MINUTES PLANNING BOARD OF THE BOROUGH OF MADISON REGULAR MEETING MARCH 6, 2018 A regular meeting of the Planning Board of the Borough of Madison was held on the 6th day of March 2018 at 7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison, NJ. The meeting was called to order by Planning Board Chairman, Steve Tombalakian Mr. Tombalakian requested the reading of the Public Meeting Notice. Ms. Boardman read the following statement in accordance with the Open Public Meetings Act. “Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the reorganization meeting of the Board held on January 16, 2018, the Board by Resolution adopted a schedule of meetings. On January 17, 2018, a copy of the schedule of meetings will be posted at the bulletin board at the entrance to the Hartley Dodge Memorial, sent to the Madison Eagle and the Daily Record, and filed with the Borough Clerk all in accordance with the “Open Public Meetings Act”. The following roll call was recorded: Present: Mayor Robert Conley, Tom Lewis, Peter Flemming, John Forte, Rachel Ehrlich, Astri Baillie, George Limbach, Ann Huber, and Steve Tombalakian Excused: None Also Present: Frank Russo, Assistant Borough Engineer Susan Blickstein, Board Planner Vince Loughlin, Planning Board Attorney Frances Boardman, Board Secretary Approval of Minutes: Copies of the minutes of the February 20, 2018 regular meeting were distributed to all Board members for their review prior to this meeting. A motion to approve the regular minutes as presented was made by Mr. Lewis, seconded by Mayor Conley. A voice vote of “Aye” was heard by all eligible Board members. Comments by the Public: Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter not on this evening’s agenda. Seeing no one he closed that portion of the meeting. RESOLUTIONS FOR MEMORIALIZATION – CASE NO. P 17-007 Minor Subdivision Patrick Esposito 362 Woodland Road Block: 4302, Lot: 2 Resolution granting the Minor Subdivision to Patrick Esposito on property located at 362 Woodland Road, Madison commonly known on the Borough of Madison Tax Map as Block 4302, Lot: 2 The draft resolutions was sent to the applicant’s Attorney, Mr. Steve Azzolini, Esq. as well as the Planning Board members and it’s Professionals for review prior to this evening’s meeting. Mr. Tombalakian asked the Board if they had any comments or questions concerning the resolution. Seeing none he asked for a motion to approve the resolution as drafted by Mr. Loughlin, a motion was made by Mayor Conley, seconded by Mr. Lewis; the following roll call was recorded: “Ayes” – Mayor Conley, Ms. Baillie, Mr. Forte, Ms. Huber, Ms Ehrlich, Mr. Lewis, Mr. Limbach and Mr. Tombalakian “Nays” – None “Abstain” – Mr. Flemming “Excused” – None 1 Planning Board March 6, 2018 CASE NO. P 17-013 Preliminary and Final Site Plan with Variances General Zod, LLC 145 Main Street Block: 2601, Lot: 18 Resolution granting the Preliminary and Final Site Plan with Variances to General Zod, LLC, on property located at 145 Main Street, Madison commonly known on the Borough of Madison Tax Map as Block: 2601, Lot: 18 The draft resolution was sent to the applicant’s Attorney, Mr. Steve Azzolini, Esq. as well as the Planning Board members and it’s Professionals for review prior to this evening’s meeting. Mr. Azzolini and the professionals requested several changes to the resolution which Mr. Loughlin incorporated into the draft resolution. Mr. Loughlin informed the Board of these changes at the meeting. Mr. Tombalakian asked the Board if they had any further comments or questions concerning the resolution. Seeing none he asked for a motion to approve the resolution as amended by Mr. Loughlin, a motion was made by Mayor Conley, seconded by Mr. Forte; the following roll call was recorded: “Ayes” – Mayor Conley, Ms. Baillie, Mr. Forte, Ms. Huber, Ms Ehrlich, Mr. Lewis, Mr. Limbach and Mr. Tombalakian “Nays” – None “Abstain” – Mr. Flemming “Excused” – None NEW BUSINESS – None OLD BUSINESS – CASE NO. P 17-007 Preliminary and Final Site Plan with Variances King’s Court Developers 174 Main Street Block: 2001, Lot: 18 Mr. Steve Azzolini, Esq. representing the applicant began by reminding the Board that this application began on November 21, 2017 and this is the continued hearing for same. Mr. Azzolini stated that the applicant has incorporated into a revised plan the suggestions discussed at the hearing in November. There will be three witnesses this evening to provide testimony for this application. Mr. Fred Meola, Engineer, John Allocca, Applicant and Architect and Jerry Sinagra, Landscape Architect. Mr. Frederick Meola, 28 Whippany Road, Whippany, was sworn in. Mr. Meola was accepted as an expert witness. Mr. Meola went over the revisions to the revised plans, dated February 6, 2018 as submitted to the Board stating that the Zoning table had been modified, a Bicycle rack has been added to the plans, the sidewalk has been brought to Main Street, and a front porch was also added to the site plans. There is no garage proposed for these units. Parking will be in the rear of the property. Mr. Meola stated that they will comply with all items mentioned in Mr. Russo’s memorandum dated October 26, 2017. Mr. Tombalakian asked if the Board or its Professionals had any questions