MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE
BOROUGH OF MADISON
August 12, 2024 - 7 p.m.
CALL TO ORDER
The Regular Meeting of the Mayor and Council of the Borough of Madison was held
on the 12th day of August, 2024. Mayor Conley called the meeting to order at 7:00
p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the
Borough of Madison.
STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT
The Borough Clerk read the statement pursuant to the Open Public Meetings Act:
“In compliance with the Open Public Meetings Act, adequate notice of this meeting
of the Council was provided by transmitting a copy of the meeting notice to the
Madison Eagle and Morris County Daily Record, posting a copy on the bulletin
board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the
office of the Clerk, all on January 12, 2024. This Notice was made available to
members of the general public.”

RECONVENE IN COUNCIL CHAMBER
Mayor Conley reconvened the Regular Meeting at 8 p.m. in the Council Chamber
with all members present. The Pledge of Allegiance was recited by all. Mayor
Conley asked for a moment of silence for the passing of Madison resident Lillian
Sodano.
APPROVAL OF MINUTES
Mr. Range moved approval of the Executive Minutes of July 22, 2024. Ms. Ehrlich
seconded the motion, which passed with a unanimous voice call vote recorded.

GREETINGS TO PUBLIC
Mayor Conley noted that due to the severe straight line wind storm that hit the Borough
of Madison Thursday, August 8th, National Night Out was canceled. Mayor Conley
thanked the many that helped including public works and utility crews from the
Borough of Chatham, Township of Millburn, Township of Morris and Borough of Butler.
Employee of the Month for March
Madison Tax Collector Chrissy Mahler, Qualified Purchasing Agent Kevin O’Keefe and
Purchasing Assistant Stacey Dooley for their help taking on additional responsibilities
while accounts payable is in transition.
Proclamation Ovarian Cancer Awareness Month – September 2024
Mayor Conley presented the following proclamation to Rachel Putman, accompanied
by her brother, Rockaway Township Councilmember Jonathan Sackett

Proclaiming
OVARIAN CANCER AWARENESS MONTH
September 2024
WHEREAS, Ovarian cancer is the 5th leading cause of death among women and the
American Cancer Society estimates each year approximately 19,680 women will be
diagnosed with ovarian cancer in 2024 and 12,740 individuals will die from the
disease nationwide, including 590 new cases and 340 deaths in New Jersey; and

WHEREAS, in the United States, a woman’s lifetime risk of being diagnosed with
ovarian cancer is about 1 in 87; and
WHEREAS, due to vague symptoms and the lack of reliable early detection tests,
most women are not diagnosed until Stage 3 or later, when the cancer has already
begun to spread to the lymph nodes and outside of the pelvis; and
WHEREAS, although the five-year survival rate for Stage 1 ovarian cancer is over
90 percent, only 15 percent of ovarian cancers are diagnosed at this early stage, and
the five-year survival rate for late-stage ovarian cancer is below 30 percent; and
WHEREAS, while a mammogram can detect breast cancer and a pap smear can
detect cervical cancer, there is no reliable early detection test for ovarian cancer; and
WHEREAS, women’s lives can be saved through increased public awareness of
ovarian cancer and its risk factors, signs, and symptoms; and
WHEREAS, this month, the Borough of Madison joins all those who are battling
ovarian cancer, those who have lost their lives to the disease, their loved ones, and
our state’s many dedicated healthcare workers in spreading awareness, committing to
public education, and embracing hope for better diagnoses, treatments and a cure.
NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on
behalf of the governing body, do hereby proclaim September 2024 as Ovarian
Cancer Awareness Month and encourage all residents to support the cause that so
deeply impacts families in every community across our country.

