MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE
BOROUGH OF MADISON
September 9, 2024 – 6:30 p.m.
CALL TO ORDER
The Regular Meeting of the Mayor and Council of the Borough of Madison was held
on the 9th day of September, 2024. Acting Mayor Range called the meeting to order
at 6:30 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in
the Borough of Madison.
STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT
The Borough Clerk read the statement pursuant to the Open Public Meetings Act:
“In compliance with the Open Public Meetings Act, adequate notice of this meeting
of the Council was provided by transmitting a copy of the meeting notice to the
Madison Eagle and Morris County Daily Record, posting a copy on the bulletin
board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the
office of the Clerk, all on January 12, 2024. This Notice was made available to
members of the general public.”

Acting Mayor Range reconvened the Regular Meeting at 8 p.m. in the Council
Chamber with all members present. The Pledge of Allegiance was recited by all.
Acting Mayor Range asked for a moment of silence to remember the victims of the
September 11th attack on our nation, and to remember James L. Crawford, Jr.,
Timothy Robert Hughes, Patrick J. McGuire, Peter M. West, Donald Arthur
Peterson, Jean Hoadley Peterson, Madison residents that were lost that awful day.

GREETINGS TO PUBLIC
Acting Mayor Range made the following comments:
Employee of the Month for September is Dennis Harrington for the additional
responsibilities he has taken on since the former Engineer’s retirement, as well as
other department members out on sick leave.
Anniversaries
September 7, 2023, Captain Joseph Longo reached his 25th anniversary with the
Borough of Madison.
September 13, 2024 Donna Cary, Utility Billing Supervisor, reached 25th anniversary
with the Borough of Madison
Acting Mayor Range provided an update of the Borough’s efforts to save the Drew
Forest, by reading the following statement: In July, after more than two years of
negotiations, the Borough of Madison made a final offer valued at more than $65
million. Unfortunately, Drew has not yet accepted that offer. The Borough implores
Drew University leadership and its Board of Trustees to accept this offer without
delay. While the offer remains on the table, upcoming deadlines for court filings and
the potential expiration of grant funds secured for the purchase of the Forest will
mean that the offer will be withdrawn as Madison will not fund lost grants with local
tax dollars or debt. The Borough’s comprehensive proposal includes acquiring and
preserving approximately 51 acres of forested land, including the Zuck Arboretum,
Hepburn Woods, and properties along Glenwild and Green Village Roads.
Additionally, the offer allows for residential development on other parts of the Drew
campus, consisting of both affordable and market-rate apartments. Madison has
collaborated with various stakeholders, including Federal, State, and County
officials, the Friends of the Drew Forest, potential private donors, and the Fair Share
Housing Center, to support the forest’s purchase. The Borough continues to
negotiate in good faith, as our current offer is, in fact, 30% more than a previous
offer made in March 2023. The Borough extends our gratitude to the Friends of the