for Mr. Meola, seeing none he opened the floor for questions from the public, seeing none that portion of the hearing was closed. Mr. John Allocca was called next to testify. Mr. Allocca was sworn in at the hearing in November and remains under oath. The following exhibits were marked: Exhibit A-1: Color rendering of the proposed home Exhibit A-2: 1st Floor and Basement Plan Exhibit A-3: 2nd and 3rd Floor Plan Exhibit A-4: Materials Board 2 Planning Board March 6, 2018 Mr. Allocca discussed the changes that were made to the plans after the last hearing. The first floor will consist of 2 bedrooms with a square footage of 1, 480 sq. feet. The second floor will also be 2 bedrooms with a total square footage of 1,548 sq. feet. The third floor will have one bedroom and be 990 square feet. The exterior materials that will be used for this application were discussed. The height of the building was also discussed. Ms. Baillie asked for clarification on the roofing material. Mr. Forte stated that the elements to this proposed site speak to Historic Madison. Mr. Tombalakian asked if the Board or its Professionals had any questions for Mr. Allocca, seeing none he opened the floor for questions from the public, seeing none that portion of the hearing was closed. Mr. Jerry Sinagra, Landscape Architect, 658 White Bridge Road, Gillette, NJ 07933 was sworn. His qualifications were provided and he was accepted as an expert witness. The following exhibit was marked: Exhibit A-5: Color Rendering of the Landscape Plan Mr. Sinagra gave a detailed description of the landscape plan; Mr. Sinagra explained the existing and proposed plantings including four new canopy trees, Streetscape trees and the foundation plantings. All plantings are relatively low maintenance and no trees in the rear of the property will be removed. Mr. Limbach asked if there would be an irrigation system and Mr. Sinagra answered yes. Mr. Limbach remarked that this was a nice plan. Mr. Tombalakian asked if the Board or its Professionals had any questions for Mr. Sinagra, seeing none he opened the floor for questions from the public, seeing none that portion of the hearing was closed. Mr. Azzolini stated that he had no further witnesses this evening. At this time Mr. Tombalakian opened the floor to the public for comments. Dr. Scott Dickerson, 6 Holmstead Road, Vernon, NJ, was sworn in. Dr. Dickerson stated that he is the owner of 176 Main Street, Madison. This home was built in 1897 and shares a common driveway with the applicant at 174 Main Street. Dr. Dickerson stated that objects to this application and has prescriptive rights to the driveway and the applicant cannot intensify the use of the driveway. Mr. Tombalakian inquired if there was any parking easement or written agreement with the previous owner? Dr. Dickerson stated that there was not. It was stated that 176 Main Street is a multiple dwelling residence with 10 units. Mr. Tombalakian stated to Dr. Dickerson that there is no shared access agreement; no recorded easements on this property and a Court of Law will handle the prescriptive rights. Mr. Meola responded to these statements stating that the site will have a normal residential driveway and that cars will be able to move along this drive aisle without going on the neighboring property. Mr. Tombalakian suggested that the applicant and Dr. Dickerson speak. There being nothing further the Board began its deliberation. Mayor Conley made a motion to approve the application with conditions as noted during testimony, seconded by Mr. Forte. The following roll call was recorded as follows: “Aye” – Mr. Conley, Ms. Baillie, Mr. Forte, Ms. Huber, Ms. Ehrlich, Mr. Lewis, Mr. Limbach and Mr. Tombalakian “Nays” – None “Excused” – Mr. Flemming PLANNING DISCUSION –  Proposed amendments to Chapter 195, Section 28 of the Borough Code Regarding Improvements. 3 Planning Board March 6, 2018 Mr. Vince Loughlin, Esq. gave the Board a brief explanation of the proposed amendments to Chapter 195, Section 28 regarding Bonding requirements. After a brief discussion it was the Board’s recommendation to forward to Mayor and Council the proposed Ordinance as discussed this evening. On motion by Mr. Flemming, seconded by Ms. Baillie the Board by voice vote instructed Ms. Boardman to send the proposed Ordinance to Mayor and Council.  Proposed Ordinance Amendments to Chapter 195. Land Development, Article II. Planning Board 195-14 Technical Coordinating Committee. Dr. Susan Blickstein reviewed for the Board and its Professional’s the proposed Ordinance, amending Chapter 195, Land Development; Article II pertaining to the Technical Coordinating Committee and the application and checklists for both Planning Board and Zoning Board of Adjustment applications. After a brief discussion it was the Board’s recommendation to forward to Mayor and Council the proposed Ordinance as discussed this evening. On motion by Ms. Baillie, seconded by Mr. Forte the Board by voice vote instructed Ms. Boardman to send the proposed Ordinance to Mayor and Council. CORRESPONDENCE – None Since there was no further business to come before the Board, Mr. Tombalakian asked for a motion to adjourn the regular meeting at 9:35pm.; motion was made by Mayor Conley, seconded by Ms. Baillie.