REPORTS OF COMMITTEES
Public Safety
Mr. Range, Chair of the Committee, made the following comments:
Mr. Range thanked all who responded during the weather event August 6th,
including Chief Miscia, Chief Wickman, the men and women who work for the
Borough. Many residents and visitors braved the rain/wind to enjoy themselves at
National Night Out, and many thanks goes to our law enforcement partners and
stakeholders that were present. Additional thanks goes to our Madison governing
body, borough administration, borough communications director, the great officers
of the Madison Police Department and Madison Fire Department for putting this
night together. We look forward to this night each year and we are already planning
2025. Madison was hit with a weather event which borough heavy rain and wind.
The storm brought downs trees and wires which made navigation through town very
difficult. Madison’s Emergency Operations Center (EOC) was opened and incident
command was set up at that location. It was a great show of departments working
together, including Police, Fire, Public Works, Electric Utility, County Officials, and
borough government/administration. During the period of the storm, the police
department answered over 600 incoming phone calls and addressed over 200
dispatched calls. The Fire Department reports 169 calls for the month of July,
including seventy four fire calls and ninety five EMS calls. Ninety people were

transported to the hospital. There were 24 home sale smoke/CO inspections
performed. There were 8 fire prevention inspections performed as well. The Fire
Prevention Bureau now has the Fire Permit Application online as well as the
Business Emergency Contact Update Form. This change eliminates the need to
print the form and mail it back in. Everything is processed electronically through the
SDL system. During the storm on August 6th the fire department responded to 51
emergencies. There were several houses damaged by fallen trees, burning wires,
gas leaks, 4 medicals and numerous flooded basements. Many basements were
flooded due to power outages. Now is a good time to look at alternative ways to
power sump pumps in the event of a power failure. There are several options
including battery back-ups, large battery powered generator type power banks and
gas-powered generators. Residents are also advised to evaluate their property to
make sure water drains away from their house.
Finance and Borough Clerk
Ms. Ehrlich, Chair of the Committee, made the following comments:
Ms. Ehrlich reported that this evening, there are two small consent agenda
resolutions to insert items of revenue into the budget. These are ministerial but
important actions that must be taken. State Statute Permits modifying the adopted
municipal budget during the year so the Borough can accept and spend grant
moneys. The municipal budget document includes a section for grant revenue and
another section for grant appropriations. Resolution 236-2024 and 237-2024 modify
the budget and establish the grant receivable and grant expense lines. And from the
Tax Department, the 3rd quarter grace period ended today. If you have not paid
yet, please call the tax office for an interest amount. The official Tax Sale Notices
are going out on Wednesday to residents with unpaid 2023 balances on their taxes
and utilities. The tax sale will be held October 3rd. The tax sale process is a way for
municipalities in New Jersey to obtain the full amount of property taxes and other
charges needed to support the annual budget, while providing the property owner
with additional time to pay off what they owe.
Public Works and Engineering
Mr. Landrigan, Chair of the Committee, made the following comments:
Mr. Landrigan noted that the Morris Township Public Works Department, the
Chatham Borough Public Works Department and the Millburn Public Works
Department, all assisted with the storm of August 6, 2024. This was a huge factor in
us getting a good amount of storm debris picked up and quite a few dangerous trees
cleared. We are continuing to clean up parks and roadways. This was a big storm
and thankfully the men and woman of Public Works stepped up and gave us a 100
percent. Unfortunately, some very nice tree were lost and we will be working with
Shade Tree Management Board on how to handle the replacements. The
Engineering Department reports that the Library renovations are near 95%
complete, and milling and overlay on Knollwood, Valley and Longview Roads are
also completed. The Solar Car Port project is progressing and we will hold a
preconstruction meeting soon.
Utilities
Mr. Haralampoudis, Chair of the Committee, made the following comments:
The Electric Utility Department reports sever damage from the straight line wind
storm, noting electric power out in some locations, and West Lane still closed.
Repairs and cleanup is still in process. Residents are asked to place small debris at
the curb for yard waste pickup and the Borough will collect larger debris.

