MINUTES PLANNING BOARD OF THE BOROUGH OF MADISON REGULAR MEETING MAY 20, 2014 A regular meeting of the Planning Board of the Borough of Madison was held on the 20th day of May 2014 at 7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison, NJ. The meeting was called to order by Planning Board Chairman, Steve Tombalakian Mr. Tombalakian requested the reading of the Public Meeting Notice. Ms. Boardman read the following statement in accordance with the Open Public Meetings Act. “Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the reorganization meeting of the Board held on January 7, 2014, the Board by Resolution adopted a schedule of meetings. On January 8, 2014, a copy of the schedule of meetings was posted at the bulletin board at the entrance to the Hartley Dodge Memorial, was sent to the Madison Eagle and the Daily Record, and filed with the Borough Clerk all in accordance with the “Open Public Meetings Act”. The following roll call was recorded: Present: Steve Tombalakian, Mayor Robert Conley, Tom Johnson, Judy Mullins, Peter Flemming, John Forte and Jeff Gertler who arrived at 7:35pm Excused: Astri Baillie Absent: Michael Kopas Also Present: Susan Blickstein, Board Planner Vince Loughlin, Planning Board Attorney Frank Russo, Board Engineer Frances Boardman, Board Secretary Approval of Minutes: Copies of the May 6, 2014 regular meeting minutes were distributed to all Board members for their review prior to this meeting. A motion to approve the minutes was made by Mrs. Mullins, seconded by Mr. Flemming. A voice vote of “aye” was heard by all eligible voting members and recorded. Comments by the Public: Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter not on this evening’s agenda. Seeing no one he closed that portion of the meeting. RESOLUTIONS FOR MEMORIALIZATION – CASE NO. P 14-001 Preliminary and Final Site Plan 39 Green Village Road, LLC Block: 3001, Lot: 23 39 Green Village Road Resolution granting the Preliminary and Final Site Plan of 39 green Village Road, LLC., for the Preliminary and Final Site Plan on property located at 39 Green Village Road, Madison commonly known on the Borough of Madison Tax Map as Block 3001, Lot 23. 1 Planning Board May 20, 2014 The draft resolution was sent to the applicant’s Attorney, Mr. Brian Burns, Esq. and the Planning Board members and it’s Professionals for review prior to this evening’s meeting. Mr. Tombalakian asked the Board and its Professionals if they had any further comments or questions concerning the resolution. Mrs. Mullins stated that a paragraph referring to tree protection during construction and snow removal from the rear of the building as discussed at the hearing on May 6, 2014 had been omitted from the resolution. Mr. Loughlin agreed with Mrs. Mullins and stated that a revised resolution with these additions would be placed in the resolution and sent to the Board secretary. Mr. Tombalakian asked for a motion to approve the resolution with this additional paragraph. A motion was made by Mayor Conley, seconded by Mrs. Mullins; the following roll call was recorded: “Ayes” – Mayor Conley, Mr. Tombalakian, Mr. Flemming, Mr. Johnson, and Mrs. Mullins “Nays” – None “Abstain” – Mr. Forte Borough of Madison Master Plan Amendment A draft resolution of the Land Use Element Amendment of the Borough of Madison Master Plan was sent to all Board members and Professionals for review prior to this evenings meeting. Mr. Tombalakian asked the Board and its Professionals if they had any further comments on the resolution seeing none Mr. Tombalakian asked for a motion to approve the resolution. A motion was made by Mayor Conley, seconded by Mr. Flemming; the following roll call was recorded: “Ayes” – Mayor Conley, Mr. Tombalakian, Mr. Flemming, Mr. Johnson, Mr. Gertler, Mr. Forte and Mrs. Mullins “Nays” – None “Abstain” – None REVIEW AND RECOMMENDATION ITEMS On referral from the Governing Body: Ordinance 31-2014 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 195, LAND DEVELOPMENT TO REVISE THE BOROUGH’S CONDITIONAL USE STANDARDS FOR DRIVE-THRU RESTAURANTS. The above referenced Ordinance was sent to the Board members and its Professionals prior to this evening meeting. Dr. Blickstein began the discussion by giving an overview of the contents of the Ordinance. 2 Planning Board May 20, 2014 Each section of the Ordinance being amended was discussed, it was decided that ‘natural wood’ should be included in Provision (r) on page three. Ms. Boardman was directed to send an email to the Borough Attorney requesting he implement the word “wood” into the Ordinance. Mr. Tombalakian asked the Board and its Professionals if they had any further comments on the review and recommendation item from Mayor and Council, seeing none Mr. Tombalakian made a motion, seconded by Mr. Gertler to approve the recommendation of Ordinance 31-2014 to Mayor and Council stating it was consistent with the Borough of Madison Master Plan. The following roll call was recorded: “Ayes” – Mayor Conley, Mr. Tombalakian, Mr. Flemming, Mr. Johnson, Mr. Gertler, Mr. Forte and Mrs. Mullins “Nays” – None “Abstain” – None PLANNING DISCUSION – Ms. Betsy Uhlman, Environmental Commission Chairwoman, discussed the ERI Amendments that the Environmental Commission would like to see added to the Borough of Madison Master Plan. The items discussed were the Threatened and Endangered Species and Madison’s Wildlife Action Plan and the Borough of Madison’s Conservation and Historic Preservation Easements. Dr. Blickstein suggested to Mrs. Uhlman that an introduction be sent to the Board secretary and that this item would be placed on a Planning Board agenda as a public hearing item sometime in the near future. • Storm Water Management Ordinance Changes - Storm water management was discussed in detail by Frank Russo. Mr. Russo referred to his memorandum, dated May 6, 2014, which was distributed to all Board members at the last meeting. Additional discussion may be required. • Conservation Easements – Mr. Russo stated that the Borough currently has seven recorded easements, five being buffer easements. Any legal document which is recorded should be enforced by the Borough Attorney not the zoning officer. A standard boiler plate for easements and an enforceable template were discussed. Additional discussion will be required at a later date.
