JUNE 2, 2025 Regular Meeting of Mayor and Council was convened at 7:00 p.m. on June 2, 2025, with Mayor Michael Mangan presiding. This meeting was held in person at Borough Hall and via Zoom. Mayor Mangan read the statement re: Open Public Meetings Act of 1975 and that adequate notice has been provided by transmitting the Resolution to the Asbury Park Press and the Coast Star, by posting it in the Borough Hall on a bulletin board reserved for such announcements, and by posting it on the official website of the borough. Mayor Mangan stated that zoom meetings are a courtesy and if the zoom platform fails the meeting will continue in person. Mayor Mangan welcomed the audience and invited them to join in a moment of silent prayer and a salute to the Flag. ROLL CALL: Present: Council Members Bruce Bresnahan, Brian Holly, Jay Bryant, Gregg Olivera, Lori Triggiano, and Sheila Vidreiro Absent: None Also present was Borough Attorney Mark Kitrick and Borough Administrator Thomas Flarity. Councilman Olivera made a motion to remove Resolution 143-2025 Liquor License for the Elks from the Consent Agenda and to have it moved to a separate vote, seconded by Councilman Bryant. Motion carried unanimously. Audience Participation Councilman Holly made a motion to open the meeting to the public, seconded by Councilwomen Triggiano. Motion carried unanimously. Being no comments Councilman Holly made a motion to close the public portion, seconded by Councilwomen Triggiano. Motion carried unanimously. Workshop Monmouth County Broad Street Presentation Commissioner Thomas Arnone of Monmouth County, joined by Commissioner Dominick DiRocco, County Engineer Joe Ettore, Engineering Consultant Joe Platt, Assistant County Engineer Michael Nei, and Project Engineer Bob Strang-Wolf, presented a preliminary design for the Manasquan Main Street intersection during the Broad Street presentation. Commissioner Arnone began by outlining the timeline of the project, from its initial conception through the planning and design stages. County Engineer Joe Ettore followed with a review of the site’s parameters and discussed proposed solutions intended to benefit both Manasquan and the County. Engineering Consultant Joe Platt then presented three design alternatives for the intersection at Broad Street and Main Street. Among the options, a compact roundabout emerged as the preferred solution. This design was highlighted for its ability to reduce traffic queues and delays compared to a traditional signalized intersection. In addition, the compact roundabout would minimize impacts to nearby properties, enhance safety, improve the overall aesthetics of the area, and create additional green space. The proposed design would accommodate all standard traffic, including school buses and fire trucks. Commissioner Arnone concluded the presentation by announcing that Monmouth County will fully fund the project, with an estimated cost of $1.5 million. Mayor Mangan concluded the presentation with thanking the county on behalf of the entire town for partnering and for their continued support. Council thanked the Commissioners and their team for the investment in the town of Manasquan.  JUNE 2, 2025 Councilman Holly made a motion to open to the public, seconded by Councilman Bresnahan. Motion carried unanimously. Nancy Jordan, of Euclid Avenue and a member of the Beautification Committee, asked if there are any examples of roundabouts in New Jersey that can be reviewed. Commissioner Arnone responded that there are several examples in Monmouth County, including locations in Colts Neck, Brookdale, and a section of Middletown that is county-owned. He also mentioned the aesthetics of roundabouts, including the possibility of placing monuments in the center. Jim Manser, owner of the Coast Star Building, expressed his concerns about the project. He urged the county to proceed cautiously, particularly in regard to the green space that attracts children on bicycles, and the visibility within the central area of the roundabout. Commissioner Arnone assured him that the county would complete the necessary work at the roundabout and would then release the property to the town, so future decisions could be made at the local level. Mayor Mangan emphasized that all aspects of safety would be fully addressed in the project. Jane Swiggett, of Pine Avenue, inquired about a preliminary timeline for project completion and asked whether flashing signs would be installed at all four corners of the intersection. County Engineer Ettore responded by outlining the general project timeline, including