Drew Forest, the 15,000+ community members who signed the change.org petition,
environmental advocates, and various government officials, including Senator
Booker, Congresswoman Sherrill, New Jersey Senators Bucco and McKeon, Morris
County Commissioners, and members of the Morris County Open Space
Committee, who continue to support our efforts. The Borough reaffirms our
commitment to protecting the Drew Forest and urges the public to remain engaged
in this important cause.
REPORTS OF COMMITTEES
Public Safety
Mr. Range, Chair of the Committee, made the following comments:
During the week of September 2, 2024, Police Department personnel met with
Vincent Ucci of Arianna’s Angels, a non-profit organization based out of East
Hanover, NJ. The organization was established to help spread Autism Awareness.
Mr. Ucci donated “Autism Info Sheets for First Responders” to the Madison Police
Department. The sheets will be kept in each officer’s patrol vehicle and alerts
officers on signs, triggers, and tips on interacting with a child or person with Autism.
For more information on this organization, please visit ariannasangels.com. During
this week, the Police Department had two MHS students begin their internship with
the department. Both Katie and Iris are MHS seniors and have aspirations to study
in the public safety/law field after high school. We welcome both the students to our
MPD family and hope they enjoy their time learning with us. For the month of
August, the Fire Department responded to 269 calls. This included 172 fire calls and
97 EMS calls. Seventy-one people were transported to the hospital. During the
month of August there was two significant storms. The August 6th storm had 51
emergency responses and the storm on August 18th resulted in 52 responses.
Basement flooding remains a problem. As reported before, now it the time to find
ways to prevent basements from flooding. These can be done with battery backups,
basement water proofing and yard grading and drainage. There were 23 home sale
smoke/CO inspections performed. There were 36 fire prevention inspections
performed as well. The Fire Prevention Bureau is also getting ready for the update
to the 2018 Edition of the NJ State Fire Code that is rolling out next month.
The Fire Department accepted a grant for $55,000 from NJ Department of
Community Affairs to purchase firefighter personal protection equipment.
Finance and Borough Clerk
Ms. Ehrlich, Chair of the Committee, made the following comments:
Ms. Ehrlich noted that the advertisement for the annual tax sale has been posted in
the Madison Eagle and was first published in last week’s newspaper. Publishing
this advertisement is one of the steps that is taken before a property owner’s
delinquency is resolved through a tax sale. A tax sale is the enforcement of
collections against a property by placing a lien against the property for outstanding
municipal charges that were due on or before December 31 of the prior year. Most
of the notices in the advertisement were for unpaid utility bills. This year’s tax sale
is scheduled for 10:00 am on Thursday October 3rd.The state requires an annual tax
sale to ensure municipalities do not have outstanding charges from prior years.
Ms. Ehrlich noted a few larger payments that appear on the voucher register. There
is a payment of $261,165 from the Open Space Trust fund which is for the MRC
land and turf debt, with $145,000 of the payment as principal on the land portion of
the MRC and $85,000 toward principal on the turf field. The remaining $31,165 is
the interest payment on the debt. As reported annually, we have principal payments
on the turf field until the year 2028. The second notable payment is $4,067,724.67
which is the monthly payment to the Board of Education for their share of property

taxes, made August 15th. Finally, on August 15th, the Borough paid $2,825,760.21
to the County of Morris, which is the third quarter payment of county taxes that was
collected by the Borough of Madison in our property tax bills. The Council receives
the voucher register, or bill list, ahead of every Council meeting. The list is compiled
by the Accounts Payable Department and includes all payments that were
processed and upcoming checks that are set to be issued.
Public Works and Engineering
Mr. Landrigan, Chair of the Committee, made the following comments:
From the Engineering Department, the reconstruction of Well B is nearing
completion. The Utility Building Roof replacement project is completed and the
Library Renovation project is 98% complete. Milling and overlay is finished for this
season, as well as line striping and Cook Avenue Parking Lot reconstruction will
begin Phase 2 this week. The Department of Public Works grinding all the tree
debris from previous storms and hauling it out to be reused. On tonight's agenda is
request for a hybrid truck that will replace a traditional gas engine truck. The
Department assisted Engineering with all the paving projects and worked with the
Electric Dept. on the Cook Avenue parking lot reconstruction project to get
underground conduit in place under Cook Ave. Fall sports are underway and DPW
is working with Recreation to line all the fields, as well as, painting of all the
crosswalks and no parking areas in the school zones that needed to be done before
the first day of school.
Utilities
Mr. Haralampoudis, Chair of the Committee, made the following comments:
The Water Department continues to work on new construction and noted some
damage to the system during the August 6th storm. The Electric Department finished
work on Well B improvements and continues with work at the Cook Avenue Parking
Lot reconstruction. There was a transformer malfunction due to the August 6th storm
on Central Avenue and the planned power outage, for August 18th to upgrade part of
the system, will be rescheduled.
Community Affairs
Ms. Honohan, Chair of the Committee, made the following comments:
Bottle Hill Day 2024 is scheduled for Saturday, October 5. Information regarding
Vendor Applications and Event Sponsorship is posted on rosenet.org. The Madison
Farm & Artisan Market is open for business every Saturday through December 14 in
the Prospect Street Parking Lot from 9:00 am until 2:00 pm. The next regular
meeting of the Downtown Development Commission will be held on September 19th
at 7:15 pm in the 2nd Floor Committee Room in the Hartley Dodge Memorial
Building. The public is invited to attend. The Madison Area Chamber of Commerce
and Madison P.B.A. #92 are hosting the 29th Annual Madison Car Show on
Saturday, October 5th. This popular event coincides with Madison’s Bottle Hill Day
street festival, and Madison Tire & Auto Repair, located at 285 Main Street, is the
primary sponsor. The Madison Car Show will take place in the Prospect Street
Parking Lot (29 Prospect Street)), just a short walk from the Bottle Hill Day festivities
held in Madison’s business district. The Madison Area Chamber of Commerce 2024
Halloween Parade & Magic Show is scheduled for Saturday, October 26, from 12:30
pm to 3:00 pm. Children, their parents, and guardians are invited to attend a
Halloween costume parade followed by a magic show and trick-or-treating in the
downtown business area. Trick or Treating will not be permitted before the end of
the magic show. The Chamber and the DDC are presenting a new event called the
Rose City Dog Day & Parade this fall. It will be held on Saturday, November 2nd,
from 11:00 am until 2:00 pm.