Community Affairs
Ms. Honohan, Chair of the Committee, made the following comments:
The Madison Farm & Artisan Market is open for business every Saturday through
December 14th in the Prospect Street Parking Lot from 9:00 am until 2:00 pm.
Please check out all the great new and returning vendors, great music, and a sense
of community. Bottle Hill Day 2024 is scheduled for Saturday, October 5th.
Information regarding Vendor Applications and Event Sponsorship is posted on
rosenet.org. The Downtown Development Commission Regular Meeting has been
canceled. The commission will meet again on September 19th at 7:15 pm in the 2nd
Floor Committee Room in the Hartley Dodge Memorial Building. The public is invited
to attend. The Chamber of Commerce will hold the annual Car Show on October 5th
and Halloween Parade & Magic Show, October 26th. A Rose City Dog Day and
Parade is planned for November 2, 2024. As of July 30th, there will be 980
scheduled events at the center in 2024. This is an average of three events per day,
with an average use of 8 hours per day, nine hours per day, if event preparation
time is taken into account. This is 61% of the permitted operational hours in the
building, 70% if event preparation is included.
Health
Mr. Forte, Chair of the Committee, made the following comments:
August is Immunization Awareness Month. Residents are encouraged to ask their
physicians if they are up to date on all immunizations. All are encouraged to "Be
Seen on Halloween”. The goal of the campaign is to help children be more visible on
Halloween. Make it easier for drivers to see children, as they dart from house to
house collecting candy in the dark. The Board if Health Committee is working on a
tobacco law enforcement review, for student violators.
COMMUNICATIONS AND PETITIONS
The Borough Clerk announced receipt of the following communications:
Email dated August 8, 2024 from John Larkin, Elm Street, regarding PSE&G’s
paving schedule at Park Avenue and Elm Street.

Mayor Conley opened the meeting to the public for their opportunity to ask
questions and make comments on those items listed on the Agenda only. Mayor
asked that, upon recognition by the Meeting Moderator, each person give his/her
name and address in an audible tone of voice, for the record. He/she shall limit
his/her statement to three (3) minutes or less.
Since no member of the public wished to be heard, the invitation for comment was
closed.
AGENDA DISCUSSIONS
08/12/2024-1 CLIMATE ACTION COMMITTEE REPORT
Ms. Ehrlich gave a brief synopsis of the annual Climate Action Annual report, noting
the entire report is on rosenet,org. This report describes Madison’s progress in 2023
and 2024 towards climate goals adopted by the Borough to cut carbon pollution and
increase our resiliency to climate change. This report will help develop proposed
2025 Climate Action Recommendations to continue to achieve climate goals.
Madison will continue to prioritize vehicles and buildings, as fossil fuels are key
contributors. Madison is taking tangible steps towards these goals, and continues to
work with Borough staff and administration. The Climate Action Committee is
developing new recommendations to present in the coming year.

08/12/2024-2 ELECTRIC UTILITY RATE INCENTIVES
Kristin Wallenstein, member of the Madison Environmental Commission, presented
information on a proposed Electrification Incentive Program, including electric heat
pumps, noting several benefits to air quality, comfort and control. Ms. Wallenstein
introduced an Electrification Incentive Pilot Program for owner-occupied residences,
with a $2,000 limit per customer/address. An online application process will be
established and billing software will be modified, similar to that used for solar
credits. Mayor Conley asked for a motion to move forward with the incentives
program. Ms. Ehrlich moved that the Electric Utility Rate Incentives program move
forward. Mr. Forte seconded the motion. There was no further Council discussion,
and the motion passed with the following roll call vote recorded:

