MINUTES
AUGUST 16, 2016
Mayor Jud Marshall convened the regular City Council meeting at 7:00 p.m. with
Council members Timothy Deans, Joel Schilling, Richard Brainerd and Lael Ramaley in
attendance. City Administrator Scott Neilson, City Attorney Jay Karlovich, City Engineer
Jay Kennedy, City Planner Erin Perdu, Finance Director Scott Schaefer, Fire Chief Terry
Fischer and City Clerk Mary Solie were also in attendance.
CONSIDER APPROVAL OF AGENDA
Council member Ramaley moved and Council member Deans seconded the motion to
approve the agenda as presented. The motion was unanimously approved.
CONSIDER APPROVAL OF CITY COUNCIL MEETING MINUTES
Council member Schilling moved and Council member Brainerd seconded the motion to
approve the minutes as presented. The motion was unanimously approved.
4. PRESENTATIONS
4a. Brian Mueller, Washington County Sheriff’s Office
Commander Brian Mueller from the Washington County Sheriff’s Office was present to
update the Council. He talked about the different types of training the officers do and
how they prepare for the different situations they encounter. They are considered one of
the top Sheriff’s Departments in the State and actually exceed state training requirements.
They are in the process of requiring all officers to be trained in crisis intervention and
learn how to de-escalate situations. They want all officers to be involved in community
engagement.
He encouraged residents to call the Sheriff’s Office with any concerns they may have.
Sheriff Hutton spoke about their body camera program. They are moving toward
developing the policies that go along with implementing the use of them and there are
also significant IT issues to consider when using them. He also mentioned the
development of a Community Engagement group. There will be more information
coming about that group.

6. CONSENT AGENDA
Council member Brainerd moved and Council member Schilling seconded the motion to
approve the Consent Agenda as presented. The motion was unanimously approved.
a. APPROVAL-Request from St. Jude of the Lake Church, 700 Mahtomedi
Avenue, to hold a gambling activity and sell beer and wine at the Corn Fest
on Saturday, September 10, 2016.

b. APPROVAL-Resolution Approving the Acceptance of Gifts for the City of
Mahtomedi.
A Resolution Approving the Acceptance of the donation for the Little Library and a table
for the Public Works Department was approved.
c. APPROVAL-Construction Pay Voucher in the amount of $352,132.62 to
T.A. Schifsky and Sons, Inc. for Phase 2 Historic District Improvement
Project.
A Construction Pay Voucher in the amount of $352,132.62 to T.A. Schifsky and Sons,
Inc. for the Phase 2 Historic District Improvement Project was approved.
d. APPROVAL-Request to Hire three Paid-On Call Firefighter/EMT’s.
Fire Chief Fischer recommended the hiring of Jordan Curry, Angelo Tuccito and Alex
Carufel as Probationary Paid-On Call Firefighter/EMT’s. The hiring is contingent on
successful completion of the psychological assessment, criminal background check, and
physical exam.
e. APPROVAL-Master Services and License Agreement Between SafetyPad
and Mahtomedi Fire Department.
Fire Chief Fischer received approval to enter into an agreement with SafetyPad to chart
ambulance calls.

f. APPROVAL-Addendum to the Master Agreement for Arbitrage Monitoring
Service for Series 2016A with Ehlers.
Approval was given to sign an addendum to the master agreement for arbitrage
monitoring services with Ehlers for the $8,640,000 General Obligation Bonds, Series
2016A.

