MAHTOMEDI CITY COUNCIL MINUTES JULY 19, 2016 Mayor Jud Marshall convened the regular City Council meeting at 7:00 p.m. with Council members Timothy Deans, Joel Schilling, Richard Brainerd and Lael Ramaley in attendance. City Administrator Scott Neilson, City Attorney Jay Karlovich, City Engineer Jay Kennedy, Fire Chief Terry Fischer and City Clerk Mary Solie were also in attendance. CONSIDER APPROVAL OF AGENDA Council member Ramaley moved and Council member Deans seconded the motion to approve the agenda as presented. The motion was unanimously approved. CONSIDER APPROVAL OF CITY COUNCIL MEETING MINUTES Council member Schilling asked to have corrections done to the July 5, 2016 City Council Workshop minutes. He asked to change the $40,000+ figure to the actual dollar amount of $$40,545. He also asked to have the word “form” changed to The Emergency Release Follow-up form. Council member Schilling moved and Council member Deans seconded the motion to approve the minutes as amended. The motion was unanimously approved. 4. PRESENTATIONS-None 5. DISCUSSION FROM THE AUDIENCE Oakdale Mayor Stan Karowski, was present to introduce himself and said he is running for the vacant Washington County Board position. Loren Sederstrom, Larry Lanoux and Bob Zick were present to talk about the recent Ramsey/Washington Suburban Cable Commission actions. 6. CONSENT AGENDA Council member Schilling moved and Council member Brainerd seconded the motion to approve the Consent Agenda as presented. The motion was unanimously approved. a. CONSENT AGENDA-Continued. b. APPROVAL-Election Judge Pay Increase. Minimum wage levels have been established by the State of Minnesota. Currently our election judges fall under the required levels beginning August 1st of this year. With the start of the 2016 election year; election judge pay levels need to be increased. Approval was given to increase the wages to $10.00/hr. for election judges and $15.00/hr. for head election judges. c. APPROVAL-Close City Hall Offices from Noon to 1:30 p.m. on July 21, 2016 for Employee Picnic. City staff requested and received permission to close the City Hall Offices from Noon to 1:30 p.m. on July 21, 2016 for the employee picnic. d. APPROVAL-Construction Pay Voucher No. 2 in the amount of $87,972.52 for Park Construction for the Hamline Lake Streetcar Trail Improvements. Construction Pay Voucher No. 2 in the amount of $87,972.52 for the Hamline Lake Streetcar Trail Improvements for Park Construction was approved. e. APPROVAL –Construction Pay Voucher No. 3 in the amount of $269,516.54 for T.A. Schifsky and Sons, Inc. for Phase 2 Historic District Improvements. Construction Pay Voucher No. 3 in the amount of $269,516.54 for Phase 2 Historic District Improvement Project for T.A. Schifsky and Sons was approved. 7. PUBLIC HEARINGS 7a. Storm Water Pollution Prevention Program (SWPP) Meghan Litsey of WSB and Associates provided an update on current requirements and activities relating to the Minnesota Pollution Control Agency with new permit language that became effective in 2006 and gave an overview of the permit process. She said there are six control measures for the permit. 1. Public education and outreach 2. Public participation and involvement 3. Illicit discharge detection and elimination 4. Construction site stormwater runoff control 5. Post Construction stormwater management 6. Engineer Litsey said the City has done the following: • Implemented IDDE inspection and recordkeeping procedures • Stormwater related articles in the City’s newsletter and website • Regular site inspections completed by White Bear Lake Building Officials • Completed 50% Outfall and Pond inspections • Televising sewer lines-one quarter per year • Street Sweeping 4-5 times per year • Anti-icing program: no sand • Completed 100% Structural Pollution Control Device BMP inspections • 2 NPDES construction permits issued in 2015 • 1 plan review completed Total Maximum Daily Load (TMDL) Waste Load Allocation’s (WLA) to Mahtomedi’s MS4 • TMDL identifies specific contributors and assigns load reductions per impaired waterbody. Enforced through MS4 permit condition for MS4’s with assigned Waste Load Allocations • MS4’s progress in meeting WLA is reported in each annual report • 2013 MS4 permit: Lake St. Croix Excess Nutrients (2030 Target Date) • 0.338 lbs./acre/year TP load reduction over the regulated MS4 • How does Mahtomedi achieve the WLA? 1. interim milestones identified in the reissued permit to meet the WLA Additional information may be found on MPCA’s, Rice Creek Watershed District, Valley Branch Watershed District and the White Bear Lake Conservation District’s websites. Mayor Marshall opened the public hearing at 7:30 p.m. Bob Zick, said the contamination at the