08/12/2024-3 ELECTRIC UTILITY BENCHMARKING
Resident and student Sam Cohen presented a program to give home owners insight
into their electric consumption. The tool helps compare your monthly consumption to
other utility users, based on consumption and square footage. Mayor Conley noted
that the program will be available on rosenet.org plus tips on how improve your
numbers.
ADVERTISED HEARINGS
Ordinances scheduled for hearing tonight were submitted in writing at a Regular
meeting of the Mayor and Council held on July 22, 2024, were introduced by title and
passed on first reading, were published in the Madison Eagle and made available to
members of the general public requesting same.
Mayor Conley called up Ordinances for second reading and asked the Clerk to read
said ordinances by title:
ORDINANCE 26-2024
ORDINANCE OF THE BOROUGH OF MADISON ADOPTING THE
REDEVELOPMENT PLAN FOR CERTAIN PROPERTY LOCATED AT
BLOCK 3303, LOT 2, AS SHOWN ON THE OFFICIAL TAX MAP OF THE
BOROUGH OF MADISON, PURSUANT TO THE LOCAL
REDEVELOPMENT AND HOUSING LAW, N.J.S.A. 40A:12A-1 TO -89
WHEREAS, the Borough of Madison, in the County of Morris, State of New Jersey
(the “Borough”), a public body corporate and politic of the State of New Jersey, is
authorized pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 to -
89 (the “Redevelopment Law”), to determine whether certain parcels of land within the
Borough constitute an area in need of rehabilitation and/or an area in need of redevelopment;
and
WHEREAS, N.J.S.A. 40A:12A-6 authorizes the governing body of any
municipality, by resolution, to have its Planning Board conduct a preliminary investigation
to determine whether an area of the municipality is a non-condemnation “area in need of
redevelopment” pursuant to the criteria contained in N.J.S.A. 40A:12A-5; and
WHEREAS, on February 12, 2024, the Mayor and Borough Council adopted
Resolution No. 61-2024, authorizing and directing the Madison Planning Board (the
“Planning Board”) to undertake a preliminary investigation hold a public hearing, and

undertake any other necessary steps to determine if certain property identified as Block
3303, Lot 2, as shown on the official Tax Map of the Borough (the “Study Area”),
constituted a non-condemnation “area in need of redevelopment” in accordance with the
Redevelopment Law; and
WHEREAS, on April 16, 2024, the Planning Board held a public hearing, duly
noticed under the Redevelopment Law, and reviewed an investigation report titled “1
Giralda Farms (Block 3303, Lot 2) Non-Condemnation Area in Need of Redevelopment
Investigation Report” prepared by Susan G. Blickstein, AICP/PP, PhD, dated March 28,
2024 (the “Study”); and
WHEREAS, on April 16, 2024, the Planning Board adopted a Resolution
recommending that the Study Area be determined by the Borough Council to be a non-
condemnation “area in need of redevelopment” under the Redevelopment Law as it relates to
Block 3303, Lot 2; and
WHEREAS, on May 13, 2024, the Mayor and Borough Council adopted Resolution
No. 157-2024, which accepted the Planning Board’s recommendation that the Study Area
was found to meet the necessary statutory criteria, designated the entire Study Area as a non-
condemnation area in need of redevelopment, and authorized the Planning Board to prepare
a Redevelopment Plan and to make recommendations for the Redevelopment Area pursuant
to the Redevelopment Law; and
WHEREAS, pursuant to N.J.S.A. 40A:12A-7(e) and N.J.S.A. 40A:12A-15 of the
Redevelopment Law, Susan G. Blickstein, AICP/PP, PhD, prepared a redevelopment plan
for the Redevelopment Area entitled “1 Giralda Farms Redevelopment Plan, Block 3303,
Lot 2, Borough of Madison, Morris County, New Jersey,” (the “Redevelopment Plan”) dated
July 16, 2024; and
WHEREAS, this Ordinance will be referred to the Planning Board to review the
Redevelopment Plan, to determine if the Redevelopment Plan is not inconsistent with the
Master Plan of the Borough of Madison and to make recommendations; and
WHEREAS, upon receipt and review of the Planning Board’s review and
recommendations relating to the Redevelopment Plan, the Borough Council desires to adopt
the Redevelopment Plan in order to effectuate a plan that is consistent with the goals and
objectives of the Borough for the redevelopment of the Redevelopment Area; and
WHEREAS, the Borough Council believes that the adoption of the Redevelopment
Plan, as amended herein, is in the best interest of the Borough for the redevelopment of the
Redevelopment Area.
NOW THEREFORE BE IT ORDAINED, by the Borough Council of the
Borough of Madison, in the County of Morris and State of New Jersey, as follows:
Section 1. The aforementioned recitals are incorporated herein as though fully set forth
at length.
Section 2. The Redevelopment Plan titled “1 Giralda Farms Redevelopment Plan,
Block 3303, Lot 2, Borough of Madison, Morris County, New Jersey,” and dated July
16, 2024, attached hereto as Exhibit A, is hereby adopted, pursuant to the terms of
N.J.S.A. 40A:12A-7 of the Redevelopment Law.