design, bidding, and construction, with the goal of starting after the summer season of 2026. In response to Ms. Swiggett’s follow-up question regarding flashing lights at each corner, Mr. Ettore stated that the final design has not yet been completed, but the placement of flashing lights will be evaluated as part of the process. Councilman Holly made a motion to close the public portion of the presentation, seconded by Councilman Bresnahan. Motion carried unanimously. Project Committee Mayor Mangan provided an update on the formation of the Projects Committee, noting that the current agenda item pertains solely to its membership. He requested to serve as a member of the committee for this year only, emphasizing that it is intended to be a three-person committee. The Mayor explained that, since this is a new initiative, he would like to assist with its initial organization. A discussion followed regarding which committee chairperson should be involved with the Projects Committee during the current year, and who would assume that role after the Mayor steps down from the committee. Zoning Ordinance Discussion Mayor Mangan provided an update on the Zoning Ordinances process, outlining upcoming changes and key priorities. He stated that the committee will focus on several important areas: residential density, general zoning regulations, and affordable housing initiatives. The new zoning ordinances which will be introduced are designed to comprehensively address these issues with an emphasis on managing community growth and ensuring housing accessibility. To maintain transparency, Mayor Mangan also announced that a dedicated website will be made available to the public in the near future, providing detailed information on the zoning process and all proposed changes. The submitted application form is complete in all respects. 2. The applicant is qualified to be licensed according to all statutory, regulatory, and local governmental laws and regulations of the Division of the Alcoholic Beverage Control. The licensee shall provide two (2) qualified uniformed security persons who shall be assigned to duty in the parking lot from the hours of 7:00 p.m. to 3:00 a.m. on those Fridays, Saturdays and holidays upon which the licensee shall be open for business. b. At any time the licensed premises offers live entertainment or amplified music, all doors shall remain closed except for access to and from the licensed premises and all windows shall be closed. c. No bottles or cans shall be dumped in the solid waste dumpster maintained by the license holder between the hours of twelve (12) midnight and seven (7) a.m. d. No live music at the licensed premises after 1:30 a.m. e. Alcoholic beverages may only be served in connection with the service of food to patrons seated at tables in Section “B” of the premises (see diagram attached). Alcoholic beverages shall be served only by waiters or waitresses. f. No permanent or portable service bar shall be located in Section “B”. g. The dining facilities and service of alcoholic beverages in Section “B” shall be closed and vacated no later than 12:00 midnight of each day. Further, Section “B” shall be open only when the kitchen is open. h. All patrons in Section “B” shall be seated. i. The 12' opening connecting Section “A” to Section “B” shall be reduced to a maximum of 8'. The restaurant area of Section “B” shall be physically secured after 12:00 midnight of each day to prevent patrons from using the area. j. The second floor of the building in Section “B” may only be used for administrative offices servicing the business on this site. k. All trash, refuse, and garbage shall be stored inside a separate designated enclosed area adjacent to the existing restaurant building and away from residential area. l. The submitted application form is complete in all respects. 2. The applicant is qualified to be licensed according to all statutory, regulatory and local governmental A. B. C. Laws and Regulations. WHEREAS, the governing body of the Borough of Manasquan has determined that C. Jung LLC., t/a Manasquan Liquors is entitled to a Plenary Retail Distribution License. RESOLUTION 149-2025 BE IT RESOLVED by the Council of the Borough of Manasquan, County of Monmouth, State of New Jersey that: WHEREAS, a refund of monies is due to the following: NAME: Michael R. Jelen 323 Euclid Ave Manasquan, NJ 08736 AMOUNT OF REFUND DUE: $2662.51 REASON: Boat lessee paid for the boat slip and then realized it was unconducive to their needs. New lessee has been secured. NOW, THEREFORE, BE IT RESOLVED that the Chief