities at Rose Hall will feature Just Say Gay, an evening of standup comedy on Saturday, June 15th at 8:00 pm. Arts by the People presenting an afternoon of LBGTQ Spoken Word on Sunday, June 23rd , at 2:00 pm followed by Morris Mutual presenting the cult film Vegas in Space at 7:00 pm. The film viewing will include a rainbow costume contest. The New Jersey Women Playwrights Program continues on Friday, June 21st, at 7:00 pm with Grace Revised by Dominique Cieri. The Monthly New Music Showcase Come Original will be presented on Saturday, June 22nd at 7:30 pm. Events for the entire year can be viewed on the MCAC landing page at madisonartsnj.org/mcac. Health Mr. Forte, Chair of the Committee, made the following comments: From the Health Department, residents age 19 and older insured or not insured can receive vaccines through the Westfield Health Department. The department has a health needs assessment survey available on the Borough’s website. This survey is PAGE 6 OF 14 Regular Meeting Minutes – June 10, 2024 being conducted by The College of New Jersey, working with Morris County Health Departments. We are hoping to get residents’ opinions about things in your community that affect health and ideas for improving health. June is Men’s Health Awareness month. I reminder that it is mosquito season and West Nile virus is on the rise. AGENDA DISCUSSIONS 06/10/2024-1 MADISON EMS SERVICES/AMBULANCE PURCHASE Fire Chief Kyle Wickman presented information regarding the newly formed EMS Division, noting that the first shift started April 6th, there are currently twenty-one (21) per-diem members covering 18 of the 24 shifts per week. Chief Wickman also noted new equipment purchased for the division, including a vital signs machine, EMS pack and a new scoop board. ADVERTISED HEARINGS – None INVITATION FOR COMMENT (2 of 2) Mayor opened the meeting to the public for their opportunity to ask questions and make comments on any subject. Judy Kroll; Laurel Way, spoke on behalf of the friends of the Drew Forest, noting activities in the forest this spring, including wild Carolina rose flowers and frog and toad hatchings. John Yoesting; South Street, raised concern regarding pedestrian crossings on Park Avenue and requested the Borough improve signage. Since no other member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of July 8, 2024 in the 2nd Floor Council Chamber of the Hartley PAGE 7 OF 14 Regular Meeting Minutes – June 10, 2024 Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 19-2024 ORDINANCE OF THE BOROUGH OF MADISON AMENDING ORDINANCE 56-2023 WHICH APPROPRIATED $125,000.00 FROM THE MUNICIPAL OPEN SPACE, RECREATION AND HISTORIC PRESERVATION TRUST FUND REGARDING THE MADISON MASONIC LOGE, 170 MAIN STREET WHEREAS, the Borough of Madison has taken title to the Madison Masonic Lodge, 170 Main Street with the $1,125,000.00 purchase price satisfied by municipal funds; and WHEREAS, the Borough Council has previously determined that the Borough should appropriate $125,000.00 from the Open Space, Recreation and Historic Preservation Trust Fund; and WHEREAS, the Open Space Advisory Committee unanimously recommended the full funding of said request; and WHEREAS, the Chief Financial Officer has previously attested to the availability of funds in an amount not to exceed $125,000.00 in the Open Space Recreation and Historic Preservation Trust Fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $125,000.00 previously appropriated from the Open Space, Recreation and Historic Preservation Trust Fund regarding the Madison Masonic Lodge is hereby ratified. SECTION 2: This Ordinance shall take effect as provided by law. Mr. Landrigan moved that Ordinance 19-2024, which the Borough Clerk read by title, be adopted. Ms. Ehrlich seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Ms. Ehrlich, Mr. Landrigan, Mr. Range, Mr. Haralampoudis, Ms. Honohan, Mr. Forte Nays: None PAGE 8 OF 14 Regular Meeting Minutes – June 10, 2024 ORDINANCE 20-2024 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $105,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF A 2022 HORTON AMBULANCE WHEREAS, the Chief Financial Officer/Assistant Borough Administrator has recommended that the Borough appropriate $105,000.00 from the General Capital Improvement Fund for the funding of a 2022 Horton Ambulance on a Ford chassis; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $105,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $105,000.00 from the General Capital Improvement Fund for the funding of a 2022 Horton Ambulance. