MINUTES BOROUGH OF MADISON ZONING BOARD OF ADJUSTMENT Regular Meeting, July 13, 2017 at 7:30 P.M., Hartley Dodge Memorial, 50 Kings Road, Madison, New Jersey 1. CALL TO ORDER BY CHAIRPERSON 2. ANNOUNCEMENT OF NOTICE (STATEMENT OF COMPLIANCE) A regular meeting of the Borough of Madison Zoning Board of Adjustment was held on July 13, 2017 at 7:30 pm in Room #140 of the Hartley Dodge Memorial Building located at Kings Road, Madison, N.J. Diane Driscoll, Vice Chairperson opened the meeting and requested the reading of the public notice as follows: “Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the reorganization meeting of the Board, held on January 12, 2017, the Board, by resolution adopted a schedule of meetings. On January 13, 2017, a copy of the schedule of meetings was posted at the bulletin board at the main entrance of the Hartley Dodge Memorial, was sent to the Madison Eagle and the Daily Record and filed with the Borough Clerk, all in accordance with the “Open Public Meetings Act”. 3. ROLL CALL Present: Diane Driscoll, Roger Paetzell, Mary Sue Salko, Toni DeRosa and Melissa Elias Also Present: Keith Loughlin, Esq. Substiitute Attorney Excused: Joseph Santoro, Ms. Kaar, Mr. Fitzsimmons, Mr. Tomlin 4. PLEDGE OF ALLEGIANCE 5. MINUTES FOR APPROVAL – Regular meeting of June 8, 2017 – The minutes will be reviewed at the next meeting in August, 2017. 6. RESOLUTIONS FOR MEMORIALIZATION – The following resolutions were distributed to all Board members prior to this meeting for their review. There were no additions or corrections made to these Resolutions. A voice vote of aye was heard from all eligible voting Board members in approval of the Resolutions. CASE NO. Z 17-012 Resolution granting variance application to Ross & Megan Downing Block: 3001, Lot: 48 6 Carteret Court to construct a 2nd Story Deck with Stairs in an R-2 (Single-Family Residential) Zone requiring relief from Minimum Rear Yard Setback and Maximum Impervious Lot Coverage. CASE NO. Z 17-013 Resolution granting variance application to Katherine Gargiulo, Block: 4402, Lot: 16, 3 Colonial Way to construct a Rear raised Blue Stone Patio with an Outdoor Kitchen, Realigned/New Slate Stepping Stone Walkway and Drywell. Applicant will remove Existing Deck, Stairs and a Portion of the Existing Slate Walk in an R-1 (Single-Family Residential) Zone requiring relief from Maximum Impervious Lot Coverage. 7. SCHEDULING AND PROCEDURAL MATTERS – ZBA Regular Meeting 7-13-17 Page 1 8. OLD BUSINESS – CASE NO. Z 17-010 Glenbrook Properties Block: 3401, Lot 9 15 Woodcliff Drive Applicant is seeking permission to construct a 2nd Story Addition, (2) 2 Story Additions, front Portico with Stairs and Sidewalk, Rear Deck, New Driveway, Installation of Drop Curb and Full Height Curb, (2) Air Conditioning Units, and Drywell Applicant will also remove Detached Garage, Gravel Driveway, Deck, Basement Entrance, front Sidewalk and Entrance Platform in an R-3 (Single-Family Residential) Zone requiring relief from Minimum Front Yard Setback, Minimum Side Yard Setback (Left) and Maximum Principal Building Coverage. This application will be carried to the August 10, 2017 Zoning Board of Adjustment meeting. The applicant will re-notice 9. NEW BUSINESS – CASE NO. Z 17-014 Maribel Abbate Block: 4201, Lot: 4.01 25 Crescent Road Applicant is seeking permission to allow the already constructed Patio Coverage Extension to remain in an R-1 (Single-Family Residential) Zone requiring relief from Maximum Principal Building Coverage. Due to insufficient noticing this application will be carried to the August 10, 2017 Zoning Board of Adjustment meeting. CASE NO. Z 17-015 Jill Denison Block: 4305, Lot: 22 11 Roscoe Avenue Applicant is seeking permission to construct (2) 2 Story Additions, and a Rear Deck while removing an Existing Deck and Existing Shed in an R-3 (Single-Family Residential) Zone requiring relief from Maximum Principal Building Coverage and Maximum Impervious Lot Coverage. Jill Denison and Cindy Boernerlay, Long Valley, NJ, Licensed Architect were both sworn in and the following exhibits were marked. B – 1 Letter of Denial from the Borough of Madison Zoning Official Dan Buckelew, dated 5-24-17 A – 1 Copy of Plans with Photos taken by Ms. Denison A – 2 Photo board of the neighboring properties, 200 feet from the property A – 3 Maps with Data Jill Denison began by explaining when she purchased her home with her family. She stated that she