Financial Officer is  JUNE 2, 2025 hereby authorized and directed to draw a warrant in the said amount to the be charged against the General Ledger. RESOLUTION 150-2025 BE IT RESOLVED by the Borough Council of the Borough of Manasquan that the Honorable Michael W. Mangan, Mayor of the Borough of Manasquan, be and is hereby authorized to execute a Sales Agreement with Everon Solutions for the purchase and installation of an additional camera for Beach Headquarters in the amount of $2,690.00. RESOLUION 151-2025 OPPOSING NEW JERSEY PROTECTING AGAINST CLIMATE THREATS/RESILIENT ENVIRONMENTS AND LANDSCAPE RULES (NJPACT) WHEREAS, the Borough of Manasquan Borough Council opposes the New Jersey Department of Environmental Protection’s (NJDEP) 1,057-page NJPACT rules due to their significant adverse impacts, the Borough of Manasquan Governing Body sets forth the following objections: A. NJPACT’S CREATION, IMPACT, AND CONSEQUENCES 1. NJPACT, stemming from Governor Murphy’s Executive Order 100, imposes excessive building regulations, including raising homes and roads 5 feet above base flood elevation, far exceeding federal and local standards, effective around August 2026. 2. NJPACT rules will devastate coastal economies, reducing property values, tourism, and housing affordability, impacting the entire state’s economic vitality and exacerbating housing shortages. 3. NJPACT relies on a sea level rise study with only a 17% likelihood 75 years from now 4. Homes along the Jersey Shore, typically replaced every 25-30 years, would be overbuilt under NJPACT, imposing unnecessary costs when risks could be reassessed in 2050 or 2075. 5. NJPACT’s costs make compliance unaffordable for current and future homeowners, forcing middle-class retreat and favoring the ultra-wealthy. 6. NJPACT aligns with National Flood Insurance Program (NFIP) minimum standards but offers no premium discounts for exceeding them, creating financial burdens without benefits. 7. Without funding, NJPACT’s enforcement strains municipalities, risking economic disaster for tourism-dependent seasonal economies. 8. Unfunded mandates may lead to inconsistent regional protection, disproportionately harming smaller communities. B. REALITIES AND PRUDENT COURSE 9. With an 83% probability that NJPACT’s mandates will be unnecessary in 76 years, a more gradual, legislatively supported approach is warranted. 10. Coastal communities contribute $16 billion annually to New Jersey’s economy, and beach replenishment is not a burden but a driver of tourism and jobs. 11. Borough of Manasquan proactively addresses climate risks through resilient action plans [or similar], meeting stringent FEMA standards and designing infrastructure for 500-year floods. 12. NJPACT’s extreme approach, based on unlikely scenarios, defies science and burdens residents and municipalities unnecessarily. 13. The Borough of Manasquan supports reasonable climate policies but requests NJPACT’s withdrawal or amendment to a fact-based, gradual approach. NOW, THEREFORE, BE IT RESOLVED, the Borough Council of the Borough of Manasquan vigorously opposes NJPACT due to its threat to public health, welfare, and economic stability. RESOLUTION 152-2025  JUNE 2, 2025 BE IT RESOLVED by the Borough Council of the Borough of Manasquan, County of Monmouth, State of New Jersey, that the Borough of Manasquan retains the services of Colliers Engineering & Design, 101 Crawfords Corner Road, Suite 3400, Holmdel, NJ 07733, for purpose of providing professional services for the preparation and submittal of the Monmouth County FY 2025 Monmouth County Open Space Grant Application for Improvements for Winterstella Park. The fees are as follows:  Prepare and resubmit a complete Grant Application package. for a total amount not to exceed $3,900.00 for the service outlined in the proposal dated May 28, 2025. AND BE IT FURTHER RESOLVED by the Borough Council of the Borough of Manasquan, County of Monmouth, State of New Jersey, that the borough authorizes, with the provision that each subsequent task shall require additional authorization subject to the recommendation of the Governing Body. RESOLUTION 153-2025 BE IT RESOLVED by the Borough Council of the Borough of Manasquan, County of Monmouth, State of New Jersey, that the Borough of Manasquan retains the Professional Engineering services of Colliers Engineering & Design, 101Crawfords Corner Road, Suite 3400, Holmdel, NJ 07733 for purposes of providing Professional Services for preparing and submitting the FY2026 Monmouth County Community Development Block Grant Application, for Phase III