Section 3. The zoning district map in the zoning ordinance of the Borough is hereby
amended to include the Property per the boundaries described in the Redevelopment
Plan and the provisions thereon.
Section 4. If any section, sentence or other part of this Ordinance is adjudged
unconstitutional or invalid, such judgment shall not affect, impair or invalidate the
remainder of this Ordinance but shall be confined in its effect to the section, portion or
other part of this Ordinance directly involved in the controversy in which such judgment
shall be rendered.
Section 5. All ordinances, or parts thereof, which are inconsistent with the provisions
of this ordinance are hereby repealed, but only to the extent of such inconsistencies.
Section 6. A copy of this Ordinance and the Redevelopment Plan shall be available for
public inspection at the office of the Borough Clerk during regular business hours.
Section 7. This ordinance shall take effect immediately upon final passage and
publication according to law.
Mayor Conley opened up the public hearing on Ordinance 26-2024. Since no
member of the public wished to be heard, the public hearing was closed.
Mr. Range moved that Ordinance 26-2024, which was read by title, be finally
adopted. Ms. Ehrlich seconded the motion. There was no Council discussion, and
the motion passed with the following roll call vote recorded:

ORDINANCE 27-2024
ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING
$120,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR
REPAIR/REPLACEMENT OF SEWER LIFT STATION VALVES AND
ACCESSORIES
WHEREAS, the Director of Public Works has recommended that the
Borough appropriate $120,000.00 for the Repair/Replacement of sewer lift station
valves and accessories; and
WHEREAS, this expenditure was reflected in the 2024 Capital Budget; and
WHEREAS, the Chief Financial Officer has attested to the availability of the
funds in the General Capital Improvement Fund for Repair/Replacement of sewer lift
station valves and accessories in an amount not to exceed $120,000.00 for this
purpose; and

WHEREAS, the Borough Council has determined that the Borough should
appropriate $120,000.00 from the General Capital Improvement Fund for the
Repair/Replacement of sewer lift station valves and accessories.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, as follows:
SECTION 1: The amount of $120,000.00 is hereby appropriated
from the General Capital Improvement Fund for Repair/Replacement of sewer lift
station valves and accessories.
SECTION 2: The budget of the Borough is hereby amended to
conform with the provisions of this Ordinance.
SECTION 3: This Ordinance shall take effect as provided by law.
Mayor Conley opened up the public hearing on Ordinance 27-2024. Since no
member of the public wished to be heard, the public hearing was closed.
Mr. Landrigan moved that Ordinance 27-2024, which was read by title, be finally
adopted. Mr. Forte seconded the motion. There was no Council discussion, and the

Claire Whitcomb; Fairwood Road, noted she was thankful for the forest, as it
absorbed excess water from Tuesday’s storm and encouraged residents to reduce
their lawns.
Kathleen Caccavale; Central Avenue, thanked the Communications team for
information during the recent storm, regarding road closures, etc. and encouraged
residents to sign up for the alert system.