wanted to stay in Madison. She stated her family needs more room for her two growing boys and would like a spare bedroom for her parents who babysit the children when she is away on business. She stated she searched for another home and decided to stay in this home and make it work for the family. The lot is undersized for the zone. Her neighbors did not agree with the improvements that she is proposing. Very minor changes are being proposed. A very minimal lot coverage variance is being requested. The public was given the opportunity to question Ms. Denison as follows: ZBA Regular Meeting 7-13-17 Page 2 Mrs. Minetti, 9 Roscoe Avenue asked when Ms. Denison notified her and when she discussed the application. Ms. Boernerlay continued by describing A – 1 and stated where the additions will be constructed. The 2nd floor will house a bedroom and bath over the 1st floor addition. She continued with the lot coverage variance and reviewed the reasoning for this request. She reviewed the Zoning Map which was distributed to the Board members. She then reviewed the building coverage and made comparisons with other homes in the area. She stated what the applicant is requesting is not inordinate for this area and there are no negative impacts upon the neighboring homes. She stated there is adequate fencing and shrubbery between neighboring homes to allow for privacy for both neighbors. The Board had several questions for the applicant, ie. Stormwater management on the property. The applicant stated there is no pooling of water and no water in the basement. Ms. DeRosa suggested that the Borough Engineer should be contacted with regards to any water issues and whether there is a drywell. There being no further testimony, the public was given the opportunity to ask questions or make comments as follows: Mrs. Minetti, 9 Roscoe Avenue, asked what effect will she have to her home with the building on this property. Mrs. Minetti commented that she has been living in Madison for many years and hopes she can count on the Board to allow her to be comfortable in her home. Katrina Pitrieska stated that the lot that is in question is very small. She is concerned with the environmental aspect. There being no further testimony, the Board began their deliberation. The applicant stated they would be willing to reduce the size of the window for the bathroom. The consensus of the Board was approve the application with the condition that the borough engineer be contacted for the stormwater management issue and the window size be reduced. A motion to approve the application was made by Ms. Salko and seconded by Mrs. DeRosa. A roll call vote was requested and recorded as follows: AYES: Mrs. DeRosa, Mrs. Driscoll, Mrs. Elias, Dr. Paetzell and Ms. Salko CASE NO. Z 17-016 Antonio DiMieri Block: 4310, Lot: 1 4 Alma Avenue Applicant is seeking permission to keep the As Built/Constructed Concrete Sidewalk in an R-3 (Single- Family Residential) Zone requiring relief from exceeding the Maximum Impervious Lot Coverage previously approved by the Zoning Board of Adjustment by resolution. Antonio DiMieri and Alan Andreas, Architect were sworn in and the following exhibits were marked. B - 1 Letter of Denial from the Borough of Madison Zoning Official Dan Buckelew, dated 6-7-17 A – 1 Zoning Comparison Chart showing what was approved as to what was built ZBA Regular Meeting 7-13-17 Page 3 Mr. Andreas began by explaining what has taken place since the house was built and that 262 sf to the impervious coverage was added totaling 2.3%. The drywell was enlarged considerably when the application was initially heard. The rear of the house was also connected to the drywell. The applicant is here to explain the mis-step during construction. Mr. Andreas stated the drywells have the capacity to handle the water on the property. Mr. Di Mieri explained what took place with his meeting with Bob Vogel, Borough Engineer. Mr. Vogel explained his issue with the plans. The public was given the opportunity to make comments or ask questions, there being none the Board began their deliberation. The consensus of the Board was to approve the application as presented. A motion to approve the application as presented was made by Mrs. Elias and seconded by Ms. Salko. A roll call vote was requested and recorded as follows: AYES: Diane Driscoll, Roger Paetzell, Ton DeRosa, Melissa Elias and Mary Sue Salko. 10. OTHER BUSINESS – No other business. 11.