Improvements to Euclid Avenue at the per diem rate not to exceed $2,800.00 for the services outlined in the proposal dated May 28, 2025. AND BE IT FURTHER RESOLVED by the Borough Council of the Borough of Manasquan, County of Monmouth, State of New Jersey, that the borough authorizes the Scope of Work for Professional Services for preparing and submitting the FY2026 Monmouth County Community Development Block Grant Application RESOLUTION 154-2025 RESOLUTION ADOPTING A BOROUGH-WIDE MASTER MEETING CALENDAR AND AMENDING THE ANNUAL MEETING SCHEDULE WHEREAS, the Borough of Manasquan recognizes the importance of efficient coordination, public accessibility, and logistical support for all official meetings of boards, committees, and commissions under the Borough’s jurisdiction; and WHEREAS, a comprehensive Master Meeting Calendar has been conceptually agreed upon by the Mayor and Borough Council to promote consistency, streamline scheduling, and ensure access to shared resources including technology and meeting spaces; and WHEREAS, implementation of this Master Calendar will enable consistent availability of remote access (Zoom) for all scheduled meetings, and ensure that meeting spaces are properly prepared and supported by Recreation Department staff; and WHEREAS, the proposed calendar requires adjustments to the current schedule of Council and Planning Board meetings; and WHEREAS, pursuant to the Open Public Meetings Act (N.J.S.A. 10:4-6 et seq.), the Borough Council is required to adopt an annual meeting schedule by resolution; NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Manasquan, County of Monmouth, State of New Jersey, as follows: 1. Adoption of Master Meeting Calendar The Borough of Manasquan hereby adopts the Master Meeting Calendar as the official scheduling framework for all Borough boards, commissions, and committees, effective July 1, 2025.  JUNE 2, 2025 2. Amendment to Annual Meeting Schedule The current resolution establishing the Council’s annual meeting schedule is hereby amended and replaced with an updated schedule consistent with the adopted Master Calendar. Said schedule shall be properly noticed in accordance with applicable law. 3. Planning Board Coordination The Borough Clerk is hereby directed to submit this matter for inclusion on the agenda of the next Planning Board meeting, with the recommendation that the Board revise its meeting schedule to align with the Master Calendar. 4. Implementation Period All applicable Borough bodies are encouraged to begin adhering to the Master Meeting Calendar beginning July 1, 2025. Full compliance shall be required beginning January 1, 2026. 5. Annual Review and Adoption The Borough Council shall review and adopt an updated Master Meeting Calendar annually, to take effect January 1 of each calendar year. 6. Distribution and Notice Copies of this resolution and the adopted Master Calendar shall be circulated to the chairs and secretaries of all Borough boards, committees, and commissions, and posted publicly in accordance with statutory requirements. RESOLUTION 161-2025 LEAP IMPLEMENTATION GRANT WHEREAS, the State of New Jersey has appropriated $6 million for Shared Services and Implementation, Challenge, and County Coordinator Grants to assist local units with the study, development, and implementation of new shared and regional services; and WHEREAS, the Department of Community Affairs, Division of Local Government Services (DLGS) is tasked with administering these grant funds through the Local Efficiency Achievement Program (LEAP); and WHEREAS, LEAP Implementation Grants exist to support costs associated with shared service implementation to ensure that meaningful, efficiency generating initiatives are not hindered by short term transitional expenses; and WHEREAS, the Monmouth County Sheriff’s Office Emergency medical services propose to enter into a shared services agreement, but face certain expenses associated with implementation that present a burden to the local units; and WHEREAS, the purpose of this shared services agreement is to provide Emergency Medical Services, which will benefit the residents of all participating local units; and WHEREAS, the Monmouth County Sheriff’s Office Emergency Medical Services has agreed to be the lead agency in this program and will submit the application to DLGS on behalf of all participating units; and NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Manasquan, that the Manasquan Borough does hereby join with the Monmouth County Sheriff’s Office  JUNE 2, 2025 Emergency Medical Services in applying for a