Health
Mr. Forte, Chair of the Committee, made the following comments:
The Madison Health Department will hold vaccine clinics at the Hartley Dodge
Memorial on September 16th, 19th and 20th, for uninsured or under insured residents.
The Department also notes that West Nile Virus has been reported in the area and
residents are encouraged to use spray repellents, wear long sleeves, remove any
standing water, and check screens for holes.

AGENDA DISCUSSIONS
09/09/2024-1 PREQUALIFICATIONS FOR RESTORATION OF MADISON HELLER
CENTER
Ms. Ehrlich provided explanation of the proposed Madison Heller Center Restoration
project, noting the building’s history and future plans. The addition of an elevator
and updated HVAC, plumbing and electrical systems are also in the reconstruction
plans. Details of the construction plan including new ADA restrooms and a new
elevator and egress stair at the rear of the building to permit full access to the
public. Exterior brick repair, reappointment and sealing are also required. Acting
Mayor Range opened the meeting to the public for comments. Since no member of
the public wished to be heard, the invitation for comments was closed.

09/09/2024-2 ELECTRIC UTILITY CAPACITY PRICES
Mr. Burnet provided information on market capacity indicators, noting PJM’s
capacity market, called the Reliability Pricing Model (“RPM”), ensures long-term grid
reliability by procuring the appropriate amount of power supply resources needed to
meet predicted energy demand in the future. The Borough’s capacity charge is
based on two factors, the price for capacity and our peak load factor. The peak load
factor is the average of the five highest non-coincident peak load days in the prior
year. Prices in PJM’s latest capacity auction hit record highs. The spike in capacity
prices was driven by fossil power plant retirements, increased load, a
supply/demand imbalance and new market rules. The Borough can reduce peaks by
residential time of use rates, Borough owned solar, smart meters and voluntary
demand response.

Lydia Chambers; Harding Township, representing the Friends of the Drew Forest,
acknowledged the tireless work by the Mayor and Council to reach an agreement to
preserve the forest and encouraged Drew University to accept the offer.
Amy Fried; Museum of Early Trades and Crafts, spoke regarding introduction of
Ordinance 29-2024 and thanked the Mayor and Council for additional funding for
repairs to the James Building clock.
Steve Sherman; Myrtle Avenue, noted an accident at Main Street and Seaman
Street and asked that the timing for cross walks along Main Street be increased.
INTRODUCTION OF ORDINANCES
The Clerk made the following statement:
Ordinances scheduled for introduction and first reading tonight will have a hearing
during the meeting of September 23, 2024 in the 2nd Floor Council Chamber of the
Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m.,
or as soon thereafter as practical, for further consideration and final adoption. Said
ordinances will be published in the Madison Eagle, be posted at the main entrance
to the Borough offices and be made available to members of the public requesting
same, as required by law.
Acting Mayor Range called up Ordinances for first reading and asked the Clerk to
read said ordinance by title:
ORDINANCE 28-2024 ORDINANCE OF THE BOROUGH OF MADISON
APPROPRIATING $60,000.00 FROM GENERAL CAPITAL IMPROVEMENT FUND
FOR THE PURCHASE OF A NEW JEEP VEHICLE AND ACCESSORIES
WHEREAS, the Director of Public Works has recommended that the
Borough appropriate $60,000.00 from the General Capital Improvement Fund for
the purchase of a new Jeep Vehicle and accessories for the Department of Public
Works; and
WHEREAS, funds are available in the General Capital Improvement Fund
and the availability of funds has been certified by the Chief Financial Officer; and
WHEREAS, the Borough Council has determined that the Borough should
appropriate $60,000.00 from the General Capital Improvement Fund for the
purchase of a new Jeep Vehicle and accessories for the Department of Public
Works.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, as follows:
SECTION 1: The amount of $60,000.00 is hereby appropriated from the
General Capital Improvement Fund for the purchase of a new Jeep Vehicle and
accessories for the Department of Public Works.

