Regular Meeting

APRIL 7, 2025 Regular Meeting of Mayor and Council was convened at 7:00 p.m. on April 07, 2025, with Mayor Michael Mangan presiding. This meeting was held in person at Borough Hall and via Zoom. Mayor Mangan read the statement re: Open Public Meetings Act of 1975 and that adequate notice has been provided by transmitting the Resolution to the Asbury Park Press and the Coast Star, by posting it in the Borough Hall on a bulletin board reserved for such announcements, and by posting it on the official website of the borough. Mayor Mangan stated that zoom meetings are a courtesy and if the zoom platform fails the meeting will continue in person. Mayor Mangan welcomed the audience and invited them to join in a moment of silent prayer and a salute to the Flag. ROLL CALL: Present: Council Members Bruce Bresnahan, Jay Bryant, Brian Holly, Gregg Olivera and Sheila Vidreiro Absent: Councilwomen Lori Triggiano Also present was Borough Attorney Mark Kitrick and Borough Administrator Thomas Flarity Mayor Mangan addressed the Council, requesting the removal of several ordinances from the meeting agenda. He outlined the ordinance review process, emphasizing the Council's commitment to transparency and the importance of presenting ordinances in the proper manner. He explained that the ordinances currently on the agenda had not gone through the appropriate zoning committee review and that a public workshop would be held to allow for proper community input. To ensure accountability and clarity moving forward, Mayor Mangan requested that a documented paper trail of any ordinance changes be included in future presentations. The Mayor specifically requested the removal of the following ordinances from the agenda: Ordinance 2440-25, Ordinance 2444-25, Ordinance 2445-25, Ordinance 2446-25 and Ordinance 2448-25 Councilman Holly made a motion to remove the ordinances from the agenda, seconded by Councilwomen Vidreiro. Motion carried unanimously. Audience Participation Councilman Holly made a motion to open the meeting to the public, seconded by Councilman Olivera. Motion carried unanimously. Jane Swiggett 377 Pine Avenue, inquired Ordinance 2551-25 which states the County of Burlington. Mayor Mangan verified the mistake and stated that it will be amended. Councilman Holly made a motion to close the public portion, seconded by Councilman Bresnahan. Motion carried unanimously. Approval of Minutes Reorganization Meeting Minutes – January 6, 2025 Councilman Holly made a motion to approve the minutes, seconded by Councilman Bresnahan. Motion carried unanimously with the Council Member and Olivera abstaining. Regular Meeting Minutes – March 3, 2025 Councilman Olivera made a motion to approve the minutes, seconded by Councilman Holly. Motion carried unanimously.  APRIL 7, 2025 Regular Meeting Minutes – March 18, 2025 Councilman Holly made a motion to approve the minutes, seconded by Councilman Bresnahan. Motion carried unanimously. Workshop Discussion – Curtis Park Signage Mayor Mangan stated the reason for this is to enhance transparency and weigh in from council and the public on topics that the council committees would normally handle. He thanked the committee for the input on the Curtis Park donor sign. He stressed the importance that the donors be recognized for their contribution to the park but also wanted it aesthetically to fit in with the park. Councilman Holly stated that the reason it took a little time because of the renditions of the sign. There was concern regarding the size and the concern of safety for the children. With collaboration with the Friends of Manasquan Recreation they were able to pick a sign that was conducive to the donors and to the safety. Monthly Engineers Report Joseph Raftery From Colliers Engineering went over the Engineers Report for March 2025 Discussion ensued regarding clarification of drainage along Stockton Lake Blvd. Mr. Raftery provided additional details on the Stockton Lake Blvd Project, he addressed the concerns about drainage and ADA (American with Disabilities) compliance with the state. He also addressed the