MINUTES PLANNING BOARD OF THE BOROUGH OF MADISON REGULAR MEETING MARCH 18, 2014 A regular meeting of the Planning Board of the Borough of Madison was held on the 18th day of March 2014 at 7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison, NJ. The meeting was called to order by Planning Board Chairman, Steve Tombalakian Mr. Tombalakian requested the reading of the Public Meeting Notice. Ms. Boardman read the following statement in accordance with the Open Public Meetings Act. “Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the reorganization meeting of the Board held on January 7, 2014, the Board by Resolution adopted a schedule of meetings. On January 8, 2014, a copy of the schedule of meetings was posted at the bulletin board at the entrance to the Hartley Dodge Memorial, was sent to the Madison Eagle and the Daily Record, and filed with the Borough Clerk all in accordance with the “Open Public Meetings Act”. The following roll call was recorded: Present: Steve Tombalakian, John Forte, Mayor Robert Conley, Tom Johnson, Michael Kopas, and Jeff Gertler who arrived at 7:43pm Excused: Peter Flemming, Judy Mullins, and Astri Baillie Also Present: Vince Loughlin, Planning Board Attorney Susan Blickstein, Board Planner Frank Russo, Board Engineer Frances Boardman, Board Secretary Approval of Minutes: Copies of the minutes of the March 4, 2014 regular meeting minutes were distributed to all Board members for their review prior to this meeting. A motion to approve the minutes was made by Mr. Forte, seconded by Mayor Conley. A voice vote of “aye” was heard by all eligible voting members and recorded. Comments by the Public: Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter not on this evening’s agenda. Seeing no one he closed that portion of the meeting. RESOLUTIONS FOR MEMORIALIZATION – None NEW BUSINESS – CASE NO. P 13-014 Minor Subdivision Parisi Builders & Developers, LLC Block: 404, Lot: 50 27 Belleau Avenue Ms. Carlotta Budd, Esq, was present to represent the applicant Parisi Builders & Developers, LLC. This application is for a minor subdivision on 27 Belleau Avenue. The site contains a total of 15, 000 square feet which will be subdivided to create two conforming lots. Ms. Budd stated that she had only one witness this evening, Mr. Kevin Page, Page Engineering Consultants. 1 Planning Board March 18, 2014 Mr. Kevin Page, Page Engineering Consultants, P.O. Box 4619, Warren, NJ was sworn in to testify. His qualifications were given and he was accepted as an expert witness. The following exhibits were marked: Exhibit A-1: Subdivision Map dated 11/25/2013 with revision date of 1/3/2014 Exhibit A-2: Two color photos taken by Mr. Page in 2013 depicting the trees on property. Mr. Page began by stating to the Board that this subdivision will create two lots fifty feet in width in the R-4 (Single-Family/Two-Family Residential) Zone. Upon these lots once subdivided the applicant will be proposing two conforming new single family dwellings. A concept of these dwellings has been placed on the site plan. The applicant is proposing a 20’ wide sanitary sewer easement in the rear of the property. A drywell is proposed for each dwelling in the front yard. Mr. Page stated that all setbacks are conforming in accordance with the Borough Zoning table. Ms. Blickstein stated that a condition should be placed in the resolution setting the front yard setback within two feet of the prevailing setback of 37.71 feet (from 35.71 to 39.71ft.). The Board agreed with this condition as did the applicant. Mr. Page stated that all comments from the Omland Engineering memorandum dated, February 27, 2014 would be complied with. Ms Budd stated that a waiver was being requested for the natural resources within 50 ft of the property. Mr. Tombalakian asked the Board if they had any questions for Mr. Page. Ms. Blickstein asked Mr. Page what landscaping was being planned for the site. Mr. Page replied that all street trees would try to be saved and those that were not salvageable would be replaced. He reminded the Board that there is not much room in the front of the proposed homes due to the drywell and the driveway. He was suggested that Mr. Page work with the Shade Tree Commission regarding the street trees. Mr. Tombalakian then opened the floor to any member of the audience that had a question of Mr. Page. Saverio Allocco, 17 Belleau Avenue, Madison stated that he was concerned with the size of the dwellings that would be built on these properties. Mr. Tombalakian stated that the new dwellings were not a part of this application for minor subdivision, and this issue was not applicable to this application. Greg Olear, 21 Belleau Avenue, Madison asked what the side yard setback was. Mr. Page reiterated that the side yard setback was 8ft. He also stated that it was the applicant’s intent to fully comply with the zoning table when building the new dwellings. Seeing no further questions from the audience members Mr. Tombalakian closed that portion of the hearing. Mr. Tombalakian then asked if there were any comments from the public, seeing none he closed that portion of the hearing. The Board began their deliberation; Mr. Loughlin addressed the conditions that will be included in the resolution. Motion to approve this application with the conditions as stated during testimony was made by Mayor Conley, seconded by Mr. Kopas. A roll call was requested and recorded as follows: “Ayes” –Mayor Conley, Mr. Kopas, Mr. Tombalakian, Mr. Forte, Mr. Gertler and Mr. Johnson “Nays” – None “Absent”: Mr. Flemming, Ms. Baillie and Mrs. Mullins. 2 Planning Board March 18, 2014 OLD BUSINESS - None PLANNING DISCUSION – Mr. Russo handed out suggested changes to the Borough Ordinance to address Stormwater Management requirements on single family lots and subdivisions. The discussion was tabled to the next regular scheduled meeting of Tuesday, April 1, 2014. CORRESPONDENCE – None Since there was no further business to come before the Board, Mr. Tombalakian made a motion to adjourn the regular meeting at 8:25 P.M.; seconded by Mr. Kopas.
