MAHTOMEDI CITY COUNCIL
MINUTES
APRIL 19, 2016
Mayor Jud Marshall convened the regular City Council meeting at 7:00 p.m. with
Council members Timothy Deans, Joel Schilling, Richard Brainerd and Lael Ramaley in
attendance. City Administrator Scott Neilson, City Attorney Jay Karlovich, City Engineer
Chris LaBounty, City Planner Erin Perdu, Finance Director Scott Schaefer and City Clerk
Mary Solie were also in attendance.
CONSIDER APPROVAL OF AGENDA
Council member Ramaley moved and Council member Brainerd seconded the motion to
approve the agenda as presented. The motion was unanimously approved.
CONSIDER APPROVAL OF CITY COUNCIL MEETING MINUTES
Council member Deans moved and Council member Schilling seconded the motion to
approve the minutes as presented. The motion was unanimously approved.
4. PRESENTATIONS
4a. Arbor Day/Month Proclamation
In 2009, the City filed an application to become a Tree City U.S.A. Currently 140 cities
in Minnesota hold this designation. The requirements consist of the City establishing a
tree board or department, approving an ordinance on tree care, establishing a tree budget
of at least $2.00 per resident, and planning an annual Arbor Day celebration. The City has
fulfilled all the requirements of this designation and is requesting approval of a
proclamation proclaiming April 29th, 2016, to be Arbor Day and the month of May 2016
to be Arbor Month in Mahtomedi.
5. DISCUSSION FROM THE AUDIENCE
Bill Coleman, 1732 Briarwood Avenue, asked the Council to consider revisiting the CIP
to take out the utilities portion and move up the road improvement project.
Eric Landgrebe, 1782 Briarwood Avenue, said he is installing a new septic system.
John Manhsip, said Briarwood is in terrible condition and asked if anything can be done
to fix it.
Council member Brainerd encouraged the Briarwood neighborhood to have their septic
systems inspected sooner than later.

6. CONSENT AGENDA
Council member Ramaley moved and Council member Deans seconded the motion to
approve the Consent Agenda as presented. The motion was unanimously approved.
a. APPROVAL-New liquor license application for Tacos Fresh Sports Cantina.
Taco Fresh Sports Cantina/William Sheffield, applied for and received a new on-sale
intoxicating and Sunday liquor license. The proposed location is in the former Starbucks
location in the Lincoln Square building at 3124 Century Avenue North.
The background check on Mr. Sheffield was been completed and no violations were
found to prevent him from receiving a license.

8. STAFF REPORTS
8a. CONSIDER APPROVAL – A request from B & C Real Estate, LLC, for Site
Plan Approval and a 7.5 foot side yard setback variance in order to expand
the existing facility located at 910 Wildwood Road.
The City is in receipt of an application from B & C Real Estate, LLC for the requests as
outlined above. The application has been reviewed by City staff and consultants and is in
order for consideration at this time.
City Planner Erin Perdu said the Applicant is proposing to construct a forty (40) x forty
(40) square foot, one-story addition to the existing building at the property located at 910
Wildwood Road. The existing building is located seven and one-half (7.5) feet from the
side property line; the Property Owner was granted a variance allowing this when the
existing building was built in 2006. The Applicant is requesting a variance of seven and
one-half (7.5) feet to the required minimum side yard setback of fifteen (15) feet. The
applicant has also proposed to construct a new trash enclosure. The current enclosure is
located where the proposed addition is to be located. The applicant is also proposing to
reconfigure the parking lot and connect it to the parcel to the east, which also contributes
to the necessity of relocating the trash enclosure.
The City’s Ordinance requires the following parking spaces for commercial retail
developments:
Retail: 1 per 250 sq. ft. gross floor area. Including the new addition, the gross floor area
is approximately 5698 sq. ft. This would require 23 parking spaces.

