MAHTOMEDI CITY COUNCIL MINUTES SEPTEMBER 6, 2016 Mayor Jud Marshall convened the regular City Council meeting at 7:00 p.m. with Council members Timothy Deans, Joel Schilling, Richard Brainerd and Lael Ramaley in attendance. City Administrator Scott Neilson, City Attorney Jay Karlovich, City Engineer Chris LaBounty and City Clerk Mary Solie were also in attendance. CONSIDER APPROVAL OF AGENDA Council member Schilling moved and Council member Ramaley seconded the motion to approve the agenda as presented. The motion was unanimously approved. CONSIDER APPROVAL OF CITY COUNCIL MEETING MINUTES Council member Deans moved and Council member Brainerd seconded the motion to approve the minutes as presented. The motion was unanimously approved. 4. PRESENTATIONS 4a. 5 Year Service Award – Josh Buck Mayor Jud Marshall presented Josh Buck with a 5 year service award and thanked him for his years of service to the City. 4b. Chris Eng – Washington County Economic Development Director Chris Eng, the newly hired Washington County Economic Development Director, was present to introduce himself and talk about the services his office will offer to cities of Washington County. He said the agency will provide a point of contact for developers, site selectors, current business owners, local economic development staff, and others to gather information on the county. It will also take on efforts to market the county as a place to locate a business, and will work with local cities and townships on business retention and expansion. The agency will provide cities and townships assistance to work with state programs and regional partners, such as GreaterMSP, that are working to grow jobs and bring investment to the Twin Cities region. 5. DISCUSSION FROM THE AUDIENCE Cameron Dahm asked to have a four way stop sign placed at the intersection of Maple Street and Warner Avenue. He said there is excessive speed on both streets and visibility is an issue also. Staff will review the request and report on it a future meeting. CITY COUNCIL MEETING MINUTES -2- SEPTEMBER 6, 2016 6. CONSENT AGENDA Council member Brainerd moved and Council member Deans seconded the motion to approve the Consent Agenda as presented. The motion was unanimously approved. a. APPROVAL - Schedule Public Hearing to Consider Certification of Delinquent Utility Accounts to Washington County for Collection with 2017 Property taxes for September 20, 2016 at 7:00 p.m. A public hearing was scheduled for September 20, 2016 at 7:00 p.m. to consider certification of delinquent utility accounts to Washington County for collection with 2017 property taxes. b. APPROVAL-2016-17 Safety Management Program Contract with MMUA. The 2016-17 Safety Management Program Contract with MMUA was approved. The amount of the contract is increasing from $7,425 to $8,000. c. APPROVAL-Operating Engineers Local #49 Health and Welfare Fund Bargaining Premium Account Participation Agreement. The Participation Agreement with Operating Engineers Local #49 relating to the Health Insurance for Local #49 Public Works employees was approved. d. APPROVAL-Lost Lake Villas Minor Subdivision Lot Line Drainage and Utility Easement Agreement and Lost Lake Villas Minor Subdivision Development Agreement. The Lot Line Drainage and Utility Easement Agreement and Minor Subdivision Development Agreement for Lost Lake Villas Minor Subdivision were approved. e. APPROVAL-Master Subscriber Agreement for Minnesota Court Data Services. An agreement to allow the City Prosecutor to be provided with electronic access to appropriate court records and documents was approved. The State of Minnesota implemented a new document access program as of August 1, 2016. The new Master Government Access Program provides the City with the same information as the former program, Odyssey. The change of programs requires a new portal access and requires new applications to be completed by the City. The new Master Subscriber Agreement for Minnesota Court Data Services supersedes the Master Subscriber Agreement for Minnesota Court Data Services that was entered into on November 12, 2010. CITY COUNCIL MEETING MINUTES -3- SEPTEMBER 6, 2016 6. CONSENT AGENDA-Continued. f. APPROVAL-City of Mahtomedi and City of Willernie Water Supply Agreement. The proposed Water Supply Agreement between the City of Mahtomedi and City of Willernie was approved. Council member Schilling thanked the two council members, Brainerd, Ramaley and staff for their effort in getting the agreement finalized. 7. PUBLIC HEARINGS 7a. CONSIDER APPROVAL-Preliminary 2017 General Fund Budget, Certification of 2017 Levy to Washington County, Schedule Public Hearing for Consideration of Final Budget Approval and Certification for December 6, 2016 at 7:00 p.m. and Schedule Public Hearing for 2017-2021 Capital Improvement Plan for November 1, 2016. Finance Director Schott Schaefer said the Finance Commission and City Council held a joint meeting on August 16, 2016 to review and discuss the preliminary budget and levy being proposed for 2017. General Fund Revenues and Expenditures are proposed to increase 6.45% from the 2016 Budget, with budgeted revenue and expenditures of $5,501,634. The 2017 General Fund Tax Levy proposed is $2,895,888, a 2.89% increase from 2016. The 2017 Special Levy proposed is $1,229,215, a 17.87% increase from 2016. The 2017 Total City Levy proposed is $4,125,103, a 6.94% increase from 2016. The 2017 Proposed Levy must be certified to Washington County by September 30, 2016. The City Council may lower, but may not increase the amount of the proposed certified levy when it adopts the Final 2017 General Fund Budget and establishes the Final Certified Levy in December. The City Council is being asked to schedule the public hearing for final budget and levy consideration on Tuesday, December 6, 2016 at 7:00 p.m. The public hearing will be held and