The Clerk made the following statement:
Consent Agenda Resolutions will be enacted with a single motion; any Resolution
requiring expenditure is supported by a Certification of Availability of Funds; any
Resolution requiring discussion will be removed from the Consent Agenda; all
Resolutions will be reflected in full in the minutes.

R 228-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING
JANET WAGSTAFF TO THE POSITION OF CONFIDENTIAL SECRETARY TO
THE CHIEF FINANCIAL OFFICER
WHEREAS, the Chief Financial Officer/Assistant Borough Administrator and
Personnel Director recommend the appointment of Janet Wagstaff, to the position of
Confidential Secretary to the Chief Financial Officer; and
WHEREAS, the Council agrees with this recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison in the County of Morris and State of New Jersey that, Janet Wagstaff is
hereby appointed to the position of Confidential Secretary to the Chief Financial
Officer at an annual salary of $71,539.00.
R 229-2024 RESOLUTION OF THE BOROUGH OF MADISON AWARDING BID
FOR THE PURCHASE OF NEW, UNUSED CAPACITOR BANK FUSES TO SWIFT
ELECTRIC SUPPLY CO.
WHEREAS, the Borough of Madison publicly advertised for bids for the
purchase of New, unused Capacitor Bank Fuses in accordance with the Local
Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, the lowest qualified bid was submitted by Swift Electric Supply
Co., in the amount of $27,222.75; and
WHEREAS, the Electric Utility Superintendent, the Qualified Purchasing
Agent and Borough Attorney have reviewed the bid submissions for compliance and
agree with the recommendation that the Borough Council award the contract to
Swift Electric Supply Co., in the amount of $27,222.75; and
WHEREAS, the Chief Financial Officer has attested that funds are available
in an amount not to exceed $27,222.75 for this purpose in Ordinance 29-2023.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, as follows:
1. The contract for the purchase of new, unused Capacitor Bank
Fuses is hereby awarded to Swift Electric Supply Co. based upon its bid in the
amount of $27,222.75.
2. The Mayor and Borough Clerk are hereby authorized and
directed on behalf of the Borough to enter into the contract with Swift Electric Supply
Co., in a form acceptable to the Borough Attorney.
R 230-2024 RESOLUTION OF THE BOROUGH OF MADISON AMENDING THE
PENSIONABLE ADJUSTMENTS FOR THE APPOINTMENTS OF BRUCE
BARRIOS, TOM BOYLAN AND EVAN WEBB AS LIEUTENANT IN THE MADISON
FIRE DEPARTMENT
WHEREAS, the Borough Council, after due consideration, previously
determined to appoint Bruce Barrios, Tom Boylan and Evan Webb, to the position of
Lieutenant in the Madison Fire Department; and
WHEREAS, Resolution 186-2024 authorized said appointments and
pensionable adjustment at the incorrect adjustment amount of $2,250.00 annually.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, that Bruce Barrios, Tom
Boylan and Evan Webb are hereby each appointed to the position of Lieutenant in
the Madison Fire Department, retroactive to July 8, 2024 with a pensionable
adjustment in the amount of $3,000.00 annually.
R 231-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING
LOUIS AMMIRATO, JR. TO THE POSITION OF HEAD CUSTODIAN
WHEREAS, the Personnel Director recommends the appointment of Louis
Ammirato, Jr., to the position of Head Custodian; and
WHEREAS, the Council agrees with this recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison in the County of Morris and State of New Jersey, that Louis Ammirato, Jr.
is hereby appointed to the position of Head Custodian at an annual salary of
$65,634.00.
R 232-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING
EXECUTION OF TERMINATION AND REMOVAL OF DEED RESTRICTION FOR
PROPERTY LOCATED AT 24 CENTRAL AVENUE (BLOCK 1601, LOTS 7 & 9)