concerns of access to Elks Lodge during the project. Ordinance – First Reading and Introduction The Borough Attorney read the title of ordinance 2450-25 for introduction. CALENDAR YEAR 2025 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) Councilman Holly made a motion to introduce ordinance 2450-25, seconded by Councilwomen Vidreiro. Motion carried by the following vote: “yes” Council Members Bresnahan, Bryant, Holly, Olivera, 0and Vidreiro. “No” none. BUDGET INTRODUCTION & RELATED DOCUMENTS Councilman Bryant thanked everyone that was involved in putting the 2025 budget together. Mr. Shechter read the budget by title as allowed by law and advised that the summary will be advertised in next week’s edition of the Coast Star. Consent Agenda RESOLUTION 89-2025 BE IT RESOLVED by the Council of the Borough of Manasquan, County of Monmouth, State of New Jersey that; WHEREAS, a refund of monies are due to the following: NAME: JOSEPH VILLANI 30 WIGWAM PATH MANASQUAN, NJ 08736  APRIL 7, 2025 AMOUNT OF REFUND DUE: $1256.00 REASON FOR REFUND: REFUND CONSTRUCTION PERMIT – OVER PAYMENT OF COAH FEE RESOLUTION 90-2025 WHEREAS the Borough is the recipient of a NJDOT/Federal Transportation Alternatives Program (TAP) Streetscapes grant to fund a downtown beautification construction project (the “Project”); and WHEREAS, the Borough has reached the point in the process wherein it must execute the Federal Aid Cost Reimbursement Agreement (Agreement) in order to allow the NJDOT to make the construction grant funds available; and WHEREAS, the Borough has received, reviewed and approved the terms of the Agreement. NOW THEREFORE, BE IT RESOLVED, that the Mayor is hereby authorized to execute the TAP Streetscapes Federal Aid Cost Reimbursement Agreement. RESOLUTION 91-2025 RESOLUTION OF THE BOROUGH OF MANASQUAN COUNTY OF MONMOUTH, STATE OF NEW JERSEY, HONORING WALLY WALL AND MEMORALIZING HIM AT THE INLET GAZEBO WHEREAS, Wally Wall served as the Manasquan Beach Manager for years from 2005; and WHEREAS, Wally became the face of Manasquan Beach for countless beach goers over the year, always ready to help with a problem or to provide information to anyone who asked; and WHEREAS, Wally retired from his Beach Manager position after the summer of 2020; and WHEREAS, the Mayor and Council are resolved to honor Wally’s years of service and dedication to Manasquan Beach. THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL, that Sunday, June 15, 2025, is hereby declared Wally Wall Day at Manasquan Beach. BE IT FURTHER RESOLVED on that day at 2pm, a brief ceremony honoring Wally Wall’s service will take place at the Inlet Gazebo and a plaque memorializing Wally Wall will be permanently affixed to the Inlet Gazebo in Wally’s honor. NOW THEREFORE, BE IT RESOLVED on the 7th day of April 2025 by the Manasquan Borough Council, County of Monmouth, State of New Jersey that the following personnel action is hereby approved: Employee Borough Title Pension Annual Hours Effective System Pensionable Date Salary Kathleen Administrative PERS $50,000.00 8:30am to 4pm April 7, Salerno Secretary- M-F 2025 DPW RESOLUTION 96-2025 A RESOLUTION ACCEPTING THE GRANT FROM THE HAZARDOUS DISCHARGE SITE REMEDIATION FUND PUBLIC ENTITY PROGRAM THROUGH THE NEW JERSEY ECONOMIC DEVELOPMENT AUTHORITY AND THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION WHEREAS, the Borough of Manasquan has applied for and has been awarded a grant in the amount of up to $144,070.63 from the Hazardous Discharge Site Remediation Fund Municipal Grant Program through the New Jersey Department of Environmental Protection and the New Jersey Development Authority (the Authority) for Preliminary Assessment, Site Investigation and Remedial Investigation of the property at 86 Main Street (formerly site of Sullivan’s Service Center). NOW, THEREFORE BE IT RESOLVED by the governing body of the Borough of Manasquan that the above referenced grant is hereby accepted and the Mayor is hereby authorized to execute grant documents as an authorized representative thereunder, as the representative for the Borough of Manasquan. BE IT FURTHER