Wildwood Elementary site is causing pollution in Lost Lake. Mayor Marshall called for a recess at 7:35 p.m. The meeting resumed at 7:45 p.m. Council member Brainerd moved and Council member Schilling seconded the motion to continue the Public Hearing until the November 15, 2016 City Council meeting. The motion was approved. CITY COUNCIL MEETING MINUTES -4- JULY 19, 2016 8. STAFF REPORTS 8a. CONSIDER APPROVAL – Request from the Mahtomedi School District for a variance in order to install a monument sign on property located at 1520 Mahtomedi Avenue that exceeds the maximum permitted size, height and right-of-way setback requirements. Administrator Neilson said the City is in receipt of an application from the Mahtomedi School District for the request outlined above. The application has been reviewed by City staff and consultants and is in order for consideration at this time. The Planning Commission recommended unanimous approval at their July 13, 2016 meeting. City Planner Erin Perdu said the applicant is requesting variances to accommodate construction of a new freestanding sign on the School District office property. Due to the Hamline Lake Streetcar Trail improvements, the School District’s existing sign will need to be moved. The existing sign’s dimensions are eight (8) feet across and nine (9) feet from the ground to the top of the sign. The proposed sign is eight (8) feet across and nine (9) feet and six (6) inches from the ground to the top of the sign. The applicant is requesting the following variances to allow for the new sign: • A variance of twenty-four (24) square feet from the maximum permitted square footage for sign area (56 square feet where 32 square feet is permitted). • A variance from the maximum permitted height of a ground sign in the P District for a sign that measures 7’ in height as measured from the average adjacent road grade (which is 30” or 2.5’ higher than the base of the sign). A maximum of 5’ in height is permitted. A variance of ten (10) feet from the required minimum setback from the property line of ten (10) feet. According to the proposed site plan, the edge of the proposed sign will be located eight feet from the centerline of the adjacent trail. This distance is adequate to avoid the required clear zone for the trail. Council member Brainerd moved and Council member Deans seconded the motion to approve Resolution No. 2016-35 Approving the Variance Request for a Sign Located at 1520 Mahtomedi Avenue. The motion was approved. 8b. CONSIDER APPROVAL-Bill List Council member Ramaley moved and Council member Deans seconded the motion to approve the bills as presented. The motion was unanimously approved. CITY COUNCIL MEETING MINUTES -5- JULY 19, 2016 9. REPORT FROM THE CITY ADMINISTRATOR Administrator Neilson said there will be a workshop on Monday, August 1, 2016 with the City Council and Finance Commission to discuss the 2017 budget. Administrator Neilson said Commander Brian Mueller, from the Washington County Sheriff’s Office will speak at the August 16th City Council meeting. 10. COMMENTS FROM THE CITY COUNCIL Council member Schilling discussed the WSB letter regarding the Warner Avenue Culvert update. He asked the City Attorney for advice about the City of Mahtomedi working on the pipe that is in the City of Willernie. City Attorney Karlovich said he would discuss this issue with the City Engineer, Jay Kennedy. Council member Brainerd said Steve Wolgamot is looking for volunteers to help with spreading woodchips on the Neighborway path which will connect Highway 244 and Quail with the new StreetCar Trail on Saturday, July 23rd. Council member Brainerd asked the City Engineer why there will be crack sealing on the roads in the Wedgewood/Jesse James area, when the street project was just completed a couple of years ago. Engineer Kennedy said it was a mill and overlay project and typically cracks that were there previously tend to come back. The cracks will be filled this year and next year the roads will be chip sealed. 11. CLOSED SESSION-Consideration of Disciplinary Action of an Employee Subject to the Council’s Authority Council member Ramaley moved and Council member Brainerd seconded the motion to recess the regular meeting at 8:02 p.m. to go into Closed Session to discuss the Disciplinary Action of an Employee Subject to the Council’s Authority. The motion was unanimously approved. The employee discipline was discussed. Following the Closed Session, Council member Brainerd moved and Council member Deans seconded the motion to reconvene the regular meeting. The motion was approved. Council member Schilling moved and Council member Brainerd seconded the motion to approve Resolution No.2016-36 Demoting a Captain of the Mahtomedi Fire Department.
