CALL to ORDER
Chairman Goddard called the meeting to order at 6:30 p.m. and asked City Administrator Hixson
to call the roll. The record of attendance is shown above.
APPROVAL OF MINUTES
A motion to approve the August 13, 2015 minutes as submitted was made by Member Miller and
seconded by Member Moeckel. A voice vote was taken, with no opposition. Minutes approved,
with the change from Member Mayer making the second to Member Moeckel.
OLD BUSINESS
A. CASE #15-V-006 – A variance application submitted by Jacob Kaestner of Kaestner
Lawn Care on behalf of Brian York to encroach into the rear yard setback by fifteen
(15) feet and to encroach into the side yard setback by four (4) feet for the purpose of
building a retaining wall at 781 Carman Meadows Dr. The property is zoned R-2A
Single Family Residential.
Neither Mr. York nor representatives for Mr. York were in attendance of the meeting to testify
for the case. The case was removed from the agenda and dismissed without prejudice.
NEW BUSINESS
B. CASE #15-V-007 –A variance application submitted by Scott Allen and Jeannette
Barron Musgrave to vary the required side yard setback from the property line of 10
feet to 9 feet for the purpose of building an addition in line with the existing structure
at 923 Pontoison Drive. The property is zoned R-2A Single Family Residential.
City Administrator Hixson gave the details of the variance case. A permit was submitted by Scott
Allen and Jeannette Barron Musgrave.

Mr. Musgrave testified that she agreed with the statements made by City Administrator Hixson.
Mr. Koehrer had nothing further to add to the case.
City Administrator Hixson verified the adjacent property owners were notified about the
variance request. He noted that the Department received no comments in support of or in
opposition to the variance case.
Testimony #1
With all the questions satisfactorily answered, Member Nissenbaum made the motion to approve
the variance. Motion was seconded by Member Mayer. The resulting vote was 5-0, with no
objections, in favor of granting the variance.
ADJOURNMENT
The meeting adjourned with a motion by Member Miller and seconded by Member Nissenbaum
at 6:45 p.m.