8. STAFF REPORTS
8a. CONSIDER APPROVAL – A request from Houwman Architects, on behalf
of Kevin Fuller, Federal Molding Inc., for a Planned Unit Development
amendment associated with modifications to the previously approved
footprint of the second building to be constructed at 16 Long Lake Road
The City is in receipt of an application from Houwman Architects, on behalf
of Kevin Fuller, for the request outlined above. The application has been reviewed by
City staff and consultants and is in order for consideration at this time. The Planning
Commission recommended unanimous approval at the August 10, 2016 meeting.
City Planner Erin Perdu said the applicants are proposing a change to the previously
approved PUD ordinance and site plan to allow for an increase in size of the second
building that was previously approved, but never built. As stated by the applicant, the
reason for the increase is to allow for the storage of finished products to fulfill orders by
customers. The existing building on the site contains the Plastic Injection Machines for
making parts, along with storage of raw materials. The proposed building will be used
primarily for storage.
The structures are situated logically in relation to one another. They allow for parking to
be located throughout the parcel, as well as appropriate area for pedestrian flow and
emergency access. The change in configuration from the originally approved building is
the addition of an “L” shape at the north end of the original rectangular shape. This
allows the configuration to remain generally the same as the previously approved plan.
The visual character will remain the same on the site, as the proposed building will be
very similar in appearance to the existing one and the one originally approved. In the
original plan, impervious surface coverage was proposed at 84.7%. In 2006, a stormwater
pond was built on the site to accommodate runoff at that level of impervious surface
coverage. The proposed impervious surface coverage for the new proposed building is
77.9%.

A detailed circulation plan has been provided to describe the proposed movements of
trucks and pedestrians/fork lifts on the site. Access to Long Lake Road will remain via
the same access point that exists today.
Loading doors are proposed on the new building, facing west toward the existing
building. Feasible circulation patterns for trucks pulling into these loading areas have
been provided.
No changes are proposed to the previously approved landscaping plan.
There are 9 proposed wall mounted light fixtures that will be affixed to the proposed
building. Some will be large to light driveways, and others will be smaller to light
entrances. The proposed lighting will be the same as the lighting that is on the existing
building. Any lighting proposed on the building must be accompanied by a photometric
plan that meets the requirements of Section 10.8 Exterior Lighting prior to issuance of
building permits.
The applicant is proposing a new monument sign at the entrance to the property on the
south side. The sign is proposed to be 8 feet tall and 8 feet long. The signage will be back
lit and provide business information. All signage must be permitted through a separate
sign permit and meet the requirements of Section 10.7 Signs.
A 25 foot wide emergency access lane is shown on the plans to the east of the proposed
building. The applicant has met with the Mahtomedi Fire Chief during the development
of the site plan to ensure appropriate emergency access. Final building plans will require
approval of the Fire Chief prior to issuance.
The circulation plan on the site causes some areas of concern for pedestrian safety.
Because trucks need to be able to maneuver between both buildings and have limited
space to do so, some issues have been identified. On the proposed building there are two
entrances on the west side that do not have any pedestrian infrastructure to connect them
to each other or to parking areas. Staff recommends that a pedestrian walkway be added
between the two doors and around the southwest corner of the building to connect
pedestrians to the adjacent parking spaces.
Another area of concern is the main pedestrian and forklift route between the two
buildings. This route is located near the loading docks, and the circulation maps show
that trucks will be backing up in the area of this route as well as backing up very close to
entrances. This route should be clearly be marked with pavement markings, signage, or
physically raised to make it very apparent that people will be walking and operating
forklifts along the route.

No additional stormwater management is proposed with this development since the new
warehouse and parking bays are within the impervious footprint of the original PUD and
proposed grades direct storm water to the pond that was previously approved. The
developer is working with the City to reconfigure the existing utilities on-site to
accommodate the new building’s needs.
The applicant, Kevin Fuller, addressed the pedestrian walkway. He said there will be a
stopping area for the trucks entering the facility and they will have to check in before
proceeding to the buildings.
Council member Brainerd moved and Council member Deans seconded the motion to
approved Ordinance No. 2016-05 Amending the PUD 2006-03 Overlay Zoning District
Associated with the Development on Lot 3, Block 1, Northeast Metro Business Park to
Allow for Changes to the Proposed Warehouse Building at 16 Long Lake Road. The
motion was approved.
Council member Brainerd moved and Council member Ramaley seconded the motion to
approved Resolution No. 2016-39 Approving a Site Plan for the Warehouse Building at
Lot 3, Block 1 of the Northeast Metro Business Park at 16 Long Lake Road. The motion
was approved.
8b. CONSIDER APPROVAL – An ordinance amending Mahtomedi City Code,
Chapter 11, Section 11.01, Subdivision 9.1 opting out of the requirements of
Minnesota Statutes, Section 462.3593 relating to Temporary Family Health
Care Dwellings
City Planner Erin Perdu said on May 12, 2016 the governor signed into law a bill creating
a process whereby landowners can place mobile residential dwellings on their property to
serve as a temporary family health care dwelling. This law requires all cities to allow
these temporary dwelling units as a permitted use unless the City enacts an ordinance
opting out of the new law.
Because these dwellings fall under the classification of recreational vehicles, most
provisions of the State Building Code do not apply. The time frame under the state law
for occupancy of these structures is up to six months. More information on this law is
provided in the attached packet from the League of Minnesota Cities.
The City of Mahtomedi has recently enacted an ordinance allowing for accessory
dwelling units, which provides one option for families needing to house an ailing relative.
The new law would alter the city’s level of zoning authority for these types of structures