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $105,000.00 is hereby appropriated from the General Capital Improvement Fund for the funding of a 2022 Horton Ambulance. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Mr. Landrigan moved that Ordinance 20-2024, which the Borough Clerk read by title, be adopted. Ms. Ehrlich seconded the motion. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, and State of New Jersey, that the Mayor is hereby authorized to execute on behalf of the Borough of Madison the Grant Agreement with Mr. Martin Heller to fund the renovation/preservation of the Masonic Lodge, in a form approved by the Borough Attorney. R 180-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CHANGE ORDER REQUEST FROM DASKAL, LLC IN THE AMOUNT OF $187,879.00 FOR THE MADISON PUBLIC LIBRARY INTERIOR RENOVATIONS CONSTRUCTION PROJECT WHEREAS, a contract for the Madison Public Library Interior Renovations Construction Project, in an amount not to exceed $2,048,000.00 plus Alternate Bid NO. 1 for floor finishes in the amount of $184,000.00, was awarded to Daskal, LLC of Butler, New Jersey, by Resolution 243-2023; and WHEREAS, the Assistant Borough Engineer has recommended approval of change orders to the contract for additional work required to address unforeseen PAGE 11 OF 14 Regular Meeting Minutes – June 10, 2024 issues, as well as miscellaneous repairs and improvements in the amount of $187,879.46 bringing the revised contract total to $2,419,879.46; and WHEREAS, the Madison Public Library will increase their funding to cover the increase in the contracted amount. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that the change order request of $187,879.46 from Daskal, LLC of Butler, New Jersey, for the Madison Public Library Interior Renovations Construction Project is hereby authorized. R 181-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING PART-TIME PER DIEM EMERGENCY MEDICAL TECHNICIAN (EMT) TO THE MADISON FIRE DEPARTMENT WHEREAS, the Chief of the Madison Fire Department recommends the appointment of Caitlyn Colabraro to the position of Part-Time Per Diem Emergency Medical Technician (EMT); and WHEREAS, the Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that Caitlyn Colabraro is hereby appointed to the position of Part-Time Per Diem EMT effective immediately; and BE IT FURTHER RESOLVED, that Caitlyn Colabraro will be compensated at the rate of $30.00 per hour without benefits. R 182-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXECUTION OF A COURTESY PARKING AGREEMENT WITH MADISON MEMORIAL HOME. FOR PARKING SPACES AT THE HELLER CENTER WHEREAS, the Borough wishes to enter into a Courtesy Parking Agreement with Madison Memorial Home for overflow parking privileges at the Heller Center, 170 Main Street, with the Borough having reciprocal overflow parking privileges at the funeral home, 159 Main Street; and WHEREAS, the Borough has determined that it is in the best interest of the public to execute such an agreement. R 184-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING JANET WAGSTAFF TO THE POSITION OF ADMINISTRATIVE SECRETARY FOR THE HISTORIC PRESERVATION COMMISSION AND SECRETARY TO THE MADISON BOARD OF HEALTH BE IT RESOLVED by the Borough Council of the Borough of Madison that Janet Wagstaff is hereby appointed to the position of Administrative Secretary for the Historic Preservation Commission, at an annual stipend of $1,000 for 2024; and BE IT FURTHER RESOLVED that Mrs. Wagstaff be appointed as Secretary to the Madison Board of Health at an annual stipend of $1,000.00 for 2024. R 185-2024 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING THE IRREVOCABLE RETIREMENT OF EVENING CUSTODIAN LUIS MONIZ EFFECTIVE SEPTEMBER 1, 2024 WHEREAS, Evening Custodian Luis Moniz, has advised the Borough in writing of his irrevocable retirement on September 1, 2024. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that the irrevocable retirement of Luiz Moniz as Evening Custodian, is hereby acknowledged and accepted with appreciation for his many years of public service.