LEAP Implementation Grant in the amount of $400,000 to support implementation of this shared service. Committee Reports Shares Services, Grants Committee & Beach - Council Member Bresnahan, reported that the beach is open on the weekends, with the reminder that animals are not allowed on the walkway or the beach. He also emphasized that the use of the beach rake is prohibited in certain areas, particularly in Sea Watch, to avoid disturbing the Plovers, a protected bird species in the area. Additionally, Bresnahan announced the upcoming dedication ceremony of the Inlet Gazebo to Wally Wall, which will take place on June 8th at 4 p.m. This event will honor Wally Wall for his many years of service to the beach. He also reviewed the beach bathroom hours of operation as well as the parking issue of backing in spaces in the parking lots and how to alleviate getting a ticket. Mayor Mangan emphasized the parking issue and explained the issue with the angled spots. Administration Committee – Councilman Bryant reported on Resolution 159-2025, which pertains to the Change Order for the Water Tower Painting. He emphasized that the reduction in price reflects a commitment to sustainable budgeting. Public Property Committee – Councilman Holly reported that new playground equipment has been installed at Sea Watch and encouraged the public to visit the site. He noted that the Sea Watch Concession is now open and that MBIA has acquired the historic clock from the former concession stand, previously owned and now donated by the Mueller Family. He also stated that Public Works will be repairing potholes throughout the week. Additionally, once the final design is confirmed, the Native American center court symbol will be installed on both the Indian Hill and Curtis Park basketball courts. Public Safety Committee – Councilman Olivera reported on the Summer Swell and recent Police Department activities. He emphasized the importance of proper parking in all paid beach parking lots, reminding residents and visitors to follow posted regulations. Land Use Committee – Councilwoman Triggiano reported on the permits issued by the Construction and Zoning Departments, as well as updates on rental property code compliance and the issuance of garage sale permits. Community Services Committee – Councilwoman Vidreiro reported that the Warrior for the Day event was a success despite a schedule change due to weather, and she congratulated the West Side for winning the competition. She also noted that Tourism’s Summer Kick-off Cocktail Party, held at Leggett’s, was well attended. Upcoming beach events have been planned and are scheduled for the season. Additionally, she announced that MBIA will hold its annual meeting on June 14th at the First Aid Building, which will feature a panel of local officials. Motion carried unanimously.  JUNE 2, 2025 Shawn Shemway, First Avenue, began his remarks by offering a public apology for comments he previously made to Mayor Mangan during the campaign period. Following his apology, Mr. Shemway raised a concern regarding an ongoing issue with a neighbor involving parking and the encroachment on Borough property. He emphasized that while the situation affects him personally, it also presents a broader public safety concern. Specifically, the obstruction limits access for emergency vehicles and impedes access to the beach, which could result in hazardous consequences. Mr. Shemway requested that the Borough take action to enforce existing regulations prohibiting the blocking of public spaces. He asked for relief and appropriate enforcement measures to be considered. Mayor Mangan thanked Mr. Shemway for his comments and asked him to leave his contact information with the Borough Administrator. The Mayor indicated that he would follow up with Mr. Shemway the following day. Justin Byrne, First Avenue, proposed a community project aimed at engaging young individuals in environmental stewardship. His idea involves setting up a designated location at the beach where buckets would be made available to the public, encouraging anyone, especially youth, to participate in beach clean- up efforts at their convenience. Mr. Byrne emphasized that this initiative could serve as a meaningful and educational activity for young people while promoting community involvement and environmental care. Mayor Mangan thanked Mr. Byrne for his suggestion and asked him to leave his contact information with the Borough Administrator. The Mayor indicated that he would refer the idea to the committee responsible for beach oversight for further discussion.