RECREATION AND HISTORIC PRESERVATION TRUST FUND FOR REPAIRS
TO THE MUSEUM OF EARLY TRADES & CRAFTS CLOCK
WHEREAS, the Borough Council has determined that the Borough should
appropriate $3,820.00 from the Open Space, Recreation, and Historic Preservation
Trust Fund as a matching grant to repair the historic clock at the James Library
Building; and
WHEREAS, the Open Space Advisory Committee has unanimously
recommended the full funding of this request; and
WHEREAS, the Chief Financial Officer has attested to the availability of
funds in an amount not to exceed $3,820.00 for this purpose in the Open Space
Trust Fund.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, as follows:
SECTION 1: The amount of $3,820.00 is hereby appropriated from the
Open Space, Recreation and Historic Preservation Trust Fund for the restoration of
the James Library building’s historic Seth Thomas clock.
SECTION 2: This Ordinance shall take effect as provided by law.

new One Cyclone Compressed Air Foam System Fire Engine; and

funds in the General Capital Improvement Fund in an amount not to exceed
$1,400,000.00 for this purpose; and
WHEREAS, the Borough Council has determined that the Borough should
appropriate $1,400,000.00 from the General Capital Improvement Fund for the
purchase of a new One Cyclone Compressed Air Foam System Fire Engine.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of

R 241-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING
ROBERT C. DEITCH TO THE POSITION OF CLASS III SPECIAL LAW
ENFORCEMENT OFFICER IN THE MADISON POLICE DEPARTMENT

WHEREAS, the Madison Board of Education has offered to fully fund a
Special Law Enforcement Officer for the 2024-2025 school year to serve elementary
schools; and
WHEREAS, the Borough Council, after due consideration, has determined to
appoint Robert C. Deitch to the position of Class III Special Law Enforcement Officer
in the Madison Police Department, effective September 10, 2024, contingent upon
receipt of full funding from the Madison Board of Education; and
WHEREAS, this appointment is expressly contingent upon the execution of
a Shared Service Agreement with the Madison Board of Education (BOE) which
provides that the BOE shall fully fund all personnel costs related to said
appointment; and
WHEREAS, this Resolution and said appointment shall lapse upon the
termination of the BOE full funding.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of
Madison, in the County of Morris and State of New Jersey, that Robert C. Deitch is
hereby appointed to the position of Class III Special Law Enforcement Officer in the
Madison Police Department, effective September 10, 2024 to be compensated at
the rate of $37.00 per hour, fully funded by the Madison Board of Education, with no
health benefits provided by the Borough.
R 242-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING
SALARY INCREASE FOR THE CHIEF OF POLICE
WHEREAS, John R. Miscia serves as the Chief of Madison Police
Department; and
WHEREAS, pursuant to N.J. S.A. 40A:14-279, the starting base salary of [a]
chief of police … shall be set at a rate that is higher than the highest base salary of
the ranking police officer next in command below the chief of police … as
appropriate. Thereafter, whenever new base salary ranges are set by the governing
body or appointive authority, unless the chief of police… consent[s] to a lesser
adjustment, the base salary of the chief of police … shall be adjusted [.]; and
WHEREAS, the Borough recently negotiated an updated collective
bargaining agreement with the Madison Superior Officers Association Local No. 92
(the “SOA”), which adjusted the base salaries of police officers within the SOA; and
WHEREAS, in light of the settlement with the SOA, the Borough intends to
adjust the salary of the Police Captain, the ranking police officer next in command
below Chief Miscia; and