WHEREAS, HQM Properties, Inc. (the “Property Owner”) is the current
owner of property located at 24 Central Avenue, also identified as Block 1601, Lots
7 & 9, in the Borough of Madison (the “Property”), which is subject to a Deed
restriction requiring a minimum of eight (8) parking spaces on the Property for
Borough and community use; and
WHEREAS, the Deed restriction was a required condition of site plan
approval on the Property, memorialized in a resolution of the Madison Planning
Board (the “Planning Board”), in 2007; and
WHEREAS, the Property Owner recently secured Zoning Board of
Adjustment site plan approval regarding an affordable housing development at 30
Central Avenue involving a portion of 24 Central Avenue which required the
termination of the Deed Restriction on the Property; and
WHEREAS, on July 11, 2024, the Zoning Board of Adjustment held a public
hearing on the application and, on July 11, 2024, the Board issued a memorializing
resolution granting the amended site plan approval subject to the removal of the
Deed restriction on the Property; and
WHEREAS, the Borough Council wishes to authorize the execution of a
Termination and Removal of Deed Restriction and has determined that it is in the
best interest of the public to execute such a document.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of
Madison, in the County of Morris, State of New Jersey, that the Mayor and Borough
Clerk are authorized to sign a Termination and Removal of Deed Restriction to
extinguish the deed restriction on 24 Central Avenue, also identified as Block 1601,
Lots 7 & 9, in the Borough of Madison, pursuant to the terms set forth in the
Madison Zoning Board of Adjustment’s July 11, 2024 resolution, in a form
acceptable to the Borough Attorney.
R 233-2024 RESOLUTION OF THE BOROUGH OF MADISON APPROVING A
SPECIAL EVENT PERMIT TO ALLOW THE USE OF MEMORIAL PARK PARKING
AREA BY THE ADULT SCHOOL OF THE CHATHAMS, MADISON AND FLORHAM
PARK
WHEREAS, the Adult School of the Chathams, Madison and Florham Park
has requested permission to use the parking area at Memorial Park on Friday,
September 27, 2024, Wednesday, October 16th, Tuesday, October 22nd, and
Tuesday, December 10, 2024 from 8:00 a.m. to 6:00 p.m.; and
WHEREAS, the Borough Administrator has recommended this request be
approved; and
WHEREAS, the Adult School of the Chathams, Madison and Florham Park
has submitted a Certificate of Liability Insurance naming the Borough of Madison as
an additional insured; and
WHEREAS, the Borough Council agrees with this recommendation.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, that the Adult School of

the Chathams, Madison and Florham Park is hereby given permission to use the
parking area at Memorial Park on Friday, September 27, 2024, Wednesday,

Department.
R 234-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING
ASSIGNMENT OF CONTRACT FOR WATER UTILITY LABORATORY SERVICES
WITH AGRA ENVIRONMENTAL AND LABORATORY SERVICES, TO PACE
ANALYTICAL SERVICES OF MINNEAPOLIS, MN
WHEREAS, the Borough entered into a contract for Water Utility Laboratory
Services with Agra Environmental and Laboratory Services, to provide operator and
laboratory services; and
WHEREAS, Agra Environmental and Laboratory Services has requested
that the Borough consent to an assignment of their contract to Pace Analytical
Services of Minneapolis, MN, for the remainder of the term, which contract will
expire at the end of 2024; and
WHEREAS, the Borough Administrator has recommended that the Council
authorize an assignment of the contract on such terms and conditions as the
Borough Attorney may determine are in the best interests of the Borough; and
WHEREAS, due to additional services required, the contract will exceed
$38,000.00; and
WHEREAS, assignment of the contract to Pace Analytical Services of
Minneapolis, MN, is contingent upon receipt of C.271 Political Contribution
Disclosure and other statutorily required documentation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison in the County of Morris and State of New Jersey as follows:
1. The Mayor and Borough Clerk are authorized to consent to an
assignment of the contract and execute documents as the Borough
Attorney may determine in order to assign the balance of the Water
Utility Services contract for the year 2024 with Agra Environmental and
Laboratory Services to Pace Analytical Services of Minneapolis, MN,
effective immediately.
2. The terms and conditions of the consent to assignment of contract and
any other legal documents necessary shall be approved by the Borough
Attorney.