RESOLVED that a comprehensive plan exists specifically for the remediation of the confirmed discharge of a hazardous substance or hazardous waste in the Borough of Manasquan  APRIL 7, 2025 and the Borough of Manasquan can demonstrate its commitment to the Authority that the Project Site will be redeveloped within a three-year period from the completion of the remediation. BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to the New Jersey Economic Development Authority. RESOLUTION 97-2025 WHEREAS, the Mayor and Council of the Borough of Manasquan on October 21, 2024, awarded the Stockton Lake Boulevard Phase 3 Improvement Project to S. Brothers, Inc; and WHEREAS, the Mayor and Council are desirous of finishing the Stockton Lake Boulevard Phase 3 Project in the most expeditious and effective manner; and WHEREAS, Chapter 3-28.3e of the Manasquan Borough Code permits Construction between the hours of 8:00 a.m. to 6:00 p.m. Monday through Saturday; and WHEREAS, S. Brothers, Inc, are requesting construction to begin at 7:30 a.m. Monday through Saturday. NOW THEREFORE BE RESOLVED on this 7th day of April 2025, by the Mayor and Council of the Borough of Manasquan, in the County of Monmouth and State of Jersey that S. Brothers Inc. is authorized to begin their construction at 7:30 a.m. Monday through Saturday. RESOLUTION 98-2025 WHEREAS, N.J.S.A. 40A:11-5 (1) (a) (1) permits the governing body to award a professional services contract without publicly advertising for bids and bidding therefor; and WHEREAS, the borough council has determined to provide the need to acquire these professional services as a non-fair and open contract pursuant to the provisions of N. J. S. A. 19:44A-20.5; and WHEREAS, the chief financial officer of the municipality has determined and certified in writing that the value of these professional services may exceed $17,500; and WHEREAS, the anticipated term of these contracts is one year (January 1, 2025, to December 31,2025); and WHEREAS, the Borough continues its environmental testing due diligence with regard at and around its property at 86 Main Street; and WHEREAS the Borough contracted with VHB Environmental, Inc., Wall, NJ in 2024 to conduct this work; and WHEREAS this work continues, and it is essential that VHB be retained based on its current knowledge of the property. WHEREAS that VHB Environmental, Inc. be retained via a non-fair and open appointment for the sole role of administering the remaining environmental due diligence activity necessary at 86 Main Street WHEREAS the professional service provider has or will submit a contract to be reviewed for completeness and approval by the borough attorney indicating that they will provide their services for the agreed upon rate (s) that are contained in their contract that is on file in the Clerk’s Office. RESOLUTION 101-2025 WHEREAS, Raymond Shinn, a dedicated employee in the Department of Public Works, has announced his retirement effective May 31, 2025; and WHEREAS, it is essential to maintain departmental operations and service to the community. NOW THEREFORE, BE IT RESOLVED on the 7th day of April 2025 by the Manasquan Borough Council, County of Monmouth, State of New Jersey, that the Personnel Officer is hereby authorized to advertise for the position of Laborer in the Department of Public Works. RESOLUTION 105-2025 WHEREAS, the Borough of Manasquan is the owner of certain surplus property which is no longer needed for public use; and WHEREAS, the Mayor and Council are desirous of selling said surplus property in an “as is” condition without express or implied warranties; and,  APRIL 7, 2025 WHEREAS, the Borough of Manasquan has determined that surplus items including but not limited to, various vehicles, equipment and sundry items listed on Schedule A attached to this resolution are property no longer needed for public use; and WHEREAS, the State of New Jersey permits the sale of surplus property no longer needed for public use through the use on an online auction service, pursuant to the Local Unit Electronic Technology Pilot Program and Study Act, P.L. 2001, c.30 