BOROUGH OF MADISON ZONING BOARD OF ADJUSTMENT
Regular Meeting, June 8, 2017 at 7:30 P.M.,
Hartley Dodge Memorial, 50 Kings Road, Madison, New Jersey
1. CALL TO ORDER BY CHAIRPERSON
2. ANNOUNCEMENT OF NOTICE (STATEMENT OF COMPLIANCE)
A regular meeting of the Borough of Madison Zoning Board of Adjustment
was held on June 8, 2017 at 7:30 pm in Room #140 of the Hartley Dodge
Memorial Building located at Kings Road, Madison, N.J. Mr. Joseph Santoro,
Chairman opened the meeting and requested the reading of the public notice as
follows:
“Let the minutes reflect that adequate notice of this meeting has been
provided in the following manner:
At the reorganization meeting of the Board, held on January 12, 2017, the
Board, by resolution adopted a schedule of meetings. On January 13, 2017, a
copy of the schedule of meetings was posted at the bulletin board at the main
entrance of the Hartley Dodge Memorial, was sent to the Madison Eagle and the
Daily Record and filed with the Borough Clerk, all in accordance with the “Open
Public Meetings Act”.
Oath of Office administered to appointed Board members
APPOINTMENTS:
Timothy Fitzsimmons, Class IV, Alternate # 1 Two Year Unexpired Term through
December 31, 2017
Mr. Hall read the Oath of Office to Timothy Fitzsimmons, he accepted his
appointment as Alt. #1 for the Zoning Board of Adjustment. A voice vote of aye
was heard in approval of this Oath and his acceptance.

5. MINUTES FOR APPROVAL – Regular meeting of May 11, 2017
The minutes for 5/11/17 were distributed to all Board members prior to this
meeting for their review. A correction was made to the minutes.
6. RESOLUTIONS FOR MEMORIALIZATION:
The following Resolutions were distributed to all Board members for their review.
There were no additions or corrections made to the Resolutions. A voice vote of

aye was heard from all eligible voting Board members in approval of the
Resolutions.

Resolution granting variance application to Anthony & Deborah D’Auria, Block:

Drywell Applicant will also remove Detached Garage, Gravel Driveway, Deck,
Basement Entrance, front Sidewalk and Entrance Platform in an R-3 (Single-
Family Residential) Zone requiring relief from Minimum Front Yard Setback,

the request of the applicant’s attorney this application will be carried to the

Applicants are seeking permission to construct a 2nd Story Deck with Stairs in an
R-2 (Single-Family Residential) Zone requiring relief from Minimum Rear Yard
Setback and Maximum Impervious Lot Coverage.
Ross Downing was sworn in along with William Byrne, Architect representing the
applicant.

A – 2 Floor Plan prepared by Byrnes Design dated 5/11/17
Mr. Downing began by describing the application. Mr. Byrne added stating that
the plan is updating the home and preserving as much as possible. Presently
there is no access to the backyard from the kitchen and dining room. The design
is proposing a door to the rear yard for the family to utilize the backyard. A
double window will be replaced by a sliding glass door. A small deck to the yard
area is proposed for safety and convenience.
The lot presents a bit of concern due to its unusual shape. The area where the
deck will be constructed is presently a planting bed. The backyard is very private
and will have no impact upon the neighbors. A bay window exists in the kitchen
and will be removed and replaced by a smaller version.
Mr. Byrne continued by stating the lot was purchased as it now stands. In 1993
all of the coverages that exist did so from that time.
Mr. Downing stated that there was a question regarding water on the site. He
has taken photos which will be helpful in showing the condition of the land. At
this point in time, the downspouts and roof leaders are flowing into a pipe which

is underground. The driveway pitches directly to the street. Most of the property
pitches towards the rear. It does not appear that the property is wet or any of the
neighbors have water issues.
Ms. Kaar questioned the applicant as to the need for the deck and Mr. Downing
answered her question. Dr. Paetzell gave his input to the application and has no
issues with it and Ms. Salko agreed. The Board had no further questions or
comments, the public was given the opportunity. There being no questions or
comments, the Board began their deliberation. The consensus of the Board was
to approve the application as presented. A motion to approve the application
was made by Ms. Salko and seconded by Mr. Fitzsimmons. A roll call vote was
requested and recorded as follows:
AYES: Mr. Santoro, Dr. Paetzell, Ms. Salko, Mr. Tomlin and Mr. Fitzsimmons

Block: 4402, Lot: 16
3 Colonial Way
Applicant is seeking permission to construct a Rear raised Blue Stone Patio with
an Outdoor Kitchen, Realigned/New Slate Stepping Stone Walkway and Drywell.
Applicant will remove Existing Deck, Stairs and a Portion of the Existing Slate
Walk in an R-1 (Single-Family Residential) Zone requiring relief from Maximum
Impervious Lot Coverage.
William Hollows, Engineer and Mr. Gargiulo applicant, were sworn in and the
following exhibits were marked:

A – 2 Grading Plan, dated 3/17/17 prepared by William Hollows, Engineer
Mr. Gargiulo began by explaining the reason for this application. Mr. Hollows
continued by describing the Grading Plan which is colorized. He stated that the
house is on a 25,000 sf lot and is over on impervious coverage. A wood framed
deck presently exists. The applicant wants to replace the deck with a bluestone
patio. The plan is 600 sf and smaller than the footprint of the existing framed
deck. A drywell will be installed in the southeasterly corner of the property. The
Impervious Coverage is increased to 23.1% and will be compensated by the
drywell in the rear. The applicant would like to eliminate the one step down from
the house and walk directly onto the bluestone patio. The deck is also aging and
needs to be replaced.
Peter Houghton, Landscaper was sworn in and began by explaining the
construction of the French Drain and he stated that it will be pitched to allow the
water to be taken away from the home. All the water will be directed into the
drywell. The leaders that exist will be tied into the drain to the drywell. An
existing bluestone walkway will be removed and a single walkway will be
installed. A general discussion took place regarding the drywell and how it will

be constructed. The Board advised that all the rear leaders should be picked up
and the applicant agreed.
The Board had no further questions or comments, the public was given the
opportunity to do so, there being none, the Board began their deliberation. The
consensus of the Board was to approve the application with the condition that all
leaders in the rear are captured by the drywell and the Borough Engineer will be
involved in the approval of this system. A motion to approve the application was
made by Ms. Kaar and seconded by Ms. Salko. A roll call vote was requested
and recorded as follows:
AYES: Mr. Santoro, Dr. Paetzell, Ms. Salko, Ms. Kaar, Mr. Fitzsimmons and Mr.
Tomlin
Mr. Santoro asked if all Board members read the Master Plan and the By-Laws
and explained their importance to making decisions for the Board.
10. OTHER BUSINESS: No Other Business
11. ADJOURNMENT: The meeting was adjourned at 8:38 pm with a motion
made by Ms. Kaar and seconded by Mr. Fitzsimons.