R 235-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING
JAMES SULLIVAN TO THE POSITION OF ACCOUNTS CLERK/ASSISTANT TO
THE CONSTRUCTION CODE OFFICIAL
WHEREAS, the Personnel Director recommends the appointment of James
Sullivan, to the position of Accounts Clerk/Assistant to the Construction Code
Official; and
WHEREAS, the Council agrees with this recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison in the County of Morris and State of New Jersey, that James Sullivan is
hereby appointed to the position of Accounts Clerk/Assistant to the Construction
Code Official at an annual salary of $44,000.00.
R 236-2024 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING
THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE
INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2024
WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of
Local Government Services may approve the insertion of any special item of
revenue in the budget of any County or Municipality when such items shall have
been made available by law and the amount thereof was not determined at the time
of the adoption of the budget; and
WHEREAS, said Director may also approve the insertion of any item of
appropriation for equal amount; and
WHEREAS, the Borough of Madison was awarded $4,278.40 in funds from
the Patrick Leahy Bulletproof Vest Partnership 2022 federal grant; and
WHEREAS, a condition of receiving this grant is that the Borough of
Madison must provide a 50% match in the amount of $4,278.40.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Madison in the County of Morris and State of New Jersey hereby
requests the Director of Local Government Services to approve the insertion of an
item of revenue in the budget of the year 2024 as follows:
Miscellaneous Revenues
Special Items of General Revenue Anticipated with Prior Written Consent of the
Director of Local Government Services – Public and Private Revenues Offset
with Appropriations: Bulletproof Vest Partnership FY 2022 Grant……... $4,278.40;
and

hereby appropriated under the caption of:

WHEREAS, the Borough of Madison publicly advertised for bids for the
purchase of two (2) new, unused Ford Police Interceptor Utility vehicles (the

seq.; and
WHEREAS, the lowest qualified bid was submitted by Nielsen Ford of

WHEREAS, the Qualified Purchasing Agent/Personnel Director has
recommended that the Borough Council award the contract to Nielsen Ford of
Morristown, Inc. in the amount of $100.606.00; and
WHEREAS, the Chief Financial Officer has attested that funds are available
in an amount not to exceed $100.606.00 for this purpose in the Police Outside Duty
Trust T-03-56-852-001.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, as follows:
1. The contract for the purchase of two (2) new, unused Ford
Police Interceptor Utility vehicles is hereby awarded to Nielsen Ford of Morristown,
Inc. based upon its bid in the amount of $100.606.00.
2. The Mayor and Borough Clerk are hereby authorized and
directed on behalf of the Borough to enter into the contract with Nielsen Ford of
Morristown, Inc., in a form acceptable to the Borough Attorney.
R 239-2024 RESOLUTION OF THE BOROUGH OF MADISON APPROVING
TEMPORARY SIGNS FOR THURSDAY MORNING CLUB
WHEREAS, the members of the Thursday Morning Club have requested
permission to put up temporary signs advertising the Thursday Morning Club’s Pre-
School Program, Before and After School Programs, August through November
2024; and
WHEREAS, the signs would be located in the public Right of Way at various
intersections and adjacent to certain Borough-owned properties, commencing on
August 13, 2024 through November 15, 2024; and
WHEREAS, the Zoning Officer has recommended that a temporary sign
permit be issued.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, that the request of the
members of the Thursday Moring Club to put up temporary signs as described herein,
is approved.

intersections and adjacent to certain Borough-owned properties, commencing on
August 13, 2024 through September 8, 2024; and