The Applicant is proposing to provide 54 parking spaces. Currently on the property there
are 48 spaces. 21 of the spaces are on the property, and the remaining 33 will be on the
neighboring property. Staff has spoken with staff at the City of White Bear Lake
regarding the sharing of parking between the sites. In the attached letter from the White
Bear Lake planning department, the combined site contains more than enough parking to
accommodate the addition. As stated in that letter, staff agrees that a cross parking
agreement be provided and executed as a condition of this site plan approval.
The applicant is proposing to plant 4 deciduous trees, 4 deciduous shrubs, 7 evergreen
shrubs, and 16 perennials on the site as a whole (including the Mahtomedi and White
Bear Lake lots).
At this time no new signage is being proposed.
The site currently shares access with the 906 Wildwood Rd. parcel, although no shared
access agreement was ever executed. As a condition of approval of this site plan, staff
recommends that a cross access agreement (as was required during approval of the initial
site plan) be submitted to both the City of Mahtomedi and City of White Bear Lake for
approval before execution. Further, that agreement must be executed with Washington
County prior to the issuance of a certificate of occupancy.
During the approval of the initial site plan in 2006, there were several crosswalks that
were required to be striped, connecting the buildings at 910 and 906 Wildwood Rd.
Those crosswalks were never completed. Therefore staff recommends that the striped
crosswalks be completed as a condition of this site plan approval, as indicated in the letter
from the White Bear Lake planning department
City Engineer LaBounty said the drainage on the southern portion of the site currently
flows to a stormwater basin that was constructed with plans submitted in 2006. The
proposed grades for the site are directed in the same general pattern as exists today, but
the proposed plan includes an increase in impervious area from the existing condition.
The developer will be required to submit engineering calculations to show the existing
storm basin is adequate to accommodate the proposed development with present day rain
data conditions. If the existing basin is unable to accommodate the increased impervious
surface, the basin shall be expanded or additional rate/volume control shall be
constructed on-site. It appears there is adequate room west of the existing basin to expand
if necessary. In addition, the calculations shall include changes proposed to the storm
sewer system and any potential impacts of said modifications.
The existing site plan includes parcels in both the City of Mahtomedi and City of White
Bear Lake. Stormwater management is currently proposed only on the City of

Mahtomedi parcel, thus the developer must memorialize a cross drainage agreement
between the two parcels prior to approval of the building permit.
The proposed site does not appear to impact more than 10,000 sf of impervious surface,
thus a Rice Creek Watershed Permit will not likely be required. If at the time of the
building permit application a RCWD permit is triggered the developer will be required to
obtain a permit from RCWD and furnish a copy to the City prior to issuance of the
building permit. If a permit is not required a copy of the Notice of Intent shall be
provided to the City.
Council member Brainerd suggested a meeting with the City of White Bear Lake
regarding the parcel that is in White Bear Lake. Administrator Neilson said he has had a
discussion with the new administrator and will follow up with her.
Council member Deans moved and Council member Brainerd seconded the motion to
approve Resolution No. 2016-19 Approving a Variance to Allow for a Reduction in the
Side Setback Requirement in the B-4 District for a Building Addition at 910 Wildwood
Road. The motion was approved.

approve Resolution No. 2016-20 Approving a Site Plan for an Addition to an Existing
Building located at 910 Wildwood Road. The motion was approved.
8b. CONSIDER APPROVAL – An amendment to Chapter 11, Section 11.01 of
the Zoning Code relating to Accessory Dwelling Units. The proposed
amendment defines an accessory dwelling unit and allows for accessory
dwelling units in all the City’s Residential Zoning Districts as a conditional
use. A conditional use permit would be required for all accessory dwelling
units.
City Planner Perdu said the Planning Commission and City Council have considered
policy issues surrounding the adoption of an accessory dwelling unit ordinance over the
course of several joint work sessions. At the last Planning Commission meeting, there
was consensus for moving forward with a draft ordinance that would allow ADUs. The
draft ordinance has been reviewed by City staff and consultants and is in order for
consideration at this time.
The change requested at the March Planning Commission meeting related to the allowance
of ADUs on lots without municipal water and sewer service. The consensus from the
commission was to allow ADUs on those lots and to include language in the ordinance
requiring documentation that the septic system was adequate to support the additional

dwelling unit. Staff consulted with Pete Ganzel of the Washington County Department
of Public Health and Environment and septic inspector for Mahtomedi. Based on his
feedback on the inspection process, this language has been added to the ordinance in
section E.2.h.
Council member Brainerd moved and Council member Deans seconded the motion to
approve Ordinance No. 2016-04 Amending City Code Relating to Accessory Dwelling
Units. The motion was approved.
8c. CONSIDER APPROVAL-Bill List
Council member Ramaley moved and Council member Schilling seconded the motion to
approve the bills as presented. The motion was unanimously approved.
9. REPORT FROM THE CITY ADMINISTRATOR
Administrator Neilson said Washington County will be holding an open house at
Mahtomedi City Hall on Thursday, April 21st at 5:30 p.m. for the proposed Stillwater
Road project.
The Rite of Spring Event is Saturday, April 23 beginning at 9:00 a.m.
10. COMMENTS FROM THE CITY COUNCIL
City Engineer LaBounty provided an update on the Phase 2 project in the Historic
District. Construction will begin on May 1st.
Engineer LaBounty said a crosswalk at Ash Street will be included in the County Road
12 project. He said they are continuing to work with MnDOT on additional crosswalks
for Neptune and Maple Streets.

Council member Ramaley moved and Council member Schilling seconded the motion to
adjourn the meeting at 8:00 p.m. The motion was unanimously approved.