action on the 2017 budget and levy will be taken at this meeting. The City Council is also being asked to schedule a public hearing to discuss the 2017- 2021 Capital Improvement Plan at the City Council meeting held on Tuesday, November 1, 2016 at 7:00 p.m. Mayor Marshall opened the public hearing at 7:43 p.m. CITY COUNCIL MEETING MINUTES -4- SEPTEMBER 6, 2016 7a. Continued. Tony Yarusso, 125 Spruce Street, urged the council to put more money into the Parks and Trail fund. He said the City could do much better with Parks and Trails with a minimal investment. The public hearing was closed at 7:43 p.m. Council member Brainerd moved and Council member Ramaley seconded the motion to approve Resolution No. 2016-42 Approval of the Proposed 2017 Annual Budget for the General Fund of $5,501,634, and schedule a public hearing for consideration of the 2017 City Budget and Final Levy Certification for Tuesday, December 6, 2016, at 7:00 p.m. and schedule a public hearing for consideration of the 2017-2021 Capital Improvement Plan on Tuesday, November 1, 2016. The motion was approved. Council member Brainerd moved and Council member Deans seconded the motion to approve Resolution No. 2016-43 Approval of the Proposed Tax Levy for 2017 and Cancellation of Debt Levy in the Amount of $1,205,491 for Taxes Payable in 2017. The motion was approved. Council member Brainerd said this budget has had a very thorough review at several meetings by both the Finance Commission and the City Council. 8. STAFF REPORTS 8a. CONSIDER APPROVAL-Review Bids and Award Contract for Katherine Abbott Park Improvements Phase 1. City Engineer Chris LaBounty said bids were received for the above project on Thursday, August 11, 2016 and were opened and read aloud. Five bids were received. The bid was presented to the Parks Commission at their August 17, 2016 meeting, and the Commission recommended the City Council award the base bid and alternate 1 to the low bidder Fitzgerald Excavating and Trucking, Inc., Goodhue, Minnesota in the amount of $151,891.50 Council member Deans moved and Council member Ramaley seconded the motion to approve the base bid and alternate 1 in the amount of $151,891.50. The motion was approved. 8b. DISCUSSION – Update on Warner Avenue Culvert. City Engineer LaBounty provided an update on the status of the Warner Avenue culvert review that was requested by the City Council in June. CITY COUNCIL MEETING MINUTES -5- SEPTEMBER 6, 2016 8b. Continued. The City Council asked staff to televise the culvert and review hydraulics in the area connected to the culvert. The culvert was found to be plugged with debris which was cleared away. An investigation of downstream culverts (in the City of Willernie) was completed, and the area was monitored during and following a series of rainfall events this summer. The flooding seems to have been taken care of for the most part, with minimal ponding after the recent rains. A survey of the Warner Avenue culvert and interconnected pipes was completed and is being summarized for use by the watershed district. A hydraulic model of the upstream drainage shed is also being updated. Engineer LaBounty said staff has reached out to the Rice Creek Watershed District and Washington County Conservation District to review potential funding sources and potential collaboration opportunities for completing an improvement project in this area. We will continue to work with Public Works to monitor the condition of the culvert. Council member Schilling said he would like to see the Local Surface Water Management Plan updated sooner than later. He feels this would be an important step to complete if the City is looking for funding sources. He also said he would like the same two council members that worked on the Willernie Water Agreement to be a part of the conversations with Willernie regarding the culvert. Council member Brainerd said he would like to see a report on the modeling of the area before meeting with the City of Willernie. Engineer LaBounty will prepare the report for a future meeting. 8c. CONSIDER APPROVAL-Bill List Council member Brainerd moved and Council member Ramaley seconded the motion to approve the bills as presented. The motion was unanimously approved. 9. REPORT FROM THE CITY ADMINISTRATOR Administrator Neilson said Piccadilly Square will open on October 1st and would like the City Council to take a tour of the facility on October 4th at 5:30 pm before the Council meeting. He said there are 33 units leased with another 12 on October 1st. They expect to be fully rented in 6 months. The Advisory Commissions open house is scheduled for Thursday, September 29th from 4-6 pm at Katherine Abbott Park. CITY COUNCIL MEETING MINUTES -6- SEPTEMBER 6, 2016 9. Continued. Administrator Neilson said there are Emergency Management training sessions available and if anyone wants to attend to let him know. He said there has been a complaint about the property at 219 Park Avenue, where there had been a fire and all that is left is the foundation. He said Staff is reviewing to see if there are any code violations. Administrator Neilson said due to utility work in the right-of-way, Highway 244 will be closed mid-day during the week of September 19-23. The road will be open mornings and later afternoons. The traffic will be detoured onto Warner Avenue. 10. COMMENTS FROM THE CITY COUNCIL Council member Brainerd noted that former Planning Commission member Jim Stratton had passed away. He also asked to have an update on the septic inspections. Council member Deans asked how the rebate program is doing. Staff said there is money left, but it will be mentioned again in the next newsletter. 11. CLOSED SESSION – None Scheduled 12. ADJOURNMENT Council member Ramaley moved and Council member Schilling seconded the motion to adjourn the meeting at 8:35 p.m. The motion was unanimously approved.