WHEREAS, the Borough Administrator has recommended a salary increase
for Chief Miscia given the relatively small administrative staff in the Police
Department and the increased job responsibilities in the role of Chief of Police; and
WHEREAS, in addition, the existing base salary of the Chief of Police in the
Borough is below the average for other Chiefs of Police in the County of Morris; and
WHEREAS, the Borough Council, after due consideration of the above, has
determined to approve a one-time salary increase for Chief Miscia to $195,000.00,
retroactive to January 1, 2024; and
WHEREAS, the Borough Chief Financial Officer certifies to the availability of
funds to cover the salary increase as set forth in this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
Borough of Madison, in the County of Morris and State of New Jersey, that the
Borough Council hereby authorizes a one-time salary increase to Police Chief John
R. Miscia to $195,000.00, which shall be retroactive to January 1, 2024.
R 243-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING
SALARY INCREASE FOR POLICE CAPTAIN JOSEPH LONGO EXCLUDED
FROM UNION COLLECTIVE BARGAINING AGREEMENT
WHEREAS, Joseph Longo serves as Captain in the Madison Police
Department; and
WHEREAS, the Borough recently negotiated an updated collective
bargaining agreement with the Madison Superior Officers Association Local No. 92
(the “SOA”), which adjusted the base salaries of police officers within the SOA and
removed the Police Captain position from the SOA; and
WHEREAS, in light of the settlement with the SOA, the Borough
Administrator has recommended a salary increase for Captain Joseph Longo to
adjust the compensation for the Police Captain position being removed from the
SOA collective bargaining agreement; and
WHEREAS, in addition, the salary increase is recommended based on the
relatively small administrative staff in the Police Department and the increased job
responsibilities in the role of Police Captain; and
WHEREAS, the Borough Council has determined to approve a salary
increase, pursuant to the below schedule, which aligns with the term of the SOA’s
collective bargaining agreement, to Police Captain Joseph Longo, retroactive to
January 1, 2022; and
WHEREAS, the Borough Chief Financial Officer certifies to the availability of
funds to cover the salary increase as set forth in this Resolution, subject to the

PREQUALIFICATION REGULATIONS FOR THE RESTORATION OF THE
HELLER CENTER
WHEREAS, on September 9, 2024, the Borough Council of the Borough of
Madison conducted a public hearing to consider the terms and conditions of the
Prequalification Regulations for the restoration of the Madison Heller Center, the
former Masonic Lodge; and
WHEREAS, the Prequalification Regulations were prepared by the Assistant
Borough Engineer and project architect for the project; and
WHEREAS, the Borough Council has reviewed the Prequalification
Regulations and has made a determination that the requirements will insure that the
restoration of the Madison Heller Center is performed by a contractor having
knowledge and experience in historic restoration.

COOPERATIVE PRICING SYSTEM
WHEREAS, the Borough of Madison desires to award a contract for the
purchase of a pickup truck and accessories through the New Jersey Cooperative
Pricing System program; and
WHEREAS, the purchase of goods and services by local contracting units is
authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, All American Ford Old Bridge, of Old Bridge New Jersey, has
been awarded the New Jersey Cooperative Pricing System contract number T0099,
24-FLEET-77708, Vehicles; Sedans, Sport Utility Vehicles and Trucks; and
WHEREAS, the Borough Qualified Purchasing Agenda has recommended

WHEREAS, the Borough of Madison has the authority to issue a new
Theater Exception Plenary Retail Consumption liquor license for the sale of
alcoholic beverages; and
WHEREAS, by Resolution 285-2022, adopted on October 24, 2022, the
Borough of Madison authorized the acceptance of applications for the issuance of a
Theater Exception Plenary Retail Consumption liquor license and established a
process for the receipt and review of submissions by prospective applicants; and
WHEREAS, by the date and time for receipt of applications, one application
was submitted by The Shakespeare Theatre of New Jersey, 36 Madison Avenue,
Madison, NJ 07940; and
WHEREAS, completion of the licensing process as required by law includes
payment of the State licensing fee, payment of the annual municipal license fee,
satisfactory completion of the municipal background checks and satisfactory