and pursuant to Local Finance Notice 2008-9; and WHEREAS, the Borough of Manasquan has the property listed in schedule A, attached to this Resolution, and desires to sell this property online. Some reasons for this may include, but are not limited to a reserve not being met, a default by a winning bidder, or discovery of misrepresentation in the description of an item. In the event this does happen the item may not necessarily be advertised again, but all bidders and bid watchers for that particular item will be automatically notified by email of the change in auction date and time. The Borough Attorney read the title of ordinance 2451-25 for introduction BOND ORDINANCE NO. 2451-25 BOND ORDINANCE PROVIDING A SUPPLEMENTAL APPROPRIATION OF $550,000 FOR IMPROVEMENTS TO BOROUGH HALL IN AND BY THE BOROUGH OF MANASQUAN, IN THE COUNTY OF MONMOUTH, NEW JERSEY, AUTHORIZING THE ISSUANCE OF $522,500 BONDS OR NOTES OF THE BOROUGH FOR FINANCING PART OF THE APPROPRIATION AND AMENDING THE PROJECT DESCRIPTION SET FORTH IN BOND ORDINANCE #2429-24 OF THE BOROUGH FINALLY ADOPTED SEPTEMBER 3, 2024 TO PROVIDE FOR ELEVATOR UPGRADES Councilman Holly made a motion to introduce ordinance 2451-25, seconded by Councilman Bresnahan. Motion carried by the following vote: “yes” Council Members Bresnahan, Bryant, Holly, Olivera, and Vidreiro. “No” none. Committee Reports Administration Committee - Councilman Bryant stated he no report at this time. Community Service Committee – Councilwoman Vidreiro stated she had no report at this time. Public Safety Committee – Councilman Olivera report on the activities in the police department for the month of March. Public Property Committee - Councilman Holly updated reported that leaf pick-up has been completed. He mentioned potholes are being repaired and the beach grading is in the process. He also reported that the Sea Watch building should be open no later than May 1st. He reported Stockton Lake Blvd project is on-going and the Senior Center will be power washed, painted and landscaped when the school is on Spring Break. Landscaping will be done at the water treatment plant. He also thanked the Sea Lavender Club for their dedication to placing flowers in town and for their ongoing contributions to the Community.  APRIL 7, 2025 Shared Services & Grants Committee- Councilman Bresnahan stated the beach committee is actively working during the off-season to prepare for the upcoming season. He reported all the applications for beach staff positions have been received and interviews have been conducted. Mayor Mangan announced the upcoming dedication of the Beach Gazebo to Wally Wall on June 8th and encouraged residents to attend to honor his many years of service as Beach Manager and a member of the Tourism Commission. Additionally, Mayor Mangan expressed his gratitude to Ray Shinn for his dedicated service to the Public Works Department as he retires, and he acknowledged Ryan's quiet contributions to the town. Audience Participation Councilman Holly made a motion to open the public portion, seconded by Councilman Bresnahan. Motion carried unanimously. Edward Quigley from Richmond, Virginia, addressed the council to raise awareness about the dangers of beach umbrellas in windy conditions. Mr. Quigley shared his personal experience of being injured by a wind-blown umbrella to underscore potential dangers He stated his mission is to advocate for increased public awareness. Mr. Quigley highlighted the task force he initiated, which developed a safety standard that has since been adopted by the Consumer Safety Commission. As part of his ongoing efforts, he travels to beach towns to advocate for the adoption of umbrella safety measures and presented a standardized sign for placement at beach access points. Mayor Mangan expressed his appreciation to Mr. Quigley for his presentation, acknowledging the importance of the information he shared with the public. Mary Ryan, 113 Beachfront, inquired if Mr. Quigley could repeat the website for the Beach Umbrellas. She thanked Mr. Quigley for his presentation and reiterated the importance of this issue.