(recreational vehicles), which staff does not feel is consistent with the desired character
of the City.
At their August 10, 2016 meeting, the Planning Commission recommended unanimous
approval of the ordinance.
Council member Brainerd moved and Council member Ramaley seconded the motion to
approve Ordinance No. 2016-06 Amending the City code Opting Out of the
Requirements of Minnesota Statute Relating to Temporary Family Health Care
Dwellings. The motion was approved.
8c. CONSIDER APPROVAL-Resolution Amending the City of Mahtomedi
Special Assessment Policies.
City Engineer Jay Kennedy said at the April 19, 2016 City Council Meeting, the City
Council adopted an ordinance allowing attached or detached accessory dwelling units in
the City. The existing assessment policy adopted in 2010 is not clear on how properties
with Accessory Dwelling Units would be specially assessed. If the proposed language is
adopted, a single family home with an ADU or rental suite (single family home that has
been retrofit to provide a suite or floor for rent) would be assessed as a single unit. The
ADU/Rental Suite would not be assessed as a second unit similar to a standard duplex.
Council member Deans moved and Council member Schilling seconded the motion to
approve Resolution No. 2016-40 Amending the City of Mahtomedi Special Assessment
Policy. The motion was approved.
8d. CONSIDER APPROVAL-Resolution Declaring Costs to be Assessed and
Ordering Preparation of Proposed Assessments for Project 2016-01, Phase 2
– Historic District Improvements and Resolution Calling for and Ratifying
an Assessment Hearing with Respect to Project 2016-01, Phase 2 – Historic
District Improvements.
For consideration is a Resolution declaring costs to be assessed for the Historic District
Phase 2 Project and a Resolution calling for and ratifying an assessment hearing for
September 20, 2016.
The total cost of the project is $3,805,381.55. The amount to be specially assessed is
13.1% of the total amount or $497,749.95. Of the remaining 86.9% of the total amount,
$3,307,631.60 shall be financed by way of general tax levy, city utility funds, and
available City reserves as determined by the City Council.

Council member Schilling moved and Council member Brainerd seconded the motion to
approve Resolution No. 2016-41 Declaring Costs to be Assessed and Ordering
Preparation of Proposed Assessments for Project 2016-01 Phase-2 Historic District
improvements. The motion was approved.
The Assessment Hearing for Project 2016-01 will be held on September 20, 2016 at 7:00
p.m. Notice of hearing will be published at least once in the official newspaper at least
two weeks prior to the hearing and the notice mailed to the owners of each parcel
described in the assessment roll.
Council member Ramaley moved and Council member Deans seconded the motion to
approve Resolution No. 2016-42 Calling for and Ratifying an Assessment Hearing for
Project 2016-01 Phase 2-Historic District Project. The motion was approved.
8e. CONSIDER APPROVAL-Bill List
Council member Ramaley moved and Council member Schilling seconded the motion to
approve the bills as presented. The motion was unanimously approved.
9. REPORT FROM THE CITY ADMINISTRATOR
Administrator Neilson said the Suburban Cable Commission had to make cuts due to a
decrease in revenues and a couple of the public access channels will be eliminated. They
will focus more on community events.
Administrator Neilson said an open house for the council and advisory commissions will
be held at Katherine Abbot Park on September 29th.
10. COMMENTS FROM THE CITY COUNCIL
Council member Brainerd said he will not be at the September 20, 2016